1 PAN-AFRICAN PARLIAMENT PARLEMENT PANAFRICAIN البرلمان األفريقي PARLAMENTO PAN-AFRICANO Gallagher Convention Centre, Private Bag X16, Midrand 1685, Johannesburg, Republic of South Africa Tel: (+27) Fax: (+27) Web site: INDIVIDUAL CONSULTANT CONSULTANCY SERVICE TO REVIEW/DEVELOP THE PAN- AFRICAN PARLIAMENT STRATEGIC PLAN Reference No.: PAP/PROC/xx/ Background The Pan African Parliament was established as an organ the African Union (AU) in order to ensure the full participation of African peoples in the development and economic integration of the continent. The first Parliament was inaugurated on 18 March 2004 in Addis Ababa, Ethiopia and its headquarters is in Midrand, South Africa. The ultimate aim of the Pan African Parliament shall be to evolve into an institution with full legislative powers, whose members are elected by universal adult suffrage. The new protocol granting these powers has been adopted by the AU and is currently under ratification by member states. However until such a time that the new protocol comes into force, the Pan African Parliament shall have consultative and advisory powers within the AU. The objectives of the Pan African Parliament is to: Facilitate the effective implementation of the policies and objectives of the OAU/AEC and ultimately the African Union. Promote the principle of human rights and democracy in Africa. One Africa, One Voice! 1 of 9
2 Encourage good governance, transparency and accountability in Member States. Familiarise the peoples of Africa with the objectives and policies aimed at integrating the African Continent within the framework of the establishment of the African Union. Promote peace, security and stability. Contribute to a more prosperous future for the peoples of Africa by promoting collective self-reliance and economic recovery. Facilitate cooperation and development in Africa. Strengthen continental solidarity and build a sense of common destiny among the peoples of Africa. Facilitate cooperation among Regional Economic Communities and their Parliamentary fora. The African Union Member States are represented at the Pan African Parliament by five parliamentarians, at least one of whom must be a woman. The representation of each Members State must reflect the diversity of political opinions in each National Parliament or other deliberative organ. 2.0 Vision, Mission, Mandate and Core Values of the Pan-African Parliament Vision A continental institution harnessing One Africa, One Voice. The PAP vision has a long-term horizon and envisions a Pan African Parliamentary Institution that will provide a common platform for African peoples to fully participate in the decisionmaking processes for the political and socio-economic development and integration of the Continent particularly through the harmonization and coordination of the policies and laws made at national and regional levels and by promoting a sense of unity and common destiny among the peoples of Africa. Mission The PAP s mission is to provide a common platform for African peoples to represent, and to act as a voice of the people of Africa presenting their opinions, their concerns and aspirations, and thus effectively holding the governing institutions of the AU 2
3 accountable in the implementation of policies and programmes as well as in the allocation and use of public resources for promoting just, equitable and sustainable development for all the peoples of Africa. Core Values The core values are a set of beliefs that guide the management of the PAP. They are the foundation upon which all policies are based. They are inbuilt in the Constitutive Act and the Protocol of PAP which include: Fundamental Human Rights: PAP subscribes to social justice, fundamental human rights, gender equality and the democratic values of human dignity, equality and freedom as a cornerstone of democracy in Africa. People-centeredness: PAP respects all the people of Africa; honour their integrity; and it is committed to representing and serving them. Subsidiarity and Cooperation: PAP co-operates with other organs of the AU, National and Regional Parliaments and Governments as well as stands for the subsidiarity principle. Professionalism and good institutional governance: PAP is accountable and transparent, and it is customer-focused and strives for the highest of service quality. 3.0 Overall mandate of the PAP The PAP was established by the AU to institutionalize a popular framework which allows citizens to engage and drive the processes that affect the continent. It is in this context that the Constitutive Act of the AU which outlines the creation of the PAP in its Article 5 that states that the PAP shall be one of the Organs of the AU. Article 2 of the Protocol states that the PAP shall only have consultative and advisory powers. Article 3 of the Protocol provides for the objectives of the PAP, which include: facilitate the effective implementation of the policies and objectives of the OAU/AEC and, ultimately, of the AU; promote the principles of human rights and democracy in Africa; and encourage good governance, transparency and accountability in Member States. Article 11 indicates that the PAP shall be vested with legislative powers to be defined by the Assembly. 3
