The appicant is presenty requesting a modification of the existing permit in order to authorize an expansion of the existing deveopment, within the southern portion of the project property, which wi resut in additiona impacts to streams and wetands not currenty authorized under the permit. The U.S. Army Corps of Engineers issued a permit for a commercia deveopment on the subject property on August 22, 2008, the authorization for which expired on March 20, The origina authorized site deveopment pan resuted in adverse impacts to a jurisdictiona wetands/waters on the project property. No site construction activities were conducted in conjunction with this permit. Subsequenty, permit authorization for a commercia deveopment on the project site, based on a revised site pan, was issued to a new Permittee on October 2, 2014, the authorization for which wi expire on September 30, The existing vaid permit authorization was then transferred to the current appicant on June 17, The current permit authorizes adverse impacts to 1,661 inear feet of intermittent stream and 0.79-acre of wetands based on the encosed Site Layout Pan, which argey avoids impacts to jurisdictiona wetands/waters within the southern portion of the project property. Of these authorized impacts, the new Permittee has yet to compete a portion of project construction resuting in adverse impacts to inear feet of stream and 0.66 acre of wetands. A compensatory mitigation required under the existing permit was previousy purchased on December 15, As depicted in the encosed, revised site pan drawings for the proposed expansion, the project wi resut in additiona impacts to 907 inear feet of stream and 0.09-acre of wetand. The appicant proposes to compensate for additiona project impacts to waters/wetands through a purchase of 4,988.5 stream and 0.63 wetand mitigation credits from an approved mitigation bank(s) servicing the project within its primary service area. The configuration of the overa deveopment has aso been revised; however the fied footprint of competed work in jurisdictiona waters remains consistent with the existing permit. The project boundaries within the northeastern portion of the property have aso been modified, whoy within existing upands and outside of the jurisdiction of the U.S. Army Corps of Engineers. The revised Site Pan aso incorporates three stormwater detention faciities, two of which contain forebays and infitration basins retrofitted to meet requirements of the Draft Etowah River Habitat Conservation Pan - Runoff Limits Manua, as recommended by the U.S. Fish and Widife Service. The third detention faciity, ocated within the Chattahoochee River Basin, is a wet extended detention basin designed to provide water quaity, channe protection, and fow contros. n addition, the appicant has incorporated smaer bio-retention basins to provide additiona water quaity pretreatment, as we as create a treatment train for initia interception of stormwater runoff 2

3 from portions of the parking ot area. Runoff and overfow from bio-retention areas wi be discharged into the arger infitration areas, ocated within the detention ponds, where it wi remain unti the capacity of the infitration area is reached. From this point, stormwater wi discharge into a forebay and then be discharged from the stormwater management system(s) at rates we beow that of the pre-deveoped runoff rate. The appicant beieves that the proposed treatment train, combined with onsite discharge above the existing pond, wi protect off-site receiving waters from potentia sedimentation and increased surface runoff voume. STATE OF GEORGA Water Quaity Certification: On June 16, 2014, the Georgia Department of Natura Resources, Environmenta Protection Division (GAEPD) issued a certification under Section 401 of the Cean Water Act, required for a Federa Permit to conduct activity in, on, or adjacent to the waters of the State of Georgia. Based on the modification of the project, as proposed, GAEPD wi determine if a reissuance of the certification may be required. State-owned Property and Resources: The appicant may aso require assent from the State of Georgia, which may be in the form of a icense, easement, ease, permit or other appropriate instrument. U.S. ARMY CORPS OF ENGNEERS The Savannah District must consider the purpose and the impacts of the appicant's proposed work, prior to a decision on issuance of a Department of the Army Permit. Cutura Resources Assessment: Review of the atest pubished version of the Nationa Register of Historic Paces indicates that no registered properties or properties isted as eigibe for incusion are ocated at the site or in the area affected by the proposed work. Presenty unknown archaeoogica, scientific, prehistorica or historica data may be ocated at the site and coud be affected by the proposed work. By etter dated October 19, 2007, the Georgia Department of Resources, Historic Preservation Division issued a no effects determination for historic and/or archeoogica resources in association with project construction under the prior authorization. Endangered Species: Pursuant to Section 7(c) of the Endangered Species Act of 1973, as amended (16 U.S.C et seq.), we request information from the U.S. Department of the nterior, Fish and Widife Service, the U.S. Department of Commerce, the Nationa Oceanic and Atmospheric Administration, and the Nationa Marine Fisheries Service; or, any other interested party, on whether any species isted or proposed for isting may be present in the area. 3

4 Pubic nterest Review: The decision whether to issue a permit wi be based on an evauation of the probabe impact incuding cumuative impacts of the proposed activity on the pubic interest. That decision wi refect the nationa concern for both protection and utiization of important resources. The benefit, which reasonaby may be expected to accrue from the proposa, must be baanced against its reasonaby foreseeabe detriments. A factors, which may be reevant to the proposa wi be considered incuding the cumuative effects thereof; among those are conservation, economics, aesthetics, genera environmenta concerns, wetands, historic properties, fish and widife vaues, food hazards, food pain vaues, and use, navigation, shoreine erosion and accretion, recreation, water suppy and conservation, water quaity, energy needs, safety, food and fiber production, minera needs, considerations of property ownership and in genera, the needs and wefare of the peope. Consideration of Pubic Comments: The U.S. Army Corps of Engineers is soiciting comments from the pubic; federa, state, and oca agencies and officias; Native American Tribes; and other interested parties in order to consider and evauate the impacts of this proposed activity. Any comments received wi be considered by the U.S. Army Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposa. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quaity, genera environmenta effects, and the other pubic interest factors isted above. Comments are used in the preparation of an Environmenta Assessment and/or an Environmenta mpact Statement pursuant to the Nationa Environmenta Poicy Act. Comments are aso used to determine the need for a pubic hearing and to determine the overa pubic interest of the proposed activity. Appication of Section 404(b)(1) Guideines: The proposed activity invoves the discharge of dredged or fi materia into the waters of the United States. The Savannah District's evauation of the impact of the activity on the pubic interest wi incude appication of the guideines promugated by the Administrator, Environmenta Protection Agency, under the authority of Section 404(b)(1) of the Cean Water Act. As the current proposa represents a modification of a vaid permit authorization, evauation of compiance with the guideines wi refect the nature and scope of the proposed work on the project site. Pubic Hearing: Any person may request, in writing, within the comment period specified in this notice, that a pubic hearing be hed to consider this appication for a Department of the Army permit. Requests for pubic hearings sha state, with particuarity, the reasons for requesting a pubic hearing. The decision whether to hod a pubic hearing is at the discretion of the District Engineer, or his designated appointee, based on the need for additiona substantia information necessary in evauating the proposed project. 4
