5 EXECUTIVE SUMMARY Project Northern Power Transmission Expansion Sector represents a 5-year time slice of Electricity of Viet Nam s (EVN) transmission expansion program, covering 500kV and 220kV transmission lines, and associated substations. The project covers the northern part of Viet Nam which is relatively poor. The project will enable power to be supplied to the planned industrial zones in the region, thereby facilitating employment and income generating opportunities. Thus it will benefit the poor and ethnic minorities living in the project area. To utilize the loan savings the EVN with agreement of ADB has decided to add 3 more subprojects into the Loan 2225-VIE namely Kim Dong 220kV s/s, Hai Duong KV s/s and Thuong Tin-Kim Dong 220kV T/L. As such, in the VIE-2225 framework, there are 12 subprojects namely (i) Son La Hoa Binh Nho Quan 500kVTransmission Line, (ii) 220kV Thanh Hoa Vinh T/L; (iii) Son La - Hiep Hoa 500 kv Transmission Line; (iv) Expansion of 500kV Thuong Tin; (v)extension 220kV Van Tri Substation; (vi)hiep Hoa 500 kv substation; (vii) 220kV Bim Son substation; (viii) 220kV Tuyen Quang substation; (ix) Extension 500kV Nho Quan substation 2nd transformer; (x) Kim Dong 220kV s/s; (xi) Thuong Tin-Kim Dong 220kV T/L; and (xii)hai Duong KV s/s. Due to the changes of subproject s list and other issues during the project implementing, it is needed to have corrective action plan to meet the ADB environmental safeguard compliance requirement. To assist in achieving environmental safeguard compliance NPPMB proposes to engage local implementation consultant (LIC)- environment in a lump-sum contract for 22 months, starting from March,2012. As such, on behalf of NPPB, LIC has provided support to VICA consultant to ensure the environmental compliance of the whole VIE-2225 project to ADB SPS 2009 and environmental regulation of the Government. From 2012 to 2014, 6 semiannual environmental reports were prepared by LIC with consultation with VICA, NPPMP, CMC, contractors and local communities. Subsequently, these reports were also revised further with constructive comments of ADB Senior Safeguard Specialist (Environment) and were disclosed in the ADB website in conformity with the ADB s public communication policy As of December 2014, 12 out of 12 subprojects have been basically completed. Based on results of the environmental spot check monitoring previously, it was observed that there have not been any significant environmental issues. Most of environmental impacts are only localized, reversible and mostly associated with small civil work during the construction time. The contractors have been complied with the environmental safeguard requirements. However, the safety and environmental sanitation on the construction sites are also the challenges in some subprojects. NPPMB with supported by LIC has strengthen its management role to push the contractor to improve the safety and environmental sanitation This Post Evaluation Report is the final report which taking stoke the environmental compliance of the subprojects during the implementation period. 6 1. OVERVIEW 1. Project Northern Power Transmission expansion sector represents a 5-year time slice of Electricity of Viet Nam s (EVN) transmission expansion program, covering 500kV and 220kV transmission lines, and associated substations. The project covers the northern part of Viet Nam which is relatively poor. The project will enable power to be supplied to the planned industrial zones in the region, thereby facilitating employment and income generating opportunities. Thus it will benefit the poor and ethnic minorities living in the project area. The project will also create the potential for power interconnection between Vietnam and the People s Republic of China. 2. The Project is to (i) strengthen the northern transmission network to improve system s reliability and quality of supply, (ii) facilitate power transmission by removing transmission bottlenecks, (iii) reduce transmission losses, and (iv) facilitate efficient utilization of existing and planned power plants. 3. The Project was approved on 21 December 2005, the Loan Agreements were signed on 22 August 2006 and declared effective on 24 November 2006 for a total loan amount of $360 million. Original loan closing date was 31 December 2010 and extended on a one-time basis to 31 December Under the Project, nine subprojects comprising three core subprojects, three non-core subprojects and three replacement subprojects have been implemented in Northern Viet Nam. The three core subprojects are: (i) 500 kv Son La- Hoa Binh and Son La - Nho Quan transmission line, (ii) 220 kv Thanh Hoa-Nghi Son-Vinh transmission line, and (iii) extension of Van Tri 220 kv substation. Three noncore subprojects are: i) Son La - Hiep Hoa transmission line; (ii) expansion of Thuong Tin 500 kv substation; and (iii) Hiep Hoa 500 kv new substation. Three subprojects which replaced originally proposed Ha Tinh-Thach Khe and Quang Ninh - Mong Duong transmission lines are: (i) expansion of the Nho Quan 500 kv substation (2nd transformer), (ii) Tuyen Quang 220 kv new substation and (iii) Bim Son 220 kv new substation. The above three replacement subprojects were decided based on the priority electricity supply requirements. 