1 PURPOSE: Public and privately owned and maintained stormwater conveyance systems collect and transport urban runoff and storm water that may contain certain pollutants. These pollutants may accumulate in the system and must be removed periodically. The systems must also be maintained to function properly hydraulically to avoid flooding. Maintaining the system may involve the following activities: 1. Inspection and Cleaning of Stormwater Conveyance Structures; 2. Controlling Illicit Connections and Discharges; and 3. Controlling Illegal Dumping. The Regional Water Quality Control Board (RWQCB) Municipal Permit requires the City to report maintenance activities and implement minimum BMPs city-wide. In 2004 the City adopted a Water Quality Ordinance that requires the implementation of Minimum Best Management Practices (BMPs). Because HOAs represent a large portion of the city, the RWQCB has requested that the City of Rancho Santa Margarita confirm HOA implementation of the BMPs. This DF-1 HOA fact sheet is the that will be submitted by HOAs to the City Engineer annually, beginning August 2005, to meet the City s reporting requirements under the Municipal NPDES permit, as requested by the RWQCB. 4 2F. Verify that appropriate employees or subcontractors are trained in proper conductance of maintenance activities, including record keeping and disposal. 2G. Annually inspect and clean v-ditches as needed, prior to the wet season. On shrub-covered slopes, vegetative debris may be placed on the downhill side of the ditch. Trash should be bagged and disposed at a landfill. 2H. Street Sweeping for privately owned streets shall be conducted, at a minimum, monthly. Storm Drain Flushing 2I. Flushing of privately owned or maintained storm drains or storm drain inlets should only be done when critically necessary and no other solution is practical. 2J. If possible, the material should be collected (vacuumed), treated with an appropriate filtering device to remove sand and debris and disposed of properly. Waste Management 2K. Store wastes collected from cleaning activities of drainage facilities in appropriate containers or temporary storage sites in a manner that prevents discharge to the storm drain. 2L. Dewater the wastes if necessary with outflow into the sanitary sewer if permitted. Water should be treated with appropriate the filtering device to remove the sand and debris prior to discharge into the sanitary sewer. If discharged into the sanitary sewer is not permitted, water should be pumped or vacuumed to a tank and properly disposed of. 5 3. Controlling Illicit Connections and Discharges 3A. Report prohibited discharges including, but not limited to, trash dumping, paint spills, abandoned oil containers, observed during the course of investigation, containment, and clean up. Report all observed illicit connections and discharges to the 24-hour water pollution problem reporting hotline (714) HOAs are responsible for the clean-up of all privately owned and maintained facilities (Catch basins, storm drains, slopes etc) and/or any facilities the HOA is required to maintain. 3B. Encourage public reporting of improper waste disposal by distributing public education materials and advertising the 24-hour water pollution problem reporting hotline. Storm Drain Stenciling ( No Dumping Drains to Ocean ) 3C. Implement and maintain a storm drain stenciling program to be consistent with City of Rancho Santa Margarita Stencil motif. Training/Education/Outreach 3D. Verify that appropriate employees and subcontractors are trained to recognize and report illegal dumping. 3E. Encourage public reporting of illegal dumping by advertising the 24-hour water pollution problem reporting hotline (714) F. Encourage the distribution of public education materials and advertising the 24- hour water pollution problem reporting hotline. 3G. Verify that contracts approved for work clean-up and/or maintain, enhance or improvements of common areas that the HOA is responsible for, as defined by the CC&Rs, is done in accordance to the City s required minimum BMPs. See attached Exhibit 1 for a list of minimum BMPs. Suggested contract language is provided below for HOA discretional use. Suggested Minimum BMP Requirements Contract Language The San Diego Regional Water Quality Control Board (RWQCB) has issued a Municipal NPDES permit to the City of Rancho Santa Margarita that governs storm water and non-storm water discharges that enter the City s storm drain system. In order to comply with the Permit requirements, the City has adopted required Best Management Practices (BMPs) that parties conducting the activities under this contract must adhere to. These BMPs apply to any party conducting activities identified in Resolution No., Exhibit 1. The BMPs contain pollution prevention and source control techniques to minimize the impact of those activities upon dry-weather urban runoff, storm water runoff, and receiving water quality. Work performed under this CONTRACT shall conform to the Municipal NPDES Permit requirements, any other applicable storm water permit requirements, the City s Ordinances, and adopted required minimum BMPs. The BMPs must be performed as described for all applicable BMPs. The CONTRTACTOR shall fully understand the BMPs applicable to activities that are being conducted under this CONTRACT prior to conducting them and maintain copies of the BMPs throughout the CONTRACT duration. The applicable BMPs are included as Exhibit 1 of this CONTRACT. BMP Fact sheets are available for review at the City. Evaluation of activities subject to BMPs performed under this CONTRACT will be conducted to verify compliance with BMP requirements and may be required through CONTRACTOR self-evaluation as determined by the City. LIMITATIONS: IT IS THE RESPONSIBILITY OF THE HOA TO FOLLOW ALL APPLICABLE REGULATIONS AND OBTAIN ALL PERMITS DURING THE COURSE OF IMPLEMENTING THESE MINIMUM BMPS. Clean-up activities may create a slight disturbance for local aquatic species. Access to private residential property to implement minimum BMPs may be limited by other laws. Trade-offs may exist between channel hydraulics and water quality/riparian habitat. If storm channels or basins are recognized as wetlands, many activities, including maintenance, may be subject to regulation and permitting by other agencies. 9/28/2004 Draft 6 City of Rancho Santa Margarita

These BMPs are required to be implemented as applicable during the course of the HOAs maintenance responsibilities. The HOA certifies that these BMPs have been received and implemented during the course of HOA activities, including those activities that the HOA has contracted out (i.e. landscape maintenance). In addition, the HOA certifies that all employees and contractors have been trained and/or provided these BMPs at least annually or with each new employee or contractor. By signing this annual report, the HOA certifies that the activities checked in Sections 1, 2 and 3 of the annual report, as well as all applicable required minimum BMPs, were implemented for the reporting period of July 1 through June 30, (year).
