2 Development Services Committee The Development Services Committee is made up of five members. Mayor Henry is an Ex Officio member. Below are the members of the Development Services Committee: Councillor Aker, Chair Councillor Pidwerbecki, Vice-Chair Councillor Carter, Member Councillor Chapman, Member Councillor Sanders, Member Mayor Henry, Ex Officio The Development Services Committee is responsible for providing advice and recommendations to Council resulting from the operations of Planning Services, Building Permit and Inspection Services, Engineering Services, Economic Development Services, the Oshawa Executive Airport and Administration and Accessibility Services. Economic Development Services DS Proposed Memorandum of Understanding with the University of Ontario Institute of Technology, Durham College, University of Toronto and the Canadian Urban Institute to Establish Oshawa as a Centre of Urban Innovation (See Pages 46 to 53) 1. That pursuant to Report DS dated March 23, 2017, Council endorse in principle the concept of establishing Oshawa as a Centre of Urban Innovation that would promote business, academia, government and non-government organizations to work together to research, develop and test new technologies and methods for addressing urban issues and opportunities; and, 2. That pursuant to Report DS dated March 23, 2017, the Mayor and Clerk be authorized to enter into a Memorandum of Understanding with the University of Ontario Institute of Technology (U.O.I.T.), Durham College, the University of Toronto (Department of Civil Engineering) and the Canadian Urban Institute in a form and content to the satisfaction of the City Manager and City Solicitor, that outlines the

Planning Services objectives, the roles and responsibilities of the parties and any administrative items to guide the Centre of Urban Innovation concept; and, 3. That pursuant to Report DS dated March 23, 2017, the City Manager be authorized to sign any required agreement for individual initiatives related to the Centre of Urban Innovation concept in a form and content acceptable to the City Manager and City Solicitor and subject to any required City funding being available for such initiatives to the satisfaction of the Executive Director of Finance Services/Treasurer; and, 4. That a copy of Report DS dated March 23, 2017 and related Council resolution be provided to the Premier of Ontario, the Ministry of Advanced Education and Skills Development, Ministry of Citizenship and Immigration, Ministry of Economic Development and Growth, Ministry of Education, Ministry of Municipal Affairs, Ministry of Research, Innovation and Science, Durham Region Members of Parliament, Durham Region Members of Provincial Parliament and Region of Durham. DS Region of Durham Request for City to sign CLOCA Application Form for an Oshawa Creek Crossing on City-owned land to Facilitate Installation of a Watermain along Bloor Street West, West of Simcoe Street South (See Pages 54 to 58) Whereas the Region of Durham has been consulting with City staff on its plans to design and install a watermain along Bloor Street West; and Whereas part of the Region of Durham s proposed watermain design requires an easement over City-owned lands north of Bloor Street West and west of Simcoe Street South for construction access and watermain installation; and Whereas in accordance with Delegation By-law , as amended, the Commissioner, Development Services Department has delegated authority to approve and execute an easement agreement with the Region of Durham to facilitate the proposed watermain construction as necessary; and

7 Public Agenda Page 5 Whereas the Region of Durham s proposed watermain installation and construction access on City-owned land also requires approval from the Central Lake Ontario Conservation Authority (C.L.O.C.A.) given the location of the work in relation to the Oshawa Creek; and Whereas the C.L.O.C.A. application will be submitted by the Region of Durham but requires a signature on behalf of the landowner, being the City of Oshawa; and Whereas the Delegation By-law does not contemplate providing the Commissioner, Development Services Department the authority to sign the C.L.O.C.A. application on behalf of the City of Oshawa; Therefore be it resolved that the Commissioner, Development Services Department be authorized to sign the C.L.O.C.A. application form submitted by the Region of Durham to cross the Oshawa Creek for the purposes of installing a watermain and construction access on City-owned property along Bloor Street West, west of Simcoe Street South. DS Declaration of Certain City-owned Land as Surplus: East of Bridle Road and North of Pimlico Drive (Part 2, 40R-28257) (See Pages 59 to 66) 1. That pursuant to Report DS dated March 23, 2017, the Cityowned land located on the east side of Bridle Road and north of Pimlico Drive as identified as Part 2, Plan 40R-28257, be declared surplus to municipal requirements and that the requirements to declare a City-owned property first as potentially surplus and all notice requirements in accordance with By-law , be waived given the localized nature of the matter; and, 2. That pursuant to Report DS dated March 23, 2017, Part 2, Plan 40R located east of Bridle Road and north of Pimlico Drive be sold to the Durham Catholic District School Board.

