2 Corporate Services Page 2 of 4 Report No. CS Purpose of Report Section 284(1) of the Municipal Act, 2001 (S.O. 2001, c.32) provides that on or before March 31 st of each year, the Treasurer of every municipality shall submit to the Council of the municipality a statement of remuneration and expenses paid to each member of Council in the previous year. This report is the Treasurer s statement in accordance with the Act. Analysis Table 1 details the remuneration paid to members of Council for the year ended December 31, The travel allowances paid to members of Council for the year ended December 31, 2007 is contained in Table 2. Benefit Costs are detailed in Table 3. 3 Corporate Services Page 3 of 4 Report No. CS The Council established a budget of $8,000 for 2007 for Members of Council to enhance community development and leadership skills by networking with representatives from the Province and other municipalities at conferences and conventions. In 2007, Members of Council received reimbursements from the municipality for expenditures related to their attendance at meetings, conferences, conventions and internet services. These reimbursements are summarized in Appendix A. Section 284(c) requires reporting of remuneration and expenses for persons appointed by Council to serve as a member of any body, including local boards. 4 Corporate Services Page 4 of 4 Report No. CS By-law No , the Expense Allowance Policy, provides for reimbursement of Members of Council who incur expenses for out of town travel. By-law No , is the current by-law establishing the annual allowance for Mayor and Members of Council. By-law No , is the current by-law authorizing remuneration to the Property Standards Committee. By-law No , is the current by-law authorizing remuneration to the Committee of Adjustment. On February 12, 2007, Council adopted By-law No deeming one-third of the Council s remuneration to be expenses incidental to the discharge of their duties as Members of Council. Therefore, the amounts paid to Mayor and Council are two-thirds taxable and one-third non-taxable, in accordance with Section 283(3) of the new Municipal Act. Section 284(4) provides that statements of Council and Board remuneration are a public record, despite the Municipal Freedom of Information and Protection of Privacy Act. Comments from Relevant Departments/Community and Corporate Partners Section 284(3) also provides that if the board pays remuneration expenditures to one if its members who was appointed by a municipality, the body shall on or before January 31 in the following year provide to the municipality an itemized statement of the remuneration and expenses paid for the year. s paid to Council appointees were confirmed with the various boards and agencies. Alternatives There are no changes to the new Municipal Act (Bill 130) affecting this report. Section 283(6) provides that Council can repeal the tax exempt position and the repealing by-law will be effective January 1 of the year following the date of repeal. Councillors will be required to pay tax on an additional one-third remuneration, but will receive a higher benefit. Total cost of this alternative increases costs for Councillors and the municipality and is therefore not recommended. The honorarium structure for Council was last reviewed in 2000 and provides for annual indexing at the same rate as provided to non-union staff.