4 4.0 Oversight, investigative, consultative and advisory powers of the PAP All organs of the AU, with the exception of the Court of Justice, are subjected to oversight, investigative, consultative and advisory functions by the PAP. The independence of judges of the Court of Justice is guaranteed in Article 13 of the Protocol of the Court of Justice of the AU. This is also in line with international convention. The PAP has oversight, investigative, consultative and advisory powers. Although the AU Organs are not accountable to the PAP, but they are still subjected to its oversight. As the legislative arm of the AU, the PAP provides a platform for African peoples and their grass-roots organizations to be involved in discussions and decision-making on the problems and challenges facing the continent. The Pan-African Parliament has been vested with the following powers: Examine, discuss or express an opinion on any matter, either on its own initiative or at the request of the Assembly or other policy organs and make any recommendations it may deem fit relating to, inter alia, matters pertaining to respect of human rights, the consolidation of democratic institutions and the culture of democracy, as well as the promotion good governance and the rule of law. Discuss its budget and the budget of the Community and make recommendations thereon prior to its approval by the Assembly of the African Union. Work towards the harmonisation or co-ordination of the laws of the Member States. Make recommendations aimed at contributing to the attainment of the objectives of the AU and draw attention to the challenges facing the integration process in Africa as well as the strategies for dealing with them. Request officials of the AU to attend its sessions, produce documents or assist in the discharge of its duties. Promote the programmes and objectives of the AU, in the constituencies of the Member States. 4
5 Promote the co-ordination and Harmonization of policies, measures, programmes and activities of the Regional Economic Communities and the parliamentary fora of Africa. Adopt its Rules of Procedure, elect its own President and propose to the Council and the Assembly the size and nature of the support staff of the Pan- African Parliament. Perform such other functions as it deems appropriate to achieve the objectives set out in Article 3 of the Protocol. 5.0 DEVELOPMENT OF THE PAN AFRICAN PARLIAMENT (PAP) STRATEGIC PLAN In March 2017, the Pan-African Parliament commenced the development of its Strategic Plan with the consultative visits to selected Member States to seek their inputs into the strategic framework. A strategic framing workshop was subsequently held in July 2017 with critical Pan-African Parliament departments to align on key deliverables of the Strategic Plan. The Pan-African parliament is therefore currently seeking to engage a consultant to finalise its Strategic Plan. 1. SCOPE OF THE ASSIGNMENT The scope of the consultancy will cover the finalization of the development of Pan- African Parliament Strategic Plan, incorporation of comments and recommendations as well as validation of the recommendations at a validation workshop to be organized by the Pan-African Parliament to ensure that the Strategic Plan are consistent with the AU Vision and Mission and in line with the Agenda 2063 requirements amongst other requirements such as the Agenda 2063 s 10 Year Plan of Implementation. 2. DESIRED OUTCOMES AND RESPONSIBILITY By the end of the Consultancy, the Pan-African Parliament expects: To review the Status of Implementation of the Pan-African Parliament ; 5
6 To organise and facilitate a SWOT Analysis meeting with Members of the Pan-African Parliament to agreed and finalise the Strategic Objectives, goals & Indicators; To have final draft of the Strategic Plan ready for adoption by the Plenary of the Pan-African Parliament by April 15 th, 2018; To develop an Annual Implementation Plan for the Strategy; 3. DELIVERABLES The following responsibility matrix presents the minimum different outputs of the assignment at five stages and the responsibility of the Consultant. Reports and Schedule of Deliverables The Consultancy Services should be completed within sixty working days beginning February The following indicate the time table and the required deliverables under the assignment. PAN-AFRICAN PARLIAMENT SUPPORT : The Pan-African Parliament will be responsible and will endeavor to support the Consultant by: Providing all the necessary information and reports to the Consultant; Facilitating access and communication with the staff of the Pan-African Parliament; Providing sufficient workspace to accommodate onsite visits. 6. QUALIFICATION AND EXPERIENCE The consultant is required to have the following qualifications: i. A Master s Degree in a relevant discipline (e.g. Social Science, Law, Politics, Public Policy, Public Administration, Economics and Human Rights, MBA). A PhD will be an added advantage; ii. At least 7 years relevant experience in drafting or reviewing strategic planning and development for internationals organizations; iii. Demonstrable experience in developing strategic plans, evaluating programs and projects especially those of a regional nature; 7
8 iv. Demonstrable knowledge and understanding of African Union mandate, structure and Agenda 2063; v. Excellent written and oral communication skills in English and knowledge of any other AU language is desirable. The Pan African Parliament now invites eligible Individual Consultants to indicate their interest in providing the Services. Interested candidate must provide information demonstrating that he/she has the required qualifications and relevant experience to perform the Services. Consulting firms may propose individual consultant, but only the experience and qualifications of individual shall be used in the selection process, and that his or her corporate experience shall not be taken into account, and the contract would be signed with the proposed individual. For evaluation of the expressions of interest the following criteria will be applied: a. General Education Qualification and Relevant Training (20 points); b. Experience related to the Assignment (30 points); c. Technical approach and methodology (40 points); d.
