1 BOROUGH OF HASBROUCK HEIGHTS MINUTES August 14, 2018 A Regular Meeting of the Mayor and Council of the Borough of Hasbrouck Heights was held on Tuesday, August 14th, at 8:22 p.m. at Borough Hall, 320 Boulevard, Hasbrouck Heights, NJ. Mayor De Lorenzo declared the meeting in Session and Acting Borough Clerk Laurie Varga stated that the meeting complied with the Sunshine Law, adequate notice of this meeting having been made to all members of the Council by personal service on January 4, 2018 and transmitted to The Record and The Herald News on January 4, ROLL CALL: Present: Mayor John De Lorenzo, Councilman Ron Kistner, Councilman Justin DiPisa, Councilwoman Josephine Ciocia, Councilman Russell Lipari, Councilman David Gonzalez, Councilman Christopher Hillmann Absent: SALUTE TO THE FLAG AND PLEDGE OF ALLEGIANCE: Mayor De Lorenzo led in the Salute to the Flag and Pledge of Allegiance. INVOCATION: The Invocation was given by Councilwoman Ciocia PRESENTATIONS: Certificates were presented to the South Bergen Softball League U10 Undefeated Champions Mayor De Lorenzo announced that the following item was being removed from the agenda: 15. Continued Public Hearing Prime Developers of New Jersey Oldfield Avenue, Lots Block APPROVAL OF MINUTES: July 10, 2018 Executive Session, July 24, 2018 Regular Meeting and Executive Session, December 27, 2017 Regular Meeting and Executive Session Mayor De Lorenzo requested a motion to accept the minutes as read which was made by Councilman DiPisa, seconded by Councilman Lipari and unanimously carried. COMMUNICATIONS: 1. Thank you note from Emma Nichols, Mary B. Quigg Scholarship recipient 2. Communication from Congressman Pascrell s Office regarding Grants in relation to the Omnibus funding bill 1

2 3. Communication from NJDOT regarding Grant opportunities for Municipal Aid, Transit Village, Bikeways or Safe Streets to Transit 4. Letter from Contemporary Club requesting permission to place a collection box in the Municipal Building to collect supplies for the Bergen County Animal Shelter in Teterboro 5. Invitation to annual Bergen County Senior Picnic to be held on Wednesday, 9/12/18. Mayor De Lorenzo asked if anyone would like to have any communication read into the record, hearing no one he requested a motion to accept the communications as read which was made by Councilman Lipari, seconded by Councilwoman Ciocia and unanimously carried. Mayor DeLorenzo requested a motion to approve the request in communication #4 which was made by Councilman Gonzalez, seconded by Councilman Lipari and unanimously carried. BILLS: WHEREAS, claims and accounts amounting to $4,312, specified in the schedule hereto annexed, have been examined and approved by the Finance Commissioner, or his Deputy; and WHEREAS, the Chief Financial Officer has certified that funds are available in the accounts listed for payment of the claims; NOW, THEREFORE BE IT RESOLVED, that the claims be paid and checks be issued on the funds and accounts indicated on the attached schedule. Mayor DeLorenzo requested a motion to approve the Bills Resolution which was made by Councilman DiPisa, seconded by Councilman Gonzalez and carried with Councilman Hillmann abstaining. 1. CONSENT AGENDA: 133. Payroll 134. Authorizing Raffle License for Greater Bergen Community Action 135. Authorizing Approval of 2018/2019 Licenses for Commercial Sale of Certain Motor Vehicle Dealers 136. Governing Body Certification of the Annual Audit (2017) 137. Authorizing appointment of Elisa Donnelly as Substitute Crossing Guard 138. Dog Licenses Payment of Fees to State 139. Approving 2018 Version of By-Laws of the Fire Department 2

