The interested contractors / bidders will have to make online payment (using credit card/debit card/net banking) of Rs. 1038/- (inclusive of all taxes) per bid per tender to online service provider of e-tendering system (Sify NexTenders) at the time of entering Online Bid Submission stage of the tender schedule. (ADF) on e-tendering website of Government of Maharashtra, by filling Demand Draft details online. Subsequently, bid has to be prepared and submitted online ONLY as per the schedule. The Tender form will be available online only. Tender forms will not be sold / issued manually from M.F.D.C. office Only those Tender offers shall be accepted for evaluation for which non-refundable Tender Fee, in the form of Demand Draft drawn in favour of Maharashtra Fisheries Development Corporation ltd. payable at par at Mumbai, is deposited in the office of Maharashtra Fisheries Development Corporation ltd. on or before scheduled date given in NOTICE DETAILS of the tender on working days. The bidders are required to download the tender document within the pre-scribed date & time mentioned in online tender schedule. After expiry of the date and time for tender document download, Department / Corporation will not be responsible for any such failure on account of bidders for not downloading the document within the schedule even though they have paid the cost of the tender to the Department / Corporation. In such case the cost of the tender paid by the bidders will not be refunded. PREPARATION & SUBMISSION OF BIDS Both the Bids (Technical as well as Commercial) shall have to be prepared and subsequently submitted online only. Bids not submitted online will not be entertained. 4

5 TECHNICAL BID Following documents should be uploaded in Online Technical Envelope (T1) in PDF format, if required can be Zipped as well and then uploaded. These documents need to be digitally signed by individual contractor s digital signature and uploaded during Online Bid Preparation stage. The list of documents to be submitted online for Technical Offer is as follows: 1) A copy of D.D./Receipt OF Tender Purchase 2) A copy of D.D. OF EMD. The Earnest Money Deposit will be forfeited if the tenderer fails to complete the contract according to terms and conditions of tender if accepted. Tenders without Earnest Money shall be rejected. 3) A copy of PAN and a Xerox copy of last three years income tax return statement should be enclosed with the Technical Envelop (T1) 4) An attested copy of the valid VAT or Central Sales Tax registration, clearance certificate up to December, 2010, should be enclosed with the Technical Envelop (T1). Or if not applicable / concession is provided then tenderers should submit a Xerox copy of certificate issued by relates sales tax office signed by authentic officer. Tenders received without the VAT clearance certificate are liable to be rejected. 5) Last three years audited copies of balance sheet and P&L Accounts should be enclosed with Technical Envelop (T1). 6) It is also mandatory to enclose a non defaulter certificate self declared An affidavit on Rs. 100/- stamp paper should be enclosed for the private entrepreneurs, declaring them to be non defaulter. Any defaulter of state government organizations, undertakings / and M.F.D.C, will not be entertained. 7) The experience certificate should be enclosed with the Technical Envelop (T1). It is mandatory to the suppliers of tube ice machinery to enclose copy of the license in manufacture of refrigeration machinery. With out such license tender will be rejected. The related license holder should have an experience of Five years in supply of such machinery to any Government agency or govt. undertakings. 8) Validity of the offer should be mentioned in Technical Envelop (T1). Tenders with less than 180 days Validity will not be considered. 5