8 Public Agenda Page 6 DS Application for Approval of a Draft Plan of Subdivision (S-O ), west of Thornton Road South, north and south of the future Consumers Drive Extension, Ontario Inc. (Halloway Developments) (See Pages 67 to 83) 1. That pursuant to Report DS dated March 23, 2017, the application submitted by Ontario Inc. (Halloway Developments) to implement a draft plan of subdivision (File S-O ), which proposes two industrial blocks, two commercial blocks, the future Consumers Drive extension and one new local road on lands located west of Thornton Road South, north and south of the future Consumers Drive extension be denied in accordance with the comments contained in Report DS-17-67; and, 2. That City Council request Metrolinx to advance the acquisition of the necessary portion of the subject property required for the future Thornton s Corners GO Station and GO Train extension to Bowmanville. DS Results of the Request for Expression of Interest Process to Develop and Operate a Marina Facility at the Oshawa Harbour (See Pages 84 to 192) 1. That Report DS dated March 23, 2017 concerning the results of the Request for Expression of Interest (Reference No. C ) process to develop and operate a marina facility at the Oshawa Harbour be received for information; and, 2. That staff be authorized to advance a Request for Proposals process to develop and operate a marina facility at the Oshawa Harbour on an invitation only basis to the four respondents of Request for Expressions of Interest (Reference No. C ).

9 Public Agenda Page 7 DS Region of Durham Request for City of Oshawa to Approve in Principle the Durham Community Climate Adaptation Plan (See Pages 193 to 196) Whereas on December 14, 2016 Durham Regional Council approved in principle the Durham Community Climate Adaptation Plan (the Plan); and Whereas due to its size the Plan can be viewed on the Region s website; and Whereas the Plan identifies 18 Programs for implementation by various levels of government and agencies across Durham that will collectively increase the resilience of our community to the changing climate and protect our infrastructure, services and citizens against increasingly severe weather; and Whereas the recommended Programs relate to cross-sectoral needs, buildings, the electrical sector, flooding, human health, roads and natural environment; and Whereas City staff participated on working groups to provide input to the Plan; and Whereas by letter dated February 21, 2017 the Region of Durham has requested that the City: 1. Approve the Plan in principle; 2. Participate on working groups to further develop the programs proposed in the Plan; 3. Work with the Region to develop a reporting framework to track progress; and, Whereas approval in principle of the Plan does not require or imply approval of funding at this time; and Whereas any future financial implications will be addressed in future budgets/reports as appropriate; Therefore be it resolved: 1. That the Durham Community Climate Adaptation Plan be approved in principle and that staff be authorized to participate on working groups organized by the Region of Durham to further develop the proposed programs within the Plan and a reporting framework; and,

