2 COMMISSION DECISION of on the Annual Action Programme 2012 in favour of Somalia to be financed from the 10th European Development Fund THE EUROPEAN COMMISSION, Having regard to the Treaty on the Functioning of the European Union, Having regard to the Partnership Agreement between the members of the African, Caribbean and Pacific Group of States of the one part, and the European Community and its Member States of the other part, signed in Cotonou on 23 June , as revised at Ouagadougou, Burkina Faso on 22 June (hereinafter referred to as the "Cotonou Agreement"), and in particular Articles 4(5) and 34 of Annex IV thereto, Having regard to Council Regulation (EC) No 617/2007 of 14 May 2007 on the implementation of the 10 th European Development Fund under the ACP-EC Partnership Agreement 3, and in particular Article 7 thereof, Having regard to Council Regulation (EC) No 215/2008 of 18 February 2008 on Financial Regulation applicable to the 10 th European Development Fund 4 and in particular Article 25(1) and Article 29(1)(a) thereof, Whereas: (1) The Commission has adopted the Joint Strategy Paper and Special Support Programme for Somalia 5, which, interalia, provides for the following priorities: deepening peace, improving security and establishing good governance, effective delivery of relevant and sustainable education services accessible to the entire population, creating an enabling environment for private sector-led growth to expand employment and reduce poverty and to promote private sector-led economic development through an improved institutional and regulatory framework and sustainable natural resource management. (2) The objectives pursued by the Annual Action Programme are: a) Support for democratisation: with the objective of realizing a stronger and more stable Somalia, by supporting peaceful and locally-owned processes of democratization in Somaliland and Puntland; a strengthened identification system through an effective civil registry process in Somaliland and building on the on-going democratization efforts at federal level; b) Support for governance and security sectors: with the objective of deepening OJ L 317, , p. 3. 3 peace, improving security and establishing good governance through the strengthening of rule of law and security mechanisms as well as local and national institutions across Somalia; c) Economic development programme for growth and resilience: with the objective of improving the livelihoods and nutrition of agro-pastoralists and pastoralists, farmers, fishermen and other vulnerable households and strengthening their resilience; d) MDG initiative for Somalia - reducing hunger and food insecurity in the Puntland region through improved and sustainable use of rangeland resources: with the objective of improving rangeland conditions and promoting a sustainable use of rangeland resources by empowering communities and by strengthening the institutional and legal framework for rangeland protection; e) Education sector development programme: with the objective of efficiently and equitably delivering education and training services, responsive to the priority requirements of the Somali population; f) Technical assistance: with the objective of contributing to the efficient and effective implementation and monitoring of the Somalia Special Support Programme and programmes and projects financed by EU thematic programmes. (3) Article 4.5 of the Annex IV to the Cotonou Agreement provides that the Commission may assume the functions of National Authorising Officer for the programming and implementation of the allocation when an ACP state faces a crisis situation preventing the National Authorising Officer from carrying out his duty. In the absence of normally established central government institutions, it is therefore appropriate for the Commission to retain this responsibility. (4) The measures covered by this Decision are in conformity with the objectives of development finance co-operation as defined in Article 55 of the Cotonou Agreement. (5) This Decision constitutes a Financing Decision within the meaning of Article 16 of Annex IV to the Cotonou Agreement and Article 67 of the Financial Regulation applicable to the 10 th European Development Fund. (6) It is appropriate to define the term substantial change within the meaning of Article 7 of Regulation (EC) N 617/2007 to ensure that any substantial change in this Decision shall follow the same procedure as the initial Decision. (7) The measures provided for in this Decision are in accordance with the opinion of the European Development Fund Committee set up by Article 8 of the Internal Agreement of 17 July HAS DECIDED AS FOLLOWS: Article 1 The Annual Action Programme in favour of Somalia constituted by the actions Support for democratisation, Support for governance and security sectors III, Economic development programme for growth and resilience Phase III, MDG initiative for Somalia - reducing hunger and food insecurity in the Puntland region through improved and sustainable use of rangeland resources, Education sector development programme III and Technical and operational support to development assistance to Somalia II, the text of which is set out in the attached Annexes, is approved. 4 Article 2 The maximum contribution of the European Union to the Annual Action Programme is set at EUR to be financed from the 10th European Development Fund. Article 3 The Commission shall assume the functions of National Authorising Officer for the programming and implementation of the 2012 Annual Action Programme in favour of Somalia until the Commission and Somalia revert to normal implementation and normal management procedures, as soon as the national authorities responsible for managing cooperation are able to do so. Article 4 Cumulated changes of the allocations to the specific actions not exceeding 20% of the maximum contribution authorised by this decision and not representing more than EUR 10 million shall not be considered substantial provided that they do not significantly affect the nature and objectives of the Annual Action Programme. This may include an increase of the maximum contribution authorised by this decision of up to 20%. The relevant authorising officer may amend the present Decision to introduce non-substantial changes in the Annual Action Programme in accordance with the principles of sound financial management.
