1 COMMITTEE OF THE WHOLE MEETING REPORT Monday, For Consideration by the Council of the Town of New Tecumseth on February 12, 2018 The Committee of the Whole Meeting was held on Monday, in the Council Chambers, 10 Wellington Street East, Alliston, Ontario. DISCLOSURES OF PECUNIARY INTEREST Mayor Milne declared a pecuniary interest with respect to item CW-5(6) Tottenham Lions Club Use Agreement as he is a member of the Lions Club. Councillor Anderson declared a pecuniary interest with respect to item CW-5(6) Tottenham Lions Club Use Agreement as he is a member of the Lions Club. Councillor Beattie declared a pecuniary interest with respect to item CW-5(2) Municipal Drain Maintenance Program as his family owns a property abutting one of the drains. Page 1 of 9

2 COMMITTEE OF THE WHOLE ITEMS CW-1 COUNCIL ITEMS (1) REQUEST FOR INSTALLATION OF AN ALL WAY STOP AT THE INTERSECTION OF FALKNER ROAD AND KNIGHT STREET, ALLISTON That an all-way stop be installed at the intersection of Falkner Road and Knight Street, Alliston. (2) SUPPORT FOR MOTION RECEIVED FROM THE TOWN OF LAKESHORE RE: MARIJUANA TAX REVENUE WHEREAS a motion has been received from the Town of Lakeshore dated January 22, 2018 seeking support with regard to Marijuana Tax Revenues; AND WHEREAS municipalities are responsible for critical infrastructure projects, such as roads, bridges, water treatment and delivery of potable water; AND WHEREAS municipalities are responsible for Police, Fire and Rescue Services, harm reduction and youth services; AND WHEREAS municipalities face a significant challenge in funding critical infrastructure projects, Police, Fire and Rescue Services, harm reduction and youth services; AND WHEREAS municipalities have limited options for increasing revenues, aside from raising property taxes, which negatively impacts all taxpayers; AND WHEREAS the new tax revenues generated from the sale of marijuana, could be used to help offset infrastructure costs for Municipalities; AND WHEREAS the Town of New Tecumseth supports the resolution of the Council of the Town of Lakeshore with regard to their request that the Government of Canada and the Government of Ontario be urged to allocate Page 2 of 9

3 a proportionate share of the new tax revenues generated from the sale of marijuana, to municipalities directly; AND FURTHER THAT that the Government of Canada and the Government of Ontario be urged to create a fund, similar to the Gas Tax Fund and the Clean Water and Wastewater Fund, from the new tax revenues generated by the sale of marijuana, to provide funding to municipalities for infrastructure projects, Police, Fire and Rescue Services, harm reduction and youth services; AND FURTHER THAT a copy of this Motion be sent to the Right Honourable Justin Trudeau, Prime Minister of Canada, Kellie Lietch, Member of Parliament, the Association of Municipalities of Ontario (AMO) and Ontario Small Urban Municipalities (OSUM) for their consideration. (3) SUPPORT OF THE ONTARIO MUSEUM ASSOCIATION RE: INCREASED FUNDING FOR THE COMMUNITY MUSEUM OPERATING GRANT WHEREAS On December 4th and 5th, 2017, the Ontario Museum Association Council met with the Minister of Tourism, Culture and Sport, Eleanor McMahon, and MPPs and senior staff to discuss the important ways that museums can be supported as outlined in Ontario's Museums 2025: Strategic Vision and Action Plan, a plan for excellence and renewal for the province's museum sector in service of all Ontarians; AND WHEREAS on December 14, 2017 the Ontario Museum Association presented to the Standing Committee on Finance and Economic Affairs as part of the 2018 pre-budget consultation process the importance of museums in their fundamental role of strengthening dynamic communities and building a prosperous knowledge based economy; AND WHEREAS the Ontario Museum Association requested an immediate increase of $5M to the Community Museum Operating Grant (CMOG) Program, through the 2018 Provincial Budget as the CMOG is a principal source of funding for Ontario museums and has not been increased in 10 years and this would bring the current Community Museum Operating Grant (CMOG) Program to $10 million in 2018; AND WHEREAS The Ontario Culture Strategy Goal 2: Strengthen Culture in Communities calls for "the review and update of provincial funding programs for community museums and heritage organizations to build capacity, strengthen leadership and support more diverse organizations"; Page 3 of 9

