1 2.A MINUTES OF MEETING SOUTH ST. PAUL PLANNING COMMISSION SEPTEMBER 6, 2017 MEETING CALLED TO ORDER BY CHAIR ROSS AT 7:00 P.M. Present: Tim Felton Absent: Ryan Briese Ruth Krueger Justin Humenik Jason Pachl John Ross Stephanie Yendell Peter Hellegers, City Planner 1) APPROVAL OF AGENDA approved as presented Pachl/Yendell (5-0) 2) APPROVAL OF MINUTES for August 2, 2017 approved as presented Krueger/Felton (5-0) 3) NEW BUSINESS A. Review of Comprehensive Plan Community Engagement Mr. Hellegers reported being in the 10-year cycle to update the Comprehensive Plan as required by state law. The City applied for and received a grant from Dakota County and the State Health Improvement Partnership (SHIP) to enhance community engagement efforts. To that end the City entered into a contract with WSB to undertake those efforts and prepare draft goals for the Comp Plan update. Addison Lewis and Karina Heim of WSB were attendance to report on engagement efforts that included: a Community Open House and Survey, a booth at Kaposia Days, Business Engagement Forum, Farmer s Market, Swimming under the Stars and engagement of the senior population at the John Carroll Highrise as well as the exercises available and findings from the sessions. Ms. Heim reported 180 responses were received from the community survey which was made available at the Community Open House, posted on the City s website and on the My Sidewalk webpage. The next event is a Community Open House is scheduled for September 14 th to report on the feedback received from the engagement sessions and how the information will be used to shape the City s Comprehensive Plan. WSB will continue to work to refine draft goals and policies that incorporates feedback from the public, staff and Planning Commission. Engagement results and draft goals/policies will be presented to the City Council for their input. Commissioner Felton asked if the total number of survey responses were statistically significant as far as a representation of the entire community. Mr. Lewis responded that the events drew different demographics from the wide range of attendees at Kaposia Days, the youth at Swimming under the Stars, and the senior population who typically are not able to attend a public meeting but were in attendance at the John Carroll Highrise. Ms. Heim stated the tally of engaging people in the community through the engagement process totaled 160 in addition to the survey responses.

2 Page 2 of 7 Commissioner Yendell asked whether the responses were representative of the City with respect to hitting the target populations for the SHIP Grant. Ms. Heim stated the information was not tracked; but anecdotal and perhaps it s something to consider in future engagement processes. Mr. Hellegers reported that flyers were distributed in a Spanish version as well as having an interpreter available at the community and business forums. Ms. Heim discussed the theme with respect to whether South St. Paul was a welcoming community noting respondents cited the community was welcoming and close knit; however, felt a gap existed between long term and new residents and identifying ways to bridge the gap. Commissioner Pachl stated community engagement was a good approach; however, didn t believe 350 people was a fair representation of a community of 20,000. Mr. Hellegers recapped the topics, goals and sub-goals stating the goals are intended to be a starting point and can be refined. Discussion ensued. Motion to approve the draft goals as outlined in the Planning Commission report Krueger/Yendell (4-0-1), Commissioner Felton abstained. B. PC Case # : Small Cell Wireless Ordinance Mr. Hellegers reported the City adopted a moratorium in October 2016 on accepting any small wireless facility applications while the City studied issues related to the facilities. That moratorium expires on October 9, In the meantime, the State passed legislation in 2017 that allows small wireless facilities in the right-of-way ( ROW ). Small wireless facilities are mounted on utility poles or street lights and are intended to fill geographic gaps in coverage that occur between major antenna facilities. The ROW ordinance has been modified to reflect the State statute amendment allowing the devices in ROWs. Mr. Hellegers reviewed examples of small wireless facilities and discussed alternatives that make devices less intrusive. Commissioner Felton asked who would be installing the small cell wireless facilities. Mr. Hellegers responded a third party would typically install the device for telecommunications carriers to provide faster service to their customers. Discussion ensued regarding the allowable maximum height of the poles. Contractors would be allowed to attach the device to an existing 50 pole; however, the device is allowed to extend the pole structure but more than 10. The zoning district ordinance has been revised as follows: to allow small wireless cell facilities in the ROW of a residential zoning district as a conditional use designate small cell wireless facilities as permitted uses in all other zoning districts if they comply with the conditions of the City s ROW ordinance any small cell wireless facilities outside the ROW would be prohibited in all zoning districts.

