Objective Scheduled reas & Sites of Ngāi Tahu Significance The historic and contemporary relationship of Ngāi Tahu mana whenua with their ancestral lands, water, sites, wāhi tapu and other taonga is recognised and provided for in the rebuild and future development of Otautahi, Te Pātaka o Rākaihautū and the greater Christchurch rea. 9.X.1.2 Objective Integrated Management of Land and Water The natural character of and Ngāi Tahu cultural values associated with water bodies, wetlands, springs (tupuna) and the coastal environment of Otautahi, Te Pātaka o Rākaihautū and the greater Christchurch rea are maintained or enhanced as part of the rebuild and future development of the District - ki uta ki tai (from source to sea). 1

(b.) Protect any site listed in Schedule X and shown on the Planning Maps as a site of Wāhi Tapu/Wāhi Taonga from inappropriate disturbance, damage or destruction; and ensure activities adjoining these sites do not adversely affect them. 9.X Policy: Ngā Tūranga Tūpuna Recognise the historic and contemporary relationship of Ngāi Tahu with the areas and landscapes identified in Schedule X and shown on the Planning Maps as Ngā Tūranga Tūpuna and: i. Facilitate opportunities to provide information about the historic occupation or use of these areas by Ngāi Tahu and associated values; ii. Incorporate representation of the association of Ngāi Tahu with these areas into the design of public or community buildings and facilities, and in the subdivision and development or redevelopment of residential or commercial areas; iii. Manage earthworks involving disturbance of soils to depths not previously disturbed by cultivation or building foundations; iv. Facilitate opportunities to enhance mahinga kai and other customary use of taonga species through planting and landscaping; 2

Enhance the natural character and cultural values of water bodies, tupuna/springs and wetlands, including reinstating original water courses where practicable; and vi. Maintain or restore natural features with cultural values within the area. 9.X Policy - Ngā Wai Recognise the cultural significance of the water bodies, tupuna/springs, wetlands, and coastal areas listed in Schedule XX and shown on the planning maps as ngā wai and manage the effects of land uses and activities on the surface of water to: Maintain the natural character of these water bodies where it is high and enhance it where it is degraded, including reinstating original water courses where practicable; Recognise historic and contemporary Ngāi Tahu customary uses and values associated with these water bodies and enhance opportunities for customary use and access. Ensure any land uses or activities on the surface of water in or adjoining these sites do not adversely affect taonga species or Ngāi Tahu customary uses in these areas. Ensure new land uses do not create an additional demand to be able to discharge sewage or stormwater directly into ngā wai, other water bodies or the coastal marine area; and address the need for existing land uses to discharge untreated sewage or stormwater into these areas. 9.X Policies Protection of Other Sites (a.) void damage to or destruction of Ngāi Tahu mana whenua archaeological sites listed in Schedule XX as Nga Tapuae or any 3

Facilitate the further identification and classification of sites and areas of cultural significance to Ngāi Tahu mana whenua for inclusion in the district plan over time. Explanation of Objectives & Policies (or introductory section to chapter) Ngāi Tahu is the tribe whose descendants hold mana whenua over the land within the greater Christchurch District (including Te Pātaka o Rākaihautū /Banks Peninsula). They are represented by six papatipu runanga. The modern tribal structure of Ngāi Tahu and its interests in and values associated with the greater Christchurch rea are explained in Chapter 1 Introduction, Section 3.2. The Resource Management ct 1991 requires the recognition and provision of the relationship of Maori and their culture and traditions with their ancestral lands, water, sites, wāhi tapu and other taonga as a Matter of National Importance (s6(e)). For Ngāi Tahu whanau all of the greater Christchurch rea is regarded as ancestral land and Ngāi Tahu has interests in the management of all natural resources in the takiwa. Within this area there are sites and places which were used more prominently for settlement and mahinga kai. Some of these areas are classified in this plan and shown on the planning maps as wāhi tapu/ wāhi taonga; ngā tūranga tūpuna; or ngā wai. The list is not comprehensive; sometimes nga runanga prefer not to disclose sites. Of the sites that are classified: Wāhi tapu/wāhi taonga sites are protected by rules requiring resource consents for buildings & structures, earthworks or to disturb archaeological sites or remove 4

