1 MUNICIPALITY OF BLUEWATER REGULAR COUNCIL MEETING MINUTES HELD IN THE BLUEWATER COUNCIL CHAMBERS VARNA, ON MONDAY, JUNE 20, :00 p.m. 1. ROLL CALL AND CALL TO ORDER Charlene Overholt, Manager of Corporate Services/Clerk conducted the roll call. Elected Officials Present: Mayor Tyler Hessel, Deputy-Mayor Jim Fergusson, Councillors John Becker, Marnie Hill, John Gillespie, George Irvin, Dave Roy, Bill Whetstone and Janisse Zimmerman. Staff Present: Kyle Pratt, Chief Administrative Officer; Charlene Overholt, Manager of Corporate Services/Clerk; Ansberth Willert, Manager of Finance; Jennette Walker, Manager of Public Works; Arlene Parker, Planning Coordinator. The Mayor welcomed those in attendance and called the meeting to order at approximately 7:00 p.m. 2. APPROVAL OF THE AGENDA Additions to the agenda: Mayor Hessel stated that members of the Bayfield Agricultural Society would like to speak regarding the lease agreement report. If Council wishes to have them speak a motion should be made after Mayors remarks. Moved by Councillor Becker, seconded by Councillor Roy that the agenda be approved as presented. Carried. 3. DECLARATION OF PECUNIARY INTEREST No declarations of pecuniary interest were made. 4. MAYOR S REMARKS Mayor Hessel provided Council with an update on meetings and conferences he has attended in the past month. 1

2 Moved by Councillor Roy, seconded by Councillor Whetstone that Council permit the members of the Bayfield Agricultural Society to speak regarding the Bayfield Agricultural Society lease. Carried. 5. ADOPTION OF MINUTES Moved by Councillor Irvin, seconded by Councillor Zimmerman that the regular Council meeting minutes of May 16, 2016 be approved as presented. Carried. Moved by Councillor Becker, seconded by Councillor Hill that the special Council meeting minutes of May 24, 2016 be approved as presented. Carried. Moved by Councillor Roy, seconded by Councillor Hill that the Committee of the Whole minutes of June 6, 2016 be approved as presented. Carried. Moved by Deputy-Mayor Fergusson, seconded by Councillor Irvin that the special Council meeting minutes of June 6, 2016 be approved as presented. Carried. 6. DELEGATIONS Ausable Bayfield Conservation Authority Councillor Orientation Alec Scott and Brian Horner presented Council with information regarding the Ausable Bayfield Conservation Authority and the services that they provide in Bluewater. 7. MANAGEMENT REPORTS FIRE D. RENNER Roof Replacement Bayfield Station Moved by Councillor Irvin, seconded by Councillor Zimmerman that Council authorize the transfer of $8,000 from the Fire Reserve into the 2016 Capital Budget to assist with cost coverage of the roof replacement at the Bayfield Station. Carried. ADMINISTRATIVE SERVICES CAO K. PRATT RUA Claybird Gun Club Ausable Line, Hay East Ward Moved by Councillor Becker, seconded by Councillor Roy that By-law , being a By-law to authorize a road user agreement with the Claybird Gun Club be given first, second and third reading and finally passed this 20th day of June, Carried. 3 Moved by Councillor Zimmerman, seconded by Councillor Hill that By-law , being a By-law to authorize an encroachment agreement with Mijan Holdings Inc. on Emma Place and Main Street be given first, second, third reading and final reading and finally passed this 20th day of June, Carried. Bayfield Agricultural Society Lease Planning Coordinator A. Parker, explained to Council the draft lease for the Bayfield Agricultural Society and various issues relating to the lands. Doug Yeo and Jentje Steenbeek requested that Council allow the area of land that the pet display building is located to be transferred to the Bayfield Agricultural Society. This would allow them to apply for grants for upgrades on the buildings. Moved by Councillor Zimmerman, seconded by Councillor Whetstone that the Corporation of the Municipality of Bluewater hereby declares the lands described as Pt Lt 772 PL 147 Confirmed by 22BA2273 Pt 1 22R-2661; S/T Interest in R267388; PIN (LT); Bluewater to be surplus to the needs of the Corporation; Notice of the proposed sale be by letter sent to owners of property that directly abut the property to be sold, by a sign posted on the property and by a notice on the Municipal web site. That an appraisal of the property need not be obtained. That the method of sale be by direct offer of the property to the Bayfield Agricultural Society for a consideration of $2.00; That the Municipality s costs for the property disposition be allocated to the Bayfield Water Project; That a public meeting be scheduled for the August 2nd regular Committee of the Whole meeting at 7:00 p.m. to consider objections for any person who indicates they are adversely impacted by the sale of the property. Carried. Moved by Councillor Whetstone, seconded by Deputy-Mayor Fergusson that By-law Number , being a By-law to authorize a property lease with the Bayfield Agricultural Society be given first, second and third reading and finally passed this 20th day of June, Moved by Councillor Whetstone, seconded by Councillor Hill that more information be obtained on the creation and transfer of the parcel of land to accommodate one frame shed and a partial frame shed located on a portion of the municipal Bayfield Complex lands. Carried. Clan Gregor Square Playground Equipment RFP Moved by Deputy-Mayor Fergusson, seconded by Councillor Whetstone that the Clan Gregor Square Equipment project be awarded to Park N Play Design in the amount of $31, (inclusive of taxes). Carried. Facilities Van Replacement 3

