The proposal conforms to the policies of the Official Plan. Comments: The Owner is requesting permission to maintain an existing gazebo, pergola and A/C unit with the above noted variances. The subject property backs onto an OS1, Open Space Conservation Zone, which contains a woodlot in close proximity to the property. As such, an Arborist Report has been received and reviewed by the Urban Design and Cultural Heritage Division. The following comments have been provided which are to be addressed through revised material: A Tree Inventory Plan is required that shows all trees on the property as well as trees within 6 metres of the property boundary. On this basis, the Development Planning Department recommends adjournment until such a time the Owner submits the Tree Inventory Plan to the satisfaction of the Urban Design and Cultural Heritage Division. Recommendation: The Development Planning Department recommends adjournment of the application. Public Comment(s): Engineering Comment(s): Prepared by: Tak Yin Chan The Development Engineering and Infrastructure Planning Department staff in Inspection & Grading division has visited the site on May 10, 2017 in response to the subject Minor Variance Application. This Department has no objection to the proposal No. 1, 3, and 4 since the existing gazebo and A/C unit do not appear to negatively affect the existing drainage pattern. Proposal No. 2 which seeks to "permit a minimum rear yard setback of 0m for the pergola", the location of the proposed pergola should not adversely impact the drainage area since the west and southwest sides of the lot are adjacent stormwater pond which will allow for positive drainage flow within the area. Accordingly, the Development Engineering and Infrastructure Planning Department has no objection to the subject Minor Variance Application. 23 COMMENTS: Alectra Utilities (formerly PowerStream) has received and reviewed the proposed Variance Application. This review, however, does not imply any approval of the project or plan. All proposed billboards, signs, and other structures associated with the project or plan must maintain minimum clearances to the existing overhead or underground electrical distribution system as specified by the applicable standards, codes and acts referenced. In the event that construction commences, and the clearance between any component of the work/structure and the adjacent existing overhead and underground electrical distribution system violates the Occupational Health and Safety Act, the customer will be responsible for 100% of the costs associated with Alectra making the work area safe. All construction work will be required to stop until the safe limits of approach can be established. In the event construction is completed, and the clearance between the constructed structure and the adjacent existing overhead and underground electrical distribution system violates the any of applicable standards, acts or codes referenced, the customer will be responsible for 100% of Alectra s cost for any relocation work.