3 140. Authorizing Contract with Airman H.V.A.C., LLC for Preventive Maintenance Services to the H.V.A.C. Systems in Certain Borough Buildings 141. Authorizing Agreement with the Board of Education of the Borough of Hasbrouck Heights to provide certain police protection services in the various schools in the Borough Mayor De Lorenzo requested a motion to approve the consent agenda which was made by Councilman Kistner (who thanked the Fire Chief and those members of the Fire Department that put in a lot of time and effort in updating the By-laws), seconded by Councilwoman Ciocia and unanimously carried except for Resolution No. 135 which was carried with Councilman Hillmann abstaining. RESOLUTIONS: 142. Authorizing Approval of 2018/2019 Licenses for Commercial Sale of a Certain Motor Vehicle Dealers BOROUGH OF HASBROUCK HEIGHTS RESOLUTION NO.: 142 DATED: August 14, 2018 WHEREAS, in the Borough of Hasbrouck Heights, County of Bergen, New Jersey, an application is required to be submitted and annual licensing fee is required to be paid by commercial enterprises in the business of selling certain motor vehicles; and WHEREAS, the fee has been paid, and pending approval by the Police Department, Fire Prevention and Building Department; NOW, THEREFORE, BE IT RESOLVED, that the Mayor and Council of the Borough of Hasbrouck Heights, County of Bergen, hereby approves the licenses of the following to operate for the period August 14, 2018 through February 28, 2019: NAME OF BUSINESS ADDRESS SUITE # PARKING New SPACES Essence Automotive 60 Railroad Avenue 108 6, 5, 18 Consumer 1st Auto Group 92 Railroad Ave , D103, D104 Arrgie 92 Railroad Ave 129 D1, D2, D61 3

4 Mayor De Lorenzo requested a motion to approve Resolution No. 142 which was made by Councilman Lipari, seconded by Councilwoman Ciocia and carried with Councilman Hillmann abstaining. APPOINTMENTS: Gino Tessaro to Hotel/Multi-Dwelling Inspector Mayor De Lorenzo requested a motion to approve the appointment of Gino Tessaro to Hotel/Multi-Dwelling inspector. (Councilman Hillmann had a question about approving Ordinance No prior to approving this appointment, but Mr. Chandless advised that this order was fine and if the Ordinance was not approved this appointment would be void anyway) The motion was made by Councilman Kistner, seconded by Councilman Lipari and carried with Councilman Hillmann voting no. ORDINANCE(S) ON INTRODUCTION: None ORDINANCE(S) ON PUBLIC HEARING: ORDINANCE NO AN ORDINANCE TO APPROPRIATE THE SUM OF $300, TO PROVIDE FOR THE ACQUISITION OF AN AMBULANCE WITH NECESSARY APPURTENANCES FOR THE USE OF FIRE DEPARTMENT OF THE BOROUGH OF HASBROUCK HEIGHTS AND A FOUR WHEEL DRIVE VEHICLE WITH NECESSARY APPURTENANCES FOR THE USE OF THE FIRE DEPARTMENT OF THE BOROUGH OF HASBROUCK HEIGHTS AND FURTHER TO AUTHORIZE THE FINANCING OF THE COST THEREOF IN ACCORDANCE WITH THE PROVISIONS OF THE LOCAL BOND LAW BY THE ISSUANCE OF BONDS OR NOTES NOT TO EXCEED THE SUM OF $285, Mayor De Lorenzo requested a motion to open the public hearing for Ordinance No which was made by Councilman Kistner, seconded by Councilman DiPisa and unanimously carried. Seeing no one come forward, Mayor De Lorenzo requested a motion to close the public hearing for Ordinance No which was made by Councilman Lipari, seconded by Councilman Kistner and unanimously carried. Mayor De Lorenzo requested a motion to approve Ordinance No which was made by Councilman Kistner, seconded by Councilman DiPisa and unanimously carried. ORDINANCE NO AN ORDINANCE TO APPROPRIATE THE SUM OF $150, TO PROVIDE FOR THE ACQUISITION OF EQUIPMENT FOR THE USE OF THE FIRE DEPARTMENT OF THE BOROUGH OF HASBROUCK HEIGHTS AND FURTHER TO AUTHORIZE THE FINANCING OF THE COST THEREOF IN ACCORDANCE WITH THE PROVISIONS OF THE LOCAL BOND LAW BY THE ISSUANCE OF BONDS OR NOTES NOT TO EXCEED THE SUM OF $142, Mayor De Lorenzo requested a motion to open the public hearing for Ordinance No which was made by Councilwoman Ciocia, seconded by Councilman Kistner and unanimously carried. Seeing no one come forward, Mayor De Lorenzo requested a 4

