Disclosure of Pecuniary Interest and the General Nature Thereof The Municipal Conflict of Interest Act requires any member of Council declaring a pecuniary interest and the general nature thereof, where the interest of a member of Council has not been disclosed by reason of the member s absence from the meeting, to disclose the interest at the first open meeting attended by the member of Council and otherwise comply with the Act. Report of the Manager of Development Services 4.1 Building Better Communities and Conserving Watershed Act Bill 139 (PLA18-006) Project Update Motion by Staff Recommendation: THAT the report on changes to the Ontario Planning Process from the Building Better Communities and Conserving Watershed Act (Bill 139) being proclaimed April 3, 2018, be received for information. The Manager of Development Services to provide an update on ongoing projects. 6. 3 3 Infrastructure and Development Services Department MANAGEMENT REPORT Date: March 29, 2018 To: Planning and Heritage Sub-Committee From: Jeff Leunissen, Manager of Development Services Report#: PLA Attachments: None Title: Building Better Communities and Conserving Watershed Act Bill 139 Objective: To provide members of Council information on the changes to the planning process as a result of the Building Better Communities and Conserving Watershed Act (Bill 139) being proclaimed April 3, Background: During 2017, the Province indicated it was considering changes to the Planning Act and the Ontario Municipal Board to fulfill the following objectives: Improve the hearing process at the tribunal; Give municipalities greater control over local planning, resulting in fewer decisions being appealed; Shelter major planning decisions from appeal; Support the Province s Climate Action Plan; and Promote mediation and settlement of disputes and reduce adversarial hearings. On December 12, 2017, the Province passed the Building Better Communities and Conserving Watersheds Act (Bill 139) and gave it Royal Assent. It is scheduled to be proclaimed on April 3, The Act will make the following changes to the province s land use planning process: The Ontario Municipal Board (OMB) is to be renamed the Local Planning Appeals Tribunal (LPAT). Establish timelines for hearings. Establish a Local Planning Appeals Support Centre to provide legal and planning support to Ontarians. Limit the Tribunal s ability to overturn municipal decisions that adhere to official plans and provincial plans. Limit appeals to whether a Council Decision is consistent with the official plan, provincial plans. Page 1

4 4 Require municipalities to include provisions dealing with the adequate provision for affordable housing and climate change. Extend the municipality s decision making timeline by 30 days for some applications. For example an Official Plan Amendment could be appealed if Council has not made a decision in 210 days, as opposed to the current timeline of 180 days, and Zoning By-law Amendment Applications could be appealed if Council has not made a decision in 150 days, as opposed to the current timeline of 120 days. Bill 139 also contains provisions on inclusionary zoning. The Province has not indicated these provisions will be proclaimed April 3, The following shows the appeal process with the new Local Planning Appeals Tribunal. Source: Ontario Municipal Board Review: Technical Overview Presentation Analysis: Proclamation of Bill 139 will result in immediate changes to processing planning applications in Ontario. Applications will be evaluated on whether they are consistent with the Provincial Policy Statement (PPS), any Provincial Plans and the municipality s Official Plan as opposed to the current test which centres around good planning. As Stratford is Page 2

5 5 not subject to a Provincial Plan, such as the Growth Plan for the Golden Horseshoe or Greenbelt Plan, provisions requiring consistency with Provincial Plan are not applicable to Stratford. Applicants, City staff and Council will have to demonstrate their application, recommendation, and decision is consistent with the PPS and the City of Stratford Official Plan. The content of Notices circulated to the public and advertised in the Town Crier and the preamble of Public Meetings before Council will have to be changed to reference the Local Planning Tribunal and not the OMB. If an application is appealed, either for lack of a timely decision by Council or because of a decision of Council, the appellants will have to demonstrate their appeal is consistent with the City s Official Plan. All appeals will require a mandatory case conference to scope issues and perhaps settle the matter. At the LPAT hearing, there will be no examination or cross-examination of witnesses and if the LPAT determines a municipal decision is not consistent with the Official Plan, the matter is sent back to the City for reconsideration within 90 days. If Council s decision is appealed a second time, the LPAT can make a final decision. Staff are taking the necessary steps to revise the City s planning process to be consistent with Bill 139 being proclaimed. Financial Impact: It is not possible to predict the financial impact of Bill 139 on the City s land use planning process at this time. 6 6 Heritage Stratford Committee November 14, 2017 Page 1 A meeting of the Heritage Stratford Committee was held on the above date at 7:00 p.m., City Hall Annex (Avon Room), 82 Erie Street, Stratford ON Present: Wayne Graham Chair Presiding, Patrick O Rourke, Dave Gaffney, Pat Bolton, Jacob Vankooten, Nancy Murie, Cambria Ravenhill Staff Present: Rachel Tucker Planner, Casey Riehl Recording Secretary Also Present: *Margaret Erb, *John Erb Absent: Councillor Danielle Ingram, Jeff Leunissen Manager of Development Services, Amanda Langis M I N U T E S 1.0 CALL TO ORDER Wayne Graham called the meeting to order at 7:00 p.m. 2.0 DISCLOSURE OF PECUNIARY INTEREST None declared. 3.0 ADOPTION OF PREVIOUS MINUTES October 4, 2017 Motion by Patrick O Rourke, seconded by Dave Gaffney to adopt the minutes dated October 4, 2017 as printed. Carried. 4.0 BUSINESS ARISING FROM PREVIOUS MINUTES (a) Non-Designated Properties List Pat O Rourke Pat O Rourke reviewed his previously distributed report on the non-designated inventory. Dave Gaffney inquired if being on this list will be voluntary for property owners? Rachel Tucker explained that under the Heritage Act, Stratford is required to keep a registry of all designated properties. If they choose to, they are authorized to keep a list of non-designated properties that Council feels has cultural value or interest. The non-designated list does not require the property owners permission to be on the list, but she suggests that the initial approach of the program should be voluntary. Members agreed that sending out a letter explaining the non-designated inventory to all 250 on