3 Page 3 of 7 Commissioner Yendell asked if design standards can be set by the City. Mr. Hellegers replied standards have been incorporated into Section 54 of the ROW ordinance; however, the ordinance was not part of the agenda packet. Discussion ensued regarding the timeline for approval. Motion to table the item to the end of the meeting agenda after a 10 minute recess to provide and review the ROW ordinance amendment Yendell/Felton (5-0) C. PC Case # : Subdivision Ordinance Amendment Mr. Hellegers reported the existing subdivision ordinance is being amended to include language that addresses the impact with pedestrians, school children and non-motorized transportation to make sure there is safe access within the subdivision ordinance. The language is required if the city would decide to apply for funding for Safe Routes to School grant funding to resolve issues with pedestrian networks leading to and from schools. The tentative City Council meeting dates are September 18 and October 16, Commissioner Yendell asked if the language would just relate to new subdivisions being built within the city. Mr. Hellegers responded in the affirmative. Motion to approve as presented Pachl/Felton (5-0) 4) PUBLIC HEARING A. PC Case # : Corey Hanneman 2 nd Garage CUP at th Avenue North Mr. Hellegers reviewed the applicants request for a CUP to build a second garage on the rear of his property at th Avenue North. The property has an existing garage that accesses to 12 th Avenue. The second garage structure would be situated on the rear southwest portion of the lot with access from the alley. The proposed garage is 26 x 28, consists of approximately 728 SF and meets setback and lot coverage requirements of the City. Commissioner Yendell asked if applicant is aware of the height requirements to which Mr. Hellegers reported the matter had been discussed with the applicant. Commissioner Ross opened the public hearing. Mr. Hellegers reported receiving an in favor of the request. There was no one in attendance to comment on the application. Commissioner Ross closed the public hearing. Commissioner Pachl queried as to the size of the existing garage noting the applicant stated the structure is a single car garage. Mr. Hellegers stated the existing garage appears to have a 16 door which is

4 Page 4 of 7 indicative of a 2-car garage. It was noted the existing garage isn t large enough for two large vehicles, tools and other property of the applicant. Motion to approve as presented Krueger/Yendell (5-0) B. PC Case #2017: Planning Applications Ordinance An amendment to the City Code regarding language on the process and application requirements for specific planning applications. Mr. Hellegers reported proposed ordinance replaces existing language regarding the processes for the various planning applications (variances, conditional use permits, interim use permits and amendments) to make the ordinance consistent with Codes. The amendment spells out the process for each type of application that is submitted. Chair Ross asked what prompted the changes. Mr. Hellegers stated this section of the Code hadn t been updated for many years and doesn t have much to address IUP applications. Having seen more IUP s over the last years the Code needed to be addressed so it made sense to structure each provision in the same fashion. Discussion ensued regarding the relationship between the amendment and the subdivision regulations. Chair Ross opened the public hearing. There was no one in attendance to comment on the proposed ordinance amendment. Chair Ross closed the public hearing. Motion to approve as presented Pachl/Felton (5-0) C. PC Case # : Parking Standards Ordinance An amendment to the City Code regarding the number of parking spaces required for bowling alleys and restaurants. Mr. Hellegers reported earlier this year staff met with the existing bowling alley owners on Concord Street regarding the parking area around their site. The parking areas are owned by the HRA; however, as the only user the space is more than the bowling alley requires. The City s current parking standards require almost 100 spaces more than are needed for the bowling alley use. Decreasing the parking standards for bowling alleys by 3 spaces per lane and decreasing parking for restaurants by.5 spaces per seat would bring the City s parking standards in line with other communities. The amendment to the parking standard for the two uses would benefit the City by providing more area for redevelopment near the bowling alley as well as removing a potential barrier for restaurant development.

