3 Municipality of Port Hope 56 Queen Street Port Hope, ON L1A 3Z9 REPORT TO: FROM: SUBJECT: Planning Committee Rupert Dobbin, Municipal Planner Public Meeting Zoning By-law Amendment Application (ZB ) Additional Permitted Uses to all Service Employment (EMP2) Zones APPLICANT: Municipality of Port Hope DATE: July 26, 2017 RECOMMENDATION: That a By-law be prepared for presentation to Council for all Service Employment (EMP2) Zones located within the Municipality of Port Hope for the purposes of rezoning the subject lands to permit three additional uses; namely, laboratory, professional office and research and development from the list of permitted uses outlined in Section D4.2 of the Official Plan. BACKGROUND: A key component of the Municipal Strategic Plan is the development of Service Employment areas including the Municipal Business Park. The objective of this amendment, to Zoning By-Law 20/2010, is to enhance the desirability and further the development of the Service Employment areas of the municipality by permitting a more comprehensive list of permitted uses from those outlined in Section D4.2 of the Official Plan. To be more specific, Section D4.2.1 of the Official Plan provides a list of uses permitted in the Service Employment land use designation. Not all of these have as yet been included in Zoning By-Law 20/2010 as permitted uses within the Service Employment (EMP2) zone. Subject Lands This Zoning By-law amendment will apply to all Service Employment (EMP2) Zones under municipal zoning control in the Municipality of Port Hope; The subject lands are those identified in the darker shade of blue as indicated on Figure 1. THE PURPOSE OF THE AMENDMENT is to enhance the desirability and further the development of the Service Employment areas of the municipality by the addition of the following uses with definitions: Public Meeting August 2, 2017 Page 2 of 11 Page 4 of 13

5 laboratory Laboratory is a building or a room where scientific or technological experiments, analyses, and research are carried out. professional office Professional Office shall mean offices where services are provided that require specialized training or professional certification including but not limited to accountant, appraiser, attorney, architect, landscape architect, engineer, land use planner, surveyor, stockbroker, physician, dentist, chiropractor, massage therapist, psychologist, and optometrist. No goods are sold or exchanged. research and development Research and Development shall mean the use of buildings or structures or a portion thereof for scientific research, investigation, testing or experimentation, but does not include facilities for the manufacture or sale of products, except as incidental to the main purpose of the facility. ANALYSIS: Provincial Policy Statement: 1.3 Employment 1) Planning authorities shall promote economic development and competitiveness by: a) Providing for an appropriate mix and range of employment and institutional uses to meet long-term needs; b) Providing opportunities for a diversified economic base, including maintaining a range and choice of suitable sites for employment uses which support a wide range of economic activities and ancillary uses, and take into account the needs of existing and future businesses; c) Encouraging compact, mixed-use development that incorporates compatible employment uses to support liveable and resilient communities; and d) Ensuring the necessary infrastructure is provided to support current and projected needs. Comment: Based on a review of the applicable policies from the PPS, the subject rezoning is consistent with the PPS and will have the effect of facilitating a wide range of employment activities and ancillary uses, and take into account the needs of existing and future businesses. This is consistent with Section 1.3 (Employment) of the PPS. Public Meeting August 2, 2017 Page 3 of 11 Page 5 of 13

6 Growth Plan for the Greater Golden Horseshoe: Growth Plan for the Greater Golden Horseshoe (2017) provides guidance for the promotion of economic development and competitiveness of the GGH through a number of provisions including those specific to Employment. Section lists 15 provisions relating to employment however, two have a specific relationship to this application Employment 1. Economic development and competitiveness in the GGH will be promoted by; a. making more efficient use of existing employment areas an d vacant and underutilized employment lands and increasing employment densities; b. ensuring the availability of sufficient land, in appropriate locations, for a variety of employment to accommodate forecasted employment growth to the horizon of this Plan; c. planning to better connect areas with high employment densities to transit; and d. integrating and aligning land use planning and economic development goals and strategies to retain and attract investment and employment. 7. Municipalities will plan for all employment areas within settlement areas, with the exception of any prime employment areas, by: a. Prohibiting residential uses and limiting other sensitive land uses that are not ancillary to the primary employment use; b. Prohibiting major retail uses or establishing a size or scale threshold for any major retail uses that are permitted and prohibit any major retail uses that would exceed that threshold; and c. Integrating employment areas with adjacent non-employment areas and developing vibrant, mixed-use areas and innovation hubs, where appropriate. Comment: Based on a review of the applicable policies from the GGH, the subject rezoning is consistent with the GGH and will have the effect of facilitating a wider range of employment activities and ancillary uses, and take into account the needs of existing and future businesses. The subject Zoning By-law Amendment will permit a more comprehensive list of permitted uses to be derived from those outlined in Section D4.2 of the Official Plan which will enhance the desirability and further the development of the Service Employment areas of the municipality. This is also consistent with the relevant policies of the Growth Plan for the Greater Golden Horseshoe. Public Meeting August 2, 2017 Page 4 of 11 Page 6 of 13

