1 Municipal Clerk's Office Approved Date: 0//0 Submitted by: Chair of the Assembly at the Request of the Mayor Prepared by: Public Works Administration, Department of Law & Municipal Clerk s Office For reading: January, 0 ANCHORAGE, ALASKA AO AN ORDINANCE OF THE ANCHORAGE MUNICIPAL ASSEMBLY CALLING A SPECIAL ELECTION BY MAIL FOR THE PURPOSE OF SUBMITTING A BALLOT PROPOSITION TO THE QUALIFIED VOTERS RESIDING IN THE AREA AFFECTED FOR CREATION OF A STREET LIGHT SERVICE AREA (SLSA), REQUESTED BY PETITION FROM PROPERTY OWNERS WITHIN THE AREA, WHICH SLSA INCLUDES CERTAIN REAL PROPERTY ADJACENT TO WREN CIRCLE AND WREN LANE, TO BE DESIGNATED AS THE WREN LANE SLSA, AND TO, UPON VOTER APPROVAL, AUTOMATICALLY CONSOLIDATE THE WREN LANE SLSA WITH THE EAGLE RIVER SLSA AND ACCORDINGLY AMEND THE EAGLE RIVER SLSA MAP IN ANCHORAGE MUNICIPAL CODE SECTION.0.00, WITH AN EFFECTIVE DATE RETROACTIVE TO JANUARY, 0. WHEREAS, a petition has been received from owners of real property adjacent to Wren Circle and Wren Lane showing public interest to create a new street light service area (SLSA) to be designated as the Wren Lane SLSA to operate and maintain street lights within the affected area; and WHEREAS, it is in the public interest to provide for operation and maintenance of the present and future street lights in the proposed Wren Lane SLSA; and WHEREAS, the Municipal Clerk has requested a cost-efficient election process for creation of the proposed Wren Lane SLSA, such as holding a special election by mail for the qualified voters residing within the area affected by the proposed creation of Wren Lane SLSA, comprising a total of parcels of real property; and WHEREAS, Anchorage Municipal Code section..0 provides that the Assembly may authorize a mail-in ballot for a special election for purposes of authorizing the creation of a service area pursuant to the Charter; and WHEREAS, the properties within the proposed Wren Lane SLSA are not currently in the Eagle River SLSA; and WHEREAS, Anchorage Municipal Charter.0(a) provides that the Assembly by ordinance may consolidate service areas in which services are provided by the municipality at the same level in each of the areas to be consolidated ; and WHEREAS, the present and future street lights and anticipated tax revenue increase will not have a significant fiscal impact on the Eagle River SLSA; and

2 Ballot Prop for creation of the Wren Lane SLSA - AO Page - - of WHEREAS, the consolidation of the street light service areas are in conformance with the legislative policy to minimize the number of new service areas, especially when it is feasible and practical to consolidate accordingly; and WHEREAS, the creation of a new service area approved only by the qualified voters residing in the proposed Wren Lane SLSA followed by an automatic consolidation with the Eagle River SLSA by the Assembly, as pre-approved by this ordinance, will provide a manageable and fair mechanism to accomplish incorporating Wren Lane SLSA, if successfully created, into the Eagle River SLSA with no apparent adverse fiscal effect on the Eagle River SLSA; and WHEREAS, the maintenance and operational services to be received in the proposed Wren Lane SLSA will be the same level of such services currently provided in the Eagle River SLSA, satisfying the prerequisite for consolidation by the Assembly; now therefore, THE ANCHORAGE ASSEMBLY ORDAINS: Section. Pursuant to Anchorage Municipal Charter.0(a), a ballot proposition in substantially the following form and substance shall be submitted to the qualified voters of the Municipality residing in the area affected, as described in Section, at a special election by mail-in ballot as described in Section : Proposition CREATION OF A NEW STREET LIGHT SERVICE AREA TO INCLUDE PROPERTIES ADJACENT TO WREN LANE AND WREN CIRCLE, EFFECTIVE RETROACTIVELY TO JANUARY, 0. This ballot proposition will create a street light service area (SLSA) that includes real property adjacent to Wren Lane and Wren Circle in Eagle River, which are not presently in the Eagle River Street Light Service Area, to operate and maintain existing and future street lights along Wren Lane beginning just north of its intersection with Lucas Avenue continuing south to the terminus of the street at Wren Circle. The new service area would be designated the Wren Lane SLSA and include the area depicted on the map included with the ballot package. If the creation of the Wren Lane SLSA is approved by the voters, the new service area will be automatically consolidated with the Eagle River SLSA pursuant to Assembly approval in AO 0-, effective retroactively to January, 0. Property owners within the Wren Lane SLSA will incur an increase in their property taxes to pay for the operation and maintenance of the street lights in the service area beginning with tax year 0. The increase in property taxes may not exceed the maximum mill rate in the Eagle River SLSA of 0. mills.

