3 THE CORPORATION OF THE DISTRICT OF PEACHLAND Public Hearing Procedure: The Mayor calls the Public Hearing to order, followed by: This Public Hearing is being held for the purpose of considering Zoning Bylaw Number 1375, 1996 Amendment Bylaw No. 2071, Anyone present who believes their interest in property is affected by the proposed bylaw will be given a reasonable opportunity to be heard or to present written submissions respecting matters contained in the proposed bylaw. Please commence your remarks by clearly stating your name and address. The Public Hearings were advertised on Friday, March 14, 2014 and Friday, March 21, 2014 in the Peachland View, and was posted at the District Office and Community Centre notice boards, pursuant to the Local Government Act and the Community Charter. The role of Council is to hear representation from those persons who wish to provide comments regarding the proposed bylaw. Everyone who wishes to speak shall be given the opportunity to be heard. No one will be, or should feel, discouraged or prevented from making his or her views known. However, it is important that all who speak at this meeting restrict their remarks to matters contained in the bylaw, and it is my responsibility as Chairman of this hearing to ensure that all remarks are so restricted. Members of Council may, if they so wish ask questions of you following your presentation. However, the main function of Council members this evening is to listen to the views of the public. It is not the function of Council at this public hearing to debate the merits of the proposed bylaw with individual citizens. No decision will be made at this hearing, but the entire proceedings will be considered by Council at a subsequent meeting. Submissions regarding this proposed bylaw may be received prior to or at this hearing. No further information or representations can be considered by Council after the public hearing is terminated. 5 District of Peachland Public Hearing Report To: From: Mayor and Council Date: March 25, 2014 Subject: Corine (Cory) Gain, Director of Planning and Development Services Zoning amendment of a portion of Lot G, D.L. 490, Plan KAP22267, located at th Street BACKGROUND: Application: Subject property comprises approximately.100ha (.247ac) and is currently zoned R-1 (Single Family Residential). The Food Bank site chosen is centrally located in the downtown area. It is within walking distance of transit stops and downtown businesses. It has easy access from both 5 th and 6 th Streets through Waldo Way while still remaining discreet and safe for client use. The cement block accessory building at the rear of th Street was chosen as the most suitable site for this type of use on municipally owned property. Habitat for Humanity suggested that they would volunteer to renovate the structure to meet the needs of the Food Bank. The Habitat for Humanity group has been working with the Food Bank Manager to create renovation plans which will result in a significantly improved facility for Food Bank operations including a larger overall area. Official Community Plan: Zoning: The property is designated as core commercial within the Official Community Plan, which permits a wide range of retail and commercial services including social and cultural activities. The OCP recognizes that with current provincial and federal grants being reduced or eliminated, and the roles and responsibilities being downloaded onto municipalities the District of Peachland must determine and implement means of continuing social services to their residents. The OCP objectives include providing accessible human services facilities in response to population growth and diverse needs. The intent of Zoning Application Z13/1,005 is to rezone a portion of the lot.0180 ha (.044ac or 180m 2.) in area containing an accessory building to P-2 (Community Institutional) to accommodate the intended use as a community Food Bank. The site is currently zoned R-1 Single Family Residential. The application is to rezone a portion of the lot, containing only the accessory building to P-2 Community Institutional Zone.018 ha (.044 acres or 180m 2 ). This split zone will allow the continued separate access and use of the residential home from 5th Street and will allow the food bank to conduct their Zoning Bylaw No. 1375, 1996 Amendment Bylaw No. 2071, 2014 Page 5 of 10

6 business from the building at the rear of the same property. All access to and from the accessory building will be via Waldo Way, which can be accessed from both 5 th and 6 th street. This amendment ensures that the District remains consistent with the zoning bylaw s permitted uses. Servicing Issues: The property is serviced by municipal water and sanitary sewer from 5 th Street. Services will be extended to the Food Bank building. The Habitat for Humanity group has advised that they will facilitate the connection to the existing services. Additional garbage and recycling containers will be obtained by the Food Bank. Separate hydro and gas connections will be applied for. The Habitat for Humanity group has volunteers to manage and cover the costs of all renovations agreed to between themselves and the Food Bank Manger. History of the Application: December 11, 2013 January 30, 2014 February 25, 2014 On-site meeting with Habitat for Humanity Group, Manager of Peachland Food Bank and Staff to review proposed food bank site. Habitat project Manager and Food Bank project Manager met and submitted proposed renovation plans for food bank site. Council passed First and Second reading of zoning bylaw. Approval Process: The District sent out letters to the property owners within 100m providing them with an opportunity to comment at the Public Hearing, as per Section 892 Local Government Act (LGA). There have not been any letters submitted by residents as of March 19th, Resident submissions received after this date will be provided at the Public Hearing. Newspaper ads were posted for 2 consecutive weeks in the local news paper, as per Section 892 (LGA). A sign was on the property, as per Section 892 (LGA). The application has been circulated to the various affected technical agencies. Technical Comments: Ministry of Transportation and Infrastructure Preliminary Approval is granted for 1 year; Peachland Fire and Rescue Services no comments; Peachland Public Works require sewer and water service connection and any power requirements if operated as a separate facility; Next steps in the process will be Third Reading and then approval of the Ministry of Transportation and Infrastructure followed by 4 th and final Reading, A Development Permit may be required for the façade improvements. 7 THE CORPORATION OF THE DISTRICT OF PEACHLAND BYLAW NUMBER 2071, 2014 A Bylaw to Amend Zoning Bylaw Number 1375, 1996 WHEREAS the Council of the Corporation of the District of Peachland has adopted Zoning Bylaw Number 1375, 1996 AND WHEREAS it is deemed necessary to amend Zoning Bylaw Number 1375, 1996 NOW THEREFORE, the Council of the Corporation of the District of Peachland, in open meeting assembled, enacts the District of Peachland Zoning Bylaw Number 1375, 1996 the Zoning Bylaw be amended as follows: 1. THAT Schedule A, the Zoning Map be amended by changing of a Portion of Lot G, DL 490, Plan KAP22267, as shown on the map attached to this bylaw from R-1 Single Family Residential Zone to P-2 Community Institutional. As per Schedule A attached to and forming part of this bylaw; 2. This Bylaw may be cited as Zoning Bylaw No. 1375, Amendment Bylaw No. 2071, This Bylaw shall take effect upon its adoption by the Council of the Corporation of the District of Peachland. Notice is hereby given that the Council of the District of Peachland will hold a Public Hearing to hear representations of persons who deem their interest in the property is affected by Zoning Bylaw No. 1375, Amendment Bylaw No. 2071, 2014 at 6:30 p.m. on March 25, 2014 in the Council Chambers located at Peachland Community Centre, th Street, Peachland, B.C. The District proposes to amend Zoning Bylaw Number 1375, 1996, as follows: By changing the zoning designation of a Portion of Lot G, DL 490, Plan KAP22267, as shown on the map below from R-1 Single Family Residential Zone to P-2 Community Institutional. The proposed amendment is in order to provide for the relocation of the Peachland Food Bank. The proposed Zoning Amendment Bylaw No. 2071, 2014 may be inspected at the Municipal Office, 5806 Beach Avenue, Peachland, B.C. during normal business hours (8:00 a.m. to 4:00 p.m.) Monday to Friday inclusive, excluding Statutory Holidays, from March 11, 2014 to March 25, Take notice that the above describes the general intent of the proposed Zoning Amendment Bylaw which has been read First and Second Times by the Council of the Corporation of the District of Peachland.