5. Three additional subprojects have been proposed for implementation utilizing the loan savings of about $29 million. The proposed new projects are: (i) Hai Duong 220 kv new substation; (ii) Kim Dong 220 kv new substation; and (iii) Thuong Tin - Kim Dong 220 kv transmission line. 6. As such, in the VIE-2225 framework, there are 12 subprojects namely (i) Son La Hoa Binh Nho Quan 500kVTransmission Line, (ii) 220kV Thanh Hoa Vinh T/L; (iii) Son La - Hiep Hoa 500 kv Transmission Line; (iv) Expansion of 500kV Thuong Tin; (v) Extension 220kV Van Tri Substation; (vi)hiep Hoa 500 kv substation; (vii) 220kV Bim Son substation; (viii) 220kV Tuyen Quang substation; (ix) Extension 500kV Nho Quan substation 2nd transformer; (x) Kim Dong 220kV s/s; (xi) Thuong Tin-Kim Dong 220kV T/L; and (xii) Hai Duong KV s/s. The substations and transmission line under this project is presented in Figure 1 7. NPPMB and CPPMB are two implementing units. Out of the nine approved subprojects, NPPBM is implementing eight subprojects and CPPMB is implementing one subproject which is Hiep Hoa 500 kv new substation. 8. In the implementation progress, International and domestic experts have been assisting NPPMB and CPPMB in environmental management planning and implementation of resettlement plans. 9. VICA Consultants International Company Ltd. (VICA) has been engaged by NPPBM since February 2010 to provide services in preparation of safeguards (environment and resettlement) documents. VICA will also help NPPMB to supervise the environmental compliance of subprojects during the construction and operation until the end of Post Evaluation Report-Environmental Monitoring-Dec 2015 Page 5

7 10. To further assist NPPMB to monitor the safeguard compliance during the project implementation the local implementation consultant (LIC)- environment has been engaged in a lump-sum contract for 22 months, starting from March, Post Evaluation Report-Environmental Monitoring-Dec 2015 Page 6

9 12. Due to the delay in subproject construction, the ADB and NPPMB have decided to extend the LIC s contract 6 months without change of contract amount. As such, the LIC will have to provide support to NPPMB until by the end of June As of December , of 12 subprojects of the VIE 2225 LOAN have been basically completed. 2. COMPLIANCE WITH ADB LOAN COVERNANTS AND APPLICABLE LAWS, REGULATION AND REQUIREMENT 14. The subproject shall be complied with ADB safeguard requirements, Vietnam laws and regulations including Vietnam s obligations under international law. 15. The Table 1 presents the Laws and regulations which the subproject shall be complied. 11 Quarterly and semiannual environmental reports were prepared by NPPMB with support from LIC. All semi-annual reports including any safety breaches, violation of environmental standards and corrective measures taken have prepared, submitted, cleared by ADB and disclosed in ADB web sites 17. The environmental management and reporting system under the project has been significantly strengthened during the implementation. In particular, the NPPMB has issued the letter No 1948/AMB-P2 dated May 16th 2013 (Annex 2) to request all contractors would have to report the environmental safeguards compliance under each contractor scope of work. To help the contractor could properly prepare the environmental compliance report, the LIC has prepared the outline of the report as well as the environmental monitoring form and provided all these supporting document to all contractors (Annex 3). As a result, the environmental compliance reports prepared by contractors have been submitted in the timely manner with better quality. 18. The subproject compliance with the Vietnam regulations on environmental protection is presented in the Table 3 Table 3: Compliance with Vietnam regulations on environmental protection. Mitigation measures were conducted by the Contractor in construction phase 19. The status of subprojects and Environmental safeguard monitoring activities has been briefly presented in the Table 4. This is one of three core subprojects. The sub project is a 240 km 500 kv line that will pass through the provinces of Son La, Hoa Binh and Ninh Binh provinces, and 11 districts and 36 communes. This sub-project is comprised of construction and installation of; (i) 269 km of double circuit 500kV transmission line and associated composite optical fiber earth. 21. The transmission line was fully energized in November 2010 and has been transported power from Son La hydropower since December Environmental Compliance Findings 22. During the construction phase, It is found that there are no any environmental issues during the operation of the subproject. It is also reported by the local resident living along the ROW of the subproject that there is not any significant impact of electromagnetic field during the operation of the subprojects. 24. As regulated in IEE, EMF should be measured yearly at least. For Son La Hoa Binh Nho Quan 500kV transmission line, only Tay Bac Transmission Unit has carried out electromagnetic field measurement at two locations out of the ROWs, closed to residential area at tower No.95 Post Evaluation Report-Environmental Monitoring-Dec 2015 Page 15

