1 Cuntry prfiles: Luxemburg Last updated: date (09/04/2015) 1 Implementatin f Tracking Systems 1.1 Electricity Disclsure Electricity disclsure is legally implemented in Luxemburg by the electricity law frm 2007 and the grand-ducal regulatin n electricity disclsure frm Detailed regulatins have been published by the natinal regulatr Institut Luxemburgeis de Régulatin (ILR), which is the Cmpetent Bdy bth fr disclsure and fr GO, in September The disclsure infrmatin cmprises shares f the fllwing fuels: Renewable Energy Surces Fssil Wind Hydr Slar Bimass Other Renewable Energy Surces Lignite Nuclear Hard Cal Natural Gas High-efficient CHP Other Fssil Nn Identifiable As explicit tracking instruments, nt nly cancelled fficial GO can be used, but als natinal generatin cntracts r ther certificates which are established by independent rganisatins r a cmpetent authrity. Therefre, n statistics are available n the ttal use f explicit tracking. Furthermre, ILR is auctining the disclsure attributes f supprted generatin, which then can be explicitly disclsed by the successfully bidding suppliers. As implicit tracking mechanism, ILR annually publishes a residual mix which is based n ETSO-E prductin mix frm which all RES is deducted. Suppliers disclsure statements have t cmprise the prduct mix, the ttal supplier mix and the natinal reference mix (i.e., the ttal f all prduct mixes delivered t cnsumers in Luxemburg as shwn in Table 1). Reference perid is the calendar year, and figures have t be published with invices as f September 1 st f the fllwing year. The supplier s mix des nt nly have t cver natinal supply, but als supply by the respective cmpany t end-cnsumers in ther dmains. As already referred the default mix fr nn-explicit tracked prducts is calculated based n the Eurpean ENTSO-E mix with all RE shares being deducted. The default natinal residual mix is supplied every year by ILR in their website. In terms f timings used in Luxemburg: The deadline fr cancellatin f GO fr purpses f disclsure f a given year X is 15 May f year X+1; Disclsure figures f year X must be published n 1 st September f year X Acceptance f GOs As already referred, Luxemburg has a disclsure system in place which transpses the RES Directive, with an electrnic register fr the issuance, transfer and cancellatin f issued RES-GO. The RES-GO system implemented is an EECS system Luxemburg imprts GO nly thrugh EECS, and the imprted GOs are treated equally as the natinal GO fr disclsure purpse. Thus Luxemburg des nt have in place any criteria fr acceptance f freign GO at natinal level; this is dne based n a case by case check by ILR. 3/7

4 Summary f findings fr Luxemburg 1.2 Guarantees f Origin fr Electricity frm Renewable Energy Surces and High- Efficient Cgeneratin RE-GO and CHP-GO System Legislatin that fully implements the GO-specific regulatins f the Renewables Directive 2009/28/EC is in place since August A natinal RES-GO system is implemented within EECS with the natinal regulatr ILR as fficially appinted Cmpetent Bdy. Regulatins n RES-GO are defined in the grandducal regulatin frm 2014 n renewable electricity 4. RES-GO are issued electrnically within EECS fr net prductin and fr a standard vlume f 1 MWh, and nly n demand by the prducer fr the specifically requested perid. The expiry regulatin has been put in place since Nvember N limitatins apply in terms f unbundled use f the GO, which can be used fr electricity disclsure nly after cancellatin in the ILR registry. The CHP-GO system in Luxemburg was created thrugh the grand-ducal regulatin f the 26 th September and this legislatin appint ILR as the cmpetent bdy respnsible fr the issuing, transfer and cancellatin f CHP-GO in this system. Hwever, n certificates have been issued yet. 5 Summary f findings fr Luxemburg 2.2 Prpsals regarding Disclsure BPR [5b]: Deadline fr cancellatin f GO shuld be set t the 31 st March X+1. At the mment the deadline is set fr the 15 th May X+1. BPR [6]: the same allcatin rule as set in