2 2. DISCUSSIONS NO ITEM OWNER 2.1 Welcome and Introduction MB (NEC) Welcome by Councillor Kent Nyamade Introductions by NEC and Eskom. Attendees agreed to the method. by ZR Attendance register (DLM) The attendance register was circulated and signed. 2.2 Purpose of Meeting To provide an introduction to the process of applying for postponement from Minimum Emission Standards (MES) NEC has been appointed by Eskom as the independent consultant to facilitate the process of applying for postponement from the MES The Public Participation Process (PPP) is an important part of the application process; hence this meeting provides opportunity for interested and affected parties (I&APs) to raise any issues of concern regarding the application and the planned approach. NEC will record the issues or concerns and consider such in the application process It does not relate to any opportunities for jobs nor closure of power stations. MB (NEC) Sesotho translation by ZR (DLM) 2.3 Presentation on Application for Postponement from the MES The MES as promulgated under the National Environmental Management Air Quality Act (NAQA) outline specific limits for power stations, with which Eskom s coal and liquid fuel fired power stations must comply. The MES has two compliance timeframes namely existing plant standards which came into effect from 1 April 2015 and more stringent new plant standards which will come into effect from 1 April Eskom faces technical plant challenges to comply with the MES with respect to the MES compliance timeframes. In 2014 Eskom applied for postponements from compliance timeframes for 16 of its power stations for Particulate Matter [PM], sulphur dioxide [SO 2 ] and nitrogen oxides [NOx]) from the 2015 existing plant limits. The Department of Environmental Affairs (DEA) granted 5 year postponements for most stations, a time that is in line with the provisions of the MES processes. The technical plant challenges faced by Eskom, as indicated in the 2014 application, still remain. Eskom seeks to apply for further postponement of the MES compliance time frames for 14 of its fleet of power stations for the primary pollutants PM, SO 2 and NOx. Through this process, Eskom will submit postponement applications for these 14 power stations to the National Air Quality Officer (NAQO) at DEA by 31 March A postponement application is subject to justification for the postponement, Atmospheric Impact Report (AIR) and a PPP. MB (NEC) Sesotho translation by ZR (DLM) It is compulsory for an independent consultant to conduct an AIR as part of the application for postponement from the MES. The decision makers need to understand what the implication of granting postponement from the MES will have on the ambient air quality. NEC was appointed to conduct the independent studies. Power stations applying for postponement are mostly located in the Mpumalanga Highveld, with a few at different provinces. Grootvlei power station falls within this region and is the subject of this particular public meeting. MB illustrated the location of the 14 power stations by means of an aerial map. 2

3 NO ITEM OWNER 2.4 Motivation for Postponement The postponement application is conducted under the provisions of the MES, which make provision for Eskom to apply for postponement from the compliance timeframes. The MES allow for a period of 5 years for any postponement granted. It was reiterated that Eskom applied in 2014, for postponement for 16 of its power stations which was awarded. The challenges faced by Eskom in the 2014 application still remain, since Eskom had provided that the applications seeked postponement until the retrofit programme was complete. Since the 5- eyar period of the previous postponement approval will expire Eskom are applying for another 5 year postponement. TB stated the MES for coal fired power plants and for liquid fired power plants. Eskom s existing power stations, except for Medupi and Kusile, were not designed to meet the MES since they were constructed before the promulgation of the MES. To comply with the MES Eskom needs to undertake retrofitting of the power stations. Retrofitting is a lengthy and expensive process. Grootvlei power station complies with the 2015 existing plant MES for PM, SO2 and NOx. The station has recently installed a Fabric Filter Plant (FFP) which allows the station to comply with the 2020 new plant limits for PM as well. Yet the station will not be able to comply with the 2020 new plant limits for SO 2 and NOx. Eskom will apply for postponement for stations that mostly comply with the existing plant limits but face challenges to achieve the compliance timeframe for new plant limits. Eskom faces challenges with respect to installation of SO 2 abatement technology due to its requirements for high volumes of water and production of additional waste streams created by its operations. Also to abate NOx, Eskom needs to install Low NOx Burners (LNB). Extending the challenge is the need to implement the expensive abatement in a short period of time. Eskom s emissions have marginal impacts on ambient air quality. To manage the emissions challenges, Eskom targets the highest polluting power stations for installation of abatement technology. Eskom will apply for postponement for: Stations which will mostly be able to comply with the existing MES, and in some cases, with the new plant MES, however, not within the legislated timeframes. Stations which are unable to comply with the new plant MES for SO 2. Some of its older fleet, which will be decommissioned within the next 12 years, where, if the retrofit were to be applied, it would only operate for a few years post-retrofit, before the power station is shut down, according to its 50-year life expectancy. TB presented Eskom s updated Emission Reduction Plan. An Emission Reduction Plan has been proposed for deployment as a means of driving compliance. Focusing on Grootvlei power station, the plan shows that FFP technology has already been installed at the power station to abate PM. The plan further indicates when the power station will reach its 50 year life expectancy. In 2014 Eskom made commitments to retrofit power stations but have experienced some delays in its implementation. Nonetheless, some of the power stations have already been retrofitted, such as Grootvlei. TB presented an overview of Eskom s application for postponement for the respective power stations. It was highlighted that the application for postponement for Grootvlei will be made in terms of primary pollutants NOx and SO 2. TB (Eskom) presented in Xhosa 3