6 COMMERCIAL BID All financial offers must be prepared and submitted online (An online form will be provided in Online Commercial Envelope (C1), during Online Bid Preparation stage) and signed using individual s digital certificate. Any bidder should not quote his offer any where directly or indirectly in Technical Envelope (T1), failing which the Commercial Envelope (C1) shall not be opened and his tender shall stand rejected. EARNEST MONEY DEPOSIT (EMD) Bidders are required to submit the Demand Draft as Earnest Money Deposit. The Demand Draft Drawn in the name of Maharashtra Fisheries Development Corporation ltd payable at par at Mumbai and is to be deposited in the office of the Maharashtra Fisheries Development Corporation on or before scheduled date given in NOTICE DETAILS of the tender on working days. Offers made without Earnest Money Deposit shall be rejected. INSTRUCTION TO BIDDERS FOR ONLINE BID PREPARATION & SUBMISSION During the activity of Bid Preparation, the tenderer is required to upload all the documents of the technical bid by scanning the documents and uploading it in the PDF format. This activity of uploading the documents as well as preparation of commercial bid and other Annexures enclosed with the tender (if any) shall be completed within the pre-scribed schedule given for bid preparation. After Bid Preparation, the tenderer is required to complete Bid Submission activity within pre-scribed schedule without which the tender will not be submitted. Interested contractors / bidders will have to make online payment (using credit card/debit card/net banking/cash Card) of Rs. 1038/- (inclusive of all taxes) per bid per tender to online service provider of e-tendering system (Sify NexTenders) at the time of entering Online Bid Submission stage of the tender schedule. Non-payment of processing fees will result in non submission of the tender and Department will not be responsible if the tenderer is not able to submit their offer due to non- payment of processing fees to the e-tendering agency. 7 The date and time for online submission of envelopes shall strictly apply in all cases. The tenderers should ensure that their tender is prepared online before the expiry of the scheduled date and time and then submitted online before the expiry of the scheduled date and time. No delay on account of any cause will be entertained. Offers not submitted online will not be entertained. If for any reason, any interested bidder fails to complete any of online stages during the complete tender cycle, department shall not be responsible for that and any grievance regarding that shall not be entertained. OPENING OF BIDS: The tenders that are submitted successfully online will be opened on the schedule date before the participant. Bids shall be opened either in the presence of bidders or it s duly authorised representatives. The bidder representatives who are present shall sign a register evidencing their attendance. Only one representative per applicant shall be permitted to be present at the time of opening the tender. TECHNICAL ENVELOPE (T1): First of all, Technical Envelope of the tenderer will be opened online through e- Tendering procedure to verify its contents as per requirements. At the time of opening of technical bid the tenderer should bring all the original documents that have been uploaded in the Online Technical Envelope (T1) so that same can be verified at the time of opening of technical bid. If the tenderer fails to produce the original documents at the time of opening of technical bid then the decision of the committee taken on the basis of document uploaded will be final and binding on the tenderer. If the various documents contained in this envelope do not meet the requirements, a note will be recorded accordingly by the tender opening authority and the said tenderer s Commercial Envelope will not be considered for further action but the same will be recorded. Decision of the tender opening authority shall be final in this regard. The commercial bids shall not be opened till the completion of evaluation of technical bids. The commercial Bids of only technically qualified Bidders as mentioned above will be opened. COMMERCIAL ENVELOPE (C1): 7

8 This envelope shall be opened online as per the date and time given in detailed tender schedule (if possible), through e-tendering procedure only, PRICE SCHEDULE Including suply and instalations at given destinations S.N. Bidders will fill the required information in these forms, online only. List of documents / Information to be uploaded / submitted online: The following documents should be uploaded in the form of PDF Files on the e- Tendering website by the tenderers during Online Bid Preparation stage. Note: If, during online bid preparation, any need arises to upload additional documents, apart from the above mentioned documents, an option to upload additional documents has been provided in the e-tendering software which will be available to bidders during online bid preparation stage. Other Terms and conditions to the tenderer I. The supply of the desired quality of items should start within 8 days from the date of receipt of order, if the supply is not started within the stipulated time period, the contract will be cancelled and Security Deposit amount will be forfeited. II. If the lowest tender, whose rates are finalized and approved, fails to supply order within stipulated time. The order can be placed next to L1 tenderer/supplier & respectively and the difference in the rate will be recovered from the defaulting tenderer either by adjusting in the deposit amount or by directly asking to pay the difference. 8

