7 EXECUTIVE SUMMARY The subproject of 220kV Cau Bong Hoc Mon Binh Tan TL has a total line of 15.59km long, 59 supporting towers, and a 22 meter (m) Right-of-way (ROW), 11m from either side of the center of line. The line starts from the Cau Bong 500kV substation located in Tan Phu Trung commune, passes through Tan Thanh Dong and Binh My communes of Cu Chi district, Dong Thanh and Thoi Tam Thon communes of Hoc Mon district, and Tan Thoi Hiep commune, and then ends at Hoc Mon 220kV substation in Tan Chanh Hiep commune of District 12, Ho Chi Minh city Implementation progress: subproject work started on June 10, 2014 and was expected to be finished in September However, the work progress has not met the expectation due to delays in providing compensation to the affected households, such that the construction sites were not available to be handed over in time to the contractors, and most construction activities at the sites in the fourth quarter were cancelled. Both PCC1 and VNECO contractors just focused on negotiating with the affected households for dragging wire. As a result, about 6000m wire were dragged and 01 tower No 24 in Village 8, Binh My commune was erected. Therefore, as of December 31 of 2015, the work progress in the fourth quarter achieved 76.5%. The environmental safeguard monitoring activities conduced in the fourth quarter of 2015 showed that the contractor s environmental compliance was good. Both PCC1 and VNECO dragged wire without damaging villagers s trees and vegetables and ensure safety in transportation and all houses roofed with metal under the RoW were connected to the earth. No complaints have been found so far. Besides Contractor VNECO that constructed tower 24 located in Village 8 of Binh My commune, Cu Chi district complied with its CEMP. For implementations of the mitigation measures at site, the contractor VNECO performed well in reducing dust, noise, vibration, avoided damaging trees surrounding the site. The Contractor was in compliance with collecting and classifying the construction wastes such as cement bags, iron materials and plastic cans to be reused or recycled; For protecting health and ensure safety for the workers and local communities, the contractors complied with the CEMP, particularly: - All migrant workers registered as temporary residents to local authorities, respected local cultures and have a good relation with the community; - Contractors installed a warning signal board surrounding the excavated holes of foundations to prevent local people from any potential accidents; - All workers have been educated to improve their awareness on social diseases especially HIV/AIDS; - The contractors have issued the labor safety regulations and provided the workers with the labor protecting equipment and reminded them to use during the time of working at site. 8 - The contractors have built the temporary camps for workers at the sites for guarding the construction materials at night time and taking a short rest at lunch time, provided workers with potable water and first aid kits for wiring workers. The camp is also located at the ventilated and safe place ensuring the environmental sanitation such as garbage bins and hygienic toilet available. - All houses roofed with tins were connected to the earth compliance with Circular No 03/2010/TT- BCT dated January 22, 2010, regarding protection on high voltage power network. Environmental issues found in the fourth quarter of 2015 During the time of waiting for completing the work, several sites of the towers located near communities have become the temporary landfills for locals. The environment surrounding the towers was polluted by garbage. Typically, the site of tower No. 17 near Tho Nam Sang Environmental Company, Binh My commune with a huge of wastes affected the landscape and also became a favorable habitat for insects and pathogens. Recommendations It is suggested that the contractors should work closely with the commune regarding this matter and also to post warning sign on the tower against dumping of wastes on the towers. Before handing over the line to an operation unit for management, the contractor VNECO should rehabilitate the environment surrounding the site of tower 17 to its original condition and ensure sanitation and landscape ***** Southern Power Project Management Board (SPPMB) 7

INTRODUCTION 1.1 Project background To carry out its plan to expand power generation, transmission and distribution capacity to meet the rapidly growing electricity demand throughout the country, the Government of Vietnam has requested the financial resource from a Multi Tranche Financing Facility (MFF) funded by the Asian Development Bank (ADB) to invest in the power development program. The program will include the physical investments in transmission and distributions of power with an expectation to (i) facilitate power transfers, (ii) remove transmission bottlenecks and (iii) reduce transmission losses and voltage fluctuations. To deploy its master plan on the national power development, 220kV Cau Bong Hoc Mon Binh Tan transmission line subproject is invested under the Tranche II with a total budget of around 18 millions USD 1, 2. NPT is the executive agency and SPPMB is the implementing agency for the subproject. 