17 and 96 Na Bo commune, Mai Son district, Son La province. As soon as operation, NPPMB cooperated with many relevant stakeholders including DPCs, CPCs, operation units at project sites to measure EMF at households closest to the ROW. According to the regulation at Article 1 (4.2.a) of Decree No. 81/2009/ND-CP dated 12/10/2009 by the Government on some amended articles of Decree No. 106/2005/ND-CP dated 17/8/2005 by the Government stipulating the detail regulation and guideline of some articles of Electricity Law on safety protection for high voltage grid. The results compared with the current regulation showed that all meet the standard and as the previous results measured with the consultant team in Jul In the next phase, transmission line operation unit need to continue measure electromagnetic field to monitor and ensure safety for local people kV Son La - Hiep Hoa Transmission Line Background 26. The total length of Son La-Hiep Hoa T/L was 268,47km. The ROW of the T/L was determined in the Decree No. 106/2005/NĐ-CP and for 500 kv transmission line which was delimited by two vertical planes in parallel to the line on two sides and the distance from the planes to the nearest wire was 7m. The average width of the ROW was 30,45m. The starting point of Son La Hiep Hoa 500kV T/L was the Son La 500KV substation and the ending point was Hiep Hoa 500KV substation. 18 Environmental Compliance Findings 27. The transmission line has been put in operation since March 31, This subproject has been monitored during the years since 2010 by VICA and by LIC since LIC has undertaken the spot check supervision to some sites of subproject until to December Being stick to the objectives of the monitoring, most of the visited sites are sensitive areas like road crossing, river, worker camp, and material storing locations. 28. It is found that there have been no major environmental issues during the construction of the subproject. The ROW has been cleared in a monthly basis whereas the tree outside of the ROW has not been cleared in most of visited site; (v) warning, danger signs, name board of tower and ground wire have been installed but still not enough; (vi) Worker have been equipped with protection suites and first aid has also been provided; (vii) it is observed that the electromagnetic field is under the permissible standard that make safe environment for people living. EMF has been measured many times by power transmission branches up to the monitoring time during the operation phase. The EMF has been monitored at some locations closed to residential area and the ROW and locations which are lie inside the ROW in June 2012 Table 7. 19 Thus, working condition under the ROW and living condition nearby the ROW are safety in term of electrical field intensity. 29. Regarding the Phu Ninh resettlement site in Phu Loc commune, Phu Ninh province, Phu Tho province where would be the resettlement site for 18 households. Currently, some househoulds have moved to the sites and built their new houses there. The site has located in the hilly area where there would be potential risk of landslide if the embankment had not been strengthen and reinforced. In this regard, the embarkment should be stablized by structure or nonstructure reinforecement (by ventive named Chrysopogon zizanioides). NPT/NPPMB has coordinated with DCRB to study options to protect slope against erosion and implement these protective measures (Letter No 3861/EVN NTP-QLX dated 8/9/2015) kV Hiep Hoa Substation Background 30. CPPMB is implementing only Hiep Hoa 500 kv substation project. The substation is to be fed by Son La hydropower station through 300 km long 500 kv transmission line. Two of the three 500 kv power transformers of Hiep Hoa substation were commissioned on 17 December 2011 and third unit was commissioned on 27 March Environmental Compliance Findings 31. During construction and operation it was observed there were insignificant environmental issues: the generation of solid waste, dust during the material transportation, safety, protective equipment, sanitation, warning signs on the construction site. However, it was also noted that the EMP has been adequately implemented. During the operation, it was also observed that the safety system is in place and the operation staffs are aware of the EMF impact and prepare the working shift plan to respond to the issue. 