1 September 20, 2011 Minutes of the Public Meeting of the Corporation of the Municipality of Port Hope held on Tuesday September 20, 2011 at 6:00 p.m. in the Council Chambers, 56 Queen Street, Port Hope, Ontario. Present: Mayor L. Thompson, Deputy Mayor J. Gilmer, Councillors R. Austin, G. Burns, M. Ellis, J. Lees, D. Turck and Student Councillor M. Harrington Staff: Members of the Public C. Cannon, Chief Administrative Officer S.C. Dawe, Director of Corporate Services/Clerk C. Martinell, Deputy Clerk R. Warne, Director of Planning and Development Services T. Merepeza, Municipal Planner J. Selvig, Director of Economic Development and Tourism There were 15 members in attendance. 1. INTRODUCTION: Councillor Ellis called the meeting to order stating the purpose of the public meeting is for the Planning and Development Committee to inform the public of the proposed Official Plan Amendment (OP004) and Zoning By-law Amendment (ZB214) for Victoria Street North. The purpose of the Official Plan Amendment would be to re-designate the portion north of the proposed road to High Density Residential in order to permit the development of four 3.5 storey condominium buildings; redesignate the portion south of the proposed road to Medium Density Residential in order to permit the development of the 18 townhouse units; and re-designate and relocate the proposed collector road to a local road. 2 The purpose of the proposed Zoning By-law amendment would be to rezone the northern portion of the site to High Density Residential Exception No.97, Holding Provision One "RES4(97)(H1)" Zone; and rezone the southern portion of the site to Medium Density Residential Exception No. 98, Holding Provision One "RES3(98)(H1) Zone. 2. ANY DECLARATIONS OF INTEREST FROM THE COMMITTEE MEMBERS None declared. 3. THE CLERK WILL NOW EXPLAIN THE STATUTORY NOTICE PROCEDURE S.C. Dawe, Municipal Clerk explained the statutory notice procedure confirming that notice was given in accordance with Section 17(17) and 34(12) of the Planning Act, R.S.O. 1990, c.p.13, to all persons and agencies who were entitled to receive notice by first class mail and advertised in the local newspapers. In addition information pertaining to the proposed Official Plan Amendment and Zoning By-law Amendment and location map were posted on the Municipal Website. Notification details are contained within the Planner's Report and within File OP004 and ZB STAFF REPORT PRESENTATION 4.1 The Municipal Planner reviewed the Staff Report dated September 14, 2011 highlighting the Background, Proposal, Analysis and Recommendation. 4.2 Applicant Presentation Bob Clark of Clark Consulting Services on behalf of the applicant Ontario Inc. provided a power point presentation pertaining to the proposed residential development. 5. CORRESPONDENCE 5.1. Letters and/or Comments from the Public S.C. Dawe, Municipal Clerk advised that there were no letters and/or comments received from the public prior to printing of the agenda. 3 5.2. Confirmation and Reading of Written Submissions Made After the Printing of the Agenda S.C. Dawe, Municipal Clerk advised that written submissions were received post printing of the agenda from members of the public as follows: Mr. Mort Hallowell, 86 Trefusis Street, dated September 6, 2011 Ronald K. Webb, Q.C., of Davis Webb on behalf of Maple Lodge Farms and Curtis Chicks, dated September 16, 2011 Port Hope Police Service received September 20, Agencies, Municipal Departments and Ministries Notification was given in accordance with the provisions of the Planning Act, as outlined in the circulation schedule of the Planner's Report. On March 5, 2010, a notice of Complete Application for the original application was mailed to all assessed persons within 120 m of the subject lands, as well as placed in both local newspapers (The Northumberland News and Northumberland Today). Notice of Revised Application, including the revised site plan was mailed on July 5, 2011 to all assessed persons within 120 m of the subject lands and those requesting to be notified. Notice of Public Meeting for the subject application was mailed on August 26, 2011 to all assessed persons within 120 m of the subject lands and those requesting to be notified. The notice was published in both local newspapers on August 26, 2011 and posted on the Municipal Website. In July 2011, the revised application was circulated to the applicable internal departments and external agencies. Comments relating to the revised applications were circulated to Staff and agencies as outlined in the circulation schedule in the Planner's report. Circulation responses received include Works and Engineering dated August 8, 2011, Parks, Recreation and Culture dated July 20, 2011, Fire and Emergency Services dated August 10, 2011, Ministry of Transportation dated July 15, 2011, Kawartha Pine Ridge District Health Unit dated July 20, 2011, Ganaraska Region Conservation Authority dated August 8, 2011, Kawartha Page 3 of 5 Page 3 of 5

4 Pine Ridge District School Board dated July 14, 2011, Peterborough Victoria Northumberland Clarington District Catholic School Board dated July 14, 2011, Veridian Connections dated August 2, 2011, Canada Post dated August 8, 2011, Union Gas dated August 8, 2011 and AECL dated August 11, APPLICANT / AGENT TO RESPOND Bob Clark and Jacqueline Mann of Clark Consulting Services on behalf of Ontario Inc.; Somer Rumm, Lyle Laderoute and Heather Doucet of New Age Homes and Joanne Christy, Real Estate Agent were in attendance. Mr. Somer Rumm responded to questions from the public. 7. QUESTION PERIOD 7.1. Questions by Council Councillor Austin regarding noise associated with proximity to the Joint Operations Centre, drainage and water runoff including storm water management and surplus lands process. Mayor Thompson regarding more details pertaining to the proposed change to the Collector Road noting the Collector Road was established through an extensive Official Plan process. Deputy Mayor Gilmer regarding the location and use of Block "C" as an alternate exit/emergency exit. Councillor Burns regarding process and moving forward to a plan of subdivision without appropriate detail Submissions from Members of the Public Councillor M. Ellis provided information on the process as follows: If a person or public body that files a notice of appeal of a decision of the Municipality of Port Hope in respect of the proposed official plan amendment and zoning by-law does not make oral submissions at a Public Meeting or make written submissions to the Municipality of Port Hope before the proposed official plan amendment and zoning by-law are adopted, the Ontario Municipal Board may dismiss all or part of the appeal. 5 All interested parties who wish to make oral submissions this evening should approach the microphone and state your name and address for the record please. Shirley Beatty, 27 Spicer Street regarding clarification between reference to apartment and that of a condominium/town house, proposed number of units and effect on neighbouring property values if high density residential development is permitted. Paul Swift, 13 Spicer Street regarding proposed development and changes in land use and process. Sanford Haskill, 4865 Lakeshore Road regarding process pertaining to severance of Municipal land and location of entrance to the Joint Operations Centre and testing for radioactive material. Bernice Makepeace, 264 Victoria Street regarding increased traffic and requested that the density be kept low. Somer Rumm, developer regarding proposed development, condominium road, responsibility for installation of servicing and experience in similar development. Petrus Strybosch, 126 Trefusis Street regarding drainage. 8. RECOMMENDED ACTION 8.1 Recommended Action Moved by Councillor Turck Seconded by Councillor Austin That consideration of Public Meeting submissions be referred to the Committee of the Whole Meeting following the Public Meeting.
