It expects to be the espondent befoe the Ontaio Municipal Boad with espect to any othe appeals that ae launched concening the Plan as adopted. The Ministe of Municipal Affais and Housing (the "Ministe") is the appoving Authoity who has appoved the Plan with modifications and has issued the Notice of Decision dated Novembe L The Region accepts many of the Ministe's modifications, but in a limited numbe of cases appeals modifications it does not accept pusuant to Subsection 17 (36) of the Planning Act The specific modifications placed befoe the Boad fo adjudication by this Appeal ae set out below. This will occu only in the event that a futue uban expansion is justified by a municipal compehensive eview in accodance with the Gowth Plan. The Futue Stategic Employment Aeas ae a constaint to futue development and not a land use designation in ROPA 38. By identifying these lands, Halton Region is seving notice to pivate landownes, the public and public agencies that these lands will be consideed fo employment uses in a futue uban expansion execise undetaken by Halton Region. The public investment in infastuctue in these tanspotation coidos calls fo these lands to he potected fo employment land use should they be bought into the uban bounday. and it would be consistent with the Povincial Policy Statement and eflective of local values fo these lands not to be deflected fom employment uses when they ae consideed fo futue inclusion in the uban bounday. The Ministe's modifications, as identified above, change the equiements fo when an Envionmentallmpact Assessment is equied. ROPA 38 equied the poponent ofany development that is located wholly o patially inside o within 120 metes of the Regional Natual Heitage System to cay out an Envionmental Impact Assessment. The Ministe's modifications have educed the equiement fo an Envionmental Impact Assessment fo any development o site alteation that is within 120 metes ofa Key Featue within the Regional Natual Heitage System. Though Regional Council's endosement of the Official Plan Diections Repot ("Towads Suslainability", Repot LPS69-09), the Region's Geenlands System was eplaced with a "science-based" Natual Heitage System as shown on Map I of ROPA 38, Regional Stuctue. The new Regional Natual Heitage System includes, among othe elements, buffes, linkages and enhancement aeas that ae vital to the long tenn potection and sustainability of the key natual featues. ROPA 38 equied the poponent of a development that is located wholly o patially inside o within J20 metes of the Regional Natual Heitage System. to pepae an Envionmental Impact Assessment to ensue that any impacts to the key featues, buffes, linkages and enhancement aeas ae minimized and mitigated. The Ministe'S modification now places enhancement aeas,

To this extent the Ministe's modification does not suppot the systems based appoach to natual heitage potection. The systems appoach eflects fact based analysis, good science and best planning pactice and ought to be eflected in the Plan bought into foce by the Boad. 3. Changes to the Requiements fo Undetaking an Envionmental Impact Assessment fo a Poposed New Agicultual Building Modifications: No. 44 (Section 100(1)); No. 73 (Section 110(7.2)); No. 98 (Section 118(3)); No. 99 (Section 118(3.1) though to 118(3.3)[new))); No. 100 (Section 118(24)). The Ministe's modifications, as identified above, have deleted the equiements fo the poponent ofan agicultual building to undetake an Envionmental Impact Assessment. In keeping with Regional Council's diection to develop and potect a "systems-based" Regional Natual Heitage System ("Towad Sustainability", Repot LPS69-09), ROPA 38 equied the poponent of a development that is located wholly o patially inside o within 120 metes ofthe Regional Natual Heitage System, to undetake an Envionmental Impact Assessment to identify measues to avoid o mitigate impacts fom the development. ROPA 38 educed the equiements fo the poponent of an agicultual building to pepae an Envionmental Impact Assessment based on the poximity to the Regional Natual Heitage System and the size of the poposed agicultual building and povided one exemption to pepaing an Envionmental Impact Assessment. To expedite the Envionment Impact Assessment and lessen the cost fo the poponent of an agicultual building. ROPA 38 allows fo the scoping of the Enviomnental Impact Assessment o the povision ofin-kind o financial assistance fom Halton Region. Though the Ministe's modifications, the poponent of a new agicultual building is not equied to undetake an Envionmental Impact Assessment but must povide a 30 mete vegetation potection zone fom Key Featues. This places those linkages, buffe aeas and enhancement aeas that ae essential to potecting the long tenn sustainability ofthe key featues at isk to the impacts ofdevelopment. The policy as adopted eflects local values and best planning pactice and ought to fonn pat of the in foce plan that is appoved by the Boad. 4. Change to the Basic Stuctue of the Regional Official Plan though the Deletion of Pime Agicultual Aeas as a Constaint to Development and the Intoduction of Pime Agicultual Aeas as a Land Use Designation Modifications: No.6 (Section 51); No.7 (Section 51(5)); No. 8(Section 51.1 and 51.2); No. 14 (Section 68); No. 16 (Section 71); No. 23 (Section77d)); No.40 (Section 92(5) elocated to

