Box 607 Benton, AR RE: SSO near Apache Rd AFIN: NPDES Permit No.: AR Dear Mr. McKinney: On February 24, 2010, I performed a reconnaissance inspection of part of the waste water treatment collection system in response to a complaint and in accordance with the provisions of the Federal Clean Water Act, the Arkansas Water and Air Pollution Control Act, and the regulations promulgated thereunder. The complainant alleged that a manhole on Hwy 35 had been overflowing for several weeks. It was stated that on at least two occasions the Wastewater Utility had been notified of this Sanitary Sewer Overflow and nothing had been done. At the time of inspection the complaint was found to be valid. This inspection revealed the following violations: 1. All SSOs must be reported to the department within 24 hours of the SSO being recognized. If the SSOs were reported to the Benton Utilities and then not reported to the ADEQ that is a violation of Part II. 4. of your permit. 2. This section of line has become clogged before; therefore, not maintaining the section of line occurring prior to the lift station at Apache Road the utility is violating proper operation and maintenance of the permit; specifically Part III.Section B.1.a. of the permit. 3. This overflow directly entered a ditch and then a creek after leaving the manhole. This had been ongoing due to the amount of sludge seen in the ditch and creek. This is placing waste where it is likely to enter a water of the state. This is a violation of the Arkansas Water and Air Pollution Control Act (A.C.A ).