9 III. The tenderer will be required to submit the past experience certificate of the work with the technical envelop (T1). IV. If the participating tenderer tries to hide the facts or any false information is submitted by him then his tender shall be treated as cancelled and the Earnest Money Deposit shall be forfeited. V. The schedule of uploading and timings have been given and the tenderers have to strictly follow the schedule & timings for uploading the documents. There will not be any changes in the scheduled programme. It is pertinent for the tenderer or his authorised representative to attend the Tender opening. Priced Tender form should be returned duly and neatly filled in, failing which Tenders will not be considered. VI. Failure to observe any of the conditions mentioned above will result in the Tenders being summarily rejected. VII. The M.F.D.C. reserves the rights to accept or reject any/all tender/s without assigning any reason thereof. VIII. Any legal disputes shall be restricted to MUMBAI Jurisdiction only. IX. That in the event of either party being rendered unable by "force majeure" to perform any obligation required to be performed by it under this agreement, the relative obligation of the party affected by such force majeure shall after notice under this clause be suspended for the period during which such clause lasts. The term Force Majeure as used herein shall mean act of god, war, strikes or riots, fire, floods, Cyclone and Earth Quack act or regulation of the Govt. of India / State Govt. or any of its authorized Agencies. Upon the occurrence of any force majeure cause and upon its termination, the party alleging that it has been rendered unable as aforesaid, shall notify the other party in writing within Twenty Four (24) hours of the alleged beginning and ending there of giving full particulars and satisfactory explanation in support of its claim. Time for performance of the relative obligation suspended by the force majeure shall then stand extended by the period for which such cause lasts without any economical burden on Principal. XX. Arbitration: Any dispute, claims or rights arising out of or in relation to this contract shall be referred for Arbitration to an Arbitrator appointed by the secretary, Department of Animal Husbandry, Dairying and Fisheries, Ministry of A.D.F., Govt of Maharashtra. 9

10 Arbitration shall be conducted in accordance with the provisions of the Arbitration and Conciliation Act 1996 and the venue for the arbitration shall be at Mumbai. Conditions releted to Commercial envelope (C1) 1. The rates should be quoted for the supply and installatin of tube ice plant as per the annexure 1 to 3 including packing at the requested Destination in tender notice with inclusive of all taxes. 2. Tenderer are requested to quote rate as per the list of destination given in the tender notice. 3. Typed rates should be quoted both in words and figures. All corrections must be duly attested by the Tenderer. Tender Form No. & Name of Scheme, Code No. of items should be quoted on the envelope. 4. More than one offer from one tenderer will be treated as invalid. 5. Conditional offer will be rejected/ not considered. 6. Consignee have the right to reject the material immediately at Destination, if it is not as per specifications given by M.F.D.C. 7. Payment shall be made on the basis of the receipts received by M.F.D.C. duly accepted & signed with seal by the authorized person of MFDC. 8. Successful tenderer will be required to pay an amount as per given in the tender notice for each item as security deposit and enter into an agreement for the due performance of the contract. In event of the order being placed against the tenderers, and the tenderers fail to supply the items according to the terms and conditions of the tender. The Managing Director, M.F.D.C., Mumbai in his sole discretion shall take action deemed fit as under. (i) The offer of the defaulting tenderer will be cancelled. (ii) The defaulting tenderer will be penalized to the extent of the difference of rate at which the remaining tenderer will be executed by next tol1 & respectively to complete the whole tender. 9. The payment of the bill shall be made after receiving certificate issued by the Authorised officer of MFDC, which shall be duly signed by the tenderer or his representative. Initially 80% payment will be released after getting the receipt of certificate and panchanama. Panchanama should be signed by the members of 10

11 authentic committee and satisfied about supply and balance 20% will be released after execution of all orders placed by MFDC. 10. In the case of non-delivery or delayed delivery against an order placed, the M.D., M.F.D.C. reserve its right to impose such penalty in its sole discretion as it thinks fit. 11. Annexure I. Ammonia Tube Ice Machine. 5 Tons per day Ammonia Tube Ice Machine having Seamless S.S. Tubes in 304 grade having 38.1mm O.D. & 1.65 mm Thick, assembled in M.S. Shell with S.S. Tube sheets, complete with Water Storage Tank, S.S. Cutter Assembly along with Water Spraying System. 1. The Tube Ice Machine comprises of an M.S. Accumulator and M.S. Oil Separator Unit. 2. The Ice Machine consists of all the suitable accessories like Solenoid Valve & Float Switch for Ammonia Liquid Controlling, Ammonia Valves, Check Valves, Expansion Valves, Solenoid Valve for Hot Gas Defrost, Solenoid Controlled Ball Valves for Water Level Controlling. Pressure gauges with valves, fittings &, water spray nozzles. Chilled water circulating pump, Vertical Gear motor for Tube Ice cutter assembly, Electronic control panel complete with thawing timer switch, cutter gear motor, etc. 11