The Ministe's modifications, as identified above, have changed the fundamental stuctue oftbe Regional Official Plan though the deletion of the Pime Agicultual Aeas as a constaint to development and the addition ofthe Pime Agicultual Aeas as a land use designation. The Ministe's modifications delete the Pime Agicultual Aeas as a constaint to development and make the Pime Agicultual Aeas as shown on Map 1E, Pime Agicultual Aeas. a land use designation that ovelays the Regional Natual Heitage System, Mineal Resouce Extaction Aeas and Agicultual Rual Aea designations. The Ministe's modifications change the basic stuctue of the Regional Plan that has always been based on mutually exclusive designations that povide cetainty and claity on the objectives, policies and pennitted land uses that goven development within these aeas. The intoduction of a new Pime Agicultual Aeas land use designation that ovelays thee othe designations will ceate confusion ove the pimacy of land use policies and land uses. This amendment to the Plan does not epesent best planning pactice. 5. Deletion of the Requiement that the Development Industy Pay Its Fai Shae of the Cost of Human Sevices Modifications: No. 25 (Section 77(15» add No. 26(Section 77(17). The Ministe's modifications, as identified above, have deleted the equiement that the development industy pay its fai shae ofthe cost ofthe povision ofhuman sevices. One of Halton's fundamental pinciples is that gowth must pay fo itself. Though ROPA 38, the Region included the equiement that the Region and Local Municipalities plan fo the povision of human sevices though thei joint infastuctue plans and that the development industy absob its fai shae of the cost of the povision of hwnan sevices. This policy ecognizes that the development industy is only obligated to pay fo those sevices as allowed unde Povincial Legislation such as the Development Chages Act, It also positions the Region to take advantage of futue changes to Povincial Legislation o egulations that may equie the development industy to contibute additional funding fo the povision of human sevices. Regional Council has aleady indicated its intent to seek changes to Povincial Legislation (i.e. the Development Chages Act, 1997 and the Municipal Act. 2001) so that it has the necessay tools to implement the vision and policies of the Gowth Plan to ceate complete bealtby conununities ("Adoption of Regional Official Plan Amendment No. 38", Repot LPSI14-09).

Incl~si~n of the Requie~ent that the Local Municipalities and the Region Include Pelnmnay Route Plannmg Study Aeas in Thei Respective Official Plans Modifications: No. 115 (Sections 173(1.1), (1.2), (1.3)); No. 118 (Section 173 (5.1)); No. 146 (Section 262.1); No. 159 (Map 3). The Ministe's modifications, as identified above, have added the equiement that Local Municipalities and the Region must amend thei espective Official Plans to show peliminay oute planning study aeas fo the Niagaa to GTA and GTA West Tanspotation Coido EAs. The GTA West Envionmental Assessment Study poposes designating a study aea which would cove a significant potion of the southen pat of the Town of Halton Hills. This would limit o pevent development until the next stage ofthe GTA West EA is complete, a pocess that could potentially take seveal yeas. As almost all of the aea coveed by the poposed study aeas fo the GTA West Coido ae within the Region's Agicultual Rual and Regional Natual Heitage designation that pemit a vey limited numbe of uses, it is unnecessay to identify the oute planning study aeas fo GTA West to GTA Tanspotation Coido Envionmental Assessment. Futhennoe, thee ae sufficient policies and planning pocesses in place though the Niagaa Escapment Planning and Development Act, 1990, the Niagaa Escapment Plan, the Geenbelt Plan and the Regional and Local Official Plans that make it unnecessay to identify the oute planning study aea fo the Niagaa to GTA Tanspotation Coido EA in the Regional and Local Official Plans. The Ministe's modifications ae a pesciptive appoach that does not allow fo the consideation of altenative appoaches and does not allow fo the Plan to eflect local planning values. These modifications ought not to be included in the Plan bought into foce by the Boad. 7. Deletion of the Geenbelt Plan Policy Aea, Extension of the Regional Natual Heitage System to include the Geenbelt Natual Heitage System and the Removal of the Ovelay in Halton Hills Modifications: No.6 (Scction 51(2.1)); No. 43 (Section 99.1 and 99.2); No. 55 (Section 101(5) thongh to 101.1(8»; No. 73 (Section 110(7.2»; No. 90 (Section 114.1(6»; No. 91 (Section 114.1(9»; No. 93 (Section and 115.4(3»; No. 105 (Section and »; No. 140 (Section 253.4»; No. 159 (Map 1).

