3 Minutes of a Regular Meeting of County Council RED DEER COUNTY Tuesday, February 21, CALL TO ORDER The regular meeting of Red Deer County Council was held in the Council Chambers of the Red Deer County Centre located at Rge Rd 275, Red Deer County, Alberta, and was called to order by Mayor J.J. Wood at 10:02 a.m. PRESENT: ABSENT: Mayor J.J. Wood, Deputy Mayor R.R. Lorenz, Councillors P.T. Archibald, D.G. Hoar, P.J.R. Massier and D.H. Nesbitt. Councillor G.W. Gehrke. STAFF PRESENT: County Manager C. Herzberg, Assistant County Manager R. Henderson, Corporate Services Director H. Gray, Planning and Development Services Director C. Cvik, Operations Services Director M. Campbell, Communications Administration A. Ahmad, Municipal Intern K. Nault and Legislative Services Manager N. Lougheed. Planning/Development administration in attendance for development applications: R. Barr, F. Joynt and T. March. 2.0 APPROVAL OF AGENDA Administration advised of the request to have Agenda Items No. 6.3 and 7.2 withdrawn from today s agenda. CC Moved by Councillor P.T. Archibald to amend the agenda by deleting Agenda Items No. 6.3 and 7.2 and to approve the agenda as amended. CARRIED UNANIMOUSLY 3.0 APPROVAL OF MINUTES CC Moved by Councillor R.R. Lorenz to approve the minutes of the February 7, 2012, regular meeting of County Council as submitted. CARRIED UNANIMOUSLY 6.0 REPORTS 6.2 Revised Speed Zone Construction Manager J. Woychuk reported on the request to reduce the speed limit on a portion of a County road from 80 km/hr to 60 km/hr. CC Moved by Councillor D.G. Hoar to refer decision on the request to reduce the speed limit on Rge Rd 280 from the south boundary of Corner Gate Estates (Twp Rd 381A) north to the west end of the curve on Twp Rd 382 to 60 km per hour and to direct administration to request the German Canadian Club of Red Deer to locate the access to the site to the access location proposed in its development permit approval and administration to revaluate the road in relation to this access location and determine Minutes of the regular meeting of County Council held Tuesday, February 21, Page 3 of 120
4 County Council Minutes of February 21, whether administration would still recommend the reduction of the speed limit on that portion of road taking into consideration the access location being proposed. CARRIED Mayor Wood, Councillors Hoar, Lorenz and Nesbitt in favor Councillors Archibald and Massier opposed 6.1 Business and Industrial Park Road Naming GIS Coordinator J. Tyrkalo reported on the recommendation to approve names for roads located within Red Deer County s business and industrial parks. CC Moved by Councillor D.H. Nesbitt to approve the following road names: Gasoline Alley East for the service road adjacent to the east side of Hwy 2 in the Gasoline Alley Business Park, Belich Crescent for the internal subdivision road in Belich Business Park and Kuusamo Drive and Kuusamo Close for the roads within the Kuusamo Industrial Park. CARRIED UNANIMOUSLY 7.0 SUBDIVISION APPLICATIONS 7.1 NE (Division 1) application to subdivide a 9.4-hectare (23.25-acre) parcel containing a homestead. CC Moved by Councillor P.J.R. Massier that, in considering this application, it is deemed that the subdivision as proposed complies with the Municipal Government Act, the Municipal Development Plan and the Land Use Bylaw; that it is suitable for the intended purposes and that it will not negatively impact adjacent land uses. Consideration has been given to topography, soil characteristics, access, the use of adjacent lands, and the availability and adequacy of water supply, sewage disposal, solid waste disposal and storm water management. Therefore, the application to subdivide 9.4 hectares (23.25 acres) from NE is approved, subject to the following conditions: 1. Subdivision to be effected by Plan of Survey or Descriptive Plan; 2. Submission of a plan by an Alberta certified surveyor confirming the location of the buildings and water well relative to the new property lines; 3. Payment of all outstanding property taxes or satisfactory arrangements to be made for payment to Red Deer County; 4. The applicant shall ensure there is adequate physical access to the new parcel and to the balance of lands. Whenever Red Deer County requires an existing road access to be upgraded, a caveat will be required as a condition of subdivision to be registered on title to ensure that prior to development of the property, the road access will be brought up to County standards. 5. Confirmation shall be provided by a licensed Safety Codes Officer that the existing septic system conforms to the Plumbing & Drainage Regulation, which includes that it is fully contained within the newly created property lines; and 6. The dedication by way of an agreement registered as a caveat on the land title indicating a 5.2-metre widening along the east boundary of the quarter section for possible future road widening or road construction purposes in favour of Red Deer County (fees required). 5 County Council Minutes of February 21, BYLAW / DEVELOPMENT APPLICATIONS & REPORTS 8.1 Spruce View Area Structure Plan - Amendment application to amend this Plan to facilitate the subdivision and redesignation of 8.6 hectares (21.25) acres in NE for a proposed private school and associated church, cemetery, playground and parking lot. Bylaw No. 2012/3 a bylaw to amend the Spruce View Area Structure Plan, Bylaw No. 2003/4, by amending Future Land Use Concept Map 3 to allow for the redesignation of a portion of NE from Agricultural District Ag to Public Service District PS to allow for the subdivision of 8.6 hectares (21.25 acres) for the development of a school, playground, church, cemetery and parking lot. CC Moved by Councillor R.R. Lorenz that Bylaw No. 2012/3 be given first reading with the public hearing for this bylaw to be scheduled for March 27, CARRIED UNANIMOUSLY 11.0 COMMITTEE REPORTS Councillors reported on meetings they have attended on behalf of Red Deer County since February 8, Recess: 10:44 a.m. Reconvene: County Council meeting called back to order at 1:30 p.m. 9.0 PUBLIC HEARINGS A summary of the comments received by the persons in attendance at the public hearing is attached and is considered to be part of these minutes. The public hearing closed at 1:32 p.m. 9.1 Bylaw No. 2012/1 a bylaw to amend the Land Use Bylaw No. 2006/6 by changing Commercial Composting Facility from a Permitted Use to a Discretionary Use in the Agricultural District Ag on parcels of 32 hectares (80 acres) or more. CC CC Moved by Councillor P.J.R. Massier that Bylaw No. 2012/1 be given second reading. CARRIED UNANIMOUSLY Moved by Councillor P.T. Archibald that Bylaw No. 2012/1 be given third and final reading.
