5 OLD VILLAGE PHASE 3: STREET, DRAINAGE, AND UTILITY IMPROVEMENTS CITY OF LAKE ELMO PROJECT NO EXECUTIVE SUMMARY AND PROPOSED IMPROVEMENTS This feasibility report has been prepared to identify the scope of improvements necessary to reconstruct streets, improve stormwater drainage conveyance, extend municipal sanitary sewer service, and replace aged water distribution system facilities for Phase 3 of the Old Village infrastructure improvements. The City Council authorized the preparation of a feasibility report to be completed in accordance with Minnesota State Statutes 429 in order to identify the necessary improvements, the estimated project costs, and to consider the assessment of a portion of the project costs to properties adjacent to and benefitting from the improvements. The project includes improvements in two areas of the village area including: 31 st Street Neighborhood street reconstruction, drainage improvements, sanitary sewer, and watermain replacement. Laverne Avenue Area extension of sanitary sewer to the Lake Elmo Elementary School. Two improvement alternatives were evaluated: o Option 1: Reconstruction of Laverne Avenue to allow placement of the sanitary sewer from 39 th Street to the school property along the public right of way. This alternative includes street reconstruction, sidewalk, storm sewer improvements, sanitary sewer, and replacement of watermain with a needed 16 inch trunk watermain. o Option 2: Lake Elmo Elementary Sewer Project. Extension of sanitary sewer through easement acquisition. If easements can be reasonably acquired, this alternative allows for the sanitary sewer service to be extended to the Lake Elmo Elementary School without disturbance and reconstruction of any streets. 31 st Street Neighborhood Street, storm sewer, sanitary sewer and watermain replacement is proposed along 31 st Street North from Lake Elmo Avenue east to the cul de sac, Laverne Court North from 31 st Street North south to the cul de sac, and Layton Court North from 31 st Street North south to the cul de sac. The improvements are scheduled to be completed in 2017 and are consistent with the City of Lake Elmo s Capital Improvement Program. City of Lake Elmo, MN. 6 The Streets will be reconstructed and replaced to a width to closely match what exists today. The street pavement section will be reconstructed to meet a minimum 7 ton pavement design with concrete curb and gutter to improve drainage and provide edge control to protect and extend the service life of the new bituminous surface. The proposed street section will consist of a 24 inche select granular borrow drainage layer with drain tile, 6 inches of class 6 gravel, and 3.5 inches of bituminous pavement. Storm sewer will be installed to provide positive drainage and a treatment basin is proposed to be installed in Reid Park to meet storm water permitting requirements. The total estimated street and drainage project costs are $763,300 with a proposed residential unit assessment of $8,700 to 26 benefiting properties and $4,350 to 1 benefiting property owner (corner property assessed ½ unit). Municipal sanitary sewer service will be extended along each street with individual service stubs installed to properties with existing homes that are located adjacent to the sewer improvements. Installation of sewer along the project corridor will be most cost effective when combined with the reconstruction of the street section. The total estimated sanitary sewer improvement cost is $344,000 with a proposed residential unit assessment of $11,300. Replacement of the existing water system is recommended to be completed as a part of this project. The existing watermain pipes are over 50 years old and subject to frequent breaks. The watermain, service piping to the right of way and associated valves and hydrants are all recommended for replacement. The total estimated water system improvement cost is $300,300. Water is not proposed to be assessed as it is a replacement of infrastructure already existing in this neighborhood. Laverne Avenue Area Option 1: Reconstruction of Laverne Avenue Street, storm sewer, sanitary sewer and watermain replacement is proposed along Laverne Avenue North from 39 th Street North south to County State Aid Highway 14 (CSAH 14) and to the Lake Elmo Elementary School west from Laverne Avenue in greenspace easements to be acquired from a combination of the school and City of Lake Elmo. The improvements are scheduled to be constructed in 2017 and are consistent with the City of Lake Elmo s Capital Improvement Program. To maintain a consistent implementation of the Village Area Plan, the project costs include an option to add a 6 foot concrete sidewalk along the west boulevard and an 8 foot bituminous trail along the north boulevard. These pedestrian facilities incorporate the walkable downtown theme. The estimated total project costs for the street, drainage, and sidewalk improvements are $384,400. Per the City s special assessment policy, non residential properties are assessed 100% of the total project costs on a front foot basis. There are 14 benefiting commercial properties along Laverne Avenue North. The assessment roll included in the Appendix provides detailed assessment information for each benefiting property. Municipal sanitary sewer service will be extended along each project corridor with individual service stubs installed to each property that is located adjacent to the sewer improvements. Installation of sewer along the project corridor will be most cost effective when combined with the reconstruction of the street section. The estimated sanitary sewer improvement cost is $409,800 with a proposed unit assessment of $11,300 per Residential Equivalent (REC) Unit method. RECs assigned to non residential properties and