2 Project: Page: 3 Project Specification: Part A Preface With the establishment of the European Single Market it became necessary to create rules for procurement procedures with which a unification of the rules of competition can be obtained and a possible discrimination of individual countries or tenderers be prevented. These rules have been laid down for the various sectors of energy in the Council Directive 93/38/EEC co-ordinating the procurement procedures. These procurement rules are legally binding. Purchasers and contractors of power plant equipment are both subject to the procurement rules which were established by transposition of the Council Directive into the standard series EN This guideline shall supplement the European Standard Guide for Procurement of Power Station Equipment, EN 45510:1998, intended for the establishment of general and technical terms of contract. This guideline integrates the VDEW Terms of Delivery for Steam Turbines and the collection and evaluation of the great experience made with the VGB Guidelines and Recommendations (VGB-R, VGB-M) which, however, cannot completely reflect the state-of-the-art, but were established to the best of our knowledge and belief. The procurement criteria to be determined on the basis of technical specifications as early as at the stage of invitation to tender will finally govern the placing of order. This procedure requires a high quality of the invitation to tender in order to avoid unpleasant surprise up to legal disputes for violation of procurement rules. The loss of freedom of choice only seems to be apparent because the same procurement rules can be used further but have to be clearly defined at a very early stage. This also applies to technical specifications. The VGB Guidelines (VGB-R, VGB-M) can still be referenced and be used further. The technical specifications to be established in due consideration and proper application of the European Standard EN are only part of the enquiry and shall be supplemented by commercial, contractual and legal stipulations. This means that the invitation to tender should address and define all aspects of the later delivery contract. This guideline will at first represent an offer for using it without obligation. Its complete application, or by way of extraction, is left to the parties involved and shall be agreed in each individual case between the purchaser and the supplier. The variety of the details makes it impossible to deal with each detail in the guideline. It may provide only a framework with criteria that have definitely to be observed in the order to largely exclude later disputes between the contracting partners. Users of this guideline are therefore asked to inform the VGB on experience gained with and proposals for improving this guideline, so that the VGB, upon evaluation of the information provided, may supplement or change this guideline appropriately.
