The Town Council will consider a request from the Midcoast Regional Redevelopment Authority (MRRA) for Tax Increment Financing funds in an amount up to $807, for Landing projects, and will take any appropriate action. (TIF Committee) 114. The Town Council will consider a Resolution for an Emergency Appropriation of $30,000 from Unappropriated Available General Fund Revenues to Fund Unanticipated Expenditures to Clear Damaged Trees and Debris Caused by Strong Winds in September 2018, and will take any appropriate action. The Town Council will consider designating a voting representative and an alternate for the Maine Municipal Association s annual business meeting, and will take any appropriate action. 3 Brunswick Town Council Agenda September 17, 2018 Council Notes and Suggested Motions MANAGER S REPORT a) Financial update: A copy of the financial reports are included in the packet. b) BHS track: At their meeting on August 22 nd, the School Board voted to move forward with a Land and Water Conservation Fund grant application for the High School Track project. As this property is Town-owned, the Council will be asked to approve the application. This item is scheduled for the October 1 st Council meeting. c) Shelter Task Force: Town Manager Eldridge will give an update on this item. d) Marijuana Moratorium: Town Manager Eldridge will give an update on this item. PUBLIC HEARING 110. Notes: This is the annual application for a special amusement license for Frontier, 14 Maine Street. They would like to offer live music and film screenings in their theater space from 2:00 11:00 pm. A copy of their application is included in the packet. Motion to approve a special amusement license for Frontier, 14 Maine Street Notes: This is the required public hearing regarding the proposed Special Events Ordinance. This ordinance was originally proposed to the Town Council last fall as a way to oversee special events that impact Brunswick residents and town services, and in discussion the Council voiced concerns with the application fee, allowing for spontaneous demonstrations, and burdensome bond/insurance requirements. The Committee then included citizens input and changes made due to Council discussion. Included in the packet is a copy of a memo from Commander Mark Waltz with a summary of the changes made, a clean version of the ordinance, and a redlined version of the ordinance. Option for the Council if they choose to vote this evening - suggested motion: Motion to suspend the Council Rules to allow the Council to vote on this item at this meeting. Motion to adopt the proposed Special Events Ordinance in Chapter 14 Streets, Sidewalks and other Public Places, Art. VII Notes: This is the required public hearing for the extension of the emergency moratorium ordinance on the location of shelters. The Town Council adopted the 3

4 Emergency Moratorium Ordinance on the Location of Shelters on April 2, 2018, as shelters are not defined in the Zoning Ordinance, nor do they include any regulations related to the zoning or operation of shelters in Brunswick. The Town Council formed a task force which would develop proposed amendments to the Town ordinances. The Task Force will soon be completing its recommendations, but the proposed recommendations will need to be considered by the Planning Board, and that cannot be completed prior to the expiration of the Moratorium Ordinance, so they are requesting that the Town Council extend the ordinance for a period not exceeding one hundred and eighty (180) days. A copy of a memo from Town Manager Eldridge, the proposed ordinance extension, a public hearing notice, and a timeline for adoption are included in the packet. Motion to adopt Extension of the Emergency Moratorium Ordinance on the Location of Shelters for a period not to exceed one hundred eighty (180) days. NEW BUSINESS 113. Notes: The Tax Increment Financing (TIF) Committee met on August 28, 2018, to consider a request from MRRA for TIF monies for projects on the Landing in accordance with Brunswick Landing TIF District and the Brunswick Executive Airport TIF District Development Programs and the Credit Enhancement Agreement (CEA) between the Town and MRRA. The Committee unanimously supported the recommendation to the Town Council to approve MRRA s request for FY 2019 funding up to $807, A copy of a memo from Town Manager Eldridge and the draft resolution are included in your packet. Motion to adopt A Resolution Authorizing an Appropriation and Grant of Available Tax Increment Financing Proceeds to the Midcoast Regional Redevelopment Authority Notes: Road and tree damage from the brief but intense storm on September 6 th will result in expenditures beyond the amounts budgeted in the budget due to the additional work performed by the Town, including the clearing of public ways of trees and debris. The Town Manager has recommended that $30,000 be appropriated from unappropriated available General Fund revenues on an emergency basis, under section 510 of the Charter of the Town of Brunswick. A copy of a memo from Assistant Manager Ryan Leighton and the emergency funding resolution are included in the packet. Motion to adopt a Resolution for an Emergency Appropriation of $30,000 from Unappropriated Available General Fund Revenues to Fund Unanticipated Expenditures to Clear Damaged Trees and Debris Caused by Strong Winds in September

Notes: The Town Council is asked to designate a voting representative and an alternate from the municipality for the Maine Municipal Association s (MMA s) annual business meeting on Wednesday, October 3, 2018, at 1:45 pm in Augusta. The MMA bylaws entitle each member community to one (1) voting representative. Information from MMA, the Annual Business Meeting s agenda, and the nomination form is included in the packet. Motion to nominate as Brunswick s voting representative and as alternate for the MMA annual business meeting Notes: The Town Council is asked to set a public hearing for this resolution, which would increase the amount appropriated from fund balance by up to $300,000, and decrease the amount from taxation by the same amount, in order to ensure that the tax rate that the Town Council expected when the budget was adopted on May 14, 2018, can be met. This is necessary because we do not have a reliable estimate of new value, the 2017 tax abatements were larger than anticipated, and a large value property received a tax exemption in July for the 2018 tax year. A copy of a memo from Town Manager Eldridge, as well as the draft resolution, is included in the packet. Move to set a public hearing for October 1, 2018 (or other date) regarding A Resolution Amending the Municipal Budget For the Period July 1, 2018 to June 30, CORRESPONDENCE/COMMITTEE REPORTS Councilors will provide brief updates on recent committee activities. CONSENT AGENDA a) Approval of the Minutes of September 4, 2018 Notes: A copy of the minutes is included in the packet. b) Adoption of A Resolution to Acknowledge Maine s Indigenous Cultures Notes: As the Council did last year for the MidCoast Indigenous Awareness Group (MIAG) the Town Council is requested to adopt A Resolution to Acknowledge Maine s Indigenous Cultures, which recognizes the second Monday in October as Indigenous Peoples Day. A copy of the draft resolution is included in your packet. 5

6 c) Approval of utility permits for the Parkview Estates area for Maine Natural Gas Notes: Maine Natural Gas seeks authorization to install a 2 gas main in the Parkview Estates neighborhood in locations specified in the Town Engineer s memo, which is included in the packet, along with the permit applications, the proposed summary of utility coordination and general location maps. Motion to approve the Consent Agenda. Motion to adjourn. 6
