Call to Order Mayor McKenzie called the meeting to order at 7:00 p.m. 2. Confirmation of the Agenda RESOLUTION: 18/18 Moved By: Councillor Bell Seconded By: Councillor Wight That the Council of the Municipality of West Perth accepts the agenda as presented. 3. Disclosure of Pecuniary Interest There were no disclosures of pecuniary interest. 4. Consent Agenda RESOLUTION: 19/18 Moved By: Councillor Vink 1

2 That the Council of the Municipality of West Perth accept Consent Items ( ) for information; with 4.3 being dealt with separately; and That the minutes of the January 8, 2018 and January 15, 2018 Public Meeting and Regular Meetings of Council be adopted. RESOLUTION: 20/18 Moved By: Councillor Burtenshaw Seconded By: Councillor Wight That West Perth Council supports the resolution passed by the Town of Lakeshore of January 16, 2018 that the Government of Canada and the Government of Ontario be urged to allocate a proportionate share of the new tax revenues generated from the sale of marijuana, to municipalities directly. Public meeting/delegation 5.1 Julia Opie - Accessibility Coordinator, County of Perth Joint Accessibility Plan: Annual Status Update, 2017 Julia Opie, Perth County Accessibility Coordinator provided West Perth Council with the Joint Accessibility Plan Annual Status Update for 2017 and the Joint Accessibility Plan. RESOLUTION: 21/18 Moved By: Councillor Herold Seconded By: Councillor Vink That the Municipality of West Perth Council receive the Joint Accessibility Plan: Annual Status Update 2017 report; and That the Municipality of West Perth Council approve the Joint Accessibility Plan: Annual Status Update, 2017; and That staff be directed to post the Joint Accessibility Plan: Annual Status Update, 2017 on the West Perth website Perth County Joint Accessibility Plan RESOLUTION: 22/18 Moved By: Councillor Burtenshaw Seconded By: Councillor Bell That the Municipality of West Perth Council receives the Perth County Joint Accessibility Plan report; and That the Municipality of West Perth Council approves the Perth County Joint Accessibility Plan; and That staff be directed to post the Perth County Joint Accessibility Plan on the West Perth website. 5.2 Mark Swallow - Planner, County of Perth Consent Application File #B57-17 The Estate of Myrtle Walkom Mark Swallow, Perth County Planner reviewed the report dated February 5, The purpose of this application is to sever the irregularly shaped property. Perth County Council adopted the Official Plan Amendment on January 18, 2018 and will come to a future meeting for a Zoning By-law Amendment once a decision has been made on the consent application. 4 That the Municipality of West Perth Council recommends that the County of Perth Land Division Committee approve the Application for Consent to Sever by The Estate of Myrtle Walkom (No. B57/17), East Part of Lot 6, West Mitchell Road Concession, and Part of Lot 24, Concession 7, Fullarton Ward, Municipality of West Perth, subject to the following conditions: 1. That confirmation be received from the Municipality of West Perth that the apportionment schedule for municipal drains in this area be reviewed, and updated (if necessary) to the satisfaction of the municipality and that the owners be responsible for all associated costs; 2. That confirmation be received from the Municipality of West Perth that all taxes have been paid; 3. That confirmation be received from the Municipality of West Perth that all financial requirements have been met (if any); and 4. That confirmation be received from the Municipality of West Perth that an amendment to the Municipality s Zoning By-law has been approved Consent Application File #B Ontario Ltd. & Ontario Ltd. Mark Swallow, Perth County Planner reviewed the report dated February 5, The purposed of this application is to sever the existing farm dwelling which is surplus to the needs to the farm operation. Mr. Swallow noted although the size of the proposed severed lot appears larger than what would be required for residential use, it is to accommodate the appropriate sewage and water services. RESOLUTION: 24/18 Moved By: Councillor Matheson Seconded By: Councillor Trentowsky That the Municipality of West Perth Council recommends that the County of Perth Land Division Committee approve the Application for Consent to Sever by Ontario Ltd. and Ontario Ltd. (No. B62/17), Fullarton Ward, Municipality of West Perth (3393 Road 155), subject to the following conditions: 1. That confirmation be received from the Municipality of West Perth that the apportionment schedule for municipal drains in this area be reviewed, and updated (if necessary) to the satisfaction of the municipality and that the owners be responsible for all associated costs; 2. That confirmation be received from the Municipality of West Perth that all taxes have been paid; 3. That confirmation be received from the Municipality of West Perth that all financial requirements have been met (if any); 4. That confirmation be received from the Municipality of West Perth that an amendment to the Municipality s Zoning By-law has been approved; and 5. That confirmation be received from the County of Perth that the property owners have entered into an agreement with the 4

