4 1. NTRODUCTON AND SCOPE OF WORK 1.1. Objectives of the Project The deveopment objectives of the proposed Rura Energy 11 Project are to assist the Government of Vietnam to aeviate poverty in the rura areas by providing basic infrastructure service such as eectricity and access to genera services, for improving iving conditions and productivity. The Project wi assist the Government of Vietnam to impement its nationa objective of providing eectricity to about 12 miion rura househods through: - An effective strategy for rura eectrification with specia focus on provision of energy to 3 - the remote mountainous areas; Rehabiitating, upgrading and expanding the rura power system in order to meet the demand for power suppy for future socio-economic deveopment; 3 - Strengthening reiabiity and quaity of power networks, reduce votage and eectricity osses on the grid, ower rura consumption price, improve businesses efficiency and rura power management abiity of oca power management boards; - Refurbishment of the existing rura power network to increase reiabiity and quaity of suppy, incuding reduction of technica and non-technica osses; this Project U incorporates 25 communes in 10 districts of Cao Bang province. - Extension of existing power networks to suppy additiona househods; - Assisting oca District and Commune committees to improve power system management processes and improve business efficiency, to provide eectricity reiaby, safey and at reasonaby cost; - Review rura power management modes, to estabish power management units of ega standing, with economic independence and the manageria/technica skis to operate effectivey and profitaby, repaying oaned funds; - Expanding the use of renewabe energy for the off-grid systems to serve the rura oad in the remote and isoated areas, where feasibe and economicay practicabe; * 1.2. NEED FOR PROJECT NVESTMENT J Based on the forecast data on economic deveopment, power demand, the current situation of the existing power distribution network of the Project's commune. The existing distribution network is degraded, not synchronous. Power osses are very high. The aignment of power ines is not we designed. Many types of poes are existed in the network. The aignment of power ines is not we designed. There are aso many types of eectricity meters. n the past in order to save money, the distribution ies were created to go across gardens, ponds etc. The conductor is overhead type and not covered by any insuating materias, so it cause a ot of risk on safety to oca peope. The Project is panned to impemented in order to: - mprove the quaity of the existing distribution network in the Project's communes. - ncrease the safety management of the distribution network; - Reduce power osses; - ncrease eectricity suppy for the Project's communes; J - Change the form for management mode of rura power network; - Graduay modernize the distribution power network Commune seection criteria 2

9 2.5. BREF DESCRPTON OF NATURAL AND SOCAL CONDTON OF THE PROJECT'S 3 PROVNCES Geographica position and topography Cao Bang is mountainous and border province. North and North East of Cao Bang is Peope Repubic of China. South of the province is Bac Kan province, East side is Lang Son province and Ha Giang province is in the West of Cao Bang. Topography of Cao Bang is compicated with mainy mountains mixed with short streams, sma vaeys, high sope. n genera, there are main three types of topography in the region.. Limestone mountains in the North occupies 32% area of the province. This area is ocated 3 aong the border with China. The area is in Bao Lac, Bao Lam, Thong Nong, Ha Quang, Tra Linh, Trung Khanh, Ha Lang, Phuc Hoa and Thach An districts. Average eevation is m. Typica andscape is high imestone mountains mixed with sma vaeys. This area is acked of water in dry seasons. * Soi mountain occupies 40% natura area of the province. There are two sub regions of soi mountains. They are (i) Soi mountain subregions in West and South West province U incuding Bao Lam, Bao Lac and Nguyen Binh districts. This area is highy partitioned with very high sope. Average eevation is 700 m to 1000 m. (ii) Soi mountain sub region in upper part of Hien river: this area is owering to Cao Bang province. But the topography is sti highy partitioned. Limestone mountains mixed with sma pain areas. 3 Natura area of Cao Bang is 6, km 2. Popuation of Cao Bang is 497,529 peope. There are nine main ethnic in the province. They are Tay (43.6%), Nung (43.06%), and Kinh, Dao, Mong and other minorities ike San Chi, Hoa. Cao Bang is consisted of 13 districts, 189 wards and townships. Cao Bang township is the center 3 of the province. 3 Cimate Cao Bang has monsoon cimate and has its specific characteristics. There are four different seasons in the years, but two main seasons are * Hot season with temperature ranging from 25 to 27 oc, hottest month is in Juy; J * Coo season with temperature ranging from 14 to 18 0C, cooest month is January. Average rainfa: 1,300 mm to 1,500 mm Average humidity: 80% Land resource 3 Tota natura and: 669,072 ha * Agricutura and: 64,652 ha * Forested and: 263,447 ha; where: natura forest is 248,879 ha; panted forest is 14,568 ha. Water resource

