WHEN IS A HERITAGE ALTERATION PERMIT REQUIRED? A Heritage Alteration Permit is required to make changes to properties designated under the Ontario Heritage Act. A heritage designated property is defined in the Ontario Heritage Act as real property, and the buildings and structures on the real property. Properties can be individually designated under Part IV of the Ontario Heritage Act, designated within a Heritage Conservation District under Part V of the Ontario Heritage Act, or both. The Ontario Heritage Act was enacted by the Province of Ontario to enable municipalities to protect properties of cultural heritage value or interest. The Ontario Heritage Act requires processes to ensure that any changes to a designated property conserves its cultural heritage value and heritage attributes. A Heritage Alteration Permit is required prior to any changes to a heritage designated property. These changes could include the replacement, removal, alteration, damage or destruction of heritage attributes on the property. For Part IV designated properties, Heritage Alteration Permit approval is required if changes are likely to affect the heritage attributes of the property (Section 33). For Part V designated properties, classes of alterations requiring Heritage Alteration Permit approval are identified in the applicable Heritage Conservation District Plan (Section 42). 3. WHAT INFORMATION IS NEEDED FOR A HERITAGE ALTERATION PERMIT APPLICATION? Sections A, B, C, and D on the Heritage Alteration Permit application form must be completed and all required information must be attached. Attachments include all the required information that will provide the visual or technical information for the review. Although it is not required to obtain professional assistance in the preparation of a Heritage Alteration Permit application, applicants are encouraged to seek assistance from an architect, architectural technologist, preservation specialist, or others familiar with the unique requirements of designated heritage properties. A Heritage Alteration Permit application is deemed complete only when all drawings, plans, and related information are received by the Heritage Planner. The Heritage Planner will review the application to determine if all required information has been submitted. Once the Heritage Planner determines all information has been submitted to their satisfaction, a Notice of Receipt will be issued by the Heritage Planner, as required under the Ontario Heritage Act. 2 3.1 REQUIRED INFORMATION The items listed below are required to be submitted with the Heritage Alteration Permit application: Full Description of Proposed Change(s) Describe the property and it heritage attributes; Describe the proposed change(s). Use drawings, plans, sketches to describe the proposed change(s), and; Describe the property's heritage attributes affected by the proposed change(s) Photographs Should sufficiently document the existing condition of the property and any of its heritage attributes that may be affected by the proposed change(s) Materials and Methodology Should sufficiently identify existing and changing materials as well as explain method of installation(s) and/or attachment. 3.2 SUPPLEMENTARY INFORMATION The items listed below may be required to be submitted with the Heritage Alteration Permit application, at the request of the Heritage Planner: Scaled and Dimensioned Plans & Elevations Dimensioned drawing(s) (in letter, legal or tabloid size) must document the existing condition and the proposed alteration. Drawings should illustrate the following: Overall dimensions; Specific sizes and labelled building elements (i.e. signs, windows, awnings); Detailed architectural information (i.e. trim, siding) with sizes and profiles; Types of material and finishes (i.e. paint) to be used (noted on drawing); and, Construction methods and means of attachment. *Note that freehand, sketched drawings are discouraged Historical Documentation Submit any historical background (i.e. photographs, articles) on the subject property that will assist the Heritage Planner understand the application Heritage Impact Assessment Submit a Heritage Impact Assessment, which is a study that determines if any cultural heritage resources that are impacted by a specific proposed development or site alteration. It can also demonstrate how the cultural heritage resource will be conserved in the context of redevelopment or site alteration Conservation Plan Submit a Conservation Plan, which is a document that details how a cultural heritage resource can be conserved. 3 4. WHAT IS THE HERITAGE ALTERATION PERMIT APPLICATION PROCESS? The following chart illustrates the typical steps that an applicant will go through when proposing changes to a heritage designated property. Contact Applicant contacts Heritage Planner to determine if a Heritage Alteration Permit is required for the proposed change Consultation Discussion with Heritage Planner regarding scope of proposed work and application requirements May include a pre-consultation meeting and site visit to the property Submit Application Applicant submits application and required information to Heritage Planner Heritage Planner evaluates completeness of application If complete, the application is commissioned and received, and Notice of Receipt is sent to the Applicant Heritage Planner will determine the type of approval required Type of Approval Consultation with the LACH and Municipal Council Decision Heritage Planner reviews application and prepares report with a recommendation to the LACH LACH makes a recommendation to Municipal Council Municipal Council considered the LACH's recommendation and makes a decision to approve, approve with terms and conditions, or refuse Delegated Authority/City Planner Decision Heritage Planner reviews application and makes a recommendation to the City Planner Decision on the application by City Planner to approve or approve with terms and conditions or referral to the LACH and decision by Municipal Council Heritage Alteration Permit Issued Applicant receives Heritage Alteration Permit 5. ADDITIONAL INFORMATION The maximum review period for a Heritage Alteration Permit application is 90 days. The owner/applicant and/or agent may choose to attend the meeting of the LACH and may give a delegation to the LACH in support of their application. An owner of property may appeal the decision of Municipal Council within 30 days of the day the owner received notice of the council s decision. Heritage Alteration Permit approval is required prior to issuance of a Building Permit or Sign Permit. Follow-up site inspections may be conducted to ensure compliance with drawings as submitted and approved. Non-compliance with an approved Heritage Alteration Permit may result in charges laid against the owner in accordance with the Ontario Heritage Act. Applicants are encouraged to consult with the City s Heritage Planners prior to filling out this application to: 1) confirm if proposed changes require a Heritage Alteration Permit, and 2) to determine the required information for a complete Heritage Alteration Permit application. There is no fee for a Heritage Alteration Permit in the City of London. SECTION A. 7 SECTION F. Notes for Declaration i) The applicant understands that submission of this application does not guarantee a complete application has been received. Further review of the application will occur and the applicant may be contacted to provide additional information and/or resolve any discrepancies or issues with the application as submitted. ii) The applicant grants permission for City of London staff to enter onto the property for the purposes of evaluation of this application and acknowledges that the City of London, or a representative of the City, will keep a photographic record of the site conditions. iii) The applicant agrees that the proposed work shall be done in accordance with this application and understands that the issuance of the Heritage Alteration Permit under the Ontario Heritage Act shall not be a waiver of any of the provisions of any By-law of the Corporation of the City of London, or the requirements of the Building Code Act, RSO 1980, c. 51. iv) The applicant acknowledges that in the event that a Heritage Alteration Permit is issued, any departure from the terms and conditions imposed by the Council of the Corporation of the City of London, or plans and specifications approved, is prohibited and could result in the Heritage Alteration Permit being revoked. v) The applicant agrees that if the Heritage Alteration Permit is revoked for any cause of irregularity, in the relation to non-conformance with the said agreements, By-laws, acts or regulations that, in consideration of the issuance of the Heritage Alteration Permit, all claims against the City for any resultant loss or damage are hereby expressly waived. vi) The personal information on this form is collected under the legal authority of Section 33(2) and Section 42(2.2) of the Ontario Heritage Act. It is the policy of the City Planning to provide public access to all development applications and supporting documentation.