BPR [5a] and BPR [5b] shuld apply fr expire GO. The date f expiry thus determines the disclsure perid fr which infrmatin frm expired GO will be used. BPR [8]: In case that nt all Eurpean cuntries are members f EECS, apprpriate cnnectins between the EECS system and nn-eecs members as well as in between different nn-eecs members shuld be established by Luxemburg. These include inter alia prcedures fr assessing the reliability and accuracy f the GO issued in a certain cuntry and interfaces fr the electrnic transfer f GO. (at the mment fr GOs nt transferred thrugh the EECS registry, the reliability and accuracy f the GO is assessed by ILR n a case by case basis. BPR [18]: Green pwer quality labels shuld use GO as the unique tracking mechanism. BPR [19]: Luxemburg shuld clarify whether and under which cnditins the use f GOs by end cnsumers is allwed. Such GO use shuld nt be based n ex-dmain cancellatins perfrmed in ther cuntries. If cnsumers are allwed t use GOs themselves, a crrectin shuld be implemented in the disclsure scheme which cmpensates fr any duble disclsure f energy cnsumed. BPR [23, 24]: (Other) Reliable Tracking Systems (RTS) shuld be defined where apprpriate based n criteria f added value, reliability and transparency. RTS can cmprise, where applicable: a. Hmgenus disclsure mixes fr regulated market segments where n chice f supplier r different prducts exists, b. Supprt systems whse interactin with disclsure requires a certain allcatin f the attributes f supprted generatin (e.g. a pr-rata allcatin t all cnsumers in a cuntry where RES electricity is supprted by a feed-in tariff), c. Cntract based tracking. BPR [25]: Luxemburg shuld prvide a Residual Mix (RM) as a default set f data fr disclsure f energy vlumes fr which n attributes are available based n cancelled GO r based n ther Reliable Tracking Systems. The use f uncrrected generatin statistics (e.g. n natinal r UCTE, Nrdel etc. levels) shuld be avided. BPR [26a]: The calculatin f the Residual Mix shuld fllw the methdlgy develped in the RE DISS prject. BPR [27]: Fr purpses f this crss-brder adjustment, ILR shuld use data prvided by RE- DISS. BPR [28]: As part f this methdlgy, ILR shuld ensure that duble cunting between GO they have issued, ther Reliable Tracking Systems in use in their cuntry and the Residual Mix is excluded. ILR shuld cperate with cmpetent bdies frm all cuntries in Eurpe in rder t adjust their Residual Mixes in reflectin f crss brder transfers f physical energy, GO and RTS. BPR [34]: The deadline fr cancelling GO fr purpses f disclsure in a given year X shuld be 31 March f year X+1. BPR [35]: ILR shuld strive t crdinate the timing f the calculatin f the Residual Mix with ther cmpetent bdies acrss Eurpe accrding t the fllwing timeline: a. By 30 April X+1 all cuntries shuld determine their preliminary dmestic Residual Mix and whether they have a surplus r deficit f attributes. b. By 15 May X+1, the Eurpean Attribute Mix shuld be determined. c. By 31 May X+1, the final natinal Residual Mixes shuld be published. d. As f 1 July X+1 the disclsure figures relating t year X can be published by suppliers. 5/7

6 Summary f findings fr Luxemburg 2.3 Prpsals regarding RE-GO and CHP-GO BPR [1a, 1b, 2]: The metered prductin perids fr purpses f issuing GO shuld nt be lnger than a calendar mnth and where pssible shuld nt run acrss the start and end dates f the disclsure perids. If pssible, issuing f GO shuld be dne directly after the end f each prductin perid, except fr small scale PV which shuld be issued yearly. BPR [3b]: GO which have reached this lifetime shuld be cllected int the Residual Mix. BPR [4]: An extensin t this lifetime can be granted if a GO culd nt be issued fr mre than [six] mnths after the end f the prductin perid fr reasns which were nt fully under the cntrl f the plant peratr. In this case, the lifetime f the GO might be extended t [six] mnths after issuing f the GO. BPR [11a]: The GO system shuld be extended beynd RES & cgeneratin t all