10 U~~~~~~~~~~~~~~~~~~~~~~~~~ There are five big rivers crossing Cao Bang province, they are Bang river, Gam river, Hien river, Quay Son river and Bac Vong river. Protected areas. Nui Pia Oac Nature Reserve is ocated in Tich Tuc town and Quang Thanh, Thanh Cong, Phan Thanh, Mai Long, Ca Thanh, Vu Nong and Hung Dao communes, Nguyen Binh districts. There are 4 Project's communes are inside this Nature Reserve, they are: Ca Thanh, Phan Thanh, Mai Long and Thanh Cong. More detais about the Nature Reserve and assessment of Project environmenta impacts to Nui Pia Oac is given in Section 4 on Environmenta Assessment. * Pac Bo Cutura and Historica site is ocated in Truong Ha Commune, Ha Quang district. There is no Project's commune is ocated in this Cutura and Historica site. 3 ndustria: Tinh Tuc tin mine; Phuc Hoa sugar pant, rattan products manufacturing, Agricutura and husbandry: rice cutivation, dry crop, fruits, tea etc. Minera resource: Cao Bang is rich in minera resources such as iron ores, tin ore, imestone etc. 3 rrigation system: 23 pumping stations, reservoirs. SOME OF MAN TECHNCAL SPECFCATONS FOR THE PROJECT Medium votage MV substation * To reduce the investment cost, faciitate site instaation and uniform project standards, the foowing is to be impemented: * A new substation are designed as outdoor type poe mounted. With substation capacity S>75 kva two poe type construction wi be used. With substation capacity S < 31.5 kva one poe type construction is used. * Substation requiring reocation or new poe support structures are to be buit as outdoor type, mounted on poes. The new substation are a poe mounted, as foows: * f capacity S>= 75 kva, mounted on two poes;. f capacity S>= 31.5 kva, mounted on 1 poe. Substation poes are centrifuga concrete type of 10 m or 12 m ength, Cass C suitabe for any requirement. Substation base (foor) is fied 0.3 m deep with soi and covered by mixture of cement and broken bricks MV ines Votage eves: MV ines are designed to accommodate any future votage eve, defined in the power network deveopment and panning scheme for Cao Bang Province. n the ong-term, votage eves 35 kv, 22 kv and 10 kv of MV power networks are used, in conformance with votage of existing 110 kv and 35/10 kv substations and transformer station to be buit in Branches suppying power to transformer station at 35 kv wi be connected into the existing 35 kv ines and designed at the 35 kv votage eve. Poe size A poes are 1Om, 12m, 14m, 16m and 20m ength of casses A,B,C,D. Poe size seection is based on the safe cearance to ground, transportation and traffic structures, crossings, deveopment requirements, sharing of ines for MV and LV votages. Poe strength is seected from oad requirements. n genera, the use of poes is as foows: a For singe circuit ines: centrifuga concrete poe 1Om, 12m. * For doube circuit ines: centrifuga concrete poe 14m. 3 * Stayed, crossing positions and specia positions: 16m, 20m poes. Poes are manufactured to Vietnam Standards and Reguations DNT-QDKT-09/ Poe foundation To support poes, cast in situ M150 concrete foundations are used. n the Project, MT1, MT2... MT8 type foundations are used. The seection of foundations for each position is specified in the design stage, based on estimations of oca soi, geoogica and hydro- ~~~geoogica conditions. 9

