1 Edmond City Council Minutes May 9, 2016, Book 40, Page Call to Order by Mayor Lamb EDMOND CITY COUNCIL MINUTES May 9, 2016 Mayor Lamb called the regular meeting of the Edmond City Council to order at 5:30PM, Monday, May 9, 2016, in the City Council Chambers, 20 S. Littler, Edmond, Oklahoma. The agenda for this meeting was posted in the City First Administration Building on May 5, 2016 at 3:27PM. PRESENT: ABSENT: Councilmember Davis 2. Approval of City Council Meeting Minutes: April 25, 2016 Motion by Massey, seconded by Waner, to approve Minutes. Motion carried as followed: 3. City Council Presentations A. Proclamation Recognizing May as National Public Works Week Mayor Lamb presented a proclamation recognizing May as National Public Works Week to Herb Blomquist, Edmond Public Works Director. B. Proclamation Recognizing May as National Police Week Mayor Lamb presented a proclamation recognizing May as National Police Week to Bob Ricks, Edmond Police Chief. C. Proclamation Recognizing May 2016 as Bike Month Mayor Lamb presented a proclamation recognizing the month of May 2016 as Bike Month to Fred Richard of the Edmond Bicycle Committee. D. City Manager's Progress Report Larry Stevens, City Manager, presented information regarding three items. The Barnett Field Splash Pad is currently undergoing Phase II of construction with Steel-Built Construction as the contractor. The contract amount is $346,232 and will be funded by the Edmond park tax. Regarding the 33 rd and Broadway intersection improvements, Mr. Stevens stated that while recent rain has slowed the progress on this major project, the contractor, Allen Contracting, is still on target for a July completion date. Edmond s twenty percent share of the project, $1.1M, comes from the 2000 Capital Improvements sales tax.

2 Edmond City Council Minutes May 9, 2016, Book 40, Page 353 Mr. Stevens provided an update on Sales Tax collections, stating that revenues continue to exceed what we received for comparable periods last year. Edmond s cumulative total through eleven months is a net 1.24% above last year. 4. General Consent Items A. Consideration of Approval of Administrative Items 1. Discussion and Consideration of Resolution No Approving The Incurrence Of Indebtedness By The Edmond Public Works Authority (The "Authority") Issuing Its Sales Tax And Utility System Revenue Bonds, Series 2016 (The "Bonds") In One Or More Series For The Purpose Of Funding Capital Projects For The City; And Approving The Proposal Of The Authority To Incur Said Indebtedness; Approving The Proceedings Of The Authority Pertaining To The Sale Of Said Bonds; Waiving Competitive Bidding; Approving A Sales Tax Security Agreement And Other Documents; And Containing Other Provisions Relating Thereto 2. Acknowledge receipt of Oklahoma Department of Environmental Quality (ODEQ) Construction Permits for the Quarters at Kelley Pointe Phase 2, Connect United Methodist Church, and Gardens II at Kelly Lakes Addition 3. Acceptance of donated Utility Easement from BC&GS L.L.C. for Petra Warehouse, located at 2101 S. Kelly Avenue 4. Approval of Transfer of Appropriation for Planning and Public Works Building Conference Room; $10,000 Motion by Waner, seconded by Caldwell, to approve items 4.A. (1-4). Motion carried as followed: B. Consideration of Ordinances and Resolutions 1. Consideration of Resolution Nos. 7-16, 8-16, 9-16, and 10-16, Declaring the Necessity for Acquiring Certain Real Property within the City of Edmond, Oklahoma for Public Use, and Authorizing Acquisition by Eminent Domain Motion by Massey, seconded by Caldwell, to approve items 4.B.1.. Approval of Change Order No. 1 to the Construction Contract with A-Tech Paving for the Public Library Lot Expansion; $11, decrease. This change order is necessary to reconcile as-built quantities and add additional items necessary to complete this project 2. Approval of the Engagement Letter from John M. Arledge and Associates, P.C. to provide audit services of the City s FY15-16 Financial Statements; proposed fee of $68, Approval of "As-Needed" Financial Services from Crawford & Associates, P.C. to provide services as necessary not to exceed $45, Acceptance of Bid for Kelly Ave. Median Landscape and Irrigation for Community Images/Forestry Department; $19, Motion by Waner, seconded by Massey, to approve items 4.C. (1-4). Motion carried as followed: Motion by Caldwell, seconded by Massey, to recess the City Council Meeting and convene the Edmond Public Works Authority Meeting. Motion carried as followed: Mayor Lamb reconvened the City Council Meeting. 7. Planning Discussion Items A. Discussion and Consideration of Request for a Right-of-Way Variance on the south side of West Edmond Road between State Street and Fretz Avenue. (Neal McGee) Steve Manek, City Engineer, provided general information regarding the applicant s request. Mr. Manek stated that staff recommend denying the applicant s request, due to the proposed right-of-way variance not needing the needs of the area and future potential widening of Edmond Road. Randel Shadid, representing the applicant, provided additional information regarding the applicant s request, stating that the applicant wished to provided 42.5 of right of way, rather than the required 90. Neal McGee, the applicant, provided information regarding the project that he wished to develop at the site and stated that it was not possible for him to do the project with the required right of way. Mr. McGee offered to provide additional right of way in the drive way to meet ADA requirements.

