BROWN, JR., Governor Kyle Butterwick, Community Development Department Director City of Dana Point Golden Lantern loll APR 2b P I:, Dana Point, CA Re: Dana Point Local Coastal Program (LCP) Major Amendment No Dear Mr. Butterwick: You are hereby notified that the California Coastal Commission, at its January 12, 2011 meeting in Long Beach, approved City of Dana Point LCP Amendment No with modifications. On January 13, 2010, the City of Dana Point submitted a request (LCP Amendment No. 1-10) to amend its certified Local Coastal Program (LCP) (also known as the Dana Point Harbor Revitalization Plan) for Dana Point Harbor, affecting the Implementation Plan (IP). Previously, this IP component was part of LCP Amendment Request 1-08, but was withdrawn and resubmitted due to timing concerns. The submitted IP amendment to the Dana Point Harbor Revitalization Plan, would implement the recently approved (October 2009) Land Use Plan (LUP) amendment, replacing, in its entirety, the implementation sections in the Dana Point Specific Plan Local Coastal Program relevant to the Dana Point Harbor. Proposed LCP Amendment Request No was submitted for Commission certification by City Council Resolution No and as reflected in the City Council Ordinance No The Commission approved the LCP amendment with suggested modifications. Therefore, LCP Amendment No will not be effective for implementation in the City's coastal zone until: 1) the Dana Point City Council adopts the Commission's suggested modifications, 2) the City Council forwards the adopted suggested modifications to the Commission by resolution, and, 3) the Executive Director certifies that the City has complied with the Commission's January 12, 2011 action and the Commission concurs with that determination. The Coastal Act requires that the City's adoption of the suggested modifications be completed within six months of the Commission's action (i.e. by July 13, 2011). That deadline can be extended for up to one year with Commission approval of an extension. If the City believes an extension will be required, please make your request in writing no later than May13,2011. Pursuant to the Commission's action on January 12, 2011, certification of City of Dana Point LCP Amendment No is subject to the attached suggested modifications (Attachment "A"). The suggested modifications included as Attachment "A" replaces in its entirety the implementation sections in the Dana Point Specific Plan Local Coastal Program relevant to the Dana Point Harbor pursuant to City Council Resolution No Thank you for your cooperation and we lookforward to working with you and your staff in the future.