12 For sand areas, types of cast in-situ excavated foundations: M01, M02, M03, M04 are used. For marshy and areas, foundations shoud be reinforced by bamboo stakes, bamboo rafts to 3 strengthen the bearing capacity of foundations and to reduce stress against the foundation surround. Foundation depth is 10-12% of poe height pus 0.3m Low votage Eectricity poe Concrete poes for most ines are H-section type, cast in workshops. For 3 phase ines and branches aong inter-district, inter-commune roads: 7.5m, 8.5m poe sizes. For two wire branches to communes: 6.5m, 7.5m poe sizes. For 1 phase ines into househod groups: 6.5m poe size. A-B-C type poes according to bearing requirements of each position; manufactured to the standard DNT-QDKT-09/2000. For poes near vehice transport areas: use 1 Om, 12m centrifuga concrete poes to ensure safe cearances. For MV, LV ine co-sharing positions: use MV ine concrete poes. Most concrete poes are A and B-type poes, manufactured to standard DNT-QDKT-09/2000. Square concrete poes and circuar concrete poes are used at the foowing positions: * Straight, corner positions of 3 phase trunk ines: singe poes; and 3a Corner anchor, straight anchor, end anchor: doube poes. f poes are instaed near househods, trafficabe roads, doube poes shoud be used at corner anchoring, straight anchoring, end anchoring positions; stayed tension poes are used ony at such high bearing positions that doube poes coud not sove and tension. poes are convenienty paced; 3 Utiize existing poes which are of good quaity and satisfy the standard when instaing new conductors. Poes under 7.5m size are not used for 3 phase trunk ines. Poes recovered from ines are to be returned to ocaities to aow peope to re-use poes to support suppy ines to houses. Poe foundation To support ine poes; cast in-situ M100 concrete bock foundations are used: 1 a For singe poes: use MV1, MV2 * H doube poes: use MV3. The depth of foundations is in proportion to poe heights and is shown in the overa ayout of LV poe, cross-arm and foundation. f doube poes cannot satisfy the high bearing requirements and are in tension poe positions, it is required to use: * D14 tension poes with foundation in proportion to poe height. Tension poes contain E14 round hot dipped stee according to Vietnamese Standards; ~~~~~~~~~~~~

13 . MN 15-5 anchors buried m according to bearing requirements and site cearance; 3 * MN stayed-on-the-spot anchors in sand areas. For ines across sand areas (rivers, coasta), cast in-situ M100 concrete excavated foundations are used, in combination with pre-cast M200 reinforced concrete round pipes with E1000, ff1200, E FE1500 diameter. For reused poe positions, if conductor size increased by two or more sizes, must increase 3 concrete in the existing foundation to ensure bearing requirements are satisfied.

14 LEGAL FRAMEWORK FOR PROJECT'S ENVRONMENTAL MPACT ASSESSMENT 3.1. VETNAM REGULATONS AND LAWS 3 - Law on Protection of the Environment (LEP) was enacted in Decree 175/CP was promugated in 1994 to guide impementation of the LEP and provides broad guideines for division of responsibiity among Ministries; environmenta impact assessments; poution prevention and disaster contro; sources of finance; and environmenta inspections and standards. 3 - Decrees 143 on amendment of tem 14 of Decree 175 CP dated 18/10/1994 of Government on guidance for impementation of LEP. - Circuar No. 490 "Guidance on setting up and appraising environmenta impact assessment reports for investment projects". - Law on Forest Protection (1992). This aw reguates forest management, protection, deveopment, and expoitation, prevention of woodcutting, and forest destruction. t aso encourages individuas and organizations to protect and deveop forests. 3 - Decree 54/1999/ND-CP reating to the protection of high-votage networks. - Decree 70/1987-HDBT specifies safety casements of high-votage transmission ines. - Decree 24/2000/ND-CP specifies the impementation on the Law on Foreign nvestment in * Vietnam (Artice 82) concerning environmenta protection. - Decree 52/1999/ND-CP incudes environmenta considerations for construction management. - Decree 26/1996/CP provides reguations on the punishment of administrative vioation of Environmenta Protection Law. 3 - Vietnam Nationa standards (TCVN) are nationa standards estabished by the Ministry of Science and Technoogy (MoST) and appied to a government agencies. They incude engineering, construction, scientific, and environmenta standards. TCVN environmenta standards incude acceptabe imits of many air, noise, and water quaity parameters. 15 44. ASSESSMENT OF ENVRONMENTAL MPACTS 4.1. CLASSFCATON OF MPACTS 3 The Environmenta mpact Assessment focuses on the major environmenta issues of the Project's Most Favoured Aternative. The potentia impacts of the Project's pre-construction, construction, and operation phases were assessed as being in one of five categories: i. NO MPACT. The potentia impact of the Project activity is assessed as NO MPACT if the project activity is physicay removed in space or time from the environmenta component. ii. MAJOR MPACT. An impact is said to be MAJOR if the project activity has potentia to affect an environmenta component. Major impacts coud be "Major Negative" or "Major Positive." The foowing criteria were used to determine whether a given impact is MAJOR: a) Spatia scae of the impact (site, oca, regiona, or nationa/ internationa); b) Time horizon of the impact (short, medium, or ong term); c) Magnitude of the change in the environmenta component brought about by the Project activities (sma, moderate, arge); d) mportance to oca human popuations; 3 e) Compiance with nationa, provincia, or district environmenta protection aws, standards, and reguations f) Compiance with Vietnam's internationa commitments, These incude the Convention on Wetands of nternationa mportance especiay as Waterfow Habitat (RAMSAR), the Convention Concerning the Protection of the Word Cutura and Natura Heritage (Word Heritage Convention), and the Convention on nternationa Trade in Endangered Species of Wid Fauna and Fora (CTES); and g) Compiance with Word Bank guideines, poicies, and reguations. iii. MNOR MPACT. f an impact occurs but does not meet the criteria for a Major mpact it is assigned the category MNOR. Minor impacts coud be "Minor negative" or "Minor Positive." 3 MTGABLE MPACT. The potentia impact of a project activity on an environmenta component is said to be MTGABLE if there is potentia for a major negative impact and the proposed mitigation measure wi *: prevent the impact or reduce the impact to acceptabe eves. 3 ~~~~~~~~~13 1