4 AND WHEREAS the Ontario Museum Association is asking municipalities to ask their local MPP to support the request for increased funding; NOW THEREFORE BE IT RESOLVED THAT the Town of New Tecumseth supports an increase for the Community Museum Operating Grant Program; AND FURTHER THAT a copy of this motion, along with a letter similar to the letter attached to the Ontario Museum Association`s request for support, be sent by the Mayor to MPP, Jim Wilson, the Minister of Tourism, Culture, and Sport, Daiene Vernile and copied to the Ontario Museum Association. CW-2 COMMITTEE, BOARD AND TASK FORCE SUMMARIES (1) HERITAGE ADVISORY COMMITTEE That the Heritage Advisory Committee Summary Report of January 9, 2018 be received. Recommendation 1: That Council support Recommendation No. 11 included in the Government of Canada s House of Commons Report of the Standing Committee on Environment and Sustainable Development s PRESERVING CANADA S HERITAGE: THE FOUNDATION FOR TOMORROW, dated December 2017, that the Federal government establish a tax credit for the restoration and preservation of buildings listed on the Canadian Register of Historic Places; And further that staff be directed to send a letter to the Federal Minister of Environment, with copies to the Minister of Finance and the local Member of Parliament, by February 28, 2018 supporting the establishment of a tax credit for the restoration and preservation of buildings listed on the Canadian Register of Historic Places. Recommendation 2: That the Heritage Plaque Policy outlining the requirements to qualify for a plaque of recognition for a designated property be approved as attached in Attachment No. 2 to the Heritage Advisory Committee Summary Report dated January 9, Page 4 of 9

5 Recommendation 3: That the Evaluation Sheet, Application Form and Designation Policy be approved as attached in Attachment No. 3 to the Heritage Advisory Committee Summary Report dated January 9, Recommendation 4: That staff be directed to evaluate the historical significance and investigate the feasibility and potential costs of relocating the structure currently located at 14 Dale Drive, Beeton to an undetermined site owned by the Town and report back at a future Heritage Advisory Committee meeting. CW-3 OFFICE OF THE CAO CW-4 CORPORATE SERVICES (1) SIR FREDERICK BANTING LEGACY FOUNDATION PROPOSED AMENDING LEASE AND OPERATIONS AGREEMENTS That Report #ADMIN be received; And further that a by-law be enacted to authorize the Mayor and Clerk to execute the Amending Lease Agreement and Amending Operations Agreement with the Sir Frederick Banting Legacy Foundation; And further that By-law No be repealed. (2) BILL 68: MODERNIZING ONTARIO'S MUNICIPAL LEGISLATION ACT, 2017 AND REQUIRED PROCEDURE BY-LAW AMENDMENTS That Report #ADMIN be received; And further that the Procedure By-law be amended and enacted to include the new definition of meeting and the additional Closed Meeting provisions as per Bill 68 - Modernizing Ontario's Municipal Legislation Act, 2017; Page 5 of 9

