3 Authority Meeting August 23, Declaration of Pecuniary Interest No persons declared a pecuniary interest relative to any item on the agenda. 3. Minutes of the Authority Meeting July 21, 2016 MOTION #G16-70 Moved by Robert Buckle Seconded by Dan Kerr THAT the minutes of the Authority meeting, held on July 21, 2016 be adopted as circulated. 4. New Business a. Draft Environmental Planning & Regulations Policies Manual Wayne Brohman introduced Karen Wianecki, Director of Practice from Planning Solutions Inc. Karen thanked the Authority for the invitation and the opportunity to review the draft Environmental Planning & Regulation Policies Manual. Historically, SVCA has not had a written policy manual and staff have been applying provincial policies as outlined in the Planning Act and the Conservation Authorities Act. This manual is intended to ensure that SVCA staff, municipal partners and the public have an understanding of planning and regulatory decisions made by SVCA. The Authority members discussed whether this manual could be presented to the public as it was written. Karen told the members that the purpose of the manual was for SVCA staff reference and that a manual for public use would need to be written as another simplified layer in the process. A coffee break was called at 2:50pm. The meeting was called back to order at 3:12pm. After discussion on the purpose of the manual and its content, the following motion was proposed: MOTION #G16-71 Moved by Maureen Couture Seconded by Steve McCabe THAT the draft Planning & Regulations Policies Manual be used as a reference guide; and further That it be reviewed by the Authority with the intent to eventually developing an approved policy document, and further; That necessary consultation take place as part of this review. 2

4 Authority Meeting August 23, 2016 The Authority members would like Motion #G16-71 to be circulated by . The Chair told the Members that it would be the responsibility of the Authority as a whole to review the document with Erik Downing and the Environmental Planning & Regulations Department, and to finalize all policies therein, especially those contained in chapters 3 & 4. Karen Wianecki will be completing the appendices with respect to the EIS and Terra Probe components as this is part of her contract with SVCA. Karen Wianecki and Candace Hamm left the meeting at 3:36pm. b. Saugeen Bluffs: No hunting designation The GM/S-T presented a map of the Saugeen Bluffs Conservation Area to the Authority and explained that currently part of the property has been designated no hunting but that hunting has been allowed in the northern region. Since the horse trails have been created, SVCA staff were concerned about hunting in areas where people could potentially be riding. After discussion the following motion was passed: MOTION #G16-72 Moved by John Bell Seconded by Maureen Couture THAT the entire Saugeen Bluffs property be designated as a no hunting area; and further THAT SVCA staff place appropriate signage on the property. 5. Other Business a. Low Water Advisory Committee The GM/S-T informed the Authority members that the Low Water Advisory committee had two vacant positions: 1) A Member of the Authority 2) A Member of a rural municipality. MOTION #G16-73 Moved by Kevin Eccles Seconded by Stewart Halliday THAT the Chair of the Authority takes a seat on the Low Water Advisory Team; and further THAT Barbara Dobreen be appointed as the Rural Municipality Representative. 3