associated assessments are shown on the preliminary assessment roll in the Appendix. The water system also is required to be upsized to accommodate future growth along the I 94 corridor and to eliminate the need for a future elevated water storage tank in the Village area. The watermain, service piping to the right of way and associated valves and hydrants are all recommended for replacement. The estimated water system improvement cost is $252,600. Water is not proposed to be assessed as it is a replacement of infrastructure already existing in this area. The estimated total project cost for the bituminous trail is $43,700. Should the City choose to construct the trail with this project the cost would be paid by the City. Laverne Avenue Area Option 2: Lake Elmo Elementary School Only Extension of sanitary sewer to this area was initiated by a petition received on April 1, 2016, from Independent School District #834 to provide sewer service to the Lake Elmo Elementary School at Stillwater Boulevard. Option 1, evaluated above, is responsive to this request, however the improvement project involves additional street, sidewalk/trail, storm sewer, sanitary sewer, and watermain improvements and results in assessments being levied to several additional properties that were not party to the petition. 8 Option 2 was evaluated to determine a project that would minimize the scope of improvements that would be necessary to extend sanitary sewer service to the school property. In order to avoid the public right of way, it would be necessary to extend the sanitary sewer from an existing stub at 39 th Street North and to extend south to the school property along easements acquired from adjacent private properties. Therefore, this option is only feasible if the acquisition of easements from these properties can be reasonably obtained. By installing the sewer main along the property lines outside of the public right of way the restoration costs for the improvements are significantly reduced. The estimated sanitary sewer improvement cost for Option 2 is $322,900 with a proposed unit assessment of $11,300 per Residential Equivalent (REC) Unit method. RECs assigned to non residential properties and associated assessments are shown on the preliminary assessment roll in the Appendix. It should be noted, however, that Option 2 does not replace the need to complete the Laverne Avenue North improvements detailed in Option 1, but simply defers those costs to a later year. The recommended Project Improvements are necessary, cost effective, and feasible and will result in a benefit to the properties proposed to be assessed. It is recommended that the City Council accept this Report, hold the public hearing, and order the improvements. I. PROJECT INITIATION AND SCOPE The City of Lake Elmo is extending sanitary sewer to serve the existing properties in the Old Village area to replace the use of private on site sewage treatment systems. The projects also include regional drainage improvements to address historic flooding issues in the Downtown area, the replacement of aged watermain pipes and reconstructing the public streets that are disturbed during the work. The Improvements are being constructed in phases and through separate projects. Phase 1 was constructed in 2015 and Phase 2 was constructed in The Old Village Phase 3 Improvements are consistent with the Old Village Capital Improvement Plan (CIP) as presented to the City Council on September 6, This feasibility report was authorized by the City Council on September 20, 2016 in order to ready these improvements for 2017 construction and in response to the receipt of petitions for sanitary sewer service. One petition was received on April 1, 2016, from the Lake Elmo Elementary School (Independent School District #834) at Stillwater Boulevard, and a second petition was received on June 8, 2016, from the property owners along 31st Street North, Laverne Court North, and Layton Court North. 9 feasibility report needs to be completed in accordance with Minnesota State Statutes 429 and must identify the necessary improvements, the estimated project costs, the assessment methodology and preliminary assessment amounts to be levied against properties adjacent to and benefitting from the improvements. This Report is a desktop study based on field observations, street inventory measurements, record drawings, aerial photography, aerial contours, Washington County plat records, and city utility maps. A visual observation was also completed as part of this report. It has been assumed that the general drainage characteristics of each neighborhood can be preserved or improved as the improvements are implemented. Detailed survey information is required to confirm the viability of the proposed street section, drainage considerations, and utility alignments proposed in this Report. II. PROJECT AREA CHARACTERISTICS The Old Village area s infrastructure is aged, deteriorated and in many ways beyond its useful service life. The Village was constructed with little to no storm sewer conveyance and storage resulting in frequent flooding. The watermain is 50 years old, undersized and in poor condition, resulting in increased watermain breaks each year. The streets are cracked and require frequent patching. Septic systems in the area are noncompliant or failing and have left some property owners on a County mandated list for replacement before property sale can occur. Without sanitary sewer service, properties are left with few alternatives for future replacement systems. As a means to address this infrastructure, the City is working to complete a comprehensive infrastructure improvement program to be constructed over the next five years with the primary goal of extending municipal sanitary sewer service to the Old Village area. This report specifically focuses on the Phase 3 Improvements scheduled for construction in III. IMPACTS OF PROPOSED IMPROVEMENTS Should a construction project be pursued as recommended there are several short term impacts that will affect properties adjacent to the surrounding area. Short term traffic delays, construction dust and noise, minor tree loss, and erosion will occur during construction of the improvements. Efforts to minimize these impacts include resident communications, proper construction traffic signage, restriction of work hours, and implementation of dust and erosion control measures. 