6 Page 6 The Ministe's modifications, as identified above, have deleted the Geenbelt Plan Policy Aea designation on Map 1, Regional Stmctue and the ovelay in the Town ofhalton Hills, all elated policies and extended the Regional Natual Heitage System ove this aea noth and west of the Niagaa Escapment. The Regional Stuctue pesented on Map I, Regional Stuctue, of ROPA 38, eflects the collective desie of Halton's esidents as conveyed though the Sustainable Halton pocess and Regional Council's commitment to implementing the vision of the Povincial Gowth Plan, to potect the Region's natual heitage system and suppot the long tem viability of Halton's agicultual secto. The Geenbelt Plan Policy Aea designation, which is the equivalent to the Potected Countyside Aea of the Geenbelt Plan was intoduced fo the aea noth and west of the Niagaa Escapment. The Ministe's modifications alte the Regional Stuctue that was unanimously appoved by Regional Council. Local policy pefeence is esponsive to the needs of the community and epesents good planning in this instance and should be suppoted by the Boad on that basis. 8. Restictions on Cetain Uses Pemitted in the Agicultual Rual Aea and the Regional Natual Heitage System Modifications: No. 47 (Section 100(16»; No. 48 (Section 100(17); No. 95 (Section 117.1[new]). The Ministe's modifications, as identified above, now place estictions on cetain uses within the Agicultual Rual Aea and Regional Natual Heitage System designations. ROPA 38 (Sections 100(16) and 100(17» pemits veteinay ctinics (seving pimaily the agicultual community) and animal ketulels (in conjunction with a single detached dwelling) in the Agicultual Rual Aea designation. The Ministe's modifications Nos. 47 and 48 now limit these uses to a commecial fam and equie them to be seconday to the fanning opeation. ROPA 38 also pemits bed and beakfast establishments, veteinay clinics and animal kennels in the Regional Natual Heitage System designation subject to cetain conditions. The Ministe's modifications No. 95 (Section 117.1) now limits these uses to commecial fams and equies them to be seconday to the fanning opeations. The Ministe's Modification places UTUlecessay estictions and oneous conditions on these uses that seve to limit and possibly pevent the establishment of much needed sevices, such as veteinay sevices, fo the agicultual community. 9. Modification to the Region's Defmition of Affodable Housing Modification: No. 127 (Section 214). The Ministe's Modification No.127 changes the Region's definition ofaffodable housing.

The Region's definition ofaffodable housing consides al~ owne~hlp costs associated WIth homeowneship (i.e. taxes, utilities, motgage, ~ual hollsmg epaus, ~tc.) t~ ensue that. a household, afte paying 30 pe cent of its goss l?c:o ne fo~ acco~~od~tjon, still has sufficient income to maintain a comfotable standad of hving. This defintlon IS used to identify the aulual "Affodable Housing Cut-Off Pice" that is epoted in the Region's annual State ofhousing epot. As modified by the Ministe, the definition now states that the puchase pice of a house o ent not exceed 30 pe cent of the goss household income. This is not an appopiate definition of affodable housing as the puchase pice of housing will always exceed 30 pe cent of goss household income. It is Halton's position that affodability should be based on owneship costs not exceeding 30 pe cent of goss household income. The Ministe's modification does not accuately addess the issue of affodable housing in Halton Region and is confusing and difficult fo the public to undestand. 10. Placement of Associated Facilities at the Discetion of the Poponent Modifications: No. 63 (Section No. 109(4)~ The Ministe's Modification No. 63 to Section 109(4) now allows the poponent of a mineal extaction opeation to place associated facilities on site whee the poponent consides it appopiate. ROPA 38 (Section 109) pemits a wide ange of uses within the mineal esouce extaction aeas designation including, among othe things, associated facilities that ae used in the extaction, tanspot o ecycling ofmineal aggegate. ROPA 38 also indicates that associated facilities must be diectly elated to the on-site mineal extaction and located such that they do not affect the ehabilitation o enhancement as contained in the appoved ehabilitation and enhancement plans. The addition of the wods "whee appopiate" in Section 109(4)a) suggests that the associated facilities may no longe need to be elated to the on-site mineal extaction activity. This is not a good planning esult in the local context since uses and activities that ae not diectly elated to the extaction occuing on the site may be pemitted which may then have an impact on the length oftime it will take to ehabilitate the site. 11. Deletion of the Requiement that Implementation Plans fom Pat of the Rehabilitation Plan Modification: No. 73 (Sections 110(7.2), 110(7.3), 110(7.4), 110(7.5)).