1.2 Project scale and description The subproject of 220kV Cau Bong Hoc Mon Binh Tan TL has a total length of km and 59 supporting towers. Its ROW is 22m, each side is 11m from the center of line. The route starts from Cau Bong 500kV substation located in Tan Phu Trung commune, then goes through Tan Thanh Dong, Binh My communes of Cu Chi district, Dong Thanh, Thoi Tam Thon of Hoc Mon district and Tan Thoi Hiep commune and ends at Hoc Mon 220kV substation in Tan Chanh Hiep commune of district 12, Ho Chi Minh City. A general layout is presented in Figure 1 and Table 1. Total I, II, III ,940 (Source: Feasibility report PECC-2, 2012) According to the IEE of Cau Bong Hoc Mon Binh Tan transmission line approved in December 2012, the scale of subproject construction that poses to potentially adverse impacts on environment in the subproject areas includes: (i) Excavating 59 tower foundations with the quantity of excavated earth and rock is 83,880 m 3 and the average of each tower is about 1,421m 3, and all earth and rocks will be temporarily stored within the construction site and will be used to fill back the tower foundation after the concrete reinforcement. (ii) Gathering construction materials such as iron, cement, sand, and stones to the sites for concreting the towers, the total volume of concrete required is 21,272 m 3 and the average for each tower is 360m 3. The materials will be transported by trucks to prepared sites as close as possible to the constructed tower based on its specific conditions such as available bare land and access roads etc. (iii) About 327,381.5m² 3 land will be in restricted use and the number of houses within the RoW is 433. All affected houses under the RoW are in compliance with the safe clearance requirements and are not required to be relocated, while 776 houses with metal roof located within 36m from the line centre will be earthed to ensure safety from electromagnetic fields. 11 is required permanently for constructing the towers, most of which is agricultural land; (iv) The transmission line route is mostly located within the outskirt of HCMC to minimize negative impacts on residential areas and facilities on the affected land. It crosses: a. Cau Bong Phu Lam 500kV transmission line one time at section of DD2 G2-1A; b. Cau Bong 220kV connection and Cau Bong 110kV connection, the low voltage transmission line 34 times at sections of G2-2 to G2-3 (04 times) from G2-5 to DC2 (30 times); c. Roads 29 times at sections of G2-1 to G2-2 (01 time), G2-2 G2-3 (02 times) and from G2-7 to G2-15 (26 times) d. Canals 06 times at sections of G2-1 to G2-2 (02 times), G2-2 to G2-3 (03 times) and G2-7 to G2-8 (01 time) and e. Rach Tra River 1 time at G2-5 to G2-6 section. In terms of biological environment, the majority of affected land under the RoW is agricultural land, of which paddy field land accounts for 40%, growing vegetables with 20%, and mixed cropping mainly of trees about 5%. There are no original habitats, significant wildlife, or conservation areas in the RoW. And no significant invasive species have been found within the project area; For physical cultural resources, there are several temples and other public infrastructures within the vicinity of the transmission line corridor. However, the distances are about 4-10 km from transmission line and none of these structures will be affected by the project activities. Southern Power Project Management Board (SPPMB) 10

12 Figure 1: Layout of 220KV Cau Bong Hoc Mon - Binh Tan transmission line 1.3 The objectives of internal environmental monitoring The objectives of internal environmental monitoring are as follows: - Monitoring the environmental compliance of subproject s construction activities with both the policies of ADB and the Government. - Monitoring the construction contractors compliance with the mitigation measures in accordance with the approved EMP and CEMP. - Recommending measures to improve the effectiveness of mitigating the environmental negative impacts during the subproject s construction period. - Identifying the environmental impacts not determined in the design stage, based on which solutions for monitoring and mitigating the impacts shall be recommended. 13 2. INCORPORATION OF ENVIRONMENTAL REQUIREMENTS INTO PROJECT CONTRACTUAL ARRANGEMENTS 2.1. Environmental law, regulation and standards - ADB s environmental safeguard policy which came into effect on January 01, 2010; - Law on Environment, 2013; - Circular No. 22/2010/TT-BXD regulating on labor safety in executing constructions issued by Ministry of Construction on December 03, 2010; - Circular No. 03/2010/TT- BCT dated on January 22, 2010 regarding protection on high voltage power network. - Decree No.59/2007/NĐ-CP on solid waste management dated April 09, 2007; - Decree No.14/2014/NĐ-CP dated February 26, 2014 regulating detail on the implementation of Law on Electricity and Power Safety; - QCVN 26/2010/BTMT national technical standard on noise - QCVN No 05/2013/BTNMT national technical standard on ambient air quality - QCVN No.27/2010/BTNMT