1 OFFICIAL TRANSLATION MINISTER OF TRADE OF THE REPUBLIC OF INDONESIA REGULATION OF THE MINISTER OF TRADE OF THE REPUBLIC OF INDONESIA NUMBER 27/MDAG/PER/5/2017 CONCERNING STIPULATION OF REFERENCE PURCHASE PRICES AT THE FARMER LEVEL AND REFERENCE SALE PRICES AT THE CONSUMER LEVEL BY THE GRACE OF THE ALMIGHTY GOD THE MINISTER OF TRADE OF THE REPUBLIC OF INDONESIA, Considering : a. that to ensure the availability, stability and assurance of prices for rice, corn, soybean, sugar, cooking oil, shallot, beef, purebred chicken and purebred chicken egg, it is necessary to conduct changing towards reference purchase prices at the farmer level and reference sale prices at consumer level; b. that based on consideration as intended in letter a, it is necessary to revoke the Regulation of the Minister of Trade Number 63/M DAG/PER/9/2016 concerning Stipulation of Reference Purchase Prices at the Farmer Level and Reference Sale Prices at Consumer Level and reregulate stipulation of reference purchase prices at the farmer level and reference sale prices at consumer level; c. that based on considerations as intended in letter a and letter b, it is necessary to stipulate Regulation of the Minister of Trade concerning

Law Number 19 of 2013 concerning Protection and Empowerment for Farmers (State Gazette of the Republic of Indonesia of 2013 Number 131, Supplementary State Gazette of the Republic of Indonesia Number 5433); 4. 3 3 in the event of National Food Security (State Gazette of the Republic of Indonesia of 2017 Number 35); 10. Regulation of the Minister of Trade Number 08/MDAG/PER/2/2016 concerning Organization and Administration of the Trade Ministry (State Gazette of the Republic of Indonesia of 2016 Number 202); HAS DECIDED: To stipulate : REGULATION OF THE MINISTER OF TRADE CONCERNING STIPULATION OF REFERENCE PURCHASE PRICES AT THE FARMER LEVEL AND REFERENCE SALE PRICES AT THE CONSUMER LEVEL. Article 1 In this Regulation of the Minister referred as: 1. Reference Purchase Prices at the Farmer shall be purchasing prices at the farmer level stipulated by the Minister by considering reasonable cost structure includes among others production cost, distribution cost, profit, and/or other costs. 2. Reference Sale Prices at the Consumer shall be selling prices at the consumer level stipulated by the Minister by considering reasonable cost structure includes among others production cost, distribution cost, profit, and/or other costs. 3. Minister shall be the minister administering governmental affairs in the field of trade. Article 2 Public Corporation of the Logistic Affairs Board (BULOG) in conducting purchase and sale for rice, corn, and soybean shall refer to Reference Purchase Prices at the Farmer Level and Reference Sale Prices at the Consumer Level stipulated by the Minister. Article 3

4 4 (1) Public Corporation of the Logistic Affairs Board (BULOG) and/or other State Owned Companies in conducting purchase and sale for sugar, cooking oil shallot, beef, purebred chicken and purebred chicken egg shall refer to Reference Purchase Prices at the Farmer Level and Reference Sale Prices at the Consumer Level stipulated by the Minister. (2) In conducting purchase and sale as intended in paragraph (1), Public Corporation of the Logistic Affairs Board (BULOG) and other State Owned Companies can cooperate with State Owned Company, Regional Owned Company, Cooperation and/or private. Article 4 Business doer in conducting purchase and sale for rice, corn, soybean, sugar, cooking oil, shallot, beef, purebred chicken and purebred chicken egg shall refer to Reference Purchase Prices at the Farmer Level and Reference Sale Prices at the Consumer Level stipulated by the Minister. Article 5 Reference Purchase Prices at the Farmer Level and Reference Sale Prices at the Consumer Level as intended in Article 2, Article 3 paragraph (3) and Article 4 are attached in Appendix which are inseparable part of this Regulation of Minister. Article 6 (1) In the event of prices at the farmer level is below Reference Purchase Prices at the Farmer and prices at the consumer level is above Reference Sale Prices at the Consumer, the Minister can assign State Owned Company to conduct purchase in accordance with Reference Purchase Prices at the Farmer Level and conduct sale in accordance with Reference Sale Prices at the Consumer Level as intended in Article 5. (2) Assignment as intended paragraph (1) shall be given after the Minister coordinates with the Minister of Agriculture and the Coordinating Minister in the Field of Economy. (3) Assignment as intended in paragraph (1) for:

5 5 a. rice, corn, and soybean commodity are given to the Public Corporation of Logistic Affairs Board (BULOG); and b. sugar, cooking oil, shallot, beef, purebred chicken and purebred chicken egg are given to the Public Corporation of Logistic Affairs Board (BULOG) and/or other State Owned Companies. Article 7 Reference Purchase Prices at the Farmer Level and Reference Sale Prices at the Consumer Level as intended in Article 5 shall be applicable for 4 (four) months as from this Regulation of Minister is stipulated. Article 8 In the event of the validity of Reference Purchase Prices at the Farmer Level and Reference Sale Prices at the Consumer Level based on this Regulation of Minister terminates and the new Reference Purchase Prices at the Farmer Level and Reference Sale Prices at the Consumer Level are not stipulated then Reference Purchase Prices at the Farmer Level and Reference Sale Prices at the Consumer Level in this Regulation of Minister shall be declared to remain in effect. Article 9 As from this Regulation of Minister comes into effect: 1. Regulation of the Minister of Trade Number 21/MDAG/PER/3/2016 concerning Stipulation for Corn Reference Purchase Price at the Farmer Level (State Gazette of the Republic of Indonesia of 2016 Number 482); and 2. Regulation of the Minister of Trade Number 63/MDAG/PER/9/2016 concerning Reference Purchase Prices at the Farmer Level and Reference Sale Prices at the Consumer Level (State Gazette of the Republic of Indonesia of 2016 Number 1405), shall be revoked and shall be declared null and void. Article 10 This Regulation of Minister shall come into effect as from its stipulation date.