10 required by the contractor to maintain access to properties and access for emergency vehicles. Driveways and boulevard areas will be impacted with curb and ditch improvements. For new curb areas, disturbances will occur into the boulevard and driveway areas. This will require the property owners to relocate all private property located within city right of way including any underground sprinkler systems or invisible dog fences prior to construction. Mailboxes will be removed and relocated by the contractor to facilitate the curb installation. In order to meet stormwater water quality and treatment requirements an infiltration basin is proposed to be installed in Reid Park east of the 31 st Street North cul de sac (see Figure 2 in the Appendix). In order to install this system, tree clearing and excavation will be required. The size of the basin and location will be evaluated during the detailed design process. Construction impacts can be mitigated through the use of proper construction specifications and best management practices. Any disruptions that occur along the existing corridor will be restored consistent with general construction practices, however it is not always possible to restore to pre existing conditions. IV. RIGHT OF WAY AND EASEMENTS The proposed improvements mostly occur within existing City right of way or City owned property with the exception of the extension of sanitary sewer to Lake Elmo Elementary School. Temporary construction easements are required along most of the streets to accommodate pipe trench excavations and boulevard grading operations. The report assumes that these temporary easements will be granted to the City at no cost based on past project experience. Permanent easements are needed to accommodate the sanitary sewer construction in either Option 1 or Option 2 to extend sanitary sewer to Lake Elmo Elementary School. The easements under Option 1 will be required on properties owned by the City of Lake Elmo and Lake Elmo Elementary School. It is assumed, for the purposes of this report that these easements are obtainable and will be received at no cost. Option 2 requires easements on private property and will be subject to the ability to negotiate and obtain said easements. V. 11 Minnesota Department of Health Watermain Extension Permit. Minnesota Pollution Control Agency Sanitary Sewer Extension Permit. Minnesota Pollution Control Agency NPDES Stormwater Permit. Valley Branch Watershed District Stormwater Management and Erosion Control Permit Washington County Right of Way Permit. VI. SUMMARY OF ESTIMATED PROJECT COSTS Included in the Appendix is the detailed estimate of probable project costs including construction, engineering, geotechnical investigations, easement acquisition, and contingencies. A 2% allowance for easement coordination has been included as standard amount to cover easement evaluation needs and staff time for negotiations. No other allowance has been provided to acquire easement and right ofway. A 3% allowance is included for legal, fiscal and administration costs per past practices and direction by the City Finance Director. These cost estimates are based on recent construction projects of similar character and assume that the proposed improvements would begin in The actual project costs will be determined through a competitive bidding process and will vary with market conditions at the time of the bid. FINANCING OF IMPROVEMENTS The improvements will be partially financed by imposing special assessments against the benefiting properties. Special assessments are levied in accordance with Minnesota Statutes Chapter 429 and consistent with the City s Special Assessment Policy and the Old Village Sewer Assessment Policy. Street and storm sewer improvement assessments are proposed at a rate of 30% for residential properties using a unit method. Residential properties are considered to provide an equal demand on street use and are therefore assessed on a per unit basis. The remaining 70% of the costs are paid through the City general fund. Residential properties along 31st Street North, Laverne Court North, and Layton Court North with direct access to the street are included as benefitting properties. There are 26 benefitted properties plus one corner property with a driveway to both Lake Elmo Avenue and 31st Street North that is assigned one half unit assessment. Street, sidewalk and storm sewer improvement assessments are proposed at a rate of 100% for non residential properties based on the actual front footage along Laverne Avenue. There are seven properties comprising of 1,875 lineal feet of frontage that abut the proposed improvements along Laverne Avenue. Consistent with the recent 39 th Street Improvement project it is assumed that the added cost for the sidewalk will be assessed and the added cost for the bituminous trail will not be assessed, if added to the project. A preliminary assessment roll detailing each property s proposed assessment amount for the street, sidewalk and storm sewer improvements are included in the Appendix of this report. 