7 Official Plan The subject lands are currently designated Service Employment by the newly approved Official Plan (see Figure 2). The predominant forms of land use within the Service Employment designation include business and employment generating activities of a higher order than those of the General Employment category. Figure 2: Official Plan Comment: The proposed rezoning of the subject lands complies with the Official Plan and the general intent and the objectives of the Plan are maintained. Zoning By-law: The subject lands are currently zoned Service Employment EMP2 Zone in accordance with Zoning By-law 20/2010, as amended (see Figure 1, above). 8 include industrial and office uses, as well as limited service commercial uses, but at a higher density to ensure a high-profile built form. Residential dwellings are not a permitted use. Table 8.1 of Zoning By-law 20/2010, contains the current list of permitted uses for the EMP2 zone. Maximum permitted net floor area The greater of 10% of the net floor area of the principal use or 75.0 square metres. 2. Only legally existing uses as of the date of passing of this By-law, are permitted. 3. Provided the use occupies no more than 20% of the net floor area of a multiple unit building. 4. Subject to Section 4.22 (Outdoor Display and Sales) of this By-law. 5. Subject to Section 4.23 (Outdoor Storage) of this By-law. Comment: A Zoning By-law amendment is required: 1) to add the following uses to those uses permitted in the EMP2 Zone as listed in Table 8.1 of By-Law 20/2010, as amended; a) Laboratory b) Professional Office c) Research and Development 2) to add the following definitions to PART 3 DEFINITIONS of By-Law 20/2010, as amended; a) Laboratory means: A building or a room where scientific or technological experiments, analyses, and research are carried out. b) Professional Office means: Offices where services are provided that require specialized training or professional certification including but not limited to accountant, appraiser, attorney, architect, landscape architect, engineer, land use planner, surveyor, stockbroker, physician, dentist, chiropractor, massage therapist, psychologist, and optometrist. 10 Comment: but does not include facilities for the manufacture or sale of products, except as incidental to the main purpose of the facility. Staff support the subject application. Included as Attachment 1 to this report is the draft implementing Zoning By-law amendment that would amend Zoning By-law 20/2010, as amended. CIRCULATION: Notice of a general amendment to By-Law 20/2010 to all lands designated as Service Employment (EMP2) was circulated and, in accordance with the Planning Act, a combined Notice of a Complete Application and Notice of the Public Meeting for the rezoning was placed in both the Northumberland News and the Northumberland Today on June 29, The notice was also placed on the municipal website. Planning Division has received one verbal inquiry from a property owner however no objection was expressed and no objection has been received. 11 CONCLUSION The proposed Zoning By-law amendment will have the effect of rezoning all Service Employment (EMP2) Zones located within the Municipality of Port Hope for the purpose of adding three additional uses from the list of permitted uses outlined in Section D4.2 of the Official Plan. Staff are of the opinion that the proposed additional uses are an appropriate use of the subject lands. The rezoning application complies with applicable Municipal, County, and Provincial policies. Staff recommend that a Zoning By-law Amendment be prepared for presentation to Council for the purposes of adding the following three permitted uses to those permitted in all Service Employment (EMP2) Zones located within the Municipality of Port Hope. Professional Office; Professional Office means: Offices where services are provided that require specialized training or professional certification including but not limited to accountant, appraiser, attorney, architect, landscape architect, engineer, land use planner, surveyor, stockbroker, physician, dentist, chiropractor, massage therapist, psychologist, and optometrist. 12 Attachment 1 CORPORATION OF THE MUNICIPALITY OF PORT HOPE BY-LAW NO. /2017 Being a By-law Under the Provisions of Section 34 of the Planning Act, R.S.O., 1990, c.p.13, as Amended, to Amend Zoning By-law 20/2010, as Amended, of the Corporation of the Municipality of Port Hope, for all Service Employment (EMP2) Zones located within the Municipality of Port Hope, in the County of Northumberland. WHEREAS Zoning By-law No. 20/2010, as amended, was passed under authority of Section 34 of The Planning Act, R.S.O. 1990, c.p.13, as amended; AND WHEREAS this By-law conforms with the general intent of the Municipality of Port Hope Official Plan, as amended; AND WHEREAS on August 2, 2017 the Council of The Corporation of the Municipality of Port Hope conducted a Public Meeting, in regard to the proposed zoning, as required by Section 34(12) of The Planning Act, R.S.O. 1990, c.p.13, as amended; AND WHEREAS the Council of The Corporation of the Municipality of Port Hope deems it advisable to amend Zoning By-law No. 20/2010, as otherwise amended, with respect to the above described lands, and under the provisions of The Planning Act has the authority to do so; NOW THEREFORE the Council of The Corporation of the Municipality of Port Hope ENACTS as follows: 1) That PART 3 DEFINITIONS, forming part of Zoning By-law 20/2010, be amended by adding the following definitions: Laboratory means: A building or a room where scientific or technological experiments, analyses, and research are carried out. Professional Office means: Offices where services are provided that require specialized training or professional certification including but not limited to accountant, appraiser, attorney, architect, landscape architect, engineer, land use planner, surveyor, stockbroker, physician, dentist, chiropractor, massage therapist, psychologist, and optometrist. No goods are sold or exchanged. 13 2) That PART 8 EMPLOYMENT ZONES, forming part of Zoning By-law 20/2010, be amended by adding to Table 8.1 Permitted Uses in the Employment Zones: a) a row for Laboratory and adding an in the EMP2 Column; b) a row for Professional Office and an in the EMP2 Column; c) a row for Research and Development and an in the EMP2 Column. 3) THAT Zoning By-law No. 20/2010, as otherwise amended, is hereby amended to give effect to the foregoing, but Zoning By-law No. 20/2010, as otherwise amended, shall in all respects remain in force and effect save as same may be otherwise amended or hereinafter dealt with. 4) THAT this By-law shall come into force on the date it is passed by the Council of The Corporation of the Municipality of Port Hope, subject to the applicable provisions of The Planning Act, R.S.O. 1990, c.p.13, as amended.
