51 Record of Consultation WCEC Transfer/Processing Facility ECA Amendment 1 Introduction Waste Management of Canada Corporation (WM), the owner and operator of the West Carleton Environmental Centre (WCEC), is seeking an amendment to its existing Environmental Compliance Approval (ECA) for the Waste Transfer/Processing Facility component of the WCEC. An amendment application is being submitted to the Ministry of the Environment and Climate Change. This document describes the consultation activities undertaken as part of the ECA amendment process. 2 Consultation Activities 2.1 Notices to Neighbours/Adjacent Property Owners A letter describing the proposed amendments to the ECA for the WCEC Waste Transfer/Processing Facility was distributed to neighbours and adjacent property owners of the WCEC facility on May 17, No comments or responses were received. A letter describing the proposed amendments to the ECA for the WCEC Waste Transfer/Processing Facility, and submission of the application, was distributed to neighbours and adjacent property owners of the WCEC facility on July 21, Copies of the letters are included in Appendix A. The distribution list for the letters is also included in Appendix A. 2.2 WCEC Public Liaison Committee A copy of the initial letter sent to neighbours and adjacent property owners describing the proposed amendments to the ECA for the WCEC Waste Transfer/Processing Facility was distributed to the WCEC Public Liaison Committee (PLC) members on May 17, During the WCEC PLC meeting held on June 14, 2016, WM staff provided an overview of the ECA amendment application. No concerns were raised by the Committee members. A copy of the final PLC meeting minutes is included in Appendix B. 2.3 Municipal Consultation WM met with local Councillor El-Chantiry, and Chair of the PLC, on April 20, 2016 to discuss the proposed amendments to the ECA for the Waste Transfer/Processing Facility. A follow up discussion was held on May 16, 2016 to coincide with notification of the WCEC facility neighbours, adjacent property owners, PLC and City of Ottawa staff of the proposed amendments to the ECA. WM staff informed the City of Ottawa General Manager, Environment Services and Manager, Solid Waste Services of the proposed amendments to the ECA for the WCEC Waste Transfer/Processing Facility. A follow up meeting was held on May 17 th with the Manager, Solid 1 July 2016

52 Record of Consultation WCEC Transfer/Processing Facility ECA Amendment Waste Services and WM provided a copy of the draft application and related letters that were distributed to the WCEC neighbours, adjacent property owners and the PLC committee members. The application was briefly reviewed. The City formally acknowledged receipt of the draft amendment application package by on May 30, City staff provided WM with a copy of their June 29, 2016 letter to the MOECC regarding the draft amendment application. A copy of the letter is included in Appendix C. A summary of the comments raised in the letter, and WM s responses to those comments, are also included in Appendix C. 2.4 MOECC Pre-Consultation Pre-consultation on this application and proposed ECA amendments included notification and discussion with the MOECC Ottawa District Office. 2 July 2016

A-2015 Annual Report Waste Management (WM) advised that the first draft of the 2015 Annual Report was sent to the Ministry of Environment and Climate Change (MOECC) at the end of March for review. This process can take three months to upwards of nine months and WM has not heard anything back from the MOECC to date. A copy of the first draft was sent to Councillor El-Chantiry s Ward office. WM advised that when l comments have been received from MOECC and edits completed by WM, then the final version of the report will be posted on the web site. Councillor El-Chantiry asked for clarification on who prepares the summary of thee lengthy report. WM advised their consultants, Blue Metrics, will prepare the summary report, which all PLC committee members will WM to send first draft of 2015 Annual Report to WCEC PLC members by .

59 7. Correspondence Received 8. Community Members Discussion receive, prior to release to the public. WM will send a copy of the first draft to the PLC committee in case of comments or questions. B Environment Compliance Approval (ECA) An amendment was made to the ECA Application to amend the service area to allow construction and demolition waste generated within Western Quebec, to be accepted at the Western Carleton Environmental Centre (WCEC). WM advised the current process is to remove items of construction and demolition waste manually, which is competitive and cost effective, in comparison to costly machines that often cannot remove viable construction and demolition materials. WCEC-PLC members advised they did not have any questions or cause for concern at this time with regards to the ECA amendment. C-General Operation WM advised they educate the public and customers on the value of source separation of cardboard, plastic and organics as cross-contamination reduces value. WM also advised the market is quite volatile with regards to recyclable prices. WM will re-drill some poor producing gas wells at the closed landfill commencing in July and finish end of August. No correspondence received. Councillor El-Chantiry confirmed WCEC-PLC will have a larger role when the Host Agreement is complete, and landfill construction and then operation begin. All consumer complaints will be handled by the PLC and PLC will liaise with the City of Ottawa and the MOECC. WM has added a more prominent link to the PLC information on the WCEC web site menu as per the committee meeting October 29, WM will the link to all of the Councillors to add to their own websites. Councillor El-Chantiry advised that a popular question with the community was the status of the Host Agreement. No information has been provided to Councillors on the status of the current negotiations or their content. When the negotiated Host Agreement is available, the PLC will review it with input from the City s legal department before it is released to the Environment Committee and the public. WM to send Councillors link to PLC site