33. Regarding the drainage, LIC and VICA consultant has monitored during the construction time as well as working with local authority. In fact, typical terrain of project area is low land and flooding has often occurred in the area during the rainny season even before the project construction. During the construciton, localized flooding has also occurred in the cultivation area of Ha Noi, Dai Mao and Huong Ninh hamlets despite some drainage works has been constructed (drainage channel, dyke) to reduce flooding. It was also proposed by the local people for additional assistance (if any) from project owner to prevent and control the flooding (pumping). In this regard, NTP has worked with the contractor and CPPMB (who is in charge of operation) to consider providing additional support to localities for drainage installation and pumping stations in the areas affected by flooding (LIC s social post evaluation report). It was also recommended by VICA and LIC long before Three extension substations of 500kV Thuong Tin and Extension 220kV Van Tri and 500kV Nho Quan substation 34. As showed in Table 1, there is no need any action required for subproject of Extension 500kV Thuong Tin, Extension 220kV Van Tri substation and Extension 220kV Van Tri substation since the substation was energized in January 2011 and has been in operation since February Post Evaluation Report-Environmental Monitoring-Dec 2015 Page 18

20 35. The LIC has visited the site on March 2012 and found that extension was limited in existing the substations and no environmental impact occurring outside the boundary of the substations. The safety system (sign, fire alarm, fire extinguisher) was found in the substations kv Thanh Hoa-Vinh T/L Subprojects Background 36. Thanh Hoa - Vinh 220 kv Transmission Line was one of three core subprojects of Northern Power Transmission Expansion Project (two others are 500 kv Son La- Nho Quan- Hoa Binh T/L and Van Tri S/s). The line has a length of 147,87km passing through 10 districts of 2 provinces Thanh Hoa and Nghe An. Districts of Thanh Hoa province include Thieu Hoa, Dong Son, Trieu Son, Nong Cong, Tinh Gia. And districts of Nghe An are Yen Thanh, Quynh Luu, Dien Chau, Nghi Loc and Vinh city. Objectives of subproject are: (i) to improve the confident of the power grid system of the Middle North area and the National power grid as well; (ii) to transport the electricity from the Nghi Son thermal power plant Phase 1 to the national power grid; and (iii) to promote the safety of the power supply, quality of voltage and reduce the power lose of the system that could make contribution to the socio-economic development in the area. The 220kV Thanh Hoa Vinh transmission line will be connected to 03 substations. For the project activities, the feeder bay of all 3 substations would be constructed to expand the substation including (i) 220KV Thanh Hoa Substation, (ii) 220kV Nghi Son Substation, and (iii) 220KV Hung Dong Substation. By the end of this quarter, the constructions of the extension of these three substations have almost been completed. In addition to that, most the tower foundations and associated civil work have also been almost completed.. Environmental Compliance Findings 37. This subproject has been monitored during the years since 2010 by VICA and by LIC since 2012 and the construction has almost been accomplished. LIC has undertaken the spot check supervision to only some sites of subproject not only last period but also this period from July to December Being stick to the objectives of the monitoring, most of the visited sites are sensitive areas like road crossing, cemetery, river, worker camp, and material storing locations. 38. During the construction phase, it was found there were insignificant environmental issues: the generation of solid waste, dust during the material transportation, safety, protective equipment, sanitation, warning signs on the construction site and conversion of protection forest in Nghi Loc province 39. The LIC has used environmental checklist and monitoring template (annex 4) for the monitoring visit to the construction site. The monitoring results showed that the contractors complied with the mitigation measures to minimize the impact on the environment and the residents life. However, during the spot check monitoring, LIC has requested the contractor to comply with the EMP and contractor has implemented the following mitigation measures: (i) Rehabilitation of the project area upon completion of site work has been mostly conducted by contractors; (ii) Some sections of the existing roads were used as access roads that the contractors have consolidated or repaired after construction completion. (iii) Construction material was properly covered and stored and worker camp was rather well organized. In addition to that, the DRR for conversion of 4.5ha forest land under the authority of the Nghi Loc protection forest management board have been prepared, the corrective action plan have been also prepared, In this regard, the Nghe An PPC has agreed to hand over the land area of ROW to NPPMB for construction. (Annex 5). The DDR has recommended that NPPMB has to work with the relevant stakeholder to implement the replacement plantation or contribute to the Forest Development and Protection Fund. In addition to carry out the mitigation measures as specified in the approved EMP, the environmental compliance report has been