1 MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT No: 863/QĐ-BNN-TCCB SOCIALIST REPUBLIC OF VIET NAM Independence - Freedom - Happiness Ha Noi, 17 th March 2016 Unofficial translation DECISION Promulgating Working Regulation of the National REDD+ Steering Committee THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT Pursuant to Decree No 199/2013/ND-CP dated 26 th November 2013 of the Government regulating function, tasks, power and organizational structure of the Ministry of Agriculture and Rural Development; Pursuant to Decision No 799/QD-TTg dated 27 th June 2012 by Prime Minister on the approval of National Action Program on Reducing emissions from deforestation and forest degradation, and the role of conservation, sustainable management of forests and enhancement of forest carbon stocks in developing countries (REDD+) for the period ; Pursuant to Decision No 34/2007 / QD-TTg dated 12/3/2007 by Prime Minister promulgating the Regulation on the establishment, organization and operation of interagency coordination organization; On the basis of the decisions of the Minister of Agriculture and Rural Development: No 39/QD-BNN-TCCB dated 07/01/2011 on Establishment of the National REDD+ Steering Committee; No 3356/QD-BNN-TCCB dated 21/08/2015 on personnel adjustment and supplementary to the National REDD+ Steering Committee; No 4806/QD-BNN-TCCB dated 23/11/2015 on the appointment of Vice-Chairman of the National REDD+ Steering Committee; At proposal made by VNFOREST at proposal letter No 102/TTr-TCLN- VP dated 25/01/2016 on working regulation of the National REDD+ Steering Committee; At proposal made by Director of Department of Personnel and Organization, DECIDES: Article 1. To promulgate Decision and to enclose the Working Regulation of the National REDD+ Steering Committee (NRSC) in Vietnam. Article 2. This Decision shall come into force on the date of signature. 1

2 Article 3. The members of NRSC, Director of Department of Personnel and Organization, Director of VNFOREST, heads of equivalent bodies bear responsibility to implement this Decision./. 3 MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT SOCIALIST REPUBLIC OF VIET NAM Independence - Freedom - Happiness WORKING REGULATION Of the National REDD+ Steering Committee (Promulgated with Decision No 863/QD-BNN-TCCB dated 17/3/2016 of Minister of Agriculture and Rural Development) Chapter I GENERAL REGULATION Article 1. Scope of regulation and subjects of application 1. The regulation provides principles, responsibilities and powers, working regime and relations and reporting mechanism of the National REDD+ Steering Committee in Vietnam (hereafter referred to NRSC). 2. The regulation applies for the members of NRSC, Vietnam REDD+ Office (hereafter referred to VRO); Ministries, sectors and localities relating to REDD+ activities in Vietnam. Article 2. Working regulation 1. NRSC works on a part-time basis and is highly appreciated individual responsibility of Chairman, Vice-Chairmen and other members of NRSC. 2. To ensure the activeness in dealing with tasks of NRSC s members and the cooperation among Ministries, sectors and central-governed provinces and cities during the implementation of Reducing emissions from deforestation and forest degradation, and the role of conservation, sustainable management of forests and enhancement of forest carbon stocks in developing countries (REDD+) 3. To work on jurisdiction and responsibility assigned in accordance with orders, procedures regulated by laws, in a timely, quality and efficiency manner. 4. Chairman and vice Chairman of NRSC who are leaders at Ministry of Agriculture and Rural Development (MARD) use the seal of MARD; vice Chairman of NRSC who is the leader of the Ministry of Natural Resources and Environment (MONRE) use the seal of MONRE to sign direction and operation documents under the responsibilities assigned. Article 3. Functions, duties and powers of NRSC NRSC handles affairs and powers as promulgated in Decision No 39/QĐ- BNN-TCCB dated 7 th January 2011 of MARD on Establishment of the National REDD+ Steering Committee, these being: 1

Propose to Minister of MARD and the National Steering Committee of the National Target Programme responding to climate change on the policy and solutions to address REDD+ issues and carbon credits in forestry sector in Viet Nam. 2. Assist Minister of MARD to direct the agencies and units under the Ministry; coordinate with relevant ministries, branches, localities and organizations in the management, coordination, solving important, interdisciplinary, inter-provincial problems on activities related to REDD+ initiatives in Viet Nam. 3. Direct the development and implementation of REDD+ Viet Nam; strategy formulation and planning, coordination of international cooperation activities and attract funding to implement REDD+ initiatives. 4. Perform other duties as the Minister of MARD assigned related to REDD+. Chapter II SPECIFIC TASKS OF MEMBERS OF THE NATIONAL REDD+ STEERING COMMITTEE Article 4. Chairman of NRSC 1. Lead, direct and operate all the activities of NRSC in the implementation of the tasks stipulated in Decision No 799/QD-TTg dated 27/06/2012 of the Prime Minister approve the National REDD+ Action Program (NRAP). 2. Decide on the program, the work plan, convene and chair meetings and make conclusions at NRSC s meetings. 3. Assign the task to vice chairmen of NRSC and its members; direct the coordinated implementation of tasks amongst the members, authorized to vice Chairman as needed. 4. Direct related agencies and units to research, propose mechanisms, policies, plans and coordinate activities between the ministries, branches and localities to implement REDD+ initiatives in Vietnam; monitor and assess the efficiency of REDD+ as regulated. 5. Make decisions on matters falling within the scope, duties and powers of the NRSC. 6. Sign direction and operation documents on behalf of NRSC as regulated. 2