13 Sanitary sewer assessments are proposed for those properties that abut the improvements and receive a service stub as part of the project. The assessment amount is based on the estimated total project costs for all project phases to replace substantially all existing septic systems in the Old Village as identified in the Old Village Capital Improvement Plan. This methodology results in all benefitting properties sharing equally in the overall system costs since the sewer system layout was designed to result in the most cost efficient overall system. After removing trunk oversize costs, to be paid directly from the sewer enterprise fund, the remaining costs are 100% assessed using a residential equivalent unit method. Each benefitting residential property is assessed 1 Residential Equivalent Connection (REC), or 1 SAC unit. Non residential properties are assigned a prorated SAC unit based on the estimated potential capacity of wastewater to be generated from the use of the building. Non residential properties are assigned a minimum of 1 SAC unit. The one unit assessment amount is then increased each year using a construction cost index to account for increased annual construction costs. A preliminary assessment roll has been prepared for the sanitary sewer improvements and can be found in the Appendix of this report. In addition to the assessment for the proposed sewer improvements, each property will be required to connect to the sanitary sewer system within two years after sewer becomes available. When a property connects to City sewer, they must also pay a $3,000 per REC unit Sewer Availability Charge (SAC), a $1,000 per REC unit Sewer Connection Charge, a $2,485 per REC unit Met Council Sewer Availability Charge, and a $65 Plumbing Permit Fee. In addition, each property owner is responsible for the costs to make the sewer service connection from the service stub to the building, a cost that will vary for each property. It is recommended that the replacement of the aged and deteriorated watermain be considered a maintenance cost and be paid for from the City s Water Enterprise Fund. The City collects Water Availability Charges and Water Connection Charges from each new user connecting to the system to pay for replacement and maintenance of water infrastructure, either directly or through bond repayments. The properties adjacent to and along the proposed improvements are current water costumers and would have been assessed or paid connection charges at the time they originally connected to the system. The City may use fund reserves or bonds for the Project improvements to pay the up front project costs and to cover City cost participation. Special assessments would be levied against the benefiting properties with payment terms structured so that the City receives funds to meet debt obligations. The remainder of the project costs are proposed to be paid through a combination of sanitary sewer enterprise funds, water enterprise funds and general funds. Consistent with the City s Special Assessment Policy, the street and storm sewer improvements will be levied over a 15 year period and the sanitary sewer improvements will be levied over a 20 year period. Assessments would be charged an interest rate of 1% over the bond rate for the project. This will address the internal costs the City will incur associated with the bonding, documentation of the assessments, and dealing with delinquent assessment payments. City of Lake Elmo, MN. PROJECT SCHEDULE The following schedule is proposed in order to construct these improvements in September 20, 2016 November 15, 2016 December 20, 2016 April 4, 2017 May 4, 2017 May 16, 2017 November 15, 2017 June 30, 2018 City Council orders preparation of Feasibility Report. City Council accepts report and calls for Hearing on Improvements to be held December 20, Public Improvement Hearing. Council orders the improvement and the preparation of Plans and Specifications. Council approves the Plans and Specifications and orders the Advertisement for Bids. Receive Contractor Bids. Council accepts Bids and Awards Contract. Substantial Completion. Final Completion, including Bituminous Wear Course and final restoration. IX. CONCLUSIONS AND RECOMMENDATIONS The City of Lake Elmo is extending sanitary sewer to serve the existing properties in the Old Village area to replace the use of private on site sewage treatment systems. Many septic systems in the area are noncompliant or failing and must be replaced to mitigate potential public health issues, and complaint systems are aging with little to no options for future replacement systems. In addition, The Old Village area s infrastructure is aged, deteriorated and in many ways beyond its useful service life. The Village was constructed with little to no storm sewer conveyance and storage resulting in frequent flooding. The watermain is 50 years old, undersized and in poor condition, resulting in increased watermain breaks each year. The streets are cracked and require frequent patching. To address these issues the Old Village Phase 3: Street, Drainage and Utility Improvements is the third phase of a multi phased project to extend municipal sanitary sewer service to the Old Village properties. To facilitate the improvements the project includes drainage improvements to address storm water runoff, the replacement of aged watermain pipes and reconstructing the public streets that are disturbed during the work. The improvements as recommended in this report are necessary to provide basic utility and infrastructure needs to the Old Village area. City of Lake Elmo, MN. 16 The project, as proposed, is consistent with the City s Comprehensive Plan, the Capital Improvement Plan, is technically and financially feasible, is necessary, cost effective, and will result in a benefit to the properties proposed to be assessed.