prepared and submitted by contractors to the LIC/NPPMP in a timely manner (report template in Annex 3) kV Bim Son Substation and Connection Background 41. The proposed Bim Son 220kV substation is located in Bac Son ward, Bim Son town, Thanh Hoa province. Main project features are the 220kV side, the 110 kv side and the 35kV and 22kV side. Main objectives of this subproject are (i) to meet the electricity supply demand for Bim Son town and industry zones strengthen and enhance networks that provide the long-term stability and reliability for 2 provinces Thanh Hoa and Ninh Binh; (ii) To increase stability, operational safety for power network and reduce the loss of electric energy, the loss of power in the grid and contribute to raise the efficiency of electricity production and trading of EVN. Summering analysis, 220kV Bim Son substation will play an important power source which mainly supply electricity for the fast development of load in this area. The subproject area with 4,3 ha has been totally handed over to the contractor. Environmental Compliance Findings 42. During the construction phase, it was found there were insignificant environmental issues: the generation of solid waste, dust during the material transportation, safety, protective equipment, sanitation, warning signs on the construction site 43. The LIC has visited the site and discussed with the contractors the entire environmental safeguard requirement during the construction. During the spot check (annex 4) the LIC has requested the contractor to comply with the EMP and contractor has implemented the following mitigation measures: (i) material on the truck had been covered to prevent the air pollution; (ii) constructor had sprayed water to control dust construction time; (ii) construction material was properly covered and stored; (iii) soil erosion control was taken care during the rainy season; sign and warning board were supplied more on the construction site; (iv) labor safety was maintained throughout the construction time; (v) Slope is stabilized by grass and concrete. (Annex 5). 44. In addition to carry out the mitigation measures as specified in the approved EMP, the environmental compliance report has been prepared and submitted by contractors to the LIC/NPPMP in a timely manner (report template in Annex 3) kV Tuyen Quang Substation and Connection Background 45. Subproject of Tuyen Quang 220kV substation is proposed in order to meet capacity transmission for Tuyen Quang Provincial load in particular and for Northern Vietnam region in general; enhance reliability and safety of power supply and power quality for Tuyen Quang s and Northern Vietnam region s power network. The project creates combination among regions in Northern Vietnam mountainous power system that is an important basis to operate system more stably and contributes to reduce the loss of capacity of the system. The proposed Tuyen Quang 220kV substation is located on low hill area planting eucalyptus and tea in Kim Phu Commune, Yen Son District, Tuyen Quang Province. The substation is 8km far from Tuyen Quang city and cover the area of m2 Environmental Compliance Finding Post Evaluation Report-Environmental Monitoring-Dec 2015 Page 20

During the construction phase, it was found there were insignificant environmental issues: the generation of solid waste, dust during the material transportation, truck has not been covered to prevent air pollution on site; protective clothes wearing of worker The LIC has visited the site and discussed with the contractors on the environmental safeguard requirement during the construction. In general the contractor has complied with the environmental protection as requested by LIC during the spot check (annex 4). Followings were observed (i) the location is far from the residential area and rather favorable for construction; (ii) the waste was kept right on the construction site; (iii) construction material was stored on the construction site; (iv) the worker camp is temporally located on the site just only for taking a rest since the worker were hiring the local residential house for living during the construction ; (iv) water channel is constructed to prevent water pollution; (v) slope was well stabilized; (vi) the sign board was observed on the site (Annex 5). 48. In addition to carry out the mitigation measures as specified in the approved EMP, the environmental compliance report has been prepared and submitted by contractors to the LIC/NPPMP in a timely manner (report template in Annex 3) kV Kim Dong Substation Background 49. Subproject of Kim Dong 220kV substation is proposed in order to meet capacity transmission for Hung Yen Provincial load in particular and for Northern Vietnam region in general; enhance reliability and safety of power supply and power quality for Hung Yen s and Northern Vietnam region s power network. The project creates combination among regions in Northern Vietnam mountainous power system that is an important basis to operate system more stably and contributes to reduce the loss of capacity of the system. The