10 Public Agenda Page 8 2. That the Oshawa Environmental Advisory Committee and Building Industry Liaison Team be consulted as resources as appropriate. DS City-initiated Amendments to the Oshawa Official Plan, the Windfields Part II Plan, Zoning By-law and University and College Area Renaissance Community Improvement Plan (See Pages 197 to 218) That pursuant to Report DS dated March 23, 2017, the Development Services Department be authorized to initiate the statutory public process under the Planning Act for Council to consider proposed amendments to the Oshawa Official Plan, the Windfields Part II Plan, Zoning By-law and University and College Area Renaissance Community Improvement Plan generally in accordance with Attachment 1 to said Report. DS Application for a Sign Variance: Pattison Outdoor Advertising LP on behalf of Louis Destounis regarding Signage at 7-15 Taunton Road East (See Pages 219 to 225) That pursuant to Report DS dated March 23, 2017, the Commissioner, Development Services Department be authorized to approve the sign variance application submitted by Pattison Outdoor Advertising LP (File: SV ), to permit the alteration of one side of an existing non-accessory roof sign to provide a read-o-graph as a display surface facing northwest at 7-15 Taunton Road East. DS Declaration of Certain City-owned Land as Surplus and Disposition Strategy: 173 Westmount Street (See Pages 226 to 234) 1. That pursuant to Report DS dated March 23, 2017, the requirement to declare the subject City-owned land as potentially surplus and all notice requirements in accordance with By-law be waived, given Council s previous direction to exit the delivery of affordable housing; and,

11 Public Agenda Page 9 Other 2. That pursuant to Report DS dated March 23, 2017, the City-owned land located at 173 Westmount Street be declared surplus to municipal needs and requirements; and, 3. That pursuant to Report DS dated March 23, 2017, staff execute the disposal strategy outlined in Section 5.4 of said Report for the City-owned land located at 173 Westmount Street. DS Development Services Committee s Outstanding Items Status Report First Quarter 2017 (See Pages 235 to 242) That Report DS dated March 23, 2017 concerning the Development Services Committee s Outstanding Items Status Report for the First Quarter 2017 be received for information. Discussion Agenda Matters Excluded From Consent Agenda Items to Be Introduced By Councillors Closed Portion of Meeting DS Potential Offer to the City to Purchase Property on Colonel Sam Drive That Correspondence DS dated March 13, 2017 regarding the potential offer to purchase property on Colonel Sam Drive be referred to staff for a report. DS Proposed Licence Renewal between the City of Oshawa and the Province for a Hydro Corridor abutting Everglades Park That pursuant to Report DS dated March 23, 2017, the Commissioner, Development Services Department be authorized to execute a licence agreement with Her Majesty the Queen in Right of Ontario with respect to the part of the hydro corridor lands abutting Everglades Park consistent with the

12 REVISED Development Services Committee March 27, 2017 Public Agenda Page 10 terms and conditions contained in said Report and in a form satisfactory to the City Solicitor. DS Ontario Limited Request for City Approval of a Lease Amendment for the Jubilee Pavilion at 55 Lakeview Park Avenue 1. That the following June 11, 2007 Council direction be rescinded: 1. That the lease dated May 25, 2005, with the Grenadier Group for the Jubilee Pavilion be amended to reflect a further four years of free rent in consideration of an additional capital investment by the Grenadier Group in the amount of $500,000, and that rent be collected commencing in year 2021; and, 2. That the Mayor and Clerk be authorized to execute the amendment in a form and content satisfactory to the City Solicitor. ; and, 2. That the lease dated May 24, 2005 assigned to Ontario Limited for the Jubilee Pavilion at 55 Lakeview Park Avenue be amended to reflect a further one year of free rent beginning on June 1, 2017 and ending on May 31, 2018 in consideration of an additional capital investment undertaken in the amount of $125,000; and, 3. That the Commissioner, Development Services Department be authorized to execute the amendment to the lease pursuant to Part 2 above, in a form and content satisfactory to the City Solicitor and the Commissioner, Development Services Department. DS Potential Appeal to the Ontario Municipal Board of a Committee of Adjustment Decision Recess That pursuant to Report DS dated March 24, 2017, staff be authorized to submit an appeal to the Ontario Municipal Board (O.M.B.) concerning a Committee of Adjustment decision, that the O.M.B. be advised that City Council supports the staff recommendation made to the Committee of Adjustment, and City staff be authorized to attend the O.M.B. hearing in support of Council s position.
