18 SOIL EROSION & SEDIMENT CONTROL Part 91 Soil Erosion and Sediment Control of the Natural Resources and Environmental Protection Act, 1994 PA, as amended. The purpose of this is to prevent soil erosion and sedimentation from non-agricultural development within Montcalm County as set forth in the Soil Erosion and Sedimentation Act, by requiring proper provision for water disposal and protection of soil surfaces during and after construction, in order to promote the safety, public health and general welfare of the county. No plot plan or plat shall be approved unless said plot plan or plat shall include Soil Erosion and Sedimentation Control measures consistent with the requirements of the General Rules. Permit Requirements, a land owner or developer who contracts for, allows or engages in an earth change in Montcalm County shall obtain a permit from the Drain Commissioner prior to commencement of an earth change which disturbs one or more acres of land or if the earth change is within 500 feet of a lake, stream or drain of this county. An application for a permit shall be submitted to the Drain Commissioner by a person proposing to undertake an earth change.

19 Soil Erosion and Sedimentation Control (SESC) Designated the County Enforcing Agency required by Michigan Department of Environmental Quality DEQ Responsible for administration and enforcement of this part and the rules by the DEQ. Any earth change disturbance within 500 feet of any lake, river, stream, creek, drain or watercourse or grading, stripping, excavation or filling of more than one acre of land requires a permit. Review and approve plans, issue soil erosion permits (55 permits for 2013), and inspect constructions sites. DEQ conducts a review of the county s program every 5 years, 2012 the County s SESC program was audited and met the requirements under Part 91 and was granted approved status. Designated by the DEQ Authorized Public Agency (APA) Responsible for preparing soil erosion and sedimentation control plans, implementing designed measures, and inspection of drain maintenance and improvement during all earth change activities on county drains. DEQ conducts a review of the county s program every 5 years, 2012 granted approved status.

21 Minimum Standards Montcalm County Drain Commissioner Subdivision Drainage Rules and Storm Water Design Criteria Responsible for ensuring that the drainage or storm water management system is adequate to address storm water management needs within the proposed site and for protecting downstream landowners. Review and approve storm water drainages plans for all commercial developments, resolutions have been adopted by 23 townships/cities/villages.
