1 6:45 P.M. MOTION FOR EXECUTIVE SESSION PERSONNEL 7:30 P.M. REGULAR MEETING Mayor Welle called the meeting to order at 6:45 PM Present in Executive Session was the Mayor Stephen Welle, Deputy Mayor Edward Shuart Jr., Trustee G. Bruce Chichester, Trustee Lawrence Mosca, Trustee Christine Sacher, and Judge Weinberg. MOTION was made by Trustee Shuart to adjourn to Executive Session for interviews for P/T Court Clerk. Interviews concluded - Judge excused at 7:10 PM Sgt. Cruz addressed the Village Board. MOTION was made by to end Executive Session at 7:25 PM. SECOND was made by Trustee Shuart. ALL IN FAVOR REGULAR 7:30 PM ROLL CALL: Mayor Stephen Welle, Deputy Mayor Edward Shuart Jr., Trustee G. Bruce Chichester, Trustee Lawrence Mosca, Trustee Christine Sacher, Village Clerk Kelly Kearney, and Village Attorney Ben Ostrer of Ostrer & Hoovler. The Mayor asked everyone to stand for the Pledge of Allegiance. APPROVAL OF MINUTES: Mayor Welle asked if there were any changes or additions to the minutes of the October 8, 2013 Board Meeting. Mayor Welle stated there is one correction that needs to be done regarding the information with the bills being audited at the last meeting. The Water Fund will be decreased by $2100. And the Trust & Agency will be increased by $2100. This is a charge that should have come out of Trust & Agency. The Trust & Agency amount should have been $ and the Water Fund should have been $75, Mayor Welle stated other than that correction the Minutes should stand as written. INFORMATIONAL ITEMS: - Mayor Welle stated that Executive Session was held this evening at 6:45 PM for interviews for P/T Court Clerk and a session with the Police Sergeant. - Mayor Welle stated we received a check from FEMA in the amount of $11, this is money from Hurricane Irene. They originally had denied us and once I sent all the information and paperwork to them they realized they made an error and we finally received that money. Trustee Chichester stated let the record reflect how much work the Mayor put into that. Mayor Welle stated Thank you.

2 Page 2 - Mayor Welle stated we received a Notice from Assemblyman Skoufis regarding the Veteran designation that is now available on NYS drivers licenses it would mean that Veterans would not have to carry their DD-214 in order to get Veteran discounts where they are offered. - Mayor Welle stated that we received a $9500. Grant from Cablevision. This is for the purchase and maintenance of the PEG equipment which is the channel 22. Kelly and I have been trying to get quotes on new equipment and there are not many people that are interested in bidding on it because it is not a big item. So we will take a look at what we got and hopefully bring something to the Board for the next meeting for approval. So hopefully we will be able to move forward on this because Channel 22 is out more than it is in, due to the age of the current equipment. - Mayor Welle stated that the Planning Board and Zoning Board of Appeals still have openings. Anyone interested should submit a letter of intent to the Village Clerk. - Mayor Welle has stated that leaf pick up has commenced it will go through sometime in the beginning of December weather permitting. - Mayor Welle stated that regarding number 6 So. Main Street the asbestos removal has been completed all utilities have been disconnected we are just waiting for the demolition quotes for the building. - Mayor Welle stated there is one addition to the agenda this evening: 7 a Water Tank Bid - Mayor Welle stated that the OC Citizens Foundation sent a notice that on Monday October 28, 2013 and Thursday November 7, 2013 they are putting on a free information and discussion session regarding the healthcare reform. This will be posted in the hallway at Village Hall. The October 28, 2013 meeting will be at the Orange-Ulster BOCES in Goshen and the November 7, 2013 meeting will be in SUNY Orange in Newburgh - Mayor Welle stated that next week is Halloween and in accordance with section 92.3 of the Village Code it states During the evening hours of October 30 and October 31 from 8:00 pm to 6:00 am and ending on November 1 at 6:00 am, or any other period that the Village Board deems necessary, it shall be unlawful for any minor to remain idle, wander, stroll or play in any public place, either on foot or cruising about without a set destination in any vehicle, in, about or upon any place in the village between the hours of 8:00 pm and 6:00 am of the following morning unless accompanied by a parent, guardian, custodian or other adult person having custody or control of such minor or unless the minor is on an emergency errand or specific business or activity directed or permitted by his parent, guardian, or other such adult person having the custody and care of the minor or where the presence of such minor is connected with or required by some legitimate employment, trade, profession or occupation. The Police will be enforcing this. PARK REQUEST CROVER Mayor Welle stated that we received a request last minute from Mary Crover Mayor Welle stated he did notify the Board regarding the request. She was requesting use of the pavilion at Mary Harriman Park this past Saturday for a family gathering for a memorial service for her father. MOTION was made by Trustee Shuart to approve the use of the park as outlined by the Mayor.