types f electricity generatin. BPR [11c]: Cmpetent bdies shuld cnsider t make the use f GOs mandatry fr all electricity supplied t final cnsumers 2.4 Prpsals regarding Acceptance f GO BPR [20, 20a, 20b, 21]: Any rejectin f GO shuld nly relate t the actual use f cancelled GO fr disclsure purpses in the respective cuntry and shuld nt restrict the transfers f GO between the registries f different cuntries. This means that the decisin abut the recgnitin f a GO shuld nt hinder its imprt int Luxemburg. Within the rules set by the respective Directives, Luxemburg shuld cnsider their criteria fr the acceptance f imprted GO fr purpses f disclsure. a. These criteria shuld address imprts at least frm all EU member states, ther members f the Eurpean Ecnmic Area (EEA) and Switzerland. The parties t the Energy Cmmunity Treaty shuld be cnsidered as well, as sn as GO imprts frm these cuntries becme relevant. b. The criteria shuld specify the electrnic interfaces, specifying data frmat and cntents f GO t be imprted, which the respective cuntry accepts fr imprts f GO (such as the EECS Hub and any ther interfaces accepted). c. Cnditins fr the recgnitin f GO frm ther cuntries shuld be that they were issued based n Art. 15 f Directive 2009/28/EC r cmpatible natinal legislatin, and that they meet the explicit requirements set in Art. 15, e.g. regarding the infrmatin cntent f the GO. d. The recgnitin f GO frm ther cuntries shuld be rejected in case that these cuntries have nt implemented an electricity disclsure system. e. The recgnitin f GO frm ther cuntries shuld be rejected in case that the cunty which has issued the GO r the cuntry which is exprting the GO have nt implemented adequate measures which effectively avid duble cunting f the attributes represented by the GO. Such adequate measures shuld ensure the exclusivity f the GO fr representing the attributes f the underlying electricity generatin, implement clear rules fr disclsure, establish a prper Residual Mix (see Methdlgy f Residual Mix Calculatin) r equivalent measures, and ensure their actual use. Furthermre, the adequate measures shuld ensure that attributes f exprted GO are subtracted frm the Residual Mix f the exprting cuntry and cannt be used fr disclsure at any time in the issuing r the exprting cuntry by explicit mechanisms, unless the GO is re-imprted and cancelled there. Eurpean cuntries shuld establish a register f their decisins taken regarding the acceptance f imprted GO, which gives guidance t ther cmpetent bdies and als prvides transparency fr market actrs. 6/7

7 Summary f findings fr Luxemburg 2.5 Further prpsals regarding Disclsure BPR [38]: All electricity prducts ffered by suppliers with claims regarding the rigin f the energy (e.g. green r lw-carbn pwer) shuld be based exclusively n cancelled GO. N ther tracking systems shuld be allwed, with the exceptin f mechanisms defined by law, e.g. a prrata allcatin f generatin attributes t all cnsumers related t the natinal supprt scheme. BPR [40]: There shuld be clear rules fr the claims which suppliers f e.g. green pwer can make twards their cnsumers. There shuld be rules hw the additinality f such prducts can be measured (the effect which the prduct has n actually reducing the envirnmental impact f pwer generatin), and suppliers shuld be required t prvide t cnsumers the rating f each prduct based n these rules. BPR [41]: Claims made by suppliers and cnsumers f green r ther lw-carbn energy relating t carbn emissins r carbn reductins shuld als be regulated clearly. These regulatins shuld avid duble cunting f lw-carbn energy in such claims. A decisin needs t be taken whether such claims shuld adequately reflect whether the energy purchased was additinal r nt. BPR [42]: In case that suppliers are serving final cnsumers in several cuntries rules must be develped and implemented cnsistently in the cuntries invlved n whether the cmpany disclsure mix f these suppliers shuld relate t all cnsumers r nly t thse in a single cuntry.