The Wren Lane SLSA is hereby created, to include the area and properties within the area as depicted and listed in the attached Exhibit A. In accordance with Anchorage Municipal Charter.0(a), the Assembly hereby consolidates the Wren Lane SLSA with the existing Eagle River Street Light Service Area set out in Anchorage Municipal Code section.0.0, (effective retroactively as of January, 0) and hereby amends AMC section.0.00 with the map attached with Exhibit A. Section. The Assembly hereby authorizes a special election by mail-in ballot for creation of the Wren Lane SLSA as set forth in this ordinance, in accordance with AMC chapter.. Notwithstanding other requirements of Title of the Anchorage Municipal Code, this special election by mail shall be conducted as set forth in this ordinance. In lieu of a resolution, the Assembly calls for the special election in this ordinance, and in accordance with AMC section..00 declares the following:. The Municipal Clerk will mail ballot packages to the registered voters qualified for this election on or before February, 0.. The Municipal Clerk shall publish a notice of election on or before February, 0.. The last date upon which individuals who may not have received a ballot package from the Municipality can file an application for a ballot package is February, 0. The application must be received by the Municipal Clerk by this date.. The last date upon which the Municipal Clerk shall mail any ballot packages to registered voters within the affected area is February, 0.. The Election Day is February, 0. All ballot envelopes mailed must be postmarked on or before this date. All ballots must be marked and attested on or before this date. Ballots may be dropped off in person at the Municipal Clerk s office before :00 p.m. on Election Day. No ballots will be accepted in person after that time.. All mail-in ballots must be received by the Municipal Clerk, in order to qualify for inclusion in the election tabulation, by :00 p.m. on March, 0. Section. Sections and shall be effective immediately upon passage and approval by the Anchorage Municipal Assembly. The proposition contained in Section of this ordinance shall be effective retroactively as of January, 0 if, but only if, said proposition is passed by a majority of the voters voting on the

This ordinance creates a new street light service area (SLSA), designated as the Wren Lane SLSA, for approval by the qualified voters residing within the area affected. If approved by the voters, the ordinance provides accordingly for amendment to service area maps in Anchorage Municipal Code section.0.00 and automatically consolidates the Wren Lane SLSA with the existing Eagle River SLSA, effective retroactively as of January, 0. A petition from residents and/or owners of property within the proposed Wren Lane SLSA requests street light maintenance and operating services for the existing and future street lights within the area. The existing public improvements constructed within the proposed Wren Lane SLSA were inspected and found to meet Municipal standards and acceptable for operation and maintenance. There are residents currently living within the proposed Wren Lane SLSA. Inclusion of the proposed Wren Lane SLSA to the existing Eagle River SLSA will not have a significant fiscal or operational impact on the Eagle River SLSA. In addition, this street light system will not present any fiscal hardship for the Public Works Department. The Eagle River SLSA does not have a formal board of supervisors who oversee the service area. All operation and maintenance is administered by the Public Works Department through private contractors. Automatic consolidation is a feasible and rational method to efficiently provide for the operation and

The maintenance and operational services to be received in the proposed Wren Lane SLSA will be the same level as such services provided in the Eagle River SLSA. The consolidation of the street light service areas is in conformance with the legislative policy to minimize the number of new service areas, especially when it is feasible and practical to consolidate accordingly. There are parcels of real property within the area affected by creation of the proposed Wren Lane SLSA. The Municipal Clerk s office has advised it would be more cost-effective and efficient to conduct the election for creation of the Wren Lane SLSA in a special election by mail-in ballot, instead of in conjunction with the regular election on April, 0. AMC section..0 provides the Assembly may authorize such a special election for these purposes. The Public Works Department believes there may be higher degree of participation of qualified voters than in the past on similar propositions if the election is conducted by mail, and supports calling a special election. The Public Works Department recommends that the Assembly approve this proposed creation of the Wren Lane SLSA, and conditional on voter approval of the ballot proposition to accordingly amend AMC section.0.00 and automatically consolidate the Wren Lane SLSA with the Eagle River SLSA, effective retroactively to January, 0.