5 Page 5 of 33 Decision Sought R artefacts. Ngā tūranga tūpuna are areas of settlement or occupation in the past. These are areas or landscapes of Ngāi Tahu cultural significance. There is not usually known physical features on the sites to be protected, (there may be archaeological sites) but there is an opportunity to incorporate Ngāi Tahu history and values into the development or redevelopment of these areas. The plan provisions focus on the design of larger scale public or community buildings and facilities or subdivisions. Ngā wai are water bodies, including wetlands, tupuna (springs) and coastal waters which are significant areas of mahinga kai or other customary use for Ngāi Tahu. These areas include Te Tai o Mahaanui the coastal area of Te Pātaka o Rākaihautū Banks Peninsula and Wairewa/Lake Forsyth both areas listed as areas of statutory acknowledgement in the Ngāi Tahu Claims Settlement ct 1998 (see Chapter 1, Introduction, section 3.2). Some areas may be shown as ngā tūranga tūpuna and include wāhi tapu/wāhi taonga or ngā wai sites within them. In that case both sets of provisions apply to the land subject to dual classifications and an activity takes its status from the more stringent rules. The only permitted activities are earthworks which create no greater disturbance than previous land cultivation, fencing where it protects a Wāhi tapu or wāhi taonga site area or planting or removal of vegetation (subject to limits). ll buildings are restricted discretionary. ll consents are to be served on the runanga as an affected party. Buildings and earthworks within 30m of a waterbody are restricted discretionary. Similar concerns are addressed and reasons for the same outlined in the submissions and further submissions filed on behalf of the Radford Family on Stages 1 and 2 of the Proposed Replacement District Plan. The amended provisions sought are inconsistent with the Resource Management ct 1991, including s 32, the Order in Council, and the PCRDP strategic objectives, including CRC considers that is it useful to provide guidance for plan users as to the role that Ngāi Tahu - as tangata whenua in the Canterbury Region - has in providing for the preservation and enhancement of the natural environment. Protection from "inappropriate disturbance, damage or destruction" and "ensure activities adjoining these sites do not affect them" is uncertain and may be unreasonably restrictive. The mapped sites of significance (including Wāhi Tapu and Wāhi Taonga) traverse large geographic areas (in some cases, with a radius kilometres wide) without any specific details or location of the site of Wāhi Tapu / Wāhi Taonga, meaning that the scale of the assessment (including consultation with Runanga) may be excessive compared with the scale and nature of the proposed activity. The intent of section 9 X Ngāi Tahu Values and the Natural Environment is understood and supported. However, there is potential for this addition to the Replacement Plan to create Plan clarity and implementation issues because the proposed insertion addresses values that are already covered by

9 Page 9 of 33 Decision Sought R 9.X.2 Rules for reas and Sites of Ngāi Tahu Significance Permitted ctivities - Wāhi Tapu/Wāhi Taonga ctivity Within any site listed in Schedule X and shown on the planning maps as a wāhi tapu/wāhi taonga the following activities are permitted activities provided they comply with the activity specific standards: Earthworks Fencing Removing any artefact or disturbing any archaeological site Planting or removal of vegetation ny activity undertaken within a papakainga zone ctivity Specific Standards i. ny earthworks shall be limited to disturbance of land over an area and to a depth to which it has been previously disturbed for cultivation. ii. ny fencing shall be limited to fencing around a wāhi tapu/wāhi taonga site for the purposes of protecting the site and is undertaken by the relevant runanga or their authorized agent. iii. The removal of any structure or artefact or the disturbance of any archaeological site is for the purposes of research, or preservation or protection of the artefact or site; and shall be undertaken be the relevant runanga or 9

The removal of any indigenous vegetation is limited to that allowed by permitted activity Rule P1 to P3* or customary use authorised by the relevant runanga. v. The activity in the Papakainga Zone is provided for within an approved outline development plan for the area and is undertaken in accordance with that plan. *These numbers may need to be updated as a consequential amendment of submissions accepted. Restricted Discretionary ctivities Wāhi Tapu/Wāhi Taonga ctivity Within any site listed in Schedule X and shown on the planning maps as wāhi tapu/wāhi taonga the following activities are The Council s discretion shall be limited to all of the following matters: i. Erecting any building or structure that does not comply with the standards for a permitted activity. iii. Removing any artefact or disturbing any archaeological site that does not comply with the standards for a permitted activity. iv. Planting or removing vegetation which does not comply with the standards for a permitted activity. v. Land uses in Papakainga zones which do not comply with the standards for a permitted activity. ii. any mitigation measures; and ppropriate conditions on any resource consent granted including the need for a cultural monitor on-site. ny application for resource consent made under this rule shall be served on the 11

Drilling bores or other earthworks that disturb soil to a depth not previously disturbed by cultivation or building/structure foundations. ii. Earthworks involving the drainage, alteration or realignment of wetlands, tupuna (springs), rivers or other water bodies. iii. The erection of any The Council s discretion shall be limited to all of the following matters: a. Conditions for the appropriate management of any site of historic Ngāi Tahu occupation disturbed by earthworks including accidental discovery protocol conditions and the use of a cultural monitor on-site during earthworks. b. The design or layout of any building or subdivision and associated landscaping or planting to reflect the Ngāi Tahu association with the area including any matters identified in a Impact ssessment or through other forms of consultation. 12

The subdivision of land which creates more than 3 lots whether staged or not or which requires the creation of one or more access roads; v. The erection of any commercial or industrial building which is more than 500m 2 in gross floor area; vi. The removal of indigenous vegetatio n other than that associated with customary harvest of taonga species, the maintenance of amenity plantings or removal ancillary to livestock grazing. c. The effect of removing indigenous vegetation on mahinga kai and other customary uses and the effects of any mitigation measures including new plantings and improved access for customary use. d. The effects of any alteration to or realignment of water bodies or other natural features, including the extent to which the realignment of any water body reflects the original position of the water course and its natural character. e.
