Rybczynski, Town Clerk; Steve Walters, Town Attorney; Ken Farrell, Deputy Town Attorney; Jennifer Roberston, Information Technology Department; Michael Quinn, Engineering Consultant; Samantha Tarczynski, Director of Administration and Finance; Greg Wickett, Chief of Police; Mark Lorquet, Conservation Advisory Board Chair. 1. RESOLVED, that the Town Board bring the Work Session to order at 7:00 P.M. On a motion of Supervisor Shaw, seconded by Farrell, the following resolution was ADOPTED Ayes 5 Shaw, Best, Farrell, Mosey, Petrie Noes 0 Abstained 0 The Town Board reviews the proposed Agenda. The Town Board, Samantha Tarczynski, Director of Administration and Finance, and Steve Walters, Town Attorney discusses the resolution regarding a Highway employee requesting a leave of absence. They discuss the hiring of new employees and staffing in the Highway Department. Best discusses a possible grievance regarding an employee being given duties outside of their civil service position. The Town Board will have Charles Naughton, Human Resources and Contract Negotiations Consultant, research this employee s complaint. Ken Farrell, Deputy Town Attorney, discusses the Memo he provided to the Town Board regarding the Motor Vehicle Policy. Items discussed: Employees taking home Town Vehicles Personnel Use of Town Vehicles Town Seal Emblem Permanently affixed Town Seals on Town Vehicles The Town Board discusses using the Code Red system to notify residents regarding when Fire Companies will be holding Public Hearings to purchase equipment.

2 Work Session Hamburg, New York 2 Supervisor Shaw states that employees cannot be hired until they take their physical examination. He states it s a persistent problem particularly with regard to the Highway Department. The Town Board, Samantha Tarczynski, Director of Administration and Finance, Jennifer Roberston, Information Technology Department, Greg Wickett, Chief of Police, and Steve Walters, Town Attorney discusses the policy and procedure of hiring of new employees. The Town Board discusses the request for the proposal regarding bulk purchases of gas and the resolution submitted by Highway Superintendent Casey. 2. RESOLVED, that the Town Board adjourns the Work Session at 8:12 P.M. and moves into the Town Board meeting. 3 Work Session Hamburg, New York 3 MEMO To: Hamburg Town Board From: Drew Reilly Planning Department Date: January 28, 2019 RE: Planning: Town Board Items- 1/28/19 meeting The following is a brief update to the Town Board on Planning Department s projects/activities: A. Rezoning Items: There were no new rezoning applications received since the last Town Board meeting. Drew Reilly was contacting by David Stapleton concerning the South Shore Golf Course rezoning (I stated at a previous meeting that this project should be considered withdrawn as no action had taken place in close to a year) and he stated that the project was still active and wanted to be on an upcoming Planning Board meeting. I told him that he really needs to return to the Town Board to update them, as this is a rezoning (I copied the Supervisor on my response). We (Supervisor, Sarah, Kurt and myself) met with Mr. Stapleton on 1/16/19 and Mr. Stapleton will be proceeding with this project and a resolution will be filed for a future Town Board meeting. The residents in the Mosey Lane area would like to know if the Town Board will be proceeding with the rezoning of the Town property (along the McKinley Mall property). They would like the lands rezoned to PR (Park Recreation). The Board authorized moving forward and have referred this to the Planning Board. There are 6 Town owned parcels in this area. Three appear to be parklands and the Planning Board will make a recommendation at a future meeting. The Planning and Building Department are also working on the potential to rezone properties (homes) in the area of Clark Street/Bayview Rd./Armor Duells Rd. from Commercial to Residential. Many of these properties are non-conforming uses. A proposal for rezoning has been developed and letters will be sent to those that would be affected to get their input prior to proceeding with any rezoning process. B. The Planning Board held their last meeting on 1/16/19 and will have their next meeting on 2/6/19. The Planning Board has several large projects before them; the South Park and Sowles road project (60 multi-family units) was approved at the last PB meeting; the residential project at the Immaculata site (168 multi-family units) had a public hearing and was tabled; the Pleasant Avenue cluster development was approved to move forward as a cluster (now needs subdivision approval); the holiday venue at Willow Bend has been withdrawn, and the Wetzl subdivision (recent Court decision)

4 Work Session Hamburg, New York 4 needs input from the Town s attorneys. The following projects are on hold; commercial development at the corner of Southwestern and Camp and the David (Stapleton discussed above) Homes proposal. C. The Code review committee has not met since 11/7/18 and I provided the summary of that meeting to the Town Board in a past report. We have also presented potential revision to the multifamily recreational requirements of the Town and other small Code revisions that the Town Board has scheduled a public hearing on for 1/28/19. The next Code committee has been tentatively scheduled for 2/6/19 (agenda to go out tomorrow). D. The Planning Department also requests a future Work session meeting with the Town Board to discuss Planning Department activities, how we can improve our services to the Town, and what planning issues need our attention in We will also be discussing some possible fee schedule changes relating to PB applications and the Telecommunications law. RESOLUTIONS/ACTIONS/PUBLIC HEARINGS A public hearing is being held tonight on revisions to the Town s Subdivision and Zoning Codes related to trees built on subdivision lots and recreation requirements for multifamily developments. Resolutions have also been filed to make a SEQR decision on the proposed Telecommunications Law Update and to adopt this amended law.

5 Work Session Hamburg, New York 5 Hamburg Code Review Committee February 6, 4:00 pm AGENDA-Work Items I. Rezoning Issues 1. Development of the South Shore Golf course- rezoning to new PUD. Referred to PB; SEQR process started; Tabled; may re-start 2. Howard Road (Howard Green site); Rezoning to R-3 Status? 3. Two properties corner of McKinley and Clark; Fairgrounds rezone to Fairgrounds District (TB referred to PB, PB ok, waiting, no action taken?). 4. Property on Lakeshore Road discussed; rezone to RE. Property is large Estate lot with large horse barn. May be good idea for this site and Planning should look at other surrounding sites Clark Street; commercial rezone to R-1 or R-2 (properties are nonconforming housing). Would entertain this request; Planning/Building Department to investigate some of the surrounding properties. See recommendation by Building Department mailings sent to get input from residents. 6. Newer; Riley (C-2 to R-3); Application received, but applicant requested tabling (No action tabled). 7. Newer; Property north of Mosey lane- east of Mall. Residents would like Town to consider changing to PR district. TB said yes. At Planning Board for recommendation. 8. New; R-1 to R-3 on Lakeshore road near Hewson, Fairway, Shoreham II. Code Issues 1. Code Enforcement Issues: Section 232 and relating to pools and fences; Kurt working on. 2. Telecommunications Law Update- Adopted. 3. Solar law; needs to address current trends (Attorney has draft). 4. Food Trucks; see article from AOT- Proceed? 5. New; Historic Preservation law- Direction needed (Kurt assigned) 6. Town Board Concerns; retail and multi-family housing 7. C-1 Intent section/ hours of operation; not authorized yet 8. CAB- Conservation Area section of the Code; CAB assigned. 9. Advisory Committees and Boards Input, new items? 10. Other issues raised at ZBA or PB meetings (get input). 11. Amendment to two trees per lot waiver language- adopted. 12. New: potential zoning amendments related to wineries.
