1 ORDINANCE NO REQUESTED BY: STEVEN OWENS, DIRECTOR OF RECREATION CO-SPONSORED BY: COUNCILMEMBERS MCDONOUGH, MINEK, WOJNAR, HINKEL, RUSSO and COUNCIL PRESIDENT KILBANE AN ORDINANCE AUTHORIZING THE DIRECTOR OF PUBLIC SERVICE AND DEVELOPMENT TO ADVERTISE FOR BIDS AND THE MAYOR TO ENTER INTO A CONTRACT WITH THE LOWEST RESPONSIVE AND RESPONSIBLE BIDDER AS DETERMINED BY THE BOARD OF CONTROL TO MAKE IMPROVEMENTS TO GRANNIS PARK AND DECLARING AN EMERGENCY WHEREAS, the City of Fairview Park has been awarded one hundred thirty-nine thousand, four hundred forty-six dollars ($139,446) through the Ohio Department of Natural Resources NatureWorks grant program to make various improvements to Grannis Park; and WHEREAS, the Project was contemplated and planned for as part of the 2018 Budget; and WHEREAS, improvements to Grannis Park will be carried out in accordance with the park plans created by Deru Landscape Architecture; and WHEREAS, such improvements include the installation of a pavilion, walkway, bio retention swale, and flagpole area. SECTION 1. That the Director of Public Service and Development is hereby authorized to advertise and accept bids for various improvements to Grannis Park. SECTION 2. That the Mayor is authorized to enter into a contract with the lowest responsive and responsible bidder as determined by the Board of Control for improvements to Grannis Park, in an amount not to exceed one hundred eighty-five thousand, nine hundred twentyeight dollars ($185,928) to be paid from the Recreation Fund (Fund 230) and reimbursed by grant funding in the amount of one hundred thirty-nine thousand, four hundred forty-six dollars ($139,446). SECTION 3. It is found and determined that all formal actions of this council concerning and relating to the adoption of this ordinance were adopted in an open meeting of this council, and that all deliberations of this council and any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements. That this ordinance is hereby declared to be an emergency measure, necessary for the immediate preservation of the public peace, health, safety and welfare; and for the further reason that the repairs should be done as soon as weather permits; and provided it receives the affirmative vote of a majority plus one of the members elected to Council, it shall take effect and be in force immediately upon its passage and approval by the mayor, otherwise from and after the earliest period allowed by law. 3 ORDINANCE NO REQUESTED BY: STEVEN OWENS, DIRECTOR OF RECREATION CO-SPONSORED BY: COUNCILMEMBERS MCDONOUGH, MINEK, WOJNAR, HINKEL, RUSSO and COUNCIL PRESIDENT KILBANE AN ORDINANCE AUTHORIZING THE DIRECTOR OF PUBLIC SERVICE AND DEVELOPMENT TO ADVERTISE FOR BIDS AND THE MAYOR TO ENTER INTO A CONTRACT WITH THE LOWEST RESPONSIVE AND RESPONSIBLE BIDDER AS DETERMINED BY THE BOARD OF CONTROL TO MAKE IMPROVEMENTS TO NELSON RUSS PARK AND DECLARING AN EMERGENCY WHEREAS, the City of Fairview Park has been awarded one hundred sixty-one thousand, five hundred forty-three dollars ($161,543) through the Ohio Department of Natural Resources Land & Water Conservation Fund grant program and fifty thousand dollars ($50,000) through Cuyahoga County s Community Development Supplemental Grant program to make various improvements to Nelson Russ Park; and WHEREAS, the Project was contemplated and planned for as part of the 2018 Budget; and WHEREAS, improvements to Nelson Russ Park will be carried out in accordance with the park plans created by Deru Landscape Architecture; and WHEREAS, such improvements include the installation of a playground, outdoor exercise equipment, a paved loop trail, parking lot resurfacing, and landscaping. SECTION 1. That the Director of Public Service and Development is hereby authorized to advertise and accept bids for various improvements to Nelson Russ Park. SECTION 2. That the Mayor is authorized to enter into a contract with the lowest responsive and responsible bidder as determined by the Board of Control for improvements to Nelson Russ Park, in an amount not to exceed three hundred twenty-three thousand, eighty-six dollars ($323,086) to be paid from the Recreation Fund (Fund 230) and reimbursed by grant funding in the amount of two hundred eleven thousand, five hundred eighty-six dollars ($211,543). SECTION 3. It is found and determined that all formal actions of this council concerning and relating to the adoption of this ordinance were adopted in an open meeting of this council, and that all deliberations of this council and any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements. 