5 Hazardous Waste Management Commission Citizen Commission consisting of seven members representing the following sectors Waste Management Industry Waste Generating Industry Petroleum Retail Industry Agriculture Three Public Members No more than three members from one political party Commissioners are appointed by the Governor and approved by the Missouri Senate At present, 2 seats are vacant (both are public seats) All 5 currently serving commissioners are in expired seats

6 Hazardous Waste Management Commission Adopts, modifies and repeals rules and regulations to implement and enforce the Missouri Hazardous Waste Management Law Holds hearings on rules, complaints and permit appeals Issues individual variances Commission meets at least four times a year; usually every other month Department staff report to commission and provide information on program issues

7 Permits Reviews/approves: Applications for Hazardous Waste Management Facility Permits and Resource Recovery Certifications Closure and Post-Closure Plans/Reports Corrective Action Site Investigation and Remediation Work Plans and Reports Performs Independent Groundwater Evaluations at Hazardous Waste Facilities Provides Financial Assurance Oversight

8 Permits Section update Assessing impact of EPA s new STAG formula Could result in reduction of $857,000 in our federal grant funds once phased in This amount represents roughly 8-10 hazardous waste FTE Details later Implementation of No Stricter Than Evaluation of Definition of Solid Waste rule

9 Compliance & Enforcement Takes action to ensure regulated parties comply with Missouri s hazardous waste and underground storage tank (UST) laws and regulations Inspects generators, transporters, permitted facilities, PCB sites and UST systems and oversees corrective actions Implements new hazardous waste and UST rules

10 Compliance & Enforcement Partners with MoDOT on transporter licensing and vehicle safety inspections Reviews hazardous waste manifests Coordinates pesticide education and collection activities Implements Electronic Scrap Management Program Provides technical assistance, regulatory guidance and training on all aspects of hazardous waste and UST issues

11 Superfund Conducts site assessments and investigations of sites where releases of hazardous substances have occurred potentially affecting public health and the environment Provides state involvement and input into the remedial process on National Priorities List (NPL) Sites Oversees the remediation of sites where the state is the lead regulatory agency Maintains the Registry of Abandoned and Uncontrolled Hazardous Waste Sites

12 Superfund NPL Sites Missouri has 33 National Priorities List (NPL) Sites, four of which are federal facilities and 10 which are historic mining sites. Sixteen NPL sites/operable units have been remediated. Fourteen NPL sites are fund lead. Six sites/operable units are under state Operations and Maintenance No Responsible Parties

13 Superfund - State Led Cleanups Superfund Cooperative Program Responsible Party agrees to clean up site under state oversight Currently 13 sites in Cooperative Program Registry Responsible Party/landowner agrees to cleanup in lieu of Registry listing Currently 8 Registry Consent Agreements

14 Superfund section update Completed cleanup of several historic lead mining sites EPA and MDNR working together to remediate mined areas of Madison and St. Francois Counties. Once completed, Natural Resource Damage activities will move forward Other sites include West Ken site and Park Hills residential yard cleanup

15 Federal Facilities Provides oversight and review of investigations, management, and remediation of hazardous substances at current or past federal facilities, including sites with radioactive or unexploded ordnance concerns Implements the radioactive materials shipment statutes for transporting radioactive materials through Missouri

16 Federal Facilities section update Implementation of a new web-based online system that offers shippers and carriers a user friendly portal for entering and tracking shipments and payment information Success stories Facilitating redevelopment of the Bannister Federal Complex/Kansas City Plant Overseeing cleanup of Hematite site in SE MO Assisted in repurposing activities at a former Minuteman II Launch Control Facility

17 Federal Facilities Radioactive Materials Transportation The section is responsible for collecting fees for transporting radioactive materials and waste (Missouri Revised Statute ) Fees are charged for each shipment of: high-level radioactive waste, transuranic radioactive waste, spent nuclear fuel, highway route controlled quantity, or low-level waste

18 Brownfields/Voluntary Cleanup Purpose is to assist parties desiring to voluntarily cleanup properties for redevelopment Conducts site assessments of properties for public entities and not-for-profit organizations Provides state oversight for voluntary cleanups of properties contaminated with hazardous substances Tracks and monitors Long Term Stewardship (LTS) issues at sites not cleaned up to unrestricted use levels Manages the Dry-cleaning Environmental Response Trust (DERT) Fund. DERT Fund expires August 28, 2017

19 B/VCP update LTS mapping tool: Missouri Environmental Site Tracking and Research Tool (E-START) Contains Superfund, B/VCP and other sites where remediation is on-going or completed Petroleum storage tank sites will be added soon Other map enhancements search feature by site name, county and municipal boundaries Links to clean letters and other site documents

20 Tanks Oversees the risk-based remediation of leaking underground storage tank sites and cleanup of above ground storage tank sites Oversees the closure of underground storage tank sites Reviews and follows up on spill reports related to regulated petroleum releases Provides technical assistance and training on tank cleanup issues

21 Tanks Section update Free Product Guidance Document A how to guidance for staff and consultants currently in development. Expected to be finalized by December 2016 Plume Stability Guidance Document A how to guidance for staff and consultants currently in development. This document will be sent to consultants for comments in 2017 Streamlined process for review of restrictive covenants Enhanced Enforcement More timely follow up at tank remediation projects through use of Administrative Orders and meetings with tank owners, consultants, and PSTIF staff to discuss disagreements and provide a path forward or referral to the AGO

22 Budget & Planning Administrative Section of the Program that develops and tracks the program s budget, prepares and administers program grants and cooperative agreements and manages state funds Manages the registration of Hazardous Waste Generators and Underground Storage Tank (UST) Facilities Manages Hazardous Waste and UST Fee Billings and Collections Manages Program files and records Coordinates Human Resource Issues

23 Budget and Planning Update New fee structure begins January 1, 2017 Invoices will go out beginning in November for calendar year 2017 Evaluation of changes to EPA s funding formula