5 Article 5. Vice-Chairman of NRSC 1. Vice-Chairman of NRSC who is the Vice Minister of MARD a) Assist the Chairman to direct the tasks under authority of the Chairman in the absence of the Chairman or when authorized. b) Check, report to the Chairman of NRSC on the coordination amongst the ministries, branches and People's Committees of provinces and cities directly under the Central Government and the agencies and organizations involved in the implementation of REDD+ plan and programs. c) Implement other tasks under the assignment of the Chairman. 2. Vice-Chairman of NRSC who is the Vice Minister of MONRE a) Assist the Chairman to urge the members of NRSC to implement their respective tasks as assigned by the Chairman. b) Check, urge, report to the Chairman of NRSC on the implementation of MONRE s tasks as stipulated in Point b, Clause 2, Section V Article 1 at Decision No 799/QD-TTg of the Prime Minister. c) Direct the REDD+ implementation within the UNFCCC, Kyoto Protocol (KP) and Convention on Biodiversity (CBD) d) Implement other tasks under the assignment of the Chairman. Article 6. The members of NRSC Members of are responsible for the implementation of tasks as assigned by the Chairman. Based on working program and tasks requirements, members of NRSC to actively monitor the progress, handle the difficulties and obstacles under the assigned functions and mandates. Members of NRSC are representatives of Ministries, sectors who are in charge of State management over their responsible issues, at the same time are directly assigned to implement some of the following: 1. Members of Ministry of Agriculture and Rural Development (MARD): a) Representative of VNFOREST - Propose to MARD, NRSC mechanisms, policy, solutions for REDD+ and carbon credit issues in forestry sector in Viet Nam. - To direct guide and operate the implementation of National REDD+ Action Program (NRAP) in accordance with regulation on management and execution of national programs. 3

6 - To direct the operation of VRO; synthesize NRAP implementation progress and report; convene the preliminary and final assessment of NRAP implementation as stipulated. - To implement other tasks under the assignment of the Chairman. b) Representative of Department of Finance - Collaborate in the development and establishment of National REDD+ Fund (NRF); issue regulations on organization and operation of NRF in accordance with Viet Nam s laws and international requirements. - On yearly basis, collaborate with other relevant agencies to summarize, review finance needs and list of REDD+ projects in order to integrate with the implementation of National Target Program on Climate Change and other relevant projects and programs. c) Representative of Department of International Cooperation - Focal point of international negotiation on REDD+; collaborate in fund raising internationally to implement REDD+. - Participate in negotiation and signing agreements on financial support with international donors who commit to contribute to NRF in accordance with laws. d) Representative of Department of Planning - Develop, approve and implement yearly, 5 year national plan - Collaborate with VNFOREST to summarize and report implementation of NRAP on a yearly basis; propose solutions for arising problems beyond authorities. e) Representative of Department of Scientific Technology and Environment Collaborate with MONRE s departments to integrate data on process and results of REDD+ implementation to National Communication and Biennial Updated Report (BUR) to submit to UNFCC; identify original timeline, data and FRELs/FRLs which serve as a basis to negotiate and assess REDD+ implementation results. 2. Members of line Ministries a) Member of MONRE: - To coordinate with MARD to integrate data on the progress and results of REDD+ implementation into the National Communication (NC) and Biennial Update Report (BUR) every 2 years and submit to United Nations Frame work on Climate Change (UNFCCC) Secretariat. - To direct land planning and management, including forest land and integrate REDD+ into land use planning at various levels. 4