5 ORDINANCE NO REQUESTED BY: STEVEN OWENS, DIRECTOR OF RECREATION CO-SPONSORED BY: COUNCILMAN RUSSO AN ORDINANCE SUPPORTING AND AUTHORIZING THE SUBMISSION OF AN APPLICATION TO THE OHIO DEPARTMENT OF NATURAL RESOURCES ( ODNR ) FOR ROUND TWENTY FIVE (25) OF THE NATUREWORKS GRANT PROGRAM ( PROGRAM ) TO PROVIDE FINANCIAL ASSISTANCE FOR THE CONSTRUCTION OF A PUBLIC RESTROOM AT NELSON RUSS PARK AND AUTHORIZING THE MAYOR TO ACCEPT ANY AWARDED GRANT FUNDS AND FILE ALL DOCUMENTS AND EXECUTE ALL AGREEMENTS NECESSARY TO RECEIVE AND ADMINISTER ANY AWARDED GRANT FUNDS AND DECLARING AN EMERGENCY WHEREAS, through ODNR, the State of Ohio administers financial assistance for public recreation purposes through the NatureWorks Grant Program ( Program ); and WHEREAS, the City of Fairview Park ( City ) is seeking financial assistance under the Program for the purpose of constructing of a public restroom at Nelson Russ Park; and WHEREAS, legislation supporting and authorizing the application is required and applications for assistance must be submitted by June 1, 2018; and WHEREAS, the total estimated project cost is one hundred thirty-four thousand, twentyone dollars and fifty cents ($134,021.50), of which the City is required to provide a twenty-five (25%) percent local funding match of thirty-three thousand, five hundred five dollars and thirtyeight cents ($33,505.38); and WHEREAS, the Program provides a seventy-five percent (75%) reimbursement for project costs, requiring the applicant to first expend funds and then request reimbursement from ODNR. SECTION 1. That the Council of the City of Fairview Park hereby approves the filing of this application for financial assistance through the Program. SECTION 2. That the City Administration is hereby authorized and directed to execute and file an application with ODNR and to provide all information and documentation required to become eligible for possible funding assistance by the June 1, 2018 application deadline. SECTION 3. That the City agrees to obligate the funds required to satisfactorily complete the proposed project and become eligible for reimbursement under the terms of the Program. Ordinance Page 1

That the City s request for Program funding is in an amount not to exceed one hundred thousand, five hundred sixteen dollars and twelve cents ($100,516.12) and all costs will be paid on a reimbursement basis out of the Recreation Fund (230). SECTION 5. That the Clerk is hereby authorized to attach a certified copy of this Ordinance to the application for assistance prior to its filing. SECTION 6. That the Mayor and City Administration are authorized to file all documents and execute all agreements necessary to accept the award and receive and administer any grant funds; and that the funds are appropriated solely for purposes described in this Ordinance. SECTION 7. It is found and determined that all formal actions of this Council concerning and relating to the adoption of this Ordinance were adopted in an open meeting of this Council, and that all deliberations of this Council and any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements. SECTION 8. That this Ordinance is hereby declared to be an emergency measure necessary for the preservation of public peace, health, safety and welfare; and for the further reason that the application must be submitted by the June 1, 2018 deadline; and provided it receives an affirmative vote of a majority plus one of the members elected to Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor; otherwise from and after the earliest period allowed by law. 7 ORDINANCE NO REQUESTED BY: ERICH UPPERMAN, POLICE CHIEF AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT THROUGH THE OHIO DEPARTMENT OF ADMINISTRATIVE SERVICES (ODAS) COOPERATIVE PURCHASING PROGRAM WITH LEBANON FORD FOR THE ACQUSITION OF ONE (1) 2018 FORD POLICE INTERCEPTOR