16 DENTFCATON OF POTENTAL MPACTS OF THE PROJECT The Project wi pay an important roe in the eectrification program and in impementation of the poicy of poverty aeviation of 25 communes within 10 districts of Cao Bang province. t wi aso promote the poicy of industriaization and modernization of the Government of Vietnam as we as create a great opportunity for overa socio-economic deveopment of the poor area. When the distribution ines are constructed, there is a trend of oca peope to move to ive near the ines. The oca peope committee wi have a proper panning accordingy to support the deveopment of the areas. These panning are incuded: road, residentia area, industria deveopment and farming etc. The communes/districts wi move toward its panning. Beside the significant beneficia impacts, the project may cause different adverse impacts on the environment and oca socio-economy. By using Environmenta Screening Data Checkist and Environmenta baseine Checkist as guided in Framework for Appying Environment Safeguards to Rura Energy Project, The potentia impacts of the Project are described in Tabe

These transformers were in use about 10 years ago and were amost produced by oca manufacturing companies, so no PCBs were used. Therefore there wi not be any potentia of PCBs risk during remova of od transformers from the distribution networks. 5 Loss of historica and cutura None None - The routes are designed to avoid tempes, churches No mpact properties and other cutura, historica properties in the areas, so the Project wi not effect any cutura heritages Construction phase - During construction if there is any vauabe historica or cutura properties are found underground, the Contractor and Project owner wi report to oca Department of Cuture and information for further consideration. 6 Surface water contamination Medium Short - The water can be more turbid due to the soi residue Mitigabe from excavation of the poe's foundation wi enter to the water bodies by water run off. 7 Noise and vibration Sma Short - Noise eves during constructon wi be required to Minor compy with Vietnamese standard TCVN 5949:1998. Negative Use of construction machinery wi be imited due to the sma scae of the project (distribution as opposed to transmission ines), and the very short period of time invoved in construction activities. - Noise and vibraton are caused by: equipment, materia transportation, project's vehices, poe's erecton and cabe's puing, generators (if there is any) 16