8 Page 8 Section 11O(7.2)g) of ROPA 38 indicated that a detailed implementation plan fo the poposed estoations and enhancements would be included as pat of the ehabilitation plan in the site plan o as a condition of the license unde the Aggegate Resouces Act. The Ministe's Modification No. 73 to Section 110(7.2) has eliminated this equiement. Though the adoption ofthe Official Plan Diections Repot (Towads Sustainability, LPS69-09), Regional Council diected staff to put in place a "systems based" Regional Natual Heitage System to potect the natual system in pepetuity and to develop an aggegate esouce stategy to, among othe things, minimize the social, envionmental and human health impacts of aggegate opeations on Halton's esidents and natual envionment. Incopoating the implementation plan within the site plan unde the Aggegate Resouces Act o as a condition of the license would ensue that the enhancements ae codified in a manne that can then be enfoced. Not including it in this manne means that thee is no legal mechanism to ensue enhancements actually take place. 12. Deletion of the Requiement that Applications be based in Pat on Halton's Aggegate Resouces Refeence Manual Modification: No. 74 (Section 1I0(7.6)(nelVl). The Ministe's Modification No. 74 to Section 110(7.6) has deleted the equiement that a new o expanded application be deemed to be complete based on the Aggegate Resouces Refeence Manual fo Halton. Section 110(3.1) of ROPA 38 diects the Region to pepae an Aggegate Resouce Manual, in consultation and patneship with public agencies, the aggegate industy and citizens goups that contains among othe things, best pactices and potocols on mitigative and estoative measues to minimize the social, envionmental and human health impacts of extactive opeations and infonnation and studies that would assist in the eview of licence applications unde the Aggegate Resouces Act, 1990 and Official Plan Amendments unde the Planning Act, Section 110(7.3) of ROPA 38 equies that an amendment to the Official Plan fo a new o expanded Mineal Resouces Extaction Aea unde the Planning Act, 1990, is deemed to be complete in accodance with Section 187(10) ofthe Plan and the Aggegate Resouces Refeence Manual unde Section 110(3.1). The Aggegate Resouces Refeence Manual fo Halton assists in identifying measues that could minimize the social, envionmental and human health impacts to Halton's esidents and its natual heitage system. 13. Deletion of Refeence to Regional Policies and Standad egading Social, Envionmental and Human Health Impacts Modification: No. 83 (Section No. 1l0(1l) though IlO(l4)).

The. Ministe's Modification No. 83 to Section I to(l1) has deleted the equiement egading RegIonal standads and policies which ensue minimal social, envionmental and human heallh impacts. The impacts associated with the tanspot of aggegate and aggegate poducts ae not solely elated to the tanspotation infastuctue but also include the social, envionmental and human health impacts ceated by this activity. As Halton's esidents ae most impacted by the tanspot of aggegate and elated poduc(s, the Region should have the ability to establish policies and standads that ae intended minimize the social, envionmental and human health impact of the tanspot ofaggegates on its esidents. 14. Deletion of Sections Seeking Geate Regional Paticipation in the Review of Cetain Mineal Resouce Extaction Activities Modification: No. 83 (Section No. 110(11) though 110(14». The Ministe's Modification No. 83, to Sections 110(13) and 110(14), has deleted seveal sections whee the Region is seeking geate paticipation in a numbe of activities including the eview ofsite plans and active licenses and changes to Povincial Legislation and egulations that would allow. among othe things, the delegation to uppe-tie municipalities of the eview and enfocement of site plans and licenses unde the Aggegate Resouces Act, Halton Region is committed to ensuing that aggegate extaction occus in a manne that minimizes social, envionmental and human health impacts and that potects and enhances the functions of the Regional Natual Heitage System duing and afte extaction. As Halton's esidents ae most impacted by mineal esouce extaction activities. RQPA 38 identifies the need fo geate Regional and Local paticipation in cetain mineal aggegate extaction activities to minimize the impact on Halton's esidents and its natual heitage system. As witten, these policies seek geate Regional and Local involvement in the site plan pocess and ensue funding is available fo the implementation of ehabilitative plans and adaptive management plans. Halton Regional Council has aleady expessed its desie to seek the appopiate changes to the Aggegate Resouces Ac, 1990 to become moe involved in the monitoing of aggegate extaction activities ("Adoption of RegionaJ Official Plan Amendment No. 38", Repot LPSI14 09). Council detennination of local policy ought to be eflected in the Boad decision. 15. Change to the Time-F~mefo the use of Adaptive Management Plans

10 Page 10 Modification: No. 80 (Section 110(8.1) and 1I0(8.2)lnew)). The Ministe's Modification No. 80 to Section 110(8.1) and Section 110(8.2) has changed the timefame fo the use of adaptive management plans fom the peiod duing and afte extaction to post-ehabilitation only. Depending on the natue of the opeation, it may he necessay to intoduce these kinds of adaptive management plans as pat of the opeation as the lands afe pogessively ehabilitated. It may also take many yeas befoe the "post-ehabilitation" state is eached. Given these extended time-fames, intoducing these kinds of measues may lead them to being consideed on a pennanent basis. These kinds of plans may be appopiate in the ealy phases ofextaction and should not he elied upon duing the ehabilitation pocess alone. Restoation of the Plan policies efeed to hee, as well as items II to 14 above to the fonn they had befoe modification epesents policies that ae suitable to the paticula cicwnslances of Halton Region and in any event epesent good planning.