5 County of Perth to prohibit any new permanent residential dwellings on the remnant farm property. 6. Reports 6.1 Chief Building Official December Permit Summary Report Site Plan Development Review 6.2 Fire Chief This Site Plan Agreement is a condition of sale of the Fullarton property. The owner's intention of use is the same as the current use of the property. Council was informed that the By-law to authorize the Site Plan Agreement is on the Agenda for Council's consideration Fire Protection Agreement with the Township of Perth East December, 2017 Fire Department Activity Report 6.3 Treasurer Recreation Plan Coordinator Position There was debate on whether this decision should be made prior to the 2018 Budget and in absence of several Councillors. Members of Council noted the importance of this position to meet strategic priorities previously set by Council. Councillor Trentowsky requested a recorded vote. RESOLUTION: 25/18 Moved By: Councillor Herold That the Council of the Municipality of West Perth authorizes staff to proceed with implementation of the Recreation Coordinator position. 6 RESOLUTION: 26/18 Moved By: Councillor Vink That the Council of the Municipality of West Perth appoint Councillor Burtenshaw to the Maitland Valley Conservation Authority Board of Directors and the Maitland Source Protection Authority Board for the 2018 term. 7.2 Stratford Perth Residential Hospice RESOLUTION: 27/18 Moved By: Councillor Wight Seconded By: Councillor Burtenshaw That the Council of the Municipality of West Perth approve a request from the Stratford Perth Residential Hospice for in-kind use of Lion's Park and the Pavilion on Sunday, May 6, 2018, for the "Hikes for Hospice" fundraising event. 7.3 Walkom's Valu-mart RESOLUTION: 28/18 Moved By: Councillor Vink Seconded By: Councillor Bell That the Council of the Municipality of West Perth authorizes the extension to the Agreement adopted by By-law ; being a by-law to enter into an agreement between the Municipality of West Perth and Loblaw Properties Limited for the purpose of displaying merchandise; and That the extension of the above noted Agreement be authorized for the period of April 1, 2018 to August 30, 2018 for the area identified as Schedule A in the request dated January 30, Margaret Scherbacth - Grass Cutting by Residents on Conservation Authority Lands CAO Brick informed Council that at this time, property owners are maintaining the property above the Municipality's maintenance standards and if put back into our care the property would receive 2-3 cuttings per year. Mr. Brick suggested that a report from staff be requested prior to setting the level of service as this decision would affect the allocation of resources. RESOLUTION: 29/30 Moved By: Councillor Burtenshaw That the correspondence relating to the grass cutting on Pond Street be referred to the Operations Department for comment. 6

By-laws RESOLUTION: 31/18 Moved By: Councillor Burtenshaw That By-law , being a By-law to provide for the collection of actual costs for the maintenance of the Jacob Municipal Drain Branch ; and That By-law , being a By-law to authorize the sale of surplus land (Logan Property); and That By-law , being a By-law to authorize the sale of surplus land (Hibbert Property); and That By-law , being a By-law to authorize the sale of surplus land (Fullarton Property); and That By-law , being a By-law to authorize the execution of a Site Plan Agreement between the Municipality of West Perth and Koertland Fullarton Inc. Ontario Corporation Number in the Municipality of West Perth in the County of Perth; and That By-law , being a By-law to retain and appoint Aird & Berlis LLP as Integrity Commissioner for the Corporation of the Municipality of West Perth, be read for a first, second and third time and finally passed this 5th day of February,

Confirmatory By-law RESOLUTION: 32/18 Moved By: Councillor Trentowsky Seconded By: Councillor Herold That By-law being a by-law to confirm the proceedings of the Council of the Corporation of the Municipality of West Perth be read a first, second and third time, and finally passed and that the said By-law be signed by the Mayor and the Clerk and sealed with the seal of the Corporation. 15.
