1 Academic Year 2018/2019 Professor: Antonello Pezzini Business management in the EU. J.M. SECS-P/08 (48 hours) J.M. chairs are distinguished by their European content. The European Union's policies must pursue a constant synthesis which respects the situations in the various regions as far as all the individual subject matters are concerned. Since the level of cultural and economic development of the various states are different, the synthesis which is achieved in Directives, regulations and resolutions must not dip below the level reached by states with greater performance in the regulated sectors. The states with less significant experiences must increase their efforts and may enjoy assistance from the EU, through structural funds and other interventions provided for by the Cohesion Policy, in order to overcome their limits. Culture, knowledge and use of best practises are, however, the best ways, above all, for high school students, to take control of their future and to be able to contribute to their regions being able to compete with the more evolved realities of the Union. Out of the 274 regions which make up the EU, some are five times richer than the poorest ones. Identifying the causes and defects which generate this poverty is the main pursuit of knowledge and, therefore, also and above all, of a course which explores the causes of the defects which generate this poverty, by looking at the best experiences of the European regions. New jobs originate from political will and capacity to favour process and product innovation. The European Commission's commitment to sustainable development is a fundamental element which materialises in directives and regulations which then become legislative documents in member states. The contents of this course aim to provide students with the appropriate tools in order to be able to seize employment opportunities deriving from innovation supported by the European Commission in new sectors emerging in the Green Economy and Circular Economy energy sectors. 3 Module 5: New EU Directives on: Concession Contracts (Directive 2014/23/EU) Public Procurement (Directive 2014/24/EU) Contracting procedures for suppliers operating in the water, transport and public service sectors (Directive 2014/25/EU) - New contracting code Legislative Decree 50/2016 The Lawfulness Rating. (8 hours) EU directive implementation: The new EU contracting regulations set three main objectives: simplification, flexibility and legal certainty. Through this reform, the public authorities may optimise their use of public procurement which, with almost 19% of European GDP, is a key factor in the European economy. The simplification of procedures, greater flexibility and their adaptation to better serve the other policies of the public sector or the possibility of greater quality-price ratio ('value for money') should make public procurement more efficient and more strategic, in compliance with the principles of transparency and competitiveness, to the benefit of both public buyers and economic operators. New Contracting Code. Legislative Decree 18/04/2016, n 50 Some of the new entries of EU directives implemented in the contracting code are : Standard Tender Documents" based on self-certification. The role of the Italian anti-corruption authority in contracting and Guidelines Law decree n 90/2014 converted into law n 114/2014, eliminating the authority monitoring public contracts regarding works, services and supplies, and transferring the competences of monitoring public contracts to the anti-corruption authority, redrafting the anti-corruption authority's institutional mission. The role of the new authority, as currently expressed, is to monitor to the ends of preventing corruption, creating a collaborative network in the context of public administrations and, at the same time, increasing the efficiency of resource use, reducing formal checks, which entail more demanding procedures and actually increase public administration costs without creating value for the public and companies. 3

4 The Lawfulness Rating: The Lawfulness Rating aims to recognise and promote the adoption of legal, ethical and transparent behaviour by business organisations. Corporate Social Responsibility (CSR), that is, company will to go beyond legal obligations, paying attention to and attempting to improve their own agreements regarding society and the environment, is one of the cornerstones of the Lawfulness Rating and, thus, one of the requisites which allows for increasing the achieved rating, regarding the adoption of processes intended to guarantee forms of Corporate Social Responsibility.
