1 DUPLICATE GOVERNMENT REGULATION NUMBER 85 OF THE YEAR 2010 ON INCREASE OF CAPITAL INVESTMENT OF THE STATE OF THE REPUBLIC OF INDONESIA IN THE EQUITY CAPITAL OF THE STATE-OWNED LIMITED LIABILITY COMPANY (PERSERO) PT SARANA MULTI INFRASTRUKTUR BY THE GRACE OF THE ALMIGHTY GOD THE PRESIDENT OF THE REPUBLIC OF INDONESIA Considering that: a. in order to boost the business capacity and strengthen the capital structure of the State-Owned Liability Company (Persero) PT Sarana Multi Infrastruktur and to support the acceleration of Infrastructure development in Indonesia, it is necessary to increase the Capital Investment of the State of the Republic of Indonesia in the equity capital of the State-Owned Limited Liability Company (Persero) PT 1

2 Sarana Multi Infrastruktur originated from the State Revenue and Expenditure of the 2010 Budget Year; b. due to the consideration as referred to in section a and to enforce the provisions of Article 4 paragraph (4) of Law Number 19 of the Year 2003 on State-Owned Enterprises, it is necessary to issue a Government Regulation on Capital Increase of the Capital Investment of the State of the Republic of Indonesia in the Equity Capital of the State- Owned Limited Liability Company (Persero) PT Sarana Multi Infrastruktur; Bearing in mind: 1. Article 5 paragraph (2) of the Constitution of the Republic of Indonesia of the Year 1945; 2. Law Number 19 of the Year 2003 on State-Owned Enterprises (Statutory State Gazette of the Republic of Indonesia of the Year 2003 Number 70, Supplement to the Statutory Gazette of the Republic of Indonesia Number 4297); 3. Law Number 1 of the Year 2004 on State Treasury (Statutory State Gazette of the Republic of Indonesia of the Year 2004 Number 5, Supplement to the Statutory Gazette of the Republic of Indonesia Number 4355); 4. Law Number 47 of the Year 2009 on State Revenue and Expenditure of the 2010 Budget Year (Statutory State 2

Government Regulation Number 44 of the Year 2005 on Procedures and Administration of Capital Investment of the State of the Republic of Indonesia in State-Owned Enterprises and Limited Liability Companies (Statutory State Gazette of the Republic of Indonesia of the Year 2005 Number 116, Supplement to the Statutory State Gazette of the Republic of Indonesia Number 4555); HAS DECIDED: To stipulate: GOVERNMENT REGULATION ON INCREASE OF CAPITAL INVESTMENT OF THE STATE OF THE REPUBLIC OF INDONESIA IN THE EQUITY CAPITAL OF THE STATE-OWNED LIMITED LIABILITY COMPANY (PERSERO) PT SARANA MULTI INFRASTRUKTUR. 3

4 Article 1 The State of the Republic of Indonesia has made an increase of capital Investment in the equity capital of the State-Owned Liability Company (Persero) PT Sarana Multi Infrastruktur, established by virtue of the Government Regulation Number 66 of the Year 2007 on Capital Investment of the State of the Republic of Indonesia for the Establishment of a State-Owned Limited Liability Company (Persero) in the Sector of Infrastructure Financing as amended by the Government Regulation Number 75 of the Year 2008 on Amendments to the Government Regulation Number 66 of the Year 2007 on Capital Investment of the State of the Republic of Indonesia for the Establishment of a State-Owned Limited Liability Company (Persero) in the Sector of Infrastructure Financing. Article 2 (1) Value of the increase of capital investment of the State as referred to in Article 1 shall be Rp. 1,000,000,000, (one trillion Rupiah); (2) The increase of capital investment of the State as referred to in paragraph (1) is originated from the State Revenue and Expenditure of the 2010 Budget Year; Article 3 This Government Regulation shall take effect as of the date 4

5 it is enacted. In order to publicize this Government Regulation, it is hereby ordered that this instrument be enacted in a Statutory Gazette of the Republic of Indonesia.