national technical standard on vibration - QCVN No.08/2008/BTNMT national technical standard on surface water quality - QCVN No.09/2008/BTNMT national technical standard on underground water quality 2.2 Environment Institutional Responsibilities Duties of the related stakeholders in the institution SPPMB - SPPMB works as an implementing agency, appointing its Supervision Engineers (SEs) from the Technical Department to have overall responsibility for supervising construction contractors in both civil works and implementing the EMP; assigning its Environmental Officers (EOs) from its Resettlement Division to be be responsible for implementing and monitoring EMP during the subproject phases. Under the support from International Environmental Specialist (IES) EO of NPT and National Environmental Specialist (NES,) the SPPMB SEs and EOs will be in charge of the following duties: SPPMB environmental officers (EOs) Supporting SPPMB to approve the CEMPs Introducing the contractors to sites; Supporting and gathering monthly reports prepared by contractors on compliance with the implementation of CEMP; Southern Power Project Management Board (SPPMB) 12

14 Collaborating with the NES to conduct monthly regular site visits and conduct quarterly workshops on the compliance with the ES policies of the subproject and the improvement awareness of the project staff and contractors on occupational and communal health and safety. Preparing monthly, quarterly and mid-year reports on coordination implementing the EMP and EMoP to be submitted to ADB, NPT; SPPMB supervision engineers (SEs) Supervising the construction contractors both in technical works and the implementation of EMP; Reviewing monthly compliance report prepared by contractors before submitting it to SPPMB. CONSTRUCTION CONTRACTORS The construction contractors have the following duties: - Mobilizing its human resources include (i) Site Engineer (SiE); (ii) Environmental, Health and Safety Officer (ESHO) and (iii) Community Liaison Officer (CLO) and necessary materials and equipment to implement the mitigation measures effectively at sites; - Developing its CEMP before starting civil works to be submitted and approved by SPPMB; - Meeting with SPPMB SE & EO at sites to ensure that the contractor s assigned staff have understood and committed to implementing the CEMP; - Maintaining a Control Record available as requested for any inspection made by SPPMB SE and EO; - Promulgating and educating its workers on safety and health; - Preparing monthly compliance report submitted to SPPMB. NATIONAL ENVIRONMENT SPECIALIST (NES) The NES has the following duties: - Supporting SPPMB in compliance with the ES policies and in coordinating implementing the EMP and EMoP for the project. - Building capacity on the implementation of the EMP and EMoP while improving the awareness on occupational and community health and safety for the workers and contractors; - Supporting SPPMB EO in preparing the quarter and mid - year internal monitoring reports on environment; Southern Power Project Management Board (SPPMB) 13

15 2.2.2 Layout of Internal monitoring arrangement Based on the institutional arrangement for implementing the EMP and EMoP concurred by ADB in December 2012 (IEE, 12/2012), a layout on the internal environmental monitoring is presented in Figure 3. ADB IES NPT SPPMB SE NES EO Contractors Supporting lines Reporting lines Figure 2: Layout on internal monitoring arrangement for environmental safeguard 2.3 The incorporation of environmental consideration into project documents The environmental consideration has been incorporated into the project documents such as EMP/IEE and bidding and contract (B&C) documents as stated in Appendix 1 3. PROGRESS ON SUBPROJECT IMPLEMENTATION The contract of constructing the 220kV Cau Bong Hoc Mon Binh Tan transmission line subproject was signed on February 14, 2014 between SPPMB and the Association of PCC1 and VNECO by the Contract No. 040/HĐXL-BQLDA- PCC1/VNECO, of which PCC1 is head of the Association. Implementation progress: the subproject was started on June 10, 2014 and expected to be finished in September However, the progress had not met the expectation due to delaying in compensation to the affected households, so that the construction Southern Power Project Management Board (SPPMB) 14

16 sites were not available to be handed over to the contractors in time. As of December 31, 2015, the work progress had achieved 76.5 % of all works, of which the subproject s construction items are completed at different levels which are specified in Table 3. Only 15.5% of the workload in the fourth quarter was done, of which about 6000m wire were dragged and 01 tower No. 24 located in village 8, Binh My commune was erected. 