ZONING: PURPOSE: PROPOSAL: BY-LAW REQUIREMENT: BACKGROUND INFORMATION: The subject lands are zoned RIV, Old Village Residential Zone and subject to the provisions of Exception 9(662) under By-law 1-88 as amended. To permit the maintenance of an existing one-storey place of worship with daycare which is presently legal non conforming. 1. To permit the expansion of a legal non-conforming Use (Day Nursery) accessory to a place of worship. 1. The expansion of the Day Nursery Use is not permitted. (Ward 5) HEARING DATE: DECEMBER 3, 2015 DATE: NOVEMBER 24, 2015 Proposed Variance(s): 1. To permit the expansion of a legal non-conforming Use (Day Nursery) accessory to a place of worship. By-law Requirement(s): 1. The expansion of the Day Nursery Use is not permitted. Official Plan: VOP 2010 designation: Low-Rise Residential, subject to the Legal Non-Conforming policies. The proposal conforms to the Official Plan Policies. Comments: The Owner is requesting permission for the expansion of a legal non-conforming use, being an existing Day Nursery (Polka Dot Preschool) in an existing institutional building (Thornhill Presbyterian Church). Development Planning Department staff conducted a site visit with photo documentation on July 28, The subject lands are developed with an existing institutional building (church), parking lot, single detached dwelling, and an existing outdoor playground area. The variance application is a result of the anticipated increase (10 additional persons) to the previously approved occupancy load (60 persons) for the Day Nursery use ( m 2 ground floor and basement). The Owner is proposing to utilize the washroom facilities of the church in order to meet the Ontario Building Code standards, and therefore, requires the expansion of the legal non-conforming use. No addition to the existing building is being proposed. The Owner has submitted concurrent Site Development File DA to legalize the existing outdoor playground area, which has existed for over 10 years on the subject lands. The Development Planning Department has no objection to the requested variance for the expansion of a legal non-conforming use, subject to Site Plan approval being obtained. The Development Planning Department is of the opinion that the proposal is minor in nature, meets the intent of the Zoning By-law, and is desirable for the appropriate development of the land. Recommendation: The Development Planning Department supports the proposal, subject to the condition(s) below: Condition(s): That the Owner shall successfully obtain Site Plan approval, to the satisfaction of the Development Planning Department. 20 COMMENTS: PowerStream has received and reviewed the proposed Variance Application. This review, however, does not imply any approval of the project or plan. All proposed billboards, signs, and other structures associated with the project or plan must maintain minimum clearances to the existing overhead or underground electrical distribution system as specified by the applicable standards, codes and acts referenced. In the event that construction commences, and the clearance between any component of the work/structure and the adjacent existing overhead and underground electrical distribution system violates the Occupational Health and Safety Act, the customer will be responsible for 100% of the costs associated with PowerStream making the work area safe. All construction work will be required to stop until the safe limits of approach can be established. In the event construction is completed, and the clearance between the constructed structure and the adjacent existing overhead and underground electrical distribution system violates the any of applicable standards, acts or codes referenced, the customer will be responsible for 100% of PowerStream s cost for any relocation work.