4 Moved by Councillor Becker, seconded by Councillor Roy that the Municipal Council of Bluewater declare the Facilities Freestar van as surplus and further that the vehicle be sold with the revenue deposited into the equipment reserve account. Carried. CLERK C. OVERHOLT Committee of the Whole June 6, 2016 Motions to be Ratified Moved by Councillor Irvin, seconded by Councillor Gillespie that Council does not support undertaking a study to determine the level of risk for structures located within the unstable bluff slope along the Lake Huron shoreline. Carried. Moved by Councillor Zimmerman, seconded by Councillor Hill that the Community Development Coordinator job description be approved. Carried. Moved by Councillor Roy, seconded by Councillor Irvin that Council create a lease agreement with a rental rate of $200 per month for the Bayfield Post Office. Carried. Moved by Councillor Irvin, seconded by Councillor Hill that Council renegotiate the Bayfield Post Office lease after 5 years. Carried. Moved by Councillor Becker, seconded Councillor Roy that Council approve that the Bluewater Fire Department implement the Critical Incident Stress Management Program for First Responders and that the funds for the 2016 committee training and materials be utilized from the remaining monies in the Fire Reserve set up for training expenses. Carried. Moved by Councillor Zimmerman, seconded by Councillor Hill that By-Law , being a by-law to ratify the Bayfield Water System Capital Charge and respective service area be given first, second, third and final reading, and finally passed this 20 th day of June, Carried. Moved by Councillor Becker, seconded by Councillor Gillespie that the April accounts in the amount of $772, be approved. Carried. Moved by Councillor Whetstone, seconded by Councillor Irvin that Council approve the Bayfield Farmers Market Committee be allowed to produce and install signs on existing Municipal welcome signs located on Highway 21 and County Road 3 (Mill Road) and in the Village of Bayfield Marina. Carried. Moved by Councillor Zimmerman, seconded by Councillor Roy that Council permit alteration (replacement of a roof) of property designated under Part V of the Ontario Heritage Act, described as 11 The Square, Plan 147, Lot 239, Ward of Bayfield, pursuant to Section 42 of the Act. Carried. Appoint Kyle Pratt as Alternate CEMC Moved by Councillor Becker, seconded by Councillor Hill that By-law , being a by-law to appoint Kyle Pratt as an alternate Community Emergency Management Coordinator be given first, second, third and final reading and finally passed this 20 th day of June Carried. 4

5 Update Cemetery Rules and Regulations Moved by Councillor Hill, seconded by Councillor Becker that By-law being a by-law for the purpose of updating the rules and regulations of cemeteries owned and operated by the Corporation of the Municipality of Bluewater be given first, second, third and final reading and finally passed this 20 th day of June Carried. TREASURY A. WILLERT Amendment #2 Hensall Town Hall Upper Room Moved by Councillor Hill, seconded by Councillor Roy that Council receive this report for information purposes. Carried. May 30, 2016 Outstanding Tax Report Moved by Councillor Becker, seconded by Councillor Irvin that the May 30, 2016 Outstanding Tax Report be received for information purposes. Carried. Refund of Funding Zurich Walking Trail Moved by Councillor Zimmerman, seconded by Councillor Gillespie that Council defer the refund of funding on the proposed Zurich Walking Trail for two months to allow Councillor Zimmerman time to see if she can get project back up and going. Carried. Staff will inquire if the funding will still be available if the project continues. Enabling Accessibility Fund Moved by Councillor Irvin, seconded by Councillor Whetstone that Council receive, note and file the report on Enabling Accessibility Fund. Carried. Canada 150 Community Infrastructure Fund Mayor Hessel asked if this grant could be used to replace the Glass Street stairs. Manager of Public Works, J. Walker stated that it would cost approximately $1000 to repair the beach access stairs. Moved by Councillor Zimmerman, seconded by Councillor Irvin that Council receive, note and file the report on Canada 150 Community Infrastructure Fund. Carried. 7. COUNCILLORS Issues Mayor Hessel stated that he received a picture of a sign on a road in Brucefield that stated, caution do not use this road, which was put up by residents. He asked if correspondence can be 5