3 Page 3 DPW SUPT REQUEST TRAINING Mayor Welle stated that the DPW Supt. John Karl is requesting for 4 people to attend the Hudson Valley Water Works on Wednesday, October 30, 2013 at IBEW in Harriman. The total cost for the 4 people will be $ out of the water line. MOTION was made by to approve the request as outlined by the Mayor. SECOND was made by. P/T COURT CLERK Mayor Welle stated that interviews were held tonight for P/T Court Clerk it is up to the Board if someone wants to make a Motion. If there is no Motion we will not move forward with it this evening. Mayor Welle stated it will die due to a lack of Motion. BUDGET TRANSFERS Mayor Welle stated that the Village Treasurer has requested a Budget Transfer for $18,000. from the Contingent to the Mayor Contractual this has to do with asbestos removal at 6 So. Main Street. MOTION was made by Trustee Shuart to approve the request as outlined by the Mayor. AUTHORIZE THE VILLAGE CLERK TO PUBLISH AN INVITATION TO BID Mayor Welle stated this is regarding the Harriman Heights Water Storage Tank and Water Main Extension; she will publish it on October 28, 2013 with a Bid opening of December 4, 2013 at 3pm MOTION was made by to approve the request as outlined by the Mayor. SECOND was made by Trustee Shuart.

4 Page 4 ATTORNEY REPORT: - Gas Easement behind TJ Maxx - Ben stated Marissa called them again today, we are still pursuing it. - DiMicco and Daveline for water easement for the existing. Ben stated he actually received a couple of s from someone about Daveline I guess they are having some issue regarding a change of use with the Planning Board. Ben stated something is going on. Mayor Welle stated I do not believe they are before the Planning Board. Ben said oh okay but anyway we only have had one response on that water line easement. Marissa is still pursuing. - Letter to 4 So. Main Marissa did speak to Ben that is in the works. Ben stated on the driveway? Mayor Welle stated yes Ben stated it is in the works. - Monroe Annexation Ben stated we had proposed early on when we were sued by the Town of Monroe that we enter in a Stipulation of Settlement and they could have it so ordered by the Judge. Then we received these Resolutions which would not satisfy, so we spoke with Galvin and Chapman at the Bonacic Firm and Chapman believes we need an Order of Stipulation from the Court and Mr. Galvin thinks we need the Resolution. Ben stated I believe will we enter into a Stipulation of Settlement. Marissa will speak to the both of them and see if she can get Chapman and Galvin on the same call and then we should have it solved. - Code Change regarding delinquent charges Ben stated Marissa is working on that and it should be ready for the next meeting. - Mayor Welle stated we have a couple of issues for Executive Session we will need to discuss regarding Lawsuit Ben stated we did receive a letter regarding the by-pass, he doesn t know why he has to pay since his contractor was the one who by-passed the meter, Ben stated we will give him a short response. PUBLIC COMMENT: There were no comments from the public MOTION was made by Trustee Shuart to enter into Executive Session to discuss a legal issue and contractual Police Chief issue. Executive Session held with Village Attorney Ben Ostrer. MOTION was made by Trustee Shuart and SECONDED by to end Executive Session and return to Regular Session.

5 Page 5 EXECUTIVE SESSION CONT D MOTION was made by Trustee Shuart to approve the contract with Daniel Henderson as Police Chief effective November 1, 2013 with a salary of $115,000 per year. questioned why is he starting on a Friday.
