Hydro, was in attendance to formally announce approval of Hydro's share of the costs of burying overhead lines on the north side of South Fraser Way, from Gladwin Road to Emerson Street, under the 1994/95 Beautification Program. He confirmed Hydro's commitment to onethird of the actual project cost, i.e., $205,000. Excluded from the costs are B.C. Telephone, Cablevision and ornamental street lighting, which are the District's responsibility. J. Coupe supported the District's initiative to beautify the main corridor of South Fraser Way, and looked forward to working with staff on the project. Coupe, J. B.C. (Hydro) Moved by Councillor Funk, seconded by Councillor Gibson, that the presentation be received. Business Out of Minutes The Manager, Current Development, presented Report No dated March 22, 1994 from A. Campeau, Assistant Planner, which recommended approval of Development Permit No The permit dealt with site and height variances for a garage constructed by M. Lehner at PI axton Crescent. The garage is sited 2.6 m from the front lot line, rather than the required 15 m and would have a maximum height of 5.0 m. Retention of a landscape screen, consisting of 60-foot high pine trees along Plaxton Crescent, and a cedar hedge and fence along the north lot line were required. The owner had agreed to the contents of the permit and surrounding property owners and occupiers had been notified that they may comment on the proposal. M. Train, # Ware Street, asked what guarantees M. Lehner could provide that the structure would not be used for commercial purposes. She noted that he had commenced construction without obtaining a building permit, and did not feel the building conformed to the aesthetics of the single-family neighbourhood. G. Boyle read letters received from residents of Lakeside Terrace, 2445 Ware Street: the MacDonalds, #703; D. Fougere, #403; S. Strachan, #307; R. Hutton, #501; and from M. Alford, 2415 Ware Street. The residents complained about noise and were concerned about an increase in traffic on the cul-de-sac. They also wanted assurances that a commercial business would not be conducted on the property. M. Train complained that she and other neighbours had been disturbed by loud engine noises and smoke fumes from the garage. She also noted that a large commercial truck belonging to a motorsports company was seen on the property. This, along with a steel I-beam in the garage, caused her to suspect that a commercial enterprise may be under way. Lehner, M. (Plaxton, D94-05) Train, M. The Director of Development Services pointed out that complaints about noise can be enforced under the Noise By-law. He said that M. Lehner is aware of these concerns. Lehner, M. (Plaxton, ) (cont'd) M. Lehner assured the public and Council that he was merely a snowmobile enthusiast and would not be conducting business from the property. The truck referred to by M. Train belongs to a company which supplies parts for his snowmobiles. He explained that the garage will be fully insulated and of 2 x 6 construction. The high ceiling is required for ventilation and to accommodate a hoist for repairs. He agreed that the snowmobiles are noisy, but added that the new garage should alleviate this considerably. He pointed out that, since acquiring the property 10 months ago, he has improved the house and yard considerably. Councillor Funk questioned the presence of a large container on the property. M. Lehner explained that this is used for storage and would be removed when the new structure is complete. Councillor Funk stressed that, if the variance is approved, Council does not want to have to deal with neighbours' complaints. The Manager, Current Development, submitted a petition accompanied by photographs, from residents at 2445 Ware Street. The residents opposed the variance and stated that the building does not conform to the residential nature of the neighbourhood. Councillor Teichrob recognized the neighbours' concerns and asked what assurances the municipality could obtain from M. Lehner. Mayor Kandal pointed out that the municipality has enforcement powers under its by-laws. Funk that, as recommended in Report No from the Assistant Planner, Development Permit No. 278 be approved for issuance. DEFEATED. Opposed: Councillors Gibson, Hambley and Wiebe Mayor Kandal said that the matter would be reconsidered when all members of Council are in attendance. In the meantime, he urged Council to view the property. Report No , dated March from the Director of Development Services, recommended issuance of Development