6 sent to residents in that area. Manager of Public Works stated that the road is being monitored and graveled on a regular basis. Councillor Hill inquired where residents can bring old microwaves as she has been informed that they are not allowed at the landfill. Manager of Public Works, J. Walker stated that they may be disposed of at the landfill in the metal bin. Councillor Roy stated that he has received inquiries regarding ATV s being allowed on municipal roads. Mayor Hessel stated that we do not have a by-law allowing ATV s to operate on our roadway. Bluewater follows provincial guidelines and rules. Councillor Roy stated that he has received inquiries regarding properties in Bayfield that have 3 or 4 lots deemed as one property and how many water connection charges would be required. Mayor Hessel stated that all inquires should be directed to the Treasury staff as each case may be different. Councillor Roy stated that he has been asked by a resident if a No Exit sign could be placed on Sarnia Street leading up to Hill Terrace as people are having to turn around in their driveway. The Manager of Public Works will look into this. Councillor Whetstone inquired what avenue residents have if they do not agree with the answers they received from staff regarding appeals for the water debenture charge. Mayor Hessel stated that they would then have to ask to come as a delegation before Council. Councillor Whetstone stated that residents in Bayfield have placed decorative bird houses on the Martha Street foot path. They would like to hold a competition and add more bird houses. Mayor Hessel stated that they should not be doing this without Council permission. Councillor Whetstone stated that he has received complaints from business owners in Bayfield that do not like the look of the sponsorship signs that have been placed in the planters. He asked if the Heritage Committee was consulted regarding the signage as they are in the Heritage District. Deputy-Mayor Fergusson stated that a member of the Heritage Committee was at the Communities In Bloom meeting when this was discussed and did not make any comments regarding the signs. Councillor Whetstone asked how long the $1000 repair will last on the Glass Street stairs. Manager of Public Works, J. Walker stated that it will depend on the winter conditions. New Business Date for Workshop Official Plan Council agreed to hold an information Workshop regarding the Official Plan on Monday July 18 th at 3:30 p.m. Councillor Roy asked if staff could order a speed sign. He received information on a speed sign from a vendor at the OSUM Conference which could be purchased out of our current reserve. 6

7 Moved by Councillor Roy, seconded by Councillor Becker that staff prepare a report regarding the purchase of a speed sign. Carried. Correspondence Councillor Irvin referred to correspondence from the City of Ottawa regarding the municipal role in the siting of wind power projects. Moved by Councillor Irvin, seconded by Councillor Gillespie that the Municipality of Bluewater support the City of Ottawa s resolution regarding the renewable energy development process with regard to wind power projects. Carried. Councillor Zimmerman referred to correspondence from the Ontario Provincial Police regarding the new report available regarding current billable calls for service. Moved by Councillor Zimmerman seconded by Councillor Gillespie that staff contact the Ontario Provincial Police to obtain the current billable calls for service report. Carried. 8. CONFERENCE, COMMITTEE AND BOARD REPORTS Agriculture and Rural Affairs Committee Mayor Hessel Mayor Hessel informed Council that if there were any items they would like to see discussed at the Agriculture and Rural Affairs Committee meeting to let him know. Multi Municipal Wind Turbine Working Group Minutes May 12, 2016 Council reviewed the Multi Municipal Wind Turbine Working Group minutes of May 12, COUNCIL STATUS REPORT ACTION ITEMS Council reviewed the Council Action Item list as of June 16, QUESTIONS FROM THE GALLERY Dave MacLaren stated that he hopes that the signs for the Farmers Market will comply with the sign bylaw. 11. IN CAMERA SESSION Moved by Councillor Irvin, seconded by Councillor Roy that Council move into an in camera session at approximately 9:06 p.m. to discuss a personal matter regarding an identifiable individual with the CAO in attendance. Carried. Moved by Councillor Gillespie, seconded by Councillor Roy that Council move into an open session at approximately 9:59 p.m. Carried. 7
