1 TERMS OF REFERENCE FOR INDIVIDUAL CONSULTANTS/CONTRACTORS (IC) Post Title: Consultancy Services for Detailed Study on uptake of Incandescent bulbs, Compact Fluorescent Lamps and LED lamps in Kenya. Agency/Project Name : Standards and Labelling Programme in Kenya Country of Assignment : Kenya Duty Station : Project Management Unit, NSSF Towers-23 rd Fl, Nairobi Duration : Twenty Five working days within 2 months 1) BACKGROUND The Standards and Labeling Programme is a five year initiative designed to remove barriers to market transformation of energy efficient products and services in Kenya with replication effect to 4 other East African Community (EAC) countries of Burundi, Rwanda, Tanzania and Uganda. The goal of the Programme is to reduce energy (electricity) related carbon dioxide (CO2) emissions in Kenya and the EAC Countries by improving the energy efficiency of selected appliances and equipment in Residential, Commercial and Industrial Sectors. This will be achieved by market transformation towards high-energy efficient appliances through the introduction of Minimum Energy Performance Standards (MEPS) and Energy Efficiency Labels. The main objective of the project is to remove the barriers to rapid and widespread uptake of energy efficient motors in the industrial sector; refrigerators in the residential; display refrigerators in the commercial sector; air-conditioners in the commercial and residential sectors; and lighting in the three sectors. Energy Efficiency Standards & Labeling are highly cost effective means to assist countries reduce energy demand and GHGs while stimulating economic growth. This project seeks to transform the Kenyan electrical equipment and appliances market by providing information that assists consumers to make informed and rational decisions based on life cycle costs rather than initial investment cost of equipment and appliances. Introduction of Minimum Energy Performance Standards (MEPS) will bring about significant improvement by phasing out inefficient electrical appliances and equipment from the market. 1

2 This project is being implemented with budget support from the Global Environment Facility (GEF), the United Nations Development Programme (UNDP) and the Government of Kenya. The UNDP is the GEF Implementing Agency while Ministry of Industrialization and Enterprise Development is the government s lead executing agency. The project is being executed through four principal components: 1. Energy Efficiency awareness Creation, Knowledge build-up and Capacity Building 2. Development and Adoption of Minimum Energy Performance Standards and Labels 3. Conducive Policy and Policy Instruments on Energy Efficiency and Standards and Labeling and 4. Monitoring and Evaluation The project has the following outcomes: i. Selection and Adoption of International Test Procedures, Minimum Energy Performance Standards and Label Classification ii. Development and Implementation of a Verification and Enforcement System iii. Awareness raising campaign for Standards and Labels targeting Distributors, Retailers and End users iv. Development of Voluntary Agreements for Efficient Commercial Display Refrigerators and Hotel Air Conditioners v. Policy Support and Policy Framework vi. Learning and Replication The following products have been selected for intervention under the S & L Programme; (a) (b) (c) (d) (e) (f) (g) Industrial AC Motors (Induction Motors) Domestic Refrigerators Non-ducted Air Conditioners Compact Fluorescent Lamps (CFLs) Ballasted Fluorescent Lamps Ballasts for Fluorescent Lamps Commercial Display Refrigerators Six MEP Standards and Testing Procedures in addition to an Energy Performance Label for the selected appliances have been developed. The regulations to govern these MEPS and Label have been developed through the Energy Regulatory Commission (ERC) and forwarded to the Attorney General Office for review before gazetttment. For lighting appliances. The MEPS only covers the compact fluorescent lamps and ballasts. However there is widespread use of the traditional incandescent bulbs which are highly inefficient. LEDs lamps are gaining popularity as technology improves and the initial cost decreases. 2