60 Councillor Chantiry advised currently there are only very limited funds available from the old host agreement for community use. There has been confusion in the past on how the funds for the community are accessed. In the future, this process should be outlined on the WM web site. 64 Record of Consultation WCEC Transfer/Processing Facility ECA Amendment Summary of City of Ottawa Staff Comments and WM Responses Issue/Comment from June 29, 2016 Letter WM Response The City is concerned this request for a service area change is a significant variance from the service area intended in the recently completed Environmental Assessment of this facility. As part of the Terms of Reference (TOR) for this facility, WM completed a needs assessment which clearly determined sufficient waste was available in the Ottawa area to justify a landfill expansion. At no point over the past ten years of this project, in the ToR, EA or ECA application did WM consult the public regarding accepting waste from western Quebec. Nor did WM did not consult the City on this expanded service area prior to making application. As host municipality, the City of Ottawa submitted Council endorsed comments on the topic of Service Area over the course of the WCEC EA. The following excerpt is from the October 2012 Council Report. Service area the proposed service area for the waste diversion facilities and landfill should be restricted to exclusively the municipal boundary of the City of Ottawa and Lanark County. Contaminated soils brought to the site should also be restricted to those generated within City limits and Lanark County. The service area for all waste diversion facilities at the site should be restricted to the City of Ottawa and Lanark County so as to prevent materials from other communities being brought into the landfill through these recycling facilities. WM agreed in the EA they would predominantly only accept waste from this service area. The inclusion of waste from Quebec will only add to the tonnage accepted from outside the preferred service area. The expansion of the landfill component of the WCEC was the subject of the recently completed EA. The service areas for the landfill and the transfer/processing facility are specified separately in the ECA. The proposed ECA amendment application relates only to the existing Transfer/Processing Facility, not the landfill. WM did provide a copy of the draft ECA amendment application to the City, the WCEC PLC and neighbours for the purpose of consulting on the proposed amendment prior to submitting a formal application. WM also met with City staff and the WCEC PLC to discuss the application. The expansion of the landfill component of the WCEC was the subject of the recently completed EA. The approved service area for all WCEC facilities is the Province of Ontario. WM is only seeking to amend the service area for the transfer/processing facility. July 2016

65 Record of Consultation WCEC Transfer/Processing Facility ECA Amendment This larger service area should have been proposed during the EA to allow more extensive consultation as this is a significant departure from the ToR approved by the MOECC. The City is not supportive of this application and requests that the EA be re-opened to allow meaningful consultation on this issue prior to Ministry approval being considered. The purpose of the ToR and the recently approved EA was to support an expansion of the landfill component of the WCEC A copy of the draft ECA amendment application was provided to the City, the WCEC PLC and neighbours for the purpose of consulting on the proposed amendment. 79 EXPLANATORY NOTE TO BY-LAW No By-law No amends the City of Ottawa Zoning By-law The amendment affects the property at 2349 Carp Road through 2437 Carp Road odd numbers only and 512 William Mooney Road, which is located north of Highway 417, south of Richardson Side Road, and has frontage on Carp Road to the east and William Mooney Road to the west, as shown on the attached Location Map. The application is to rezone the subject property from Rural Light Industrial Subzone 5 rural exception 275 with a holding provision (RG5[275r]-h), Mineral Extraction Subzone 2 (ME2), Rural Heavy Industrial (RH), Rural Heavy Industrial Subzone 4 (RH4) to Rural Heavy Industrial Exception Holding (RH[787r]-h) in the City of Ottawa Zoning Bylaw. The proposed zoning will permit the expansion of a solid waste disposal facility and a waste processing and transfer facility subject to the site plan control process for lifting of the holding provision and larger setbacks and soft landscape buffers for all exterior edges of the zoned lands. 83 City Council Minutes Page 7 of 49 14/07/2016 MOTION No. 78/3 Moved by Councillor El-Chantiry Seconded by Councillor Qadri WHEREAS, at their meeting of July 3, 2014, the Agricultural and Rural Affairs Committee was advised by staff that the Lifting of a Holding Provision does not return to Committee but rises directly to Council once the conditions of the Holding Provision have been satisfied; and WHEREAS the Agricultural and Rural Affairs Committee wishes to be formally notified of the Lifting of the Holding Provision for the zoning of the West Carleton Environmental Centre prior to the matter rising to City Council; THEREFORE BE IT RESOLVED that City Council direct that staff provide an information report to the Agricultural and Rural Affairs Committee and the affected west-end Councillors, Councillors Wilkinson and Hubley, with respect to the final resolution of the Holding Provision in respect of the West Carleton Environmental Centre prior to a by-law being submitted to Council.