5 Page 5 of 7 Commissioner Krueger asked if the change creates more space for development. Mr. Hellegers stated that the additional space could be developed on its own or combined with other property to create more developable property on Concord/Concord Exchange. Commissioner Yendell queried as to how the change affects restaurants in other areas of the city. Mr. Hellegers responded it decreases their parking requirement; however, it doesn t change the space number greatly. Commissioner Pachl stated the decrease of parking requirement for restaurants is not extreme but would benefit all restaurants in town while promoting development. Commissioner Ross opened the public hearing. No correspondence was received nor was there anyone in attendance to comment on the proposed parking standards ordinance amendment. Commissioner Ross closed the public hearing. Motion to approve the proposed Parking Standards Ordinance amendment for bowling alleys and restaurants Yendell/Pachl (5-0) D. PC Case # : Industrial District Ordinance An amendment to the City Code dividing the Industrial District into two sub-districts and establishing standards for those two districts. Mr. Hellegers reported the proposed ordinance would take the existing Industrial zoning district and divide it into two sub-districts: I-1 Light Industrial and I-2 Medium Industrial. The I-1 Light Industrial District would cover office/showroom/warehouse uses in the BridgePoint business park area which is consistent what has been developed the past 20 years. The I-2 Medium Industrial District would provide for heavier uses south of 494. Mr. Hellegers stated it is difficult to have uniform standards for the wide variety of uses that are contained in one district. The two zoning districts would have some differences with regard to uses that are permitted, prohibited or conditional. The intent is to ensure higher quality development standards and provide protections for businesses. In addition, establishing the two sub-districts is consistent with Comprehensive Plan adopted in Discussion ensued regarding the need for either a CUP or IUP for exterior storage in the I-1 district and prohibited uses in that district. Conditional uses in the I-2 district would include uses allowed by CUP in the I-1 district. Chair Ross opened the public hearing.

6 Page 6 of 7 Mr. Hellegers reported the city attorney received questions regarding the existing rendering use in the BridgePoint area which is proposed to be zone I-1. Mr. Hellegers reported the use is allowed as it is existing and is protected under the PUD. Existing uses would be legal non-conforming as long as the use remained the same. No one was in attendance to comment on the proposed ordinance amendment. Chair Ross closed the public hearing. Commissioner Yendell queried as to which district a distribution type use would fall under. Mr. Hellegers responded a distribution use would be considered warehousing; therefore, would fall under I-1 light industrial. Motion to approve the proposed ordinance amendment Felton/Pachl (5-0) E. PC Case # : Home Occupations Ordinance An amendment to the City Code Sections and regarding home occupations and residential businesses offices Mr. Hellegers reported the proposed ordinance would take existing language of the zoning definitions section and take the standards which were listed in the definitions and place those standards in the R-1 zoning district regulations. The proposed ordinance amendment world eliminate the Residential Business Office definition as it fits under the Home Occupation definition and standards. Chair Ross opened the public hearing. No correspondence was received nor was anyone in attendance to comment on the application. Chair Ross closed the public hearing. Motion to approve as presented Yendell/Krueger (5-0) Chair Ross temporarily adjourned the meeting at 9:00 P.M. for a recess in order to obtain additional information relating to PC Case # Small Cell Wireless Ordinance. Chair Ross reconvened the meeting at 9:16 P.M. NEW BUSINESS B. Small Wireless Facilities (continued discussion) Commissioner Yendell asked if rent can be charged for some of the uses and if the fee goes to the City. Mr. Hellegers reported the fees are for the cost of the permit and a nominal amount of rent for space on the pole which is basically cost recovery rather than revenue source for the City.

7 Page 7 of 7 Mr. Hellegers read a portion of Section 54 Right of Way ordinance pertaining to the conditions of small cell wireless facilities. Discussion ensued with regard to making the devices as unobtrusive as possible. Motion to approve as presented with the language of City Code Section as provided in the Planning Commission agenda packet in addition to Section 54 of City Code regarding Right of Way Management which was provided at the recess Yendell/Krueger (5-0) Motion adjourn at 9:26 P.M.