ASSESSMENT OF PROJECT MPACT ON NU PA OAC NATURE RESERVE As it was identified in Section 2.5. there are four Project's communes (Ca Thanh, Phan Thanh, Mai Long and Thanh Cong) are ocated in Nui Pia Oac Nature Reserve. n order to assess potentia impact of Project to these protected areas, information about bioogica, ecoogica vaues of these protected areas and Project's activities in these communes are described in more detais NU PA OAC NATURE RESERVE Nui Pia Oac Nature Reserve is ocated in Tinh Tuc town and Quang Thanh, Thanh Cong, Phan Thanh, Mai Long, Ca Thanh, Vu Nong and Hung Dao communes, Nguyen Binh district, Cao Bang province (Tordoff et a. 2000). Nui Pia Oac was incuded on Decision 194/CT of the Chairman of the Counci of Ministers, dated 9 August 1986 (MARD 1997), which decreed the estabishment of a 10,000 ha nature reserve for the protection of "subtropica mountain forests" (Cao Van Sung 1995). An investment pan for Nui Pia Oac was prepared by Xuan Mai Forestry Coege in This investment pan was approved by Cao Bang Provincia Peope's Committee in the same year but has not yet been approved by MARD. This investment pan proposed estabishing a 13,312 ha nature reserve, comprising a 5,244 ha strict protection area, a 8,053 ha 3 forest rehabiitation area, and a 15 ha administration and services area (Anon. 1999). Nui Pia Oac is incuded on a ist of Specia-use Forests to be estabished by the year 2010, prepared by the FPD of MARD, as a 10,000 ha nature reserve (FPD 2003); this ist has not yet been approved by the government. To date, however, a management board has yet to be estabished for Nui Pia Oac Nature reserve, and the site is under the management of Nguyen Binh District FPD and Nguyen Binh Forest Enterprise (Cao Bang Provincia FPD in ift. 2003). L,:656.5S: &>.6.N566 The nature reserve is centered on Mount Pia Oac (1,931 m) and characterized by steep topography. n the west of the nature reserve, there are patches of imestone karts (Tordoff et a. 2000). -~~~-S According to the investment pan (Anon. 1999), Nui Pia Oac Nature Reserve contains 11,839 ha of natura forest. However, 1998 and-use data provided by Cao Bang Provincia FDD and ground-trusted during a rapid fied survey in 1999 indicate that the nature reserve supports ony 3,174 ha of natura forest, which is mainy distributed above 1,000 m. The forest has been subjected to high eves of disturbance in the past and is secondary in paces. Natura regeneration does, however, appear to be taking pace. Beow 700 m, the vegetation is dominated

27 25 11 by scrub and grassand. n the west of the nature reserve, there are areas of imestone karts 3 without forest, and, at ower eevations in the south, there are Pinus massoniana pantations (Tordoff et a. 2000). 3 Mamma diversity at Nui Pia Oac has been severey reduced by hunting, and it woud appear that the site supports few viabe popuations of species of goba conservation importance. However, the nature reserve supports a number of bird species restricted to broadeaf evergreen forest above 800 m, and may support one of the few remaining areas of suitabe habitat for such species in north-eastern Vietnam (Tordoff et a. 2000). 3 Beow 1,000 m, most of the natura forest in the nature reserve has been ceared for cutivation. Above, 1,000 m, however, the natura forest is distributed on steep hisides at high eevations, which are unsuitabe for cutivation. Consequenty, cearance for agricuture is not a major threat to biodiversity at Nui Pia Oac (Tordoff et a. 2000). Mount Pia Oac and the surrounding area are rich in mineras, particuary zinc. Mining activities * during the French coonia era resuted in cearance of arge areas of forest and high eves of disturbance to remaining areas. Athough these activities have now argey ceased, the forest is 3 under continued pressure from oca peope, who extract bamboo, bamboo shoots, medicina pants and firewood from the nature reserve. Uncontroed expoitation of forest products threatens to impede the process of forest regeneration in the nature reserve. Nguyen Binh District FPD has, however, aocated amost a of the forest and in the nature reserve to individua househods for protection (Tordoff et a. 2000). Another threat to biodiversity at Nui Pia Oac Nature Reserve is hunting, as a resut of which popuation sizes of arge and medium-sized mamma species have reportedy decined 3 dramaticay (Tordoff et a. 2000). The proposed boundary defined in the investment pan for Nui Pia Oac Nature Reserve (Anon ) incudes 10,073 ha of non-forest and, a town, a zinc mine and severa thousand peope. Consequenty, both Wege et a. (1999) and Tordoff et a. (2000) recommended that the boundary be revised to excude a areas of scrub, grassand, agricutura and and habitation. 0 i - -_, Cao Bang Provincia Peope's Committee are considering deveoping the area around Mount Pia Oac as a site for tourism. The potentia for the deveopment of tourism in the area is high for severa reasons: the area is easiy accessibe from Cao Bang town by surfaced road; there are severa ruined French vias that coud be renovated; there is a coorfu ethnic minority market in the area; and the summit of Mount Pia Oac is easiy accessibe on foot (Tordoff et a. 2000).