P2M SEDAN FOR THE POLICE DEPARTMENT AND DECLARING AN EMERGENCY. WHEREAS, the Police Department is in need of one (1) new 2018 Ford Police Interceptor P2M Sedan; and WHEREAS, the Ford Interceptor vehicle is available pursuant to Ohio Department of Administrative Services (ODAS) Contract #RS from Lebanon Ford, Lebanon, Ohio. SECTION 1. The Mayor is hereby authorized to enter into a contract with Lebanon Ford, an authorized vendor who offers such vehicle to the City at a price determined by ODAS. SECTION 2. That the cost of the acquisition of the police sedan, in an amount not to exceed thirty Thousand Dollars ($30,000.00) will be paid from the P.O.P.A.S. Fund (716). SECTION 3. It is found and determined that all formal actions of this Council concerning and relating to the adoption of this ordinance were adopted in an open meeting of this Council, and that all deliberations of this Council and any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements. SECTION 4. That this Ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, health, safety and welfare and so that the police sedan can be ordered immediately and available for use by the Police Department, and provided it receives the affirmative vote of a majority plus one of the members elected to Council, it shall take effect and be in force from immediately upon its passage and approval by the Mayor, otherwise from and after the earliest period allowed by law.

8 ORDINANCE NO REQUESTED BY: SHAWN LEININGER, DIRECTOR OF PUBLIC SERVICE & DEVELOPMENT AN ORDINANCE AUTHORIZING THE DIRECTOR OF PUBLIC SERVICE & DEVELOPMENT TO PURCHASE PAVEMENT MARKING SERVICES AND DECLARING AN EMERGENCY WHEREAS, certain City streets have center and/or edge line pavement markings. WHEREAS, these pavement markings are necessary for the safety of motorists and pedestrians utilizing City streets. WHEREAS, the City does not have the equipment necessary to properly install and maintain these center and/or edge line pavement markings and purchases this service from businesses specializing in applying pavement markings. SECTION 1. The Director of Public Service & Development is hereby authorized to purchase from Aero-Mark, Inc. pavement marking services to remark center and edge lines on certain City streets. SECTION 2. That the cost of the service is fifteen thousand four hundred three dollars ($15,403.00) to be paid in one lump sum payment from the Capital Projects Fund (Fund 811). SECTION 3. It is found and determined that all formal actions of this Council concerning and relating to the adoption of this Ordinance were adopted in an open meeting of this Council, and that all deliberations of this Council and any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements. SECTION 4. That this Ordinance is hereby declared to be an emergency measure necessary for the preservation of the public peace, health, safety and welfare and so that the order for the equipment may be replaced as soon as possible to provide for continued road maintenance and public safety, and provided it receives the affirmative vote of a majority plus one of the members elected to Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor, otherwise from and after the earliest period allowed by law. 10 ORDINANCE NO REQUESTED BY: SHAWN LEININGER, DIRECTOR OF PUBLIC SERVICE & DEVELOPMENT AN ORDINANCE AUTHORIZING THE DIRECTOR OF FINANCE TO SELL A ROSCO STAPAC III ASPHALT COMPACTOR AND PURCHASE A NEW VOLVO DD15 ASPHALT COMPACTOR AND DECLARING AN EMERGENCY WHEREAS, the Rosco Stapac III Asphalt Compactor was put into service by the City in WHEREAS, the existing compactor has exceeded its useful life, and replacement parts are difficult and costly to obtain. WHEREAS, the Public Service Department is in need of a new asphalt compactor to continue day to day road maintenance and sewer and water repair operations. WHEREAS, a new Volvo DD15 Asphalt Compactor can be purchased from Rudd Equipment, Inc. utilizing a State of Ohio State Term Schedule 515 Schedule SECTION 1. The Director of Finance is hereby authorized to purchase from Rudd Equipment, who offers such equipment to the City of Fairview Park using State of Ohio State Term Schedule 515 Schedule , a new Volvo DD15 Asphalt