2 Administration Report #2D 16 CITY OF QUESNEL Original prepared by City Manager Johnson Administration Report Report Date: February 10, 2016 Meeting Date: February 16, 2016 To: From: Subject: Mayor & Council City Manager Alternative Approval Process Forms & Dates Approval PURPOSE The purpose of this report is to have Council approve the forms which will be used to collect voter responses and set the dates for the Elector Responses period. SUMMARY The City must advertise for two consecutive weeks in the Cariboo Observer its intent to enter into the debenture. This advertising will occur in the February 24 th and March 2 nd issues. Council must establish the deadline by which Elector Response forms may be submitted, this is calculated as 30 days subsequent to the last legal newspaper publication of the project. In our case this works out to April 4, % of the estimated voter list must register their opposition in order to stop this from proceeding (this is estimated at 723 voters). Attached to this report are the various forms and a copy of the advertisements which will appear in the newspaper. STATUTORY REQUIREMENTS The Alternative Approval Process is prescribed by Section 86 of the Community Charter FINANCIAL IMPLICATIONS The financial implications of conducting an Alternative Approval Process are negligible. 3 OPTIONS Council has the options of approving or not approving this next stage of this project. Council can also choose to approve or extend the voting deadline date. RECOMMENDATION WHEREAS the City of Quesnel has given three readings to the City of Quesnel Public Works Loan Authorization Bylaw No of 2016 which proposes the construction of a new Public Works Facility and a debenture not to exceed $10,000,000 be obtained to finance the construction of a new Public Works Facility which will be repaid over a period not to exceed 30 years; AND WHEREAS the City of Quesnel cannot adopt the City of Quesnel Public Works Loan Authorization Bylaw No of 2016 until the approval of the electors has been obtained; THEREFORE BE IT RESOLVED that the Corporate Officer undertake an alternative approval process to determine the opinion of the electors with regard to the matter; AND THAT IT BE FURTHER RESOLVED that Council approves the Alternative Approval Process Single Response Form for eligible electors to sign and submit to the Corporate Officer to indicate their OPPOSITION that Quesnel City Council may NOT proceed with the proposed City of Quesnel Public Works Loan Authorization Bylaw No of 2016; AND THAT IT BE FURTHER RESOLVED that the deadline for submitting elector response forms be established as April 4 th, 2016 at 4:30 pm. 4 CITY OF QUESNEL BYLAW NO A Bylaw to authorize the borrowing of the estimated cost of constructing the new Public Works Facility. WHEREAS it is deemed desirable and expedient to construct a new Public Works Facility. AND WHEREAS the estimated cost of constructing the Public Works Facility including expenses incidental thereto is the sum of $10,945,000 of which the sum of $10,000,000 is the amount of debt intended to be borrowed by this bylaw; NOW THEREFORE, the Council of the City of Quesnel in open meeting assembled enacts as follows: 1. The Council is hereby empowered and authorized to undertake and carry out or cause to be carried out the construction of the Public Works Facility generally in accordance with general plans on file in the municipal office and to do all things necessary in connection therewith and without limiting the generality of the foregoing: a) To borrow upon the credit of the Municipality a sum not exceeding $10,000,000. b) To acquire all such real property, easements, rights-of-way, licenses, rights or authorities as may be requisite or desirable for or in connection with the construction of the said Public Works Facility. 2. The maximum term for which debentures may be issued to secure the debt created by this Bylaw is thirty (30) years. 3. 7 The City of Quesnel intends to adopt the City of Quesnel Public Works Loan Authorization Bylaw No of The purpose of the bylaw is to borrow an amount not to exceed $10,000,000 to finance the cost of new Public Works Facility that will be repaid over a period not to exceed 30 years. It is estimated that the borrowing will result in a tax increase for the average residential property of $26.17 per year. It is anticipated that other costs will be reduced that will offset this tax increase. The intent is to build a new Public Works Facility on property owned by the City on Sword Road. The current Public Works Facilities are very old and decrepit and are located below the 200 year flood level. The new facility will be professionally designed with energy savings in mind and replace 11 different buildings currently used. The total estimated cost of the project is $10,945,000 with the remaining funds coming from capital reserves. A copy of City of Quesnel Public Works Loan Authorization Bylaw No of 2016 and a report summarizing the project is available from the local government s offices during each business day of the week between 8:30 a.m. to 4:30 p.m. Further information about the construction of a new Public Works Facility can be found on the City s website at Eligible electors wanting to indicate their OPPOSITION that Quesnel City Council may NOT proceed with the proposed City of Quesnel Public Works Loan Authorization Bylaw No of 2016 may submit one Electoral Response Form until 4:30 