4 The Planning Act The province establishes the rules for municipal land use planning through the Planning Act. Purposes of the Act: promote sustainable economic development in a healthy natural environment; provide for a land use planning system led by provincial policy; integrate matters of provincial interest in provincial and municipal planning decisions;

5 The Planning Act continued... The province establishes the rules for municipal land use planning through the Planning Act. Purposes of the Act: provide for planning processes that are fair by making them open, accessible, timely and efficient; encourage co-operation and co-ordination among various interests; and recognize the decision-making authority and accountability of municipal councils in planning.

6 The Planning Act establishes: Types of Development Applications for example Official Plan and Zoning By-law amendments, Site Plan Control Application When to circulate an application complete application Complete application means that the application has met the minimum requirements for technical studies and plans Minimum timeframe for the City to review the application, deem it complete and circulate the application to public and technical agencies

7 The Planning Act establishes: Timelines for processing applications for example Council must render a decision within a specific timeframe or an appeal to the Ontario Municipal Board may be launched Public Consultation Requirements for example posting of signs, mailing of notices, advertisement of meetings

10 The Provincial Policy Statement (PPS 2014) Issued under the Planning Act by the Ministry of Municipal Affairs and Housing Sets the policy foundation for regulating the development and use of land in Ontario Guides municipalities in creating their planning policies, as the policies adopted by the City shall be consistent with the direction of the PPS

12 The Provincial Policy Statement (PPS 2014) Provides policy direction on matters of provincial interest related to land use planning and development. Key part of Ontario s policy-led planning system, it sets the policy foundation for regulating the development and use of land. It also supports the provincial goal to enhance the quality of life for the citizens of Ontario.

13 Example: Settlement Areas Settlement areas are urban areas and rural settlement areas, and include cities, towns, villages and hamlets. Ontario s settlement areas vary significantly in terms of size, density, population, economic activity, diversity and intensity of land uses, service levels, and types of infrastructure available.

14 Official Plan Secondary Plans / CDPs Provides a vision of the future growth of the City Provides policy framework to guide its physical development in 20-year horizons Legal document that addresses matters of provincial interest defined by the Provincial Policy Statement under the Ontario Planning Act Approved by the Province

15 The Official Plan guides the physical growth and development of the municipality: Where land uses will go Where services will be needed/provided What lands will be preserved from development How decisions will be made How consultation will occur

21 Zoning By-law Secondary Plans / CDPs Passed by the councils of municipalities can regulate land use elements such as: Restricting use of land Restricting erecting, locating or using of buildings Contaminated lands; sensitive or vulnerable areas Natural features and areas Construction of buildings or structures Loading or parking facilities

25 Secondary Planning How do we do it? Secondary Planning studies are undertaken in a variety of ways at the City: Lead by the City with City staff Lead by the City with consultants hired to undertake the process (City oversees the process) Lead and funded by the applicant as a result of a development application or proposal (City oversees the process) Lead and funded by the applicants/developers (City oversees the process)

26 What is a Secondary Plan? Council-approved document 20-year horizon A sub-plan of the City s Official Plan Created under the authority of the Planning Act (legal document) Statutory Document

27 What is a Secondary Plan? A tool to implement secondary planning studies such as a CDP Specific to a geographic area (i.e. boundary of a CDP or TOD or area-specific) Conforms to Official Plan (may result in changes to Official Plan)

28 Secondary Plans Why have them? Official Plan policies are broad (City-wide), while the provisions in zoning are very specific A Secondary Plan provides area-specific direction that is expecting future development An example of the contents of a Secondary Plan (specific to the area/site): Objectives and purpose Goals and principles Land use designations, building heights and locations Mobility Public realm