4 NO ITEM OWNER Eskom is not applying to emit higher emission levels, but to continue operating at its current levels until able to complete its Emission Reduction Plan. Independent specialists, NEC, were appointed to assess impacts on the ambient air quality -, health implications for the public, as well as the cost benefit analysis for respective power stations which are applying for postponement of the MES compliance timeframes All stakeholders are invited to form part of the application process through public engagement. Air Quality Impact Assessment Report (AIR) and Cost Benefit Analysis (CBA) MB explained this was already touched on in the purpose for the meeting and background to the postponement application The AIR will include the assessment of the impacts on the environment, and human health. It will include a CBA which will explain the human health cost to which the public would be exposed to as a result of postponement from the MES. Reference was made to the stack of a power station where emissions are emitted and also the cooling towers which emit water vapour. Reference was made to communities who live and work close to power stations. MB presented the basic principles of power generation at coal fired power stations. A power station consists out of six generating units. It was highlighted that power stations do have installed technology for reducing emissions, e.g. for electrostatic precipitators (ESP) installed for PM emissions. MB explained the AIR will be based on a dispersion model, simulating the emissions from the power stations, to determine the impact on the ambient air quality and peoples exposure thereto. It was stated the model will be informed by data retrieved from ambient air quality monitoring stations set up in areas of power stations to allow NEC to verify the accuracy of the model. The dispersion model will model three scenarios the worst case scenario, the actual emissions from stations and then the actual MES to indicate the effect on the ambient air quality if there actually were compliance with the MES. These are the three modeling scenarios which will go into the AIR and be used as part of the application. Eskom is compelled to apply for a worst case scenario limit which it would not exceed under any circumstances and over three operating years. MB (NEC) Based on the graph it is evident that Eskom operates way below the worst case limit. NEC is still busy preparing the specialist studies and will make them available for public review and comment in November The outcomes of the studies will be communicated through a 2nd round of public engagement Public Participation Process (PPP) OWNER MB from NEC introduced and discussed the PPP approach for the project In summary the bulk of the stations are located in the Mpumalanga Highveld and Vaal Triangle. Only two stations are located in the Cape Region. Two rounds of public engagement have been scheduled for the project. The 1 st round seeks to announce the project and present the BID at several public meetings, such as at Thabakgoadi Community Hall. All comments received during the 1 st round of engagement will be recorded in an Issues and Response Report (IRR) and responses provided thereto will be included in the IRR. The 2 nd round will see the motivation for application for postponement, the AIR, CBA and PPP Report being placed in the public MB (NEC) Sesotho translation by ZR (DLM) 4