7 - To propose mechanism, policy on forest land allocation and contract relating to REDD+ implementation; reduce green house gas emission and monitor relevant stakeholders to properly implement green house gas emission reduction roadmap. - Collaborate to direct, guide Provincial People s Committees to review and complete land allocation together with forest allocation and issue land use right certificate relating to REDD+ implementation; provide results of green house gas inventory in Viet Nam. - Collaborate to develop and submit the FRELs/FRLs, Summary of Safeguards Information to UNFCCC Secretariat, develop MRV, assess REDD+ implementation results. - To summarize financing requirements and REDD+ projects menu to integrate with National Target Program on Climate Change. b) Member of Ministry of Planning and Investment (MPI): - Take lead and guide Ministries, sectors, and localities to develop and synthesize annual and three- year medium term state budget plan to submit to NRSC. - Consult NRSC on balancing and allocating counterpart funds for NRAP, integrate REDD+ into national target programs. - Collaborate to research, propose mechanism and policy to manage and implement REDD+. c) Member of Ministry of Finance (MOF): - Coordinate to develop mechanisms and policies related to the financial management of NRAP; manual for management and utilization of NRF at various levels. - To supervise relevant parties to follow strictly the financial management rules applicable for NRAP. d) Member of Ministry of Foreign Affairs (MOFA): collaborate to conduct international negotiation on REDD+ and mobilize international fund to implement REDD+ and for NRF. đ) Member of Ministry of Science of Technology (MOST): - Take lead and coordinate to develop guidance, standard and procedure of monitoring, reporting and verification (MRV) in green house gas emission reduction. - Integrate REDD+ with other appropriate science and technology programs. e) Member of Committee of Ethnic Minorities Affairs (CEMA) 5

8 - Propose solutions and participate in propagandize activities, communication campaigns to raise awareness and capacity on REDD+ for ethnic minorities. - Integrate NRAP implementation with relating programs and projects. g) Member of Government Office: collaborate timely with relevant Ministries, sectors, and agencies, summarize report, advise to Prime Minister to resolve difficulties, obstacles relating to REDD+ implementation in Viet Nam. Article 7. Standing body of the NRSC 1. VNFOREST submits MARD, Chairman of NRSC the working plan of NRSC, organize the implementation after approval. Chair, collaborate to organize negotiation, mobilize support and implement the international cooperation projects, and programs on REDD+. 2. Vietnam REDD+ Office located in VNFOREST, MARD is assisting body of the NRSC; implement tasks as assigned by Chairman of NRSC, take responsibility before Chairman of NRSC and Director of VNFOREST. Article 8. Implementation budget Implementation budget of NRSC and VRO is approved by MARD in total annual budget of VNFOREST. Chapter III WORKING REGIME AND RELATION AND INFORMATION, REPORTING MECHANISM Article 9. Working regime of NRSC The NRSC works on the principle of concentration, members of NRSC bear responsibility in guiding the agencies and units under their management to coordinate with VRO to implement relating activities; report the Chairman on the implementation of assigned tasks. Article 10. Meeting of NRSC 1. The Chairman convenes and chairs the regular meetings every 6 months, in June and July every year, and ad hoc meeting in case of necessity to update the progress report and direct the implementation of NRSC s working program and plan. The Chairman may authorize the Standing Vice-Chairman to chair the meetings. 2. Chairman of NRSC decides to invite members outside NRSC who are scientists, managers, representatives of relevant agencies and organizations to participate in NRSC s meetings. 6

9 3. Members of NRSC shall have full participation and prepare reports within the tasks assigned. To authorize or send staff to attend the meetings in case of absence; authorized or replaced staff must be qualified and capable to report and solve the tasks. 4. Contents of regular meetings a) Consider, assess the activities of NRSC. b) Approve the annual REDD+ plan and resource allocation plan. c) Direct, coordinate activities among Ministries, sector and localities. d) Direct the research, development and completeness of mechanism, policy to implement REDD+. đ) Propose to the Prime Minister on REDD+ important issues in REDD+. Article 11. Working plan Every year, NRSC develops plan and assess the implementation of annual plan; assign specific tasks to members; conduct the inspection and monitoring the plan implementation at local levels, the implementation of international cooperation activities with REDD+ countries; summarize and report REDD+ implementation results by Article 12. Regime on information and report 1. Members of NRSC report to the Chairman under the forms as follows: direct report, written report, and report in the regular or ad hoc meetings of NRSC. The report contents contain following issues: a) Working progress of assigned tasks. b) Contents and results of conferences, meetings in which they chair or being assigned to participate in by the Chairman. c) Results and recommendations of Ministries, sectors, localities and partners. 2. Ministries, localities and the Head of the bodies implementing NRAP are responsible for periodical report (6 month, per year), ad hoc report in accordance with the requirement of the NRSC. a) Report must analyze, assess, synthesize the management and implementation of NRAP; to analyze the objective and subjective reasons affecting NRAP implementation results; report must be exact, precise, and reflect adequately the implementation process and achieved results. b) Report timeframe - 6 month report: 5 th July - Annual report: 15 th January of the next year. 3. VNFOREST receives and summarizes reports of NRSC. 7

10 4. VRO is responsible for: Timely providing related documents for members of NRSC on REDD+ activities upon request. Storage and management of data and documents of NRSC in accordance with current regulation. Chapter IV IMPLEMENTATION Article 13. The Chairman, Vice-chairmen are responsible for organizing and directing members of NRSC and VRO to implement the regulation. Article 14. During the implementation process, if any issues arise or need to be adjusted, supplemented in this Working Policy, the Chairman will consider and decide based on feedbacks and reports of NRSC s members./.