4. ENVIRONMENT COMPLIANCE MONITORING 4.1 Institutional arrangement for implementing EMP and EMoP in the fourth quarter of 2015 It is assessed that the coordination of implementing the EMP and EMoP has been properly performed by SPPMB s staff and its contractors. SPPMB s EO and SE NES - EO worked closely with the NES in coordinating implementation of the EMP and EMoP; - EO together with NES strictly required the contractors to assign staff who has experience in using first aid kits with necessary medicine and working along with wiring workers at sites. - SPPMB s technical department (SE) worked as a construction supervision unit that carried out their tasks in supporting the contractors in implementation of the construction measures and the environmental performances at sites, while signing in the monthly environmental compliance report prepared by the contractors before submitting to SPPMB. - Visited the construction sites on December 09-14, 2015 to follow up the corrective action plan prepared by contractors, resolving the shortcomings found in the third quarter monitoring trip. - Worked closely with contractors through the means of and Phones to collect the monthly environmental compliance report of contractors. Analyzed the reports to identify both the environmental compliant performances and Southern Power Project Management Board (SPPMB) 15

17 difficulties that the contractors had met when implementing the mitigation measures. Based on that NES could facilitate them to carry out the measures effectively in the coming months. - Summarized the environmental issues and work progress of contractors from October to December, 2015 to ADB s environmental specialist; finalized the 2015 third quarter environmental safeguard internal reports to be submitted to SPPMB, NPT and ADB. CONSTRUCTION CONTRACTORS: - Complied with the environmental safeguard policies and the implementation of the CEMP appropriately and resolving all shortcomings found in the third quarter of Cooperated actively with the NES in supervising the implementation of EMP and EMoP at sites, receiving the recommendations from the NES and SPPMB EO on the environmental safeguard and carrying out its corrective action plan to resolve any shortcomings effectively; - Prepared and submitted its monthly environmental compliance report to the NES and SPPMB in time; 4.2 Environmental compliance at sites Contractor PCC1 dragged about 4.5km from tower 4 to tower 15 and Contractor VNECO finished about 1.5km wire from tower 29 to tower 34. Beside of that, Contractor VNECO constructed tower No 24 located in village 8, Binh My commune. All contruction activities were complied with the CEMP. The environmental compliance at sites was summarized in Table 4. Implementing agency Recommended activities 4.3 Contractor s compliance in safety and health for workers and communities Both Contractor VNECO and PCC1 complied strictly with all procedures and process that are approved by SPPMB to ensure labor safety in wiring activities. The workers dragging wire were provided with the technical knowledge, adequate labor protective equipment including clothes, caps, gloves and shoes as regulated. They also provided adequately the wiring workers with mobile first aid kit and assigned health staff to work along with them. All houses located within the RoW were connected to the earth as required to prevent any negative impacts from electromagnetic fields. The achievements and some issues in terms of occupational and communal health and safety in the period of October to December of 2015 are summarized in Table 5. CONCLUSION AND RECOMMENDATIONS 6.1 Conclusion Implementation progress: As of December 31, 2015, the implementation progress had reached about 76.5% compared with the overall plan. 24 The EMP and EMoP were properly performed by SPPMB and its related contractors, which is in compliance with both environmental policies of ADB and the Government. All involved parties mentioned in the institutional arrangement performed well their assigned tasks. The SPPMB s staff and its contractor s workers have improved their awareness on their occupational health and safety as well as the community health and safety throughout the training workshops. In terms of implementation of CEMP of contractor at site, the fourth quarter of 2015 environmental monitoring shows that contractor resolved all the environmental safeguard shortcomings found in the third quarter Furthermore, Contractor was in compliance with providing their wiring workers with mobile first aid kit and necessary medicines required to respond to urgent accidents at sites. However, rehabilitating environment at sites was not totally completed. During the time of waiting for completing the work, several sites of the towers located near communities have become the temporary landfills for locals. The environment surrounding the towers was polluted by garbage. Typically, the site of tower No. 17 near Tho Nam Sang Environmental Company, Binh My commune with a huge of wastes affected the landscape and also became a favorable habitat for insects and pathogens. Recommendations It is suggested that the contractors should work closely with the commune regarding this matter and also to post warning sign on the tower against dumping of wastes on the towers. Before handing over the line to an operation unit for management, the contractor VNECO should rehabilitate the environment surrounding the site of tower 17 to its original condition and ensure sanitation and landscape ***** Southern Power Project Management Board (SPPMB) 23