proposed Kim Dong 220kV substation is located on the rice field in Toan Thang commune, Kim Dong district, Hung Yen province. The substation covers the area of m2. Environmental Compliance Finding 50. During the construction phase, it was found there were insignificant environmental issues: the generation of solid waste, dust during the material transportation, truck has not been covered to prevent air pollution on site; protective clothes wearing of worker The LIC has periodically conducted the spot check to the site (annex4). During the site visit the LIC has discussed with the contractors on the environmental safeguard requirement right on the construction time. Specific mitigation measures have been conducted: (i) the sign board was observed on the site; (ii) construction material was not stored neatly on the site; (iii) the worker camp is temporally located on the site; (iv) workers have wore the protective clothes (see Annex 5); 52. In addition to carry out the mitigation measures as specified in the approved EMP, the environmental compliance report has been prepared and submitted by contractors to the LIC/NPPMP in a timely manner (report template in Annex 3) kV Thuong Tin Kim Dong T/L Background 53. Subproject of 220kV Thuong Tin-Kim Dong T/L is proposed in order to meet capacity transmission for Hung Yen Provincial load and Hanoi city in particular and for Northern Vietnam Post Evaluation Report-Environmental Monitoring-Dec 2015 Page 21

23 region in general; enhance reliability and safety of power supply and power quality for Hung Yen s and Northern Vietnam region s power network. The project creates combination among regions in Northern Vietnam mountainous power system that is an important basis to operate system more stably and contributes to reduce the loss of capacity of the system. The proposed Kim Dong 220kV substation is located on the rice field in Thuong Tin district of Hanoi city and Khoai Chau and Kim Dong district of Hung Yen province. The T/L is 26.68km length. Environmental Compliance Findings 54. During the construction phase, it was found there were insignificant environmental issues: the generation of solid waste, dust during the material transportation; safety and sanitation. 55. The LIC has visited the site and discussed with the contractors on the entire environmental safeguard requirement during the construction. During the spot check (annex 4) the LIC has requested the contractor to comply with the EMP and contractor has implemented the following mitigation measures: (i) the waste was kept right and construction material were properly stored on the construction site; (ii) (Annex 5) 56. In addition to carry out the mitigation measures as specified in the approved EMP, the environmental compliance report has been prepared and submitted by contractors to the LIC/NPPMP in a timely manner (report template in Annex 3) Hai Duong 2 S/S Background 57. Subproject of 220kV Hai Duong 2 S/s is proposed in order to meet electricity supply demand for Kinh Mon district, Hoa Phat and Tan Phu Xuan steel factories Phuc Son and Phu Tan cement factories and other industrial sectors of east west area of Hai Duong province and enhance local network that provide the long-term stability and reliability of supplying electricity for Hai Duong province. The proposed of 220kV Hai Duong 2 S/s is located on the rice field in of Hue Tri village, An Phu commune, Kinh Mon district, Hai Duong province. Hai Duong 2 substation shall take up an area of 35232m2. LIC has also been requested by NPPMB to prepare the IEE for 220KV Hai Duong 2 S/S. The revised IEE has also been approved by ADB on September, Environmental Compliance Findings 58. During the construction phase, it was found there were insignificant environmental issues: the generation of solid waste, dust during the material transportation, safety, protective equipment, 59. The monitoring results (annex 4) showed that the contractors complied with the mitigation measures to minimize the impact on the environment and the residents life. However, during the spot check the LIC has requested the contractor to comply with the EMP and contractor has implemented the following mitigation measures: (i) the waste and construction material ware stored on the construction site; (ii) provide protective helmet for the worker; (iii) the sign board the site. 60. In addition to carry out the mitigation measures as specified in the approved EMP, the environmental compliance report has been prepared and submitted by contractors to the LIC/NPPMP in a timely manner (report template in Annex 3). 3.3 Environmental management under the participation of the stakeholders. 61. The project s institutional framework of environmental management is described in the Initial Environmental Evaluation (IEE) and Environmental Management Plans (EMP). The participants are involving in environmental management including: Post Evaluation Report-Environmental Monitoring-Dec 2015 Page 22