5 NO ITEM OWNER domain for comment. The outcome of the assessment will also be presented at a series of public meetings, to be scheduled closer to the time. MB detailed the PPP approach and specified the newspapers used to announce the project, libraries/venues where the BID was placed for public review and elaborated on the venues selected for public meetings for the 1 st Round of public engagement. Details on the method to announce the project and 1 st round of public meetings were provided. It was highlighted that the advertisement for Grootvlei power station was published in several newspapers namely Beeld, Daily Sun, Heidelberg/Nigel Heraut. The Background Information Document (BID) is available at various public venues in the area, namely, Grootvlei Mine Town -, Greylingstad- and Balfour Ward 3 Library for review and comment. Two public meetings are held in the area relevant to Grootvlei power station which includes the meeting at Siyathemba Community Hall in Balfour and Thabakgoadi Community Hall at Grootvlei on 21 August DISCUSSION SESSION Response For recording purposes attendees were requested to state their name before raising an issue. NEC is still busy conducting their impact assessments, which include health and cost-benefit analyses Thank you Eskom for explaining the postponement application process to us. How will this postponement application affect us as a community? NEC will consider the impact from the three primary pollutants on the ambient air quality and potential health risk to people surrounding the power station. Naledzi will conduct this health risk analysis independently How can we obtain more information regarding the project in the future? How will we as a community benefit from this project? The outcome of the investigation will be available during the 2 nd round of public engagement for public review and comment. MB (NEC) NEC will notify the public through newspaper advertisements, site notices in the local area. We will place project documentation again at the Grootvlei Mine Town Library. The information will also be placed on the NEC website. We will also notify the Speaker s Office of DLM and the Councillor of the availability of the outcome of the studies in the 2 nd round of public engagement. Another public meeting will be held in the area to communicate the outcome of the assessments with the community. TB (Eskom) Through this application process, Eskom is not requesting to emit more 5

6 NO ITEM OWNER than what it is currently emitting, they are only applying for postponement since they cannot reduce the emission levels according to the 2020 MES. Therefore, Eskom is applying to retain its licence to operate as it currently does. The process does not include job opportunities, as there are no activities that open those, in the postponement application process. This said, cognizance should be given to the fact that Grootvlei power station employs some members of the community, and families are benefiting through such employments. Failure to secure the licence to operate would render Grootvlei to be unable to operate, and such would affect the opportunities currently being enjoyed Philemon Tshabalala Please just clarify for us the laws relating to the emissions around the compliance timeframe of 2015 and TB (Eskom) The MES has two compliance timeframes namely existing plant standards which came into effect on 1 April 2015, Grootvlei complies with the existing limits; and there are more stringent new plant standards which will come into effect from 1 April Grootvlei will have a challenge complying with SO 2 and NOx for the 2020 limits Is Grootvlei affected by this application or the other power stations? Will the NOx and SO 2 emissions be eliminated completely? That means that by 1 April 2020 all Eskom s existing and new power stations, including Grootvlei must comply with the more stringent emission limits. TB (Eskom) Grootvlei power station will also seek postponement from the 2020 new plant MES compliance timeframes for SO 2 and NOx. TB (Eskom) No. Eskom faces challenges to abate SO 2 levels due to its requirement for high volumes of water and the additional waste stream created by its operation. Also to abate NOx, Eskom needs to install of Low NOx Burners (LNB). Grootvlei has not been targeted for retrofits to reduce SO 2 and NOx. Hence Grootvlei will seek postponement from the MES compliance timeframe. 2.8 Closure OWNER MB indicated the way forward and closed the meeting. MB (NEC) 6

37 Minimum Emission Standards (MES) Eskom s MES Postponement applications 2018/2019 The MES have two compliance timelines : 1) 01 April 2015: Compliance with existing plant standards 2) 01 April 2020: Compliance with new plant standards The MES makes provision for postponement of emission limits and timeframes for compliance with the limits. The postponement is granted for a period of up to 5-years per application. Stations which are unable to comply with the new plant MES for SO 2 Some of its older fleet, which will be decommissioned within the next 12 years, where, if the retrofit were to be applied, it would only operate for a few years post-retrofit, before the power station is shut down according to its 50-year life expectancy.