Variance Permit No. 279 to Rempel Bros. Concrete Ltd., for property at block McCallum Road. The permit would relax Section of the Zoning By-law to allow two cement silos with a maximum height of 25 m, and a slewing stacker of 16 m, rather than the required limit of 12.2 m. Rempel Bros. The amendment would permit excavation of approximately 6,000 m 3 of gravel from the southwest corner of the site and also provides for site restoration and landscaping. G. The purchase is to be funded from the Equipment Reserve Fund. Oak Creek Golf & Turf Inc. (Equipment) Tender - Mower 14-7 Moved by Councillor Funk, seconded by Councillor Hambley that, as recommended by the Purchasing Manager, the tender for supply of one ride-on, three-wheel, frontwheel drive, three-gang reel mower be awarded to Oak Creek Golf and Turf Inc. for the total delivered price of $15, The Manager of Inspection Services, in his Report No dated March 14, 1993, recommended that court injunctions be applied for under Section 751 of the "Municipal Act" for failure of the owners to comply with the terms of their restrictive covenants. Under the terms of the restrictive covenants, the owners were to demolish or convert their old dwellings when the new dwelfings were complete. T. Higgins noted that letters had been sent to all the owners, and none have complied. Belf, 6344) - Injunctions The Water and Sanitation Engineer addressed his Report No. 25 regarding award of a tender for the South Clearbrook Trunk Sewer-Marshalf Pump Station Diversion. The sewer will divert flow from the Marshall Road and South Fraser Way lift stations, resulting in reduced pumping costs. The work involves construction of 5 km of 1050 mm diameter sanitary sewer from Clearbrook Road at Highway No. 1 to Old Yale Road at Maclure Road. Eleven contractors submitted tenders, with the lowest being from Karland Contacting in the amount of $2, That price was reduced by $28,890 to $2,147, after a shorter alignment had been selected. Bomhof explained that the low tender is still higher than anticipated and, when combined with higher costs for land acquisition, the total project is estimated to be approximately $270,000 more than budgeted. Additional funds are proposed to come from the Infrastructure Renewal Fund. Itq Wiebe that, as recommended in Report No. 25 from the Water and Sanitation Engineer, Contract No be awarded to Karland Contracting Ltd. in the amount of $2,147,317.79, based on following the alternate "B" alignment; and the budget be increased to $2,887,500 for completion of both Phases 1 and 2 of the project, with the additional funds coming from the Infrastructure Renewal Fund. Karland Contracting (Construction) Tender - South Clearbrook Trunk Sewer (cont'd) R. Bomhof's Report No. 27 discussed a petition for local improvement from residents of Matsqui Village to install a sanitary sewer system in the Village. The Ministry of Health has ordered 33 residents to repair their existing septic tanks due to environmental and health concerns. R. Bomhof explained that the cost is based on receiving a 50% Provincial grant. (Sanitary Sewer) Local Improvement - Matsqui Village )50 Hambley that, as recommended in Report No. 27 from the Water and Sanitation Engineer, a local improvement project for a sanitary sewer system in Matsqui Village be approved, subject to receiving a 50% grant from the Province; and that the municipality contribute 50% of the cost of the project, net of the Provincial grant. Correspondence dated March 8, 1994 from the Fraser Valley Regional Library requested comments by April 15 on the present library funding formula. Councillor Gibson pointed out that, after amalgamation, the municipality will be the second largest member in the system. He said that $100,000 has been allocated for materials for the new library. The Administrator confirmed that the formula is based on 50% lagged assessments and 50% population. F.V. It was also requested that the "World Flag" be flown during the month of June. Councillor Gibson expressed his reluctance to approve the proclamation as this organization was unfamiliar to him. Global Essence Media (World Environment Day/Week) - June 1994 Moved by Councillor Gibson, seconded by Councillor Hambley, that the correspondence from Global Essence Media (G.E.M.) be received. Councillor Teichrob provided an update on the new library. He said that the design work is complete and tenders are expected to be called in May. It was suggested that the architectural design be presented for information at a public televised meeting.