24 NPPMB 62. On behalf of the PPC and NPT, the NPPMB is responsible for implementing the whole project including planning, selecting constructors and supervising. In which, environmental Management (EM) is one of the important tasks of the NPPMB. In order to successfully accomplish the environmental management tasks, the NPPMB is in association with the PPC and DPC to perform this task In general, NPPMB have undertaken well their responsibilities through each stages of the Project. All construction activities as well as monitoring consultancy activities are observed and NPPMB was considered as the important bridge to solve all problems between the contractor, consultant firms, construction monitoring consultations and local people. Contractors 64. The Contractors are responsible for carrying out the environmental impact mitigation measures to ensure workers and local people s safety, as well as complying with the environmental protection policies of ABD and Vietnam during the construction phase. Besides, the Contractors also take responsibility for reporting results of implementation of the mitigation measures or any environmental problems to the NPPMB. Most of the Contractors are highly appreciated their construction implementation and efforts in mitigating environmental impacts. 65. In general, the contractors have made great attempts to comply with procedures and regulations on safety and to implement environmental mitigation measures. However, one remarkable issue is that the workers lack of awareness on safety when working; including not complying with safety regulations, not wearing protective suits, setting up shortage of danger signs and works signs at some packages. Construction Monitoring Consultants (CMC) 66. The key role of the CMC is to supervise construction activities from the beginning of construction, such as following up and regularly, checking on the quantity and quality of construction works and progress of construction implementation in compliance with the current requirements of quality management and approved design. In accordance with the EMP, another important task of the CMC is to directly supervise on the Contractors compliance with the environmental impact mitigation, labor safety, and environmental sanitation measures. However, in some reports of the CMC submitted to the NPPMB, the environmental sanitation and occupational safety are only one part of the general monitoring. 67. In general, CMCs observed and warned the contractors to comply with regulations on safety as well as environment in Viet Nam. However, CMC should pay more attention to regularly warn construction contractors to apply mitigation measures to the construction phase and material transport process. Department of Natural Resources and Environment (DONRE) 68. This department is responsible for providing Consultants and informing the NPPMB about any breach of Vietnam s environmental protection policies, as well as supplying technical assistances as required during the project implementation. The consultant supports implementing the environmental monitoring (LIC) 69. Detailed duties of the local implementation consultant include the following: (i) Provide guidance to the NPPMB on the documentswhich need to be prepared following ADB s reporting requirements. (ii) Provide guidance to and supervise the local planning and implementation Post Evaluation Report-Environmental Monitoring-Dec 2015 Page 23

25 agencies on implementation of environmental safeguard issues following the ADB s policy and the project policy frameworks; (iii) On behalf of NPPMB, make sure that environmental mitigating measures are effectively carried out and, if not, propose corrective action; (iv) Assist the NPPMB to prepare the corrective action plans following the due diligence reports, monitoring reports, mission findings and others; (v) Provide a coordinated approach to EMP implementation for the project; (vi) Supervise the implementation of project environmental safeguard (EMP) and review the regular reports of the monitoring consultants; (viii) Prepare the progress reports and supervision reports to submit quarterly to the NPPMB and to ADB Commune People s Committee (CPC) at the project area 70. At the same time of collecting the community feedbacks on environmental problems during the project implementation, the Consultants team also studies about the local authorities participation in environmental monitoring and management. It was acknowledged that the local authorities have positively involved in the project implementation from the beginning to resolve any arising problems. 71. Local authorities observed and coordinated with construction units to figure out solutions for arising issues. When receiving the local people s complaints about environmental issues, the local authority will sends a representative to learn about and tackle the problem. 