p.m. April 4, 2016 at City Hall, via facsimile , or via to alternativeapproval@quesnel.ca. Additional Information About Elector Eligibility In order to sign an elector response form in relation to the alternative approval process, a person must be either be a resident elector or a non-resident property elector. A resident elector is an individual who is entitled to sign an Elector Response Form during an Alternative Approval Process by virtue of living within that jurisdiction. When signing an Elector Response Form, a resident elector must: Be 18 years of age or older Be a Canadian Citizen Have lived in British Columbia for at least six months immediately preceding voting day Have lived in the City of Quesnel for at least 30 days immediately preceding voting day Have lived in the area defined for the Alternative Approval Process Not be disqualified under the Local Government Act, or any other enactment form voting in a local election, or be otherwise disqualified by law A non-resident property elector is an individual that does not live in a jurisdiction and who is entitled to sign an Elector Response Form during an Alternative Approval Process by virtue of owning property in that jurisdiction. NOTICE TO ELECTORS OF AN ALTERNATIVE APPROVAL PROCESS TO AUTHORIZE A LOAN FOR A NEW PUBLIC WORKS FACILITY MORE INFO ON This notice is the first of two notices to advise electors in the City of Quesnel of the intention to adopt City of Quesnel Public Works Loan Authorization Bylaw No of The purpose of the bylaw is to borrow an amount not to exceed $10,000,000 to finance the cost of a new Public Works Facility that will be repaid over a period not to exceed 30 years. It is estimated that the borrowing will result in a tax increase for the average residential property of $26.17 per year. A copy of Bylaw 1786 and a summary of the proposal are available from the local government s offices during each business day of the week between 8:30 a.m. to 4:30 p.m. The City of Quesnel proposes to borrow the money and undertake the construction of a new Public Works Facility unless, by 4:30 p.m. on April 4, 2016, at least 10 percent of the electors in the City of Quesnel sign an elector response form opposing the implementation of the proposal unless the City of Quesnel holds a vote. The number of elector responses required to prevent the local government from proceeding unless a vote is held is estimated to be 723. A report respecting the basis on which this determination was made is available upon request from the local government. Elector responses are required to be submitted to the local government on forms that can be obtained during regular business hours from City Hall located at 410 Kinchant Street. The form can also be downloaded from the City of Quesnel website at: The only elector response forms that will be accepted by the local government are the ones provided by the City of Quesnel, or an accurate copy of the form. Eligible electors wanting to indicate their OPPOSITION that Quesnel City Council may NOT proceed with the proposed City of Quesnel Public Works Loan Authorization Bylaw No of 2016 may submit one Electoral Response Form until 4:30 p.m. April 4, 2016 at City Hall, via facsimile , or via to alternativeapproval@quesnel.ca. Only electors of the City of Quesnel are eligible to sign the elector response forms. There are two types of electors resident electors and non-resident property electors. Resident Elector: When signing an elector response form, a resident elector must: be 18 years of age or older; be a Canadian Citizen; have lived in British Columbia for at least six months immediately preceding voting day; have lived in the City of Quesnel for at least 30 days immediately preceding voting day; have lived in the area defined for the Alternative Approval Process; and not be disqualified under the Local Government Act, or any other enactment form voting in a local election, or be otherwise disqualified by law. Non-Resident Property Elector: When signing an elector response form, a non-resident property elector must: be 18 years of age or older; be a Canadian Citizen; have lived in British Columbia for at least six months immediately preceding voting day; be the registered owner of real property in the City of Quesnel at least 30 days immediately preceding voting day; own property in the area defined for the Alternative Approval Process; and not be disqualified under the Local Government Act, or any other enactment form voting in a local election, or be otherwise disqualified by law. Note: Only one non-resident property elector may sign an elector response form per property, regardless of how many people own the property; and, that owner must have the written consent of a majority of the other property owner(s) to sign the response form on their behalf. An eligible elector can only vote once/alternate Approval Process. (See Form 2-8) Property owned in whole or in part by a corporation does not qualify under the non-resident property elector provisions. Resident electors signing the elector response form must provide their name and address. Non-resident property electors must provide their name and the address of the property in relation to which they are entitled to register as a non-resident property elector. The local government will not share the information on the form with anyone other than the Corporate Officer, or other person designated by the Corporate Officer.
