2 The ASEAN Charter To provide ASEAN with its own legal personality distinct from its Member States To enshrine ASEAN key principles and purposes To set up necessary institutional mechanisms and bodies to implement ASEAN cooperation progarammes and activities To provide legal framework for community building and integration processes.

5 Legal framework Each ASEAN Community Pillar has developed various instruments under its respective areas of competence to pursue ASEAN integration agenda Almost 400 legal instruments in ASEAN are in place, putting rules and measures for regional cooperation and integration the task is not done when the instruments are introduced. The challenge is how to ensure the effective implementation Monitoring and Compliance Mechanism, Proper coordination at both national and regional level

6 Legal instruments Implementation of the ASEAN Constituent Treaty (the ASEAN Charter) Ensuring the completion of ratification process by all Member States, necessary for the entry into force of the Charter Putting in place relevant legal instruments, rules and procedures to operationalise various provisions of the ASEAN Charter : Agreement on Privileges and Immunities of including the Host Country Agreement ASEAN,

7 Putting in place rules and procedures Protocol to the ASEAN Charter on the ASEAN Dispute Settlement Mechanism: Rules of Procedure for arbitration Rules of Procedure for Good Offices, Mediation and Conciliation Rules of Procedure for submission of unresolved to the ASEAN Summit disputes Rules of Procedure for Submission of Non-Compliance to the ASEAN Summit

8 Putting in place rules and Procedures Rules for Authorisation of Legal Transactions under Domesticlaws Rules of Procedure for Conclusion of International Agreements by ASEAN Rules of Procedure for Requesting the ASEAN Secretariat to interpret the ASEAN Charter Many other rules and guidelines are being considered and developed by ASEAN to operationalise various provisions of the ASEAN Charter

9 Rules-based ASEAN Rule of law, promotion and protection of human rights, democracy and good governance ( the ASEAN Charter and the Blueprints of the ASEAN Community ) Promote understanding and appreciation of political systems, culture and history of ASEAN Member States (Important roleplayed by media ( the ASEAN Ministers responsible for Information) to deepen mutual understanding among ASEAN Member States)

10 Rules-based ASEAN Promoting and Protecting Human Rights: The Establishment of the ASEAN Inter- Commission on Human Rights Governmental Promoting education and public awareness on rights human The establishment of the ASEAN Commission on the Promotion and Protection of the Rights of Women and Children Developing an ASEAN Declaration on Human Rights

11 Rules-based ASEAN Good Governance : Promote sharing of best practices and experiences on Governance Good ASEAN Conference on Civil Servant Matters undertaking various activities/ policies to transparency, accountability, participatory governance (ACCSM) is promote and effective ACCSM will hold its Good Governance Forum in October 2012 in Malaysia to look into good strategies on good governance in ASEAN Good Governance is also handled by the AMM establishment of the ASEAN Supreme Audit Institutions (ASEANSAI)