72. Local authorities monitored, observed and requested the constructor to register a temporary residence when implementing construction works in the commune. Follow-up consultation activities with communities or stakeholders 73. In all monitoring trip, the consultants continued collecting feedbacks from local people on environmental impacts during the construction phase of subprojects. Interview results show that the interviewed local people said that occupational or traffic accidents had not happened during the construction and material transportation. The interviewed residents reflected that the gathering of materials and machines had not caused any impacts on the local transportation. Also, the interviewed residents answered that their lives and farming activities had not been changed due to construction activities. All the interviewed residents affirmed that an increasing number of workers at the construction site had not affected on the social security and environment. The interviewed households said that the environmental quality is become as good as before after the construction phase is completed. However, it was also noted that some interviewed households reflected that the material transport damages some segments of roads and sewers and they requested the contractors to repair the damaged property. Some households said that the compensation for the borrowed land is not appropriate. The repair of damaged segments of roads at Hiep Hoa substation subproject is conducted slowly. There are four steps to get the local people feedbacks as follows: Step 1: 75. Local people will report to the community supervisor if any problem of environmental sanitation and occupational safety happen due to the Contractors having not carried out the mitigation measures. In fact, in most of the monitored communes, the local people reflect that there had been no problems of environmental sanitation and occupational safety. A majority of local people only pay attention to resettlement and compensation. Through the interview, the consultant acknowledged that people show their full understandings about the feedback reflecting process. Namely, they firstly report problems to the community supervisors who are considered a bridge among local people and CPCs. The CPC is responsible for making solutions to the problems. 76. The community supervisors report problems to the CPC and co-ordinate with the NPPMB in requesting the Contractors to comply with the mitigation measures, or in seeking for appropriate solutions within 15 days. Step 2: 77. If the local people don t understand or don t satisfy, or don t receive responses from the CPC within 15 days, they can request the DPC and NPPMB to solve their complaints within 1 month since the receiving day. 27 Step 3: 78. If local people don t satisfy with the NPPMB s decision or don t receive any feedback, they would send their complaints to the PPC in the project areas. Based on the information, the PPC will work with the representative of National Power Transmission (NPT) to make a decision within 30 days. Step 4: 79. If the local people still do not satisfy with the PPC s or NPT s decision or do not receive any response within the required period of time, the effected people can make their debut at the Provincial People's Court. 3.5 Trainings on environment, health and safety 80. Right after the project start, the training on environment, health and saftty was organized by May Stakeholders involving the environmental management and monitoring including technical staffs of NPT, NPPMB, CPPMB, CMC, contractors and representatives of community were invited to attend the training workshop. 81. In addition, the ADB requirement of environmental safeguard compliance has been provided to the contractors during the monitoring mission from Futhermore, the environmental management and reporting system under the project has been significantly strengthened. In particular, the NPPMB has issued the letter No 1948/AMB-P2 dated May 16 th 2013 and 1976/AMB-KT dated April 18 th 2014 (Annex 2) to request all contractors would have to report the environmental safeguards compliance under each contractor scope of work. To help the contractor could properly prepare the environmental compliance report, the LIC has prepared the outline of the report as well as the environmental monitoring form and provided all these supporting document to all contractors (Annex 3). Therefore, the quality of the report was improved after several rounds of comments provided by LIC and NPPPMB. 4. CONCLUSIONS AND RECOMMENDATIONS 4.1 Conclusions 83. Overall, the contractors have implemented the mitigation measures during the construction phase as proposed in the relevant EMPs. 84. NPPMB with supported by LIC has complied with all requirement of ADB and Government environmental safeguard during both preparation and operation by maintaining and coordinating the environmental management and reporting monitoring and communicating systems with all contractors. 4.2 Recommendations and lesson learnt 85. During the operation, it is recommended that the electromagnetic field should be regularly monitored to ensure no negative impact to the health of local people surrounding the S/S as well as ROW. 86. Safety corridor should be taken care of to ensure the safety power transportation during the operation phase. 87.