7 7 Heritage Stratford Committee November 14, 2017 Page 2 Margaret Rowell s list would be a wise first step. This way the committee can see what kind of interest they get. Cambria Ravenhill also suggested a letter could be sent to property owners to opt-out of the inventory program. Rachel Tucker proposed inviting property owners to an open house to explain the objective of the program. Ms. Tucker suggested taking the details of the nondesignated inventory list and the steps the committee intends to take to Council prior to any contact with property owners. This way Council can approve and be fully aware of the program prior to hearing about it from property owners. *Margaret Erb and John Erb now present (7:12 p.m.) (b) (c) (d) Heritage Stratford Web Page Update Danielle Ingram Deferred to next meeting. Recognition of Land on the HS Web Page Amanda Langis Deferred to next meeting James Anderson Award Staff previously ed committee members an invitation to attend a James Anderson reception at the Stratford-Perth Museum on Wednesday, November 29, The museum will also post information regarding nominations for the 2017 James Anderson award. There have not been any nominations received to date. 5.0 DESIGNATION UPDATES Stratford Fairgrounds Dave Gaffney reported that he attended the Britannia Street development open house and it appeared that the corner with the gates is part of the development. He voiced his concern to Councillor Henderson and explained that it is well outside the purview of the development. Rachel Tucker received a rezoning application for the Britannia Street housing project. She will circulate it to the permit review sub-committee for comment. She indicated to developers they will have to speak to how they will respect the gates. Ms. Tucker also updated the committee that the Director of Infrastructure & Development Services is close to depositing the reference plan. Pat O Rourke questioned if the HS committee should go ahead and do the reference plan, allowing the designation to move forward. Ms. Tucker will confirm timing with the Director and at the same time inquire what the costs involved are to do the deposit. 6.0 BUILDING DEPARTMENT REPORT (November 2017) Rachel Tucker Rachel Tucker reviewed the recent permit applications received.

8 8 Heritage Stratford Committee November 14, 2017 Page BLUE PLAQUE UPDATE Dave Gaffney reported that the sub-committee met and has three possible locations for blue plaques. They will do some further research and bring recommendations for discussion at the next meeting. 8.0 NEW BUSINESS (a) (b) County of Perth Courthouse/Land Registry/Jail Dave Gaffney discussed with the committee the possibility of designating the courthouse, the old registry office and the jail. Perhaps at the very least, asking the Federal Government to put a designation on the courthouse, similar to Stratford City Hall. Mr. Gaffney will do some research and the committee can discuss further at the next meeting. Lawn Bowling/Badminton Club Margaret Erb Margaret Erb attended the HS meeting to inquire if the committee has received any requests regarding designating the lawn bowling and badminton club property. Wayne Graham stated that to date nothing has come to HS. Rachel Tucker reported that she has been contacted by another citizen inquiring about the designation process. The information may be submitted by the next HS meeting, however she is not sure of what their timelines are. She offered to send Ms. Erb s contact information to this citizen so they could possibly work together. 9.0 NEXT MEETING DATE Thursday, December 12, 2017 at 7:00 p.m. Avon Rm ADJOURNMENT Motion by Dave Gaffney, seconded by Patrick O Rourke to adjourn the meeting.