4 Edmond City Council Minutes May 9, 2016, Book 40, Page 355 Mr. Manek stated that even with the proposed addition on the driveway, it would still not be possible to meet ADA requirements with the applicant s proposed variance. A minimum of 52 would be necessary. Mayor Lamb suggested that even 52 was a significant variance to the code requirement of 90 and that he would not vote to grant a variance without a positive staff recommendation. Motion by Caldwell, seconded by Massey, to approve item 7.A.. Motion failed as followed: B. Case #Z Public Hearing and Consideration of Ordinance No Amending the Edmond Plan from Single-Family Dwelling District to Two-Family Dwelling, generally located one-eighth mile west of the Burlington Northern Santa Fe Railroad track on the south side of West Thatcher Street. (Irvin Judd) (Emergency Approval Required) Bob Schiermeyer, City Planner, provided general information regarding the applicant s request. Mr. Schiermeyer stated that while the Edmond plan had not projected the property in this manner, it would be consistent with the surrounding property uses. The Planning Commission recommended approval. Randel Shadid, representing the applicant, provided more information regarding the request, stating that the property would be used for duplexes. Motion by Waner, seconded by Caldwell, to approve item 7.B.. Case #Z Public Hearing and Consideration of Ordinance No Rezoning from A Single Family Dwelling to B Two Family Dwelling generally located on one-eighth mile west of Burlington Northern Santa Fe Railroad, on the south side of West Thatcher Street. (Larry Toombs) (Emergency Approval Required) Bob Schiermeyer, City Planner, presented general information regarding the applicant s request. Tim, Johnson, representing the applicant, stated that he was willing to meet with citizens regarding their concerns. Mark Livingston, representing residents surrounding the property, provided information regarding their concerns including traffic concerns. Mr. Livingston indicated that he was willing to meet with the applicant to discuss these concerns. Motion by Caldwell, seconded by Waner, to continue agenda items 7.D., 7.E., and 7.F. to the June 27 th City Council meeting. Motion carried as followed: E. Case #Z Public Hearing and Consideration of Ordinance No. Rezoning from G-A General Agricultural to a Residential Planned Unit Development for Covell Valley South PUD on 102 acres east of Air Depot Boulevard and north of Danforth Road (Larry Toombs) F. Case #Z Public Hearing and Consideration of Ordinance No. Rezoning from G-A General Agricultural to E-1 General Commercial on 31 acres east of Air Depot Boulevard and North of Danforth Road. (Larry Toombs) G. Case #U and Case #SP Public Hearing and Consideration of a Specific Use Permit, to include a Site Plan, for a church activity center, located west of Fretz between 7th and 8th Street. (Edmond Chinese United Methodist Church) Bob Schiermeyer, City Planner, provided general information regarding the applicant s request, and stated that the Planning Commission recommended approval. The applicant s related request would close the public access alley, but be retained as a public easement. Motion by Massey, seconded by Caldwell, to approve item 7.G.. Motion carried as followed: H. Case #ES Public Hearing and Consideration of Ordinance No to close the east/west alley, on the west side of Fretz Avenue, between 7th and 8th Streets.