3 There is need to determine the uptake of the three different lamp types and reasons for preference for each type. The report will be useful in advocating for increased incentives for uptake of the efficient lamps. This may also make a case for future limitation of importation of inefficient lamps in Kenya. The results will also be used to justify the adoption of the Energy Performance Standards and the related MEPS regulations. In addition, the outcomes of this assignment will in future inform policy development regarding the sale of incandescent bulbs in the country. This assignment will address Outcome (v) highlighted in the Project Outcomes. 2) OBJECTIVES OF THE ASSIGNMENT The objective of this assignment is to study, prepare and deliver a report on the usage and uptake of three different types of light fittings in Kenya. The consultant will also identify barriers to adoption of efficient lighting and propose modalities that could be used to ban incandescent lamps in Kenya. 3) SCOPE OF SERVICES 1. This study shall involve determining the available lighting appliances in use in Kenya focusing on incandescent lamps, Compact Fluorescent lamps and Light Emitting Diodes (LEDs). This should be limited to lamps rated 100W and below 2. Obtain import details and quantities of the above 3 type of lamps. The details will be for the last 3-5 years and estimate the trend of the same over the next five years if there is no intervention to promote higher adoption of energy efficient lamps. These data maybe be obtained from KRA and main dealers and importers. 3. Clearely indicate the average class annual energy consumption of these lamps. 4. Estimate the current energy consumption of each type of light in Kenya. 5. Estimate the energy savings accrued on phasing out energy inefficient lamp with the implementation of the MEPS and Labeling annually over the next five (5) years. 6. Identify the barriers to adoption of energy efficient lights 7. Propose modalities that could be used to phase out the incandescent lamps and increased adoption of efficient lights in Kenya 8. Determine the economic impacts of banning incandescent lamps in Kenya. This can (i) (ii) (iii) be summarized as: Economic benefits of decreasing the cost of modern energy services supply; Environmental benefits of reduced carbon emissions; Poverty reduction benefits of decreasing the electricity bill of households/industries with the appliances 9. Deliver the Study results at a validation workshop in Nairobi. 3

4 4) DURATION OF ASSIGNMENT, DUTY STATION AND EXPECTED PLACES OF TRAVEL The duration of this assignment shall not exceed twenty five work days spread over a period of 3 (three) months. The Consultant is expected to work from Kenya and venue of the Stakeholder validation workshop will be Nairobi. The programme will handle all the logistics of the workshop venue including selection, invitation and venue management. Where applicable, UN Daily Subsistence Allowance (DSA) Rates for towns outside Nairobi shall apply. 5) DELIVERABLES The main output of this consultancy assignment will be as outlined below; i. Prepare a report on the expected energy savings in Kenya as defined in the scope (Section 3). The report should also indicate the expected carbon dioxide emission reductions by transistion from incadscent bulbs to CFLs/LEDs. ii. iii. iv. Prepare a detailed inventory, including rated energy consumption, of lighting lamps (incadscent lamps, CFLs and LEDs) imported into and /or manufacture in Kenya for the last 3-5 years. Prepare a detailed report on expected economic, social, and environmental impacts of implementing the MEPS and the regulations for CFLs Prepare a comprehensive report with the findings covering 1-8 in the Scope of services v. Present the findings in a Stakeholders Workshop 6) PROVISION OF MONITORING AND PROGRESS CONTROLS The consultant will work under the direction of the National Project Manager in collaboration with the Energy Regulatory Commission and Ministry of Energy and Petroleum. 7) DEGREE OF EXPERTISE AND QUALIFICATIONS Qualifications: i. Having a Masters or Doctorate degree in engineering, economics or other scientific/technical field with relevance to energy efficiency; ii. iii. Expertise and / or professional experience in Energy field; Research Methods and /or Monitoring and Evaluation Techniques. More than eight years of experience as a technical expert or implementer on standard and labeling processes, technical content, implementation and related issues; 4

5 iv. Having good knowledge of practical experiences of EES&L development, implementation & enforcement in the region; v. Having a Certification in Energy Management will be an added advantage vi. Outstanding speaking, reading and writing skills in English. In addition, the consultant needs to have good knowledge and Professional experience in the industrial sectors, preferably in Kenya. LANGUAGE All the deliverables shall be in English language. Therefore, excellent English communication skills (oral, written and presentation) are essential for this assignment. 8) TIMING The assignment is expected to commence on 23 rd March Specific dates will be agreed with the consultants 9) PAYMENT TERMS Schedule of payments and amount Outputs 20% Acceptance of work plan and inception report if applicable 30% On submission of Draft Report and presentation in a validation workshop 50% On acceptance of the final report by S&L PMU/ UNDP 5