5 motion to close the public hearing for Ordinance No which was made by Councilman Lipari, seconded by Councilwoman Ciocia and unanimously carried. Mayor De Lorenzo requested a motion to approve Ordinance No which was made by Councilman Kistner, seconded by Councilwoman Ciocia and unanimously carried. ORDINANCE NO AN ORDINANCE TO APPROPRIATE THE SUM OF $100, TO PROVIDE FOR THE CONTINUED REHABILITATION AND ENVIRONMENTAL REMEDIATION OF THE DEPARTMENT OF PUBLIC WORKS OF THE BOROUGH OF HASBROUCK HEIGHTS AS REQUIRED BY THE NEW JERSEY DEPARTMENT OF ENVIRONMENTAL PROTECTION AND FURTHER TO AUTHORIZE THE FINANCING OF THE COST THEREOF IN ACCORDANCE WITH THE PROVISIONS OF THE LOCAL BOND LAW BY THE ISSUANCE OF BONDS OR NOTES NOT TO EXCEED THE SUM OF $95, Mayor De Lorenzo requested a motion to open the public hearing for Ordinance No which was made by Councilman DiPisa, seconded by Councilman Gonzalez and unanimously carried. Councilman Hillman requested clarification on what was being cleaned to which Mr. Kronyak advised that there were underground storage tanks dating back to the early 1990s which have since been replaced with above the ground tanks. Seeing no one else come forward Mayor De Lorenzo requested a motion to close the public hearing for Ordinance No which was made by Councilman Gonzalez, seconded by Councilwoman Ciocia and unanimously carried. Mayor De Lorenzo requested a motion to approve Resolution No which was made by Councilman Gonzalez, seconded by Councilman DiPisa and unanimously carried. ORDINANCE NO AN ORDINANCE TO SUPPLEMENT ENTITLED EXEMPT OFFICERS OF ARTICLE IV ENTITLED RESIDENCY REQUIREMENT EXEMPTIONS OF CHAPTER 45 ENTITLED OFFICERS AND EMPLOYEES OF THE CODE OF THE BOROUGH OF HASBROUCK HEIGHTS SO AS TO ADDITIONALLY PROVIDE THAT THE OFFICE OF LOCAL HOTEL AND MULTIPLE DWELLING INSPECTOR BE EXEMPT FROM THE RESIDENCY REQUIREMENTS OF N.J.S.A. 40A:60-6b(3) Mayor De Lorenzo requested a motion to open the public hearing for Ordinance No which was made by Councilman Lipari, seconded by Councilman Hillmann and unanimously carried. Councilman Hillmann asked if it was looked into to see if there were any licensed residents of Hasbrouck Heights to fill this position. Mayor De Lorenzo advised that since Gino Tessaro was already on staff as the Zoning Officer he was asked him to take it over for us, so it was an easier transition. Seeing no one else come forward, Mayor De Lorenzo requested a motion to close the public hearing for Ordinance No which was made by Councilman Lipari, seconded by Councilman Gonzalez and unanimously carried. 5

6 Mayor De Lorenzo requested a motion to approve Ordinance No which was made by Councilman Kistner, seconded by Councilman Lipari and carried with Councilman Hillmann voting no. MISCELLANEOUS FROM PUBLIC: Mayor DeLorenzo requested a motion to open the meeting to the public which was made by Councilman Kistner, seconded by Councilman DiPisa and unanimously carried. Mayor DeLorenzo invited members of the public to come up to discuss any topics at all. James and Angelisa Annichiarico, from 262 Paterson Avenue, came forward to discuss their concerns with a tree that is in front of their house and causing problems. Mayor De Lorenzo requested that this be looked into. Lisa Krommenhoek, from 225 Central Avenue, came forward to discuss her concerns with recycling and the fact that it looks like not everyone is recycling as required. Councilman Gonzalez offered that some people do bring their items down to the recycling center instead of putting them out and some also donate their paper to the animal shelter. Since Superintendent Spindler was not present, Mayor De Lorenzo asked that it be looked into as it has come up in the past and we do want our residents to recycle. Mayor DeLorenzo asked if there was anyone else who would like to come forward to speak, seeing no one, he requested a motion to close the public portion of the meeting which was made by Councilman DiPisa, seconded by Councilman Gonzalez and unanimously carried. Mayor DeLorenzo advised that the meeting would move directly into Work Session. ADJOURN: Mayor DeLorenzo requested a motion to adjourn which was made by Councilman Gonzalez, seconded by Councilman DiPIsa and unanimously carried.