6 And further that due to the current uncertainties associated with electronic meeting participation that it be considered during the next term of Council; And further that a by-law be enacted to appoint Councillor Whiteside as the Town s alternate member to the Council of the County of Simcoe during an absence of the Mayor or Deputy Mayor. (3) GENERAL MATTERS RE 2018 MUNICIPAL ELECTIONS That Report #ADMIN be received. (4) COUNCIL CHEQUE SUMMARY REPORT - DECEMBER That Report #FIN be received. CW-5 DEVELOPMENT AND INFRASTRUCTURE SERVICES (1) ONTARIO MUNICIPAL BOARD APPEALS PROPOSED OFFICIAL PLAN AND ZONING BY-LAW AMENDMENTS SAN MARCO IN LAMIS LIMITED (PAUL MANCINI) HUNTINGTON WOODS PARTS OF LOTS 9, CONCESSIONS TH LINE TOWN OF NEW TECUMSETH FILE NUMBER: DEV 209 OMB FILE NUMBER: PL That Report #PD be received. (2) MUNICIPAL DRAIN MAINTENANCE PROGRAM Councillor Beattie declared a pecuniary interest with respect to item CW- 5(2) as his family owns a property abutting one of the drains. 7 And further that the deputation of Bob Mackenzie be received; Committee of the Whole Meeting And further that the municipal drain maintenance work and estimated cost (to be adjusted based on the actual construction cost) to adjacent landowners as outlined by the Drainage Superintendent be approved; And further that a report be brought forward to Council to approve the necessary by-law to accept the Drainage Superintendent s final report including a Cost Allocation Schedule for the drainage maintenance work. (3) TRANS CANADA TRAIL EASEMENT AGREEMENT REQUEST - HOLDEMAR INVESTMENTS (ONTARIO) LIMITED That Report #PRC be received; And further that the deputation of Sarah Turney be received; And further that Holdemar Investments (Ontario) Limited s request for a crossing easement between their adjacent lands, which is dissected by the Trans Canada Trail, within the Abandoned Rail Corridor be denied. (4) PARKS, RECREATION AND CULTURE - FINAL PRC MASTER PLAN 2018 That Report #PRC be received; And further that the deputations of Doug Kowalinski, Alan Masters, Kathleen McCartie, Amy Roberts, and Tracy Jones be received; And further that the updated Parks, Recreation and Culture Master Plan, dated January 2018, included as Attachment #3 to Report #PRC be approved. (5) SOLAR PHOTOVOLTAIC ENERGY SYSTEMS - LANDLORD ACKNOWLEDGEMENT AGREEMENT WITH SOLOGIX CLEAN ENERGY CORPORATION (FORMERLY SOLERA SUSTAINABLE ENERGIES COMPANY) That Report #PRC be received; Page 7 of 9

8 And further that staff be directed to bring back additional information with respect to whether or not the agreements will be registered on title and what the Town's responsibility is if the Lessee defaults on payment. (6) TOTTENHAM LIONS CLUB USE AGREEMENT Mayor Milne declared a pecuniary interest with respect to item CW-5(6) as he is a member of the Lions Club. Mayor Milne did not participate in the discussion or vote on the matter. Councillor Anderson declared a pecuniary interest with respect to item CW-5(6) as he is a member of the Lions Club. That Report #PRC be received; And further that the amended agreement between the Tottenham and District Lions Club Inc, and the Town of New Tecumseth substantially in the form attached to Report #PRC , to release the control and jurisdiction over the Club Room #1 at the Tottenham Community and Fitness Centre be approved; And further that the necessary by-law be enacted to authorize the Mayor and Clerk to execute the agreement, substantially in the form attached to Report #PRC , as Attachment #1, to the satisfaction of the Town s solicitor; And further that Parks, Recreation and Culture Department staff be directed to include Club Room #1 in the available indoor space inventory, for direct recreation and culture programs delivery, and rentals to the community, on a permit basis. CLOSED SESSION The Committee of the Whole convened into Closed Session at 9:15 p.m. to discuss item CS-1 with respect to advice that is subject to solicitor-client privilege, including communications necessary for that purpose per the Municipal Act, Section 239 (2) (f). The Committee of the Whole reconvened into Open Session at 9:41 p.m. to report on item CS-1 with respect to advice that is subject to solicitor-client privilege, including communications necessary for that purpose per the Municipal Act, Section 239 (2) (f).