Compactor. SECTION 2. That the cost of the purchase of the equipment is $30,681 (thirty thousand six hundred eighty-one dollars) to be paid in one lump sum payment from the Sanitary Sewer Fund (Fund 510). SECTION 3. The Director of Finance is hereby authorized to sell a Rosco Stapac III Asphalt Compactor with the proceeds of said sale to be deposited in the Sanitary Sewer Fund (Fund 510). SECTION 4. It is found and determined that all formal actions of this Council concerning and relating to the adoption of this Ordinance were adopted in an open meeting of this Council, and that all deliberations of this Council and any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements. 12 ORDINANCE NO REQUESTED BY: SHAWN LEININGER, PUBLIC SERVICE & DEVELOPMENT DIRECTOR AN ORDINANCE AUTHORIZING THE DIRECTOR OF FINANCE TO SELL AN OBSOLETE HUDSON TRAILER AND DECLARING AN EMERGENCY WHEREAS, the City of Fairview Park has a Hudson HTD18E Trailer which is no longer of use for daily operations. WHEREAS, it is in the best interest of the City to dispose of said obsolete equipment. SECTION 1. The Director of Finance is hereby authorized to sell the Hudson HTD18E Trailer (VIN 10HHTD1E0G000001) for the highest and best price via auction, internet sale, trade or by other proposal as determined to be the best method by the Director of Finance: SECTION 2. That the proceeds from the sale of the vehicles be deposited into the Permanent Improvement Fund (260) of the City of Fairview Park. SECTION 3. It is found and determined that all formal actions of this Council concerning and relating to the adoption of this ordinance were adopted in an open meeting of this Council, and that all deliberations of this Council and any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements. SECTION 4. That this Ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, health, safety and welfare and to immediately dispose of unused equipment, and provided it receives the affirmative vote of a majority plus one of the members elected to Council, it shall take effect and be in force from immediately upon its passage and approval by the Mayor, otherwise from and after the earliest period allowed by law.

13 ORDINANCE NO REQUESTED BY: MAYOR EILEEN ANN PATTON AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT WITH THE GO2IT GROUP FOR PROFESSIONAL SUPPORT SERVICES FOR THE CITY'S COMPUTER SYSTEMS AND DECLARING AN EMERGENCY WHEREAS, the City's computer systems require monthly maintenance and periodic support services; and WHEREAS, The Go2IT Group has been selected to provide the necessary professional computer services to maintain and operate the City's computer systems from June 1, 2018 to May 31, 2020; to wit: provide pro-active support services, anticipate and prevent IT problems, successful installation and configuration of necessary technologies to monitor and maintain critical technology systems. SECTION 1. The Mayor is hereby authorized to enter into a contract with The Go2IT Group to provide managed professional computer maintenance and support services for the City's computer systems in the amount of $2, per month, new projects to be billed at the amount of $ per hour and online backup of data at $0.50 per gigabyte of online backup storage per month. SECTION 2. The cost of the professional services contract with The Go2IT Group shall be paid from the General Fund (100), the Recreation Fund (232) and the Permanent Improvement Fund (260) as determined by the Director of Finance. SECTION 3. It is found and determined that all formal actions of this Council concerning and relating to the adoption of this ordinance were adopted in an open meeting of this Council, and that all deliberations of this Council and any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements. SECTION 4. That this ordinance is hereby declared to be an emergency measure necessary for the preservation of the public peace, health, safety and welfare and immediately provide for continued computer maintenance service and provided it receives the affirmative vote a majority plus one of the members elected to Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor, otherwise from and after the earliest period allowed by law.