5 Authority Meeting August 23, Closed Session: Violation Matter MOTION #G16-74 Moved by Steve McCabe Seconded by Barbara Dobreen THAT the Authority Members move to Closed Session, In Camera, to discuss a legal matter; and further THAT Wayne Brohman, Erik Downing, Michelle Gallant and Janice Hagan remain in the meeting. MOTION #G16-76 Moved by Steve McCabe Seconded by Barbara Dobreen THAT the Authority adjourn from closed Session, In camera, and rise and report. Only those items identified on the agenda were discussed in Closed Session. There were no actions to report from the Closed Session, In Camera. No quorum was present. The Members waited the required half hour, as outlined in the Authority s Administration Resolutions. John Bell, Kevin Eccles, Stewart Halliday, Sue Paterson, and Mike Smith had all indicated that they would be arriving late to the meeting, however, they had not yet arrived by the time one half hour had expired. 7 Background The Saugeen Valley Conservation Authority's role in municipal plan input and review is laid out in a Memorandum of Understanding (MOU) between Conservation Ontario, the Ministry of Municipal Affairs and Housing and the Ministry of Natural Resources, signed in This MOU is not binding on the SVCA but it does clarify the role in plan input and review that was delegated to all Conservation Authorities (CAs) by the Minister of Natural Resources in April According to the MOU, the areas of delegated provincial interest that were described in the minister's letter are now fully encompassed within Section 3.1 of the Provincial Policy Statement. The role delegated to a CA, according to the MOU, is to "review policy documents and development proposals processed under the planning act to ensure that the application has appropriate regard to Section 3.1. of the PPS." The MOU is explicit in stating that this is the full extent of the CA's delegated role in municipal planning activities. The MOU does recognize that CA activities under the Conservation Authority's Act may create a role for CAs in plan input, review and appeal that is separate from the role delegated to them by the province. The MOU makes it clear that CAs may become involved in municipal plan review to ensure that program interests developed under the CA Act are addressed in land use decisions. The importance of making applicants and municipal planning authorities aware of any regulations and requirements established under the CA Act is also recognized as a good reason for CA participation in the review of municipal planning activities. In short, the MOU describes the CAs as promoting 'integrated watershed management' along two tracks when it comes to municipal plan input and review. These are the areas of interest that must form the basis of any SVCA policy that seeks to govern our municipal plan input and review activities: 1. Representing the Provincial interest by ensuring that municipalities give appropriate regard to section 3.1 of the PPS in their planning activities. 2. Representing the CA's interest by advocating for the intent of CA policies and regulations to be reflected in municipal planning decisions. SVCA policies should make clear that the Authority accepts the delegated role in municipal plan input and review as it is described in the 2001 MOU. The policies should reiterate the terms of the MOU by stating that SVCA's plan input and review will be focused on determining if policy documents and development proposals are compliant with section 3.1 of the PPS and with SVCA policies established under the CA Act.

8 Importantly, SVCA policies should assert that all natural hazard features covered by section 3.1 of the PPS are also subject to SVCA's, Ontario Regulation 169/06 and that Ont. Reg. 169/06 provides the best articulation of SVCA policies as they pertain to municipal planning. In effect, the following general principles should be applied to the SVCA Planning and Regulations Policy; The provincial interest, as represented by the SVCA, in planning input and review is fully encompassed within the area regulated by the SVCA under Reg. 169/06; The area regulated by the SVCA under Reg. 169/06 represents the extent of the SVCA's own interest in municipal plan input and review; The SVCA's interest in municipal planning activities only extends beyond the area regulated by 169/06 in situations where the SVCA is an affected landowner as defined by the Planning Act. On the basis of these principles, the SVCA should stipulate that it will provide review and input on planning activities primarily where those activities intersect with the area regulated by Reg. 169/06 and that, in so doing, the SVCA will fully execute its role as defined by the MOU with the provincial ministries. The attached resolution is presented for consideration by the Authority in order to enact this concept within SVCA Planning and Regulations Policies. Respectfully submitted, Chair

9 Resolution Whereas, there is a Memorandum of Understanding (MOU) between Conservation Ontario, the Ministry of Municipal Affairs and Housing and the Ministry of Natural Resources that defines the role of a Conservation Authority (CA) in municipal plan input and review. And whereas, the roles of a CA in municipal plan review, as defined by this MOU, are as follows: 1. CA represents the Provincial interest by ensuring that municipalities give appropriate regard to section 3.1 of the Provincial Policy Statement (PPS) in their planning activities. 2. CA represents its own interest by advocating for the intent of CA policies and regulations to be reflected in municipal planning decisions. And whereas, Ontario Regulation 169/06 encompasses the areas of provincial interest in the Saugeen watershed as described in PPS section 3.1 and is the best encapsulation of the SVCA policies and regulations that are relevant to municipal planning activities. And whereas, the Saugeen Valley Conservation Authority (SVCA) would fulfill its role in municipal plan input and review, as defined by the MOU with the provincial ministries, by providing review and input on planning activities primarily where those activities intersect with the area regulated under Ontario Regulation 169/06. And whereas, the SVCA seeks to establish policies to define, describe and regulate its role in municipal plan input and review within the Saugeen watershed. Now therefore, be it resolved; That the SVCA accepts the delegated role of a CA in municipal plan input and review as it is described in the MOU with the provincial ministries. And That the SVCA's plan input and review will be focused on determining if policy documents and development proposals are compliant with section 3.1 of the PPS and with SVCA policies and regulations. And That, to fully execute its role in municipal plan input and review, it shall be the policy of the SVCA to provide review and input on planning activities primarily where those activities intersect with the area regulated under Ont. Reg 169/06. And That the SVCA hereby directs its staff to integrate this policy into the Authority's Planning and Regulations Policy document and authorizes the Chair to negotiate new planning services agreements with partner municipalities on the